Is The Martian Just The Latest Example Of A Way To Avoid Liability Copyright Infringement In International Waters?, Brittany Binderoff
Cardozo Arts & Entertainment Law Journal (AELJ) Blog
The 2015 Golden Globe winning Best Motion Picture Musical or Comedy, The Martian, is a movie about an astronaut, played by Matt Damon, who was left stranded on Mars after being presumed dead as the result of a storm. He ended up surviving and was left to find a way to signal Earth that he was alive. Many people may not connect this movie with copyright law, but about three-fourths of the way through the movie, Damon’s character makes the following statement: “I’ve been thinking about law on Mars. There’s an international treaty saying that no country can lay claim …

Hurricanes And Long-Term Gdp Growth: The Role Of Institutional Quality, Kyoko Sakai
Hurricanes And Long-Term Gdp Growth: The Role Of Institutional Quality, Kyoko Sakai
Economics Honors Projects
This paper compares the long-term effects on real per-capita GDP of two hurricanes in 1992, hurricane Andrew in Florida and hurricane Iniki in Hawaii. The literature suggests that the long-term effect on GDP of a natural disaster for a region with good pre-disaster institutional quality may be positive (i.e., GDP levels exceed those which would have materialized without the disaster) because the destruction of capital induces firms to investment in more technologically advanced structures and machines. In contrast, a region with bad pre-disaster institutional quality should experience a negative impact because it face severe limits in the amount it can …

Active Learning, Primary Documents, And Complex Events: Reinvigorating History Education, Samantha Clonch
Honors Projects
History is frequently taught through lectures, tests, and individual work with primary documents, which can be exceedingly tedious for students. This is problematic because it leads to student disengagement and limited learning. Also problematic in history education is the lack of time spent teaching events which are viewed as less impactful than others on the course of history. The Louisiana Purchase is one such event. It is often taught in one day or less as an action that simply doubled the size of the United States. This project is an attempt to combat these problems. The project contains a seven …

Popular Discontents: The Historical Roots Of Italian Right Wing Populism, Anthony Marshall Simone
Popular Discontents: The Historical Roots Of Italian Right Wing Populism, Anthony Marshall Simone
Political Science Honors Projects
Emerging from the ashes of the old electoral system of the First Republic, an ideological populism built on regional identity, most significantly espoused by the Lega Nord political party, became a dominant force in Italian politics. This populism initially attacked a corrupt state, but evolved to confront perceived threats to its homeland region, such as globalization and immigration. Despite these developments, this populism continues to create a discourse which pits a virtuous, homogenous people against a set of self-serving poteri forti (powers that be). What self-serving powers gave rise to this populism? This anti-state, xenophobic populism exists as a response …
Exploring The Role Of Horticulture In Alleviating Food Insecurity Among Women In Botswana, Rachel Fehr
Exploring The Role Of Horticulture In Alleviating Food Insecurity Among Women In Botswana, Rachel Fehr
Geography Honors Projects
By most measures, Botswana is an African development success story. However, there are still segments of the population that suffer from the interlinked phenomena of persistent poverty and food insecurity. The Government of Botswana and its partners have increasingly sought to address household food insecurity through gardening initiatives of various sizes and commercial orientation, but the success of these efforts has not yet been evaluated. I use an interdisciplinary approach, incorporating both econometric analysis and qualitative data viewed through the theoretical lens of political ecology, to determine how effective these women’s gardening initiatives are in addressing household food insecurity. I …

The Unintended Legacy Of Hellenism: The Development And Dissemination Of The Buddha Image, Chukyi Kyaping
The Unintended Legacy Of Hellenism: The Development And Dissemination Of The Buddha Image, Chukyi Kyaping
History Honors Papers
This paper traces the development and evolution of the Buddha image from the first century CE in Gandhara to the fifth century CE in Luoyang, China and discusses the circumstances that allowed the image to adapt to different cultural environments. The emergence of the Buddha image marked a significant shift in the perception of the Buddha himself, through which Buddhism had effectively transformed from a philosophy into a religion.
Due to the syncretic nature of the Gandhari region, the Buddha image incorporated elements from multiple cultures, most notably from the Hellenistic artistic tradition. The dissemination of the Buddha image, traced …

Bosnia: Doomed To Failure Or A Rising Hope?, Caitlin V. Moore
Bosnia: Doomed To Failure Or A Rising Hope?, Caitlin V. Moore
Politics Honors Papers
Bosnia and Herzegovina is a country that suffers from a lack of a national identity as it has three main ethnic groups, Bosniaks, Croats and Serbs, who are all fighting for power. After the Bosnian war, which lasted from 1992-1995 and involved genocide that was committed against the Bosniaks, the ethnic divisions were further entrenched. These divisions were not helped by the provisions of the Dayton Peace Accords, which was the peace settlement that brought an end to the war. Dayton created an ethnocracy within Bosnia that places more importance on ethnic groups than national identity. In order to see …

Libraries Faculty and Staff Scholarship and Research
Australia released the newest edition of its Defense White Paper, describing Canberra’s current and emerging national security priorities, on February 25, 2016. This continues a tradition of issuing defense white papers since 1976. This work will examine and analyze the contents of this document as well as previous Australian defense white papers, scholarly literature, and political statements assessing their geopolitical significance. It will also examine public input into Australian defense white papers and the emerging role of social media in this public involvement. It concludes by evaluating whether Australia has the political will and economic resources necessary to fulfill its …
Un-Lockeing The Beauty Which Prejudice Has Overlaid: On Alain Locke's Philosophical Anthropology, Value Theory, And The Movement Towards Cosmopolitanism, Corey Lorenzo Barnes
Un-Lockeing The Beauty Which Prejudice Has Overlaid: On Alain Locke's Philosophical Anthropology, Value Theory, And The Movement Towards Cosmopolitanism, Corey Lorenzo Barnes
Electronic Theses and Dissertations Archive
This work is an elucidation of Alain Locke’s philosophical anthropology and value theory as devices to combat racial superiority, which Locke took to be the greatest challenge to the possibility of establishing a cosmopolitan community. For Locke, the possibility of establishing a cosmopolitan community implies healthy social and political relations, which themselves imply respect. However, respect is denied to members of certain races because they are perceived to be the bearers of inherently inferior cultures, which are grounded in values. Locke needs a philosophical anthropology that combats the idea of distinct differences in races that are caused by either nature …

Characterizing The Mortuary Practices In Highland Ancash, Perú: Analysis Of Funerary Contexts At Hualcayán, Elizabeth Katherine Cruzado Carranza
Electronic Theses and Dissertations Archive
This thesis is the study of the characteristics of mortuary practices at the archeological site of Hualcayán, in highland Ancash, Perú, during A.D.. 1 to 1000. Hualcayán is a complex site with nearly 4000 years of occupation in an area of 4 square kilometers. In order to define the characteristics of mortuary practices at this site, I developed three research questions to examine the multiple lines of evidence for variation and significance of the burials. These are the questions: which burial pattern variations occurred in Hualcayán during A.D.. 1 to 1000, what are the burial pattern variations between funerary structure …
Integrative 3d Recording Methods Of Historic Architecture: Burg Hohenecken From Southwest Germany, Aaron C. Pattee
Integrative 3d Recording Methods Of Historic Architecture: Burg Hohenecken From Southwest Germany, Aaron C. Pattee
Department of Anthropology: Theses and Student Research
This research explores the methodology and application of photogrammetric and laser-scanning recording methods to a castle ruin, with the primary purpose of digitally preserving the castle. Both methods generated interactive 3D models via the combination of still images (photogrammetry) and precise laser measurements (laser-scanning), which were then combined into a single model. The case study is the medieval castle ruin Burg Hohenecken located in the city of Kaiserslautern in southwest Germany. The castle was active from 1212-1689, as one of over fifty castles within the region of the Pfalz. The inhabitants included the noble von Hoheneck family and various …
How Cosmopolitan Are International Law Professors?, Ryan Scoville, Milan Markovic
How Cosmopolitan Are International Law Professors?, Ryan Scoville, Milan Markovic
Faculty Scholarship
This Article offers an empirical answer to a question of interest among scholars of comparative international law: why do American views about international law appear at times to differ from those of other countries? The authors contend that part of the answer lies in legal education. Conducting a survey of the educational and professional backgrounds of nearly 150 legal academics, the authors reveal evidence that professors of international law in the United States often lack significant foreign legal experience, particularly outside of the West. Sociological research suggests that this tendency leads professors to teach international law from predominantly nationalistic and …

Multi-Scale Modeling And Assessment Of Malaria Risk In Northern South America, Temitope O. Alimi
Multi-Scale Modeling And Assessment Of Malaria Risk In Northern South America, Temitope O. Alimi
Open Access Dissertations
With malaria control in Latin America firmly established in most countries and a growing number of these countries in the pre-elimination phase, malaria elimination appears feasible. A review of the literature indicates that malaria elimination in this region will be difficult without locally tailored strategies for vector control, which depend on more research on vector ecology, genetics and behavioral responses to environmental changes, such as those caused by land cover alterations, and human population movements. An essential way to bridge the knowledge gap and improve vector control is through risk mapping. Malaria risk maps based on statistical and knowledge-based modelling …

Cultivating Resistance: Haitian-Dominican Communities And The Dominican Sugar Industry, 1915-1990, Amelia Hintzen
Open Access Dissertations
This dissertation integrates archival, ethnographic, and oral-historical research to investigate the intertwined histories of the Dominican sugar industry and Haitian immigrant communities in the Dominican Republic. Over the first half of the twentieth century the Dominican economy became increasingly dependent on Haitian labor to cut sugarcane, and at the same time government policies became more anti-Haitian. During the thirty-year dictatorship of Rafael Trujillo, the Dominican state worked to recruit what they assumed would be a male and temporary Haitian workforce. Trujillo developed an extensive legal apparatus to surveil the country’s population, enabling state officials to segregate Haitians on sugar plantations …

A Climatology Of The Interaction Between Short-Wave Troughs And Shore-Parallel Lake-Effect Snowstorms Off Of Lake Ontario, Zachary S. Bruick, Emily W. Ott, Nicholas D. Metz
Symposium on Research and Creative Expression (SORCE)
Lake-effect snowstorms can produce prolific snowfall amounts near the shores of Lake Ontario while presenting a severe hazard to public safety. Shore-parallel lake-effect snow bands are 20–50 kilometers wide and can extend inland for over 200 kilometers. While lake-effect snow is primarily a lower tropospheric event, middle and upper tropospheric features can have an impact on the evolution of lake-effect snow. In order to understand the influence of the upper troposphere on lake-effect snow, an eight-year (2007–2015) climatology of the interactions between 500-hPa short-wave troughs and Lake Ontario shore-parallel lake-effect snowstorms was developed. A short-wave trough database and single site …
Conceptions Of Authority And The Anglo-American Common Law Divide, Dan Priel
Conceptions Of Authority And The Anglo-American Common Law Divide, Dan Priel
Articles & Book Chapters
This essay seeks to explain the puzzle of the divergence of American law from the rest of the common law world through the lens of legal theory. I argue that there are four competing ideal-type theories of the authority of the common law: reason, practice, custom, and will. The reason view explains the authority of the common law in terms of correspondence to the demands of pure practical reason; the practice view sees the authority of the common law as derived from the expertise of practitioners (especially judges and practice-oriented academics) who try to develop the common law as a …
