This Review examines the influence of foreign legal actors on jurisdictions that are not their own. Rachel Stern, a scholar of China, reflects on this point in her groundbreaking book published in 2013. In her penultimate chapter, Stern discusses how such foreign legal actors wield influence in China because of their presence on the ground. Building off of Stern's research, this Review proceeds to ask whether foreign legal actors can influence a domestic environment when that environment prohibits them from permanently working there. Professor Beazley explores the future implications to appellate advocacy as we move into the digital age. Understanding how that digital world affects legal reading is vital to understanding the future of appellate advocacy. Lawyers need to understand some of the science of how people read and interact with the written word; unfortunately, we have been slow to grasp the importance of this science. She defines and explains the concepts of "Active Readers" and "Knowledge Work." She then addresses some of the issues that arise as active readers transition from paper to digital platforms. Many American students struggle with reading, particularly in the area of comprehension. As such, early identification of reading difficulties, use of evidenced-based interventions, and monitoring of student reading progress over time is essential. Curriculum-based measurement (CBM) is a technically adequate, efficient tool whose features and design make it a good candidate for early identification and progress monitoring purposes, especially within a response to intervention framework. However, there is still some uncertainty regarding the utility of reading CBM as progress monitoring tools. Though intended to educate patients on the risks, benefits, side effects and alternatives within medical treatment, informed consent documents may have unanticipated consequences for patients. Patients may regard these forms as little more than a ritual to access treatment. Or patients may perceive that these forms exist to protect doctors rather than to contribute to a meaningful, patient-protective educational interaction. To rehabilitate the informed consent project, this essay considers the baggage that informed consent documents have acquired through practical use, explores patients' and providers' lived experience of informed consent, and considers whether a multimedia consent application would be a viable …

Leadership potential in regular students is not usually identified by organization advisors at the high school level. Teachers serving as advisors have academic workloads and they are trained to identify the gifted and honors students as leaders, but generally not those at the regular level. Although leadership potential exists in all students, organization advisors tend to seek out those at the top of the class. This study explored how organization advisors, who are also high school teachers, identify student leadership. This dissertation examines the relationship between Joan of Arc, postcolonial identity, and public memory. Since her repopularization in the nineteenth century, Joan of Arc has become one of the most emblematic figures of French history. Commemorated in public statuary, celebrated by writers, and championed by politicians, la Pucelle’s story is tantamount to national myth. While Joan of Arc’s centrality to France’s iconic imagining of itself during the spread of its empire has received much critical attention, her postcolonial afterlife remains understudied. This project offers a counterpoint to the prevailing assumption that Joan of Arc has few implications for postcolonial studies …

In June 2015, the United States Supreme Court granted the State of Mississippi leave to file a bill of complaint against the State of Tennessee, the City of Memphis, and Memphis Light, Gas & Water Division for wrongfully converting groundwater from the interstate Sparta-Memphis Aquifer. The dispute arises from Memphis and its municipal utility pumping groundwater within Tennessee, which Mississippi alleges has lowered the water tables within its territory. The Supreme Court's grant of leave raises for the first time the question of what legal doctrine applies to transboundary interstate groundwater resources. Tennessee and lower courts would subject interstate groundwater …

Test anxiety is a construct that includes cognitive, physiological, and behavioral symptoms occurring in response to anxiety prior to, during, or following examinations. The current literature on test anxiety has evaluated a number of possible predictors, including demographic variables, academic indicators, and self-perceptions. The movement toward school accountability and higher academic expectations of students has increased the severity of consequences occurring as a result of poor academic achievement. Thus, test anxiety is a critical concern that may impact student academic success. This comparative study asserts the centrality of spirituality to literature that explores life in the African Diaspora. Specifically, it emphasizes the importance of spirituality both to the authors and to the lives of their characters in the novels Victoire, les saveurs et les mots (2006) by the Guadeloupian author Maryse Condé, Camwood at Crossroads (2007) by Nigerian author Femi Euba, and El color del verano (1991) by Cuban author Reinaldo Arenas. This study provided insights into how upper elementary teachers from three southern school districts used standards based curriculum materials and the resulting changes in their beliefs, knowledge, and practice. Additionally, this study sought to identify whether the following four factors were predictors of change in teacher practice: coherence of the professional development program, opportunities to collaborate, years of teaching experience, and curriculum use. The participating school districts were selected through purposeful sampling with districts being chosen largely based on a strong commitment to implementing Eureka Math in their schools. We have criticized the amendments to the Federal Rules of Civil Procedure since the 1980s and the procedural changes made by United States Supreme Court decisions during the same period. These amendments and changes, even if subtle and incremental, launched a new era—the Fourth Era in the grand history of American civil procedure. In this era, tragically, litigation is often perceived as a nuisance, trials are a mistake, and judicial case management is a catholicon. Research has consistently demonstrated that literacy skills are associated with a host of benefits that are both substantial and long lasting. Given the implications of reading skill development, efforts to understand the most effective methods of teaching students how to read are consequential. Fortunately, substantial research has been conducted on this topic and has subsequently highlighted two essential building blocks of a balanced literacy framework: phonemic awareness and phonics. J. A. C. Redford’s Antiphons is a reverent and mystically beautiful, choral song cycle, consisting of seven settings and written for a cappella divisi mixed chorus. Based on texts originating from the seven, ancient Great O Antiphons, each of Redford’s settings interweave the original antiphon text with one of seven Advent sonnets written by English poet-priest, Malcolm Guite. The texts of the Great O Antiphons coincide with the seven verses of the familiar Advent hymn, “O Come, O Come Emmanuel.” This study contains a brief history and a comprehensive textual analysis of the ancient antiphons, an in-depth textual analysis of …

The primary purpose of the study was to determine the influence of selected demographic and academic characteristics on success in nursing education among first year baccalaureate nursing students enrolled in a private college in the Southern region of the United States. The participants in the study were 102 baccalaureate students admitted to the nursing program in Fall, 2013. For the purpose of the study, success was defined as a grade of C or higher in two clinical nursing courses in the first year of the nursing program. Given that youth mental health is associated with their success in school and in life more broadly, it is important that school-based psychological service providers embrace best-practice prevention and intervention strategies that target mental health when working with student populations. One line of study in this area has begun exploring the incorporation of a dual-factor model of mental health within universal screening systems in schools. The dual-factor model is differentiated from the traditional unidimensional mental health model, which focuses on the presence or absence of psychopathology, by conceptualizing mental health alternatively as consisting of both psychopathology and wellbeing dimensions. Search efficiency is usually improved by presenting observers with highly detailed target cues (e.g., pictures). However, in the absence of accurate target cues, observers must rely only on categorical information to find targets. Models of visual search suggest that guidance in a categorical search results from matching categorically-diagnostic target features in the search display to a top-down attentional set (i.e., the search template), but the mechanisms by which such attentional set is constructed have not been specified. Recent work has shown that intentional forgetting of distracting, erroneous, or irrelevant information aids memory, and relies on active, effortful processes. Two experiments investigated the underlying attentional mechanisms that are active during directed forgetting (DF). Across both experiments, participants completed a modified item-method DF task, in which they received memory instructions to remember or forget individual images for a subsequent memory test. Participants studied items associated with remember or forget instructions before they were shown a subliminal presentation of target items. This study makes use of the manorial court rolls of Dyffryn Clwyd, a cantref in Northern Wales, and the certificates of debt from London to examine the lives of two medieval usurers, Ieuan Kery and Sir William Capell, between the years 1340 to 1352 , and 1478 to 1509 . By examining the life of these two individuals who both operated one of the rarest, most socially complex occupations of his place and time, this study begins to expose the ways in which usury helped to shape the fabric of late Medieval culture in the British Isles. This special report in partnership with CNN en Espanol examined changes in the Latino electorate, registered voters, and voters in the U.S. and key swing states between 1992 and 2016. Methods: Data were obtained from the U.S. Census Bureau, Voting and Registration, as a part of the Current Population Survey data from the November Voter Supplements. The 2016 estimates were derived by using the yearly percentage rate of increase between 2004 and 2012. Results: The absolute number of Latinos eligible to vote, registered, and who voted grew dramatically. Yet the rates of Latino voter registration were almost exactly the same …

In August, 2013 Mikki Kendall, writer and pop culture analyst, started the hashtag #SolidarityisforWhiteWomen as a form of cyberfeminist activism directed at the predominantly white feminist activists and bloggers at sites like Feministing, Jezebel and Pandagon who failed to acknowledge the racist, sexist behavior of one their frequent contributors. Kendall’s hashtag activism quickly began trending and reignited a discussion about the trouble with white feminism. A number of journalists have excoriated Kendall specifically, and women of color more generally, for contributing to a “toxic” form of feminism. Objectives: The purpose of this study was to examine the overlap in burnout and depression. Method: The sample comprised 1,386 schoolteachers (mean age = 43; mean years taught = 15; 77% women) from 18 different U.S. states. We assessed burnout, using the Shirom-Melamed Burnout Measure, and depression, using the depression module of the Patient Health Questionnaire. Results: Treated dimensionally, burnout and depressive symptoms were strongly correlated (.77; disattenuated correlation, .84). Burnout and depressive symptoms were similarly correlated with each of 3 stress-related factors, stressful life events, job adversity, and workplace support. Language and communication disorders are often associated with deficits in working memory (WM) and interference control. WM studies involving children with specific language impairment (SLI) have traditionally been framed using either resource theories or decay accounts, particularly Baddeley's model. Although significant interference problems in children with SLI are apparent in error analysis data from WM and language tasks, interference theories and paradigms have not been widely used in the SLI literature. A primary goal of the present paper is to provide an overview of interference deficits in children with SLI. Review of the extant literature on interference control shows deficits …

At least three methodological problems affect the study by Katsavouni et al. (2016). First, there are currently no diagnostic criteria for burnout, neither in the DSM-5, nor in the ICD-10. Second, one extremely important variable was omitted from this study of firefighters, namely, depression. Third, the authors did not control for relevant nonoccupational factors such as stressors occurring outside of work.
