Defining A Medium: The Educational Aspirations For Early Radio, Amanda R. Keeler
College of Communication Faculty Research and Publications
This essay examines the attempts by many writers to steer the burgeoning U.S. radio industry towards educational uses and programming in the 1920s. At the same time that commercial radio began to take shape, several competing and seemingly incompatible visions of the airwaves emerged—one of which privileged the use of radio for educational purposes. Using discourse from trade journals, general interest magazines, and newspapers, this article explores the calls for educational programming amid the rapidly expanding and consolidating commercial radio industry.

Fiduciary Capacity And The Bankruptcy Discharge, Jonathon S. Byington
Fiduciary Capacity And The Bankruptcy Discharge, Jonathon S. Byington
Faculty Law Review Articles
Bankruptcy law has fiercely competing policies. A primary one is the debtor's fresh start. Another is that discharge of debt is a selectively conferred privilege rather than an unlimited right. This latter policy is manifested in part by the Bankruptcy Code's exceptions to discharge. One exception involves a debt "for . . . defalcation while acting in a fiduciary capacity."1 In 2013, the Supreme Court addressed the meaning of the term "defalcation" and established a new, heightened mental standard based on the Model Penal Code's definition of recklessly.2 The meaning of the term "fiduciary capacity" is not clear. This Article …

Does Teaching Parents Emotion-Coaching Strategies Change Parental Perception Of Children's Negative Emotions?, Eric Labass
Does Teaching Parents Emotion-Coaching Strategies Change Parental Perception Of Children's Negative Emotions?, Eric Labass
Antioch University Dissertations & Theses
The purpose of this study was to explore if parental perception of children's negative emotions changes after participating in the parenting program How to Talk to Kids So Kids Will Listen-Video Series (HTK) (Faber & Mazlish, 2002). The HTK workshop comprises six sessions designed to teach parents to identify and empathize with children's feelings and learn emotional communication skills that facilitate a respectful relationship between parent and child. The Coping with Children's Negative Emotions Scale (CCNES) (Fabes, Eisenberg, & Bernzweig, 1990) was given to parents before and after participation in the HTK workshop. The CCNES revealed that a total of …
Demographic Characteristics And Trauma Symptomology In Juvenile Justice Residents At Echo Glen Children's Center, Britta L. Bergan
Demographic Characteristics And Trauma Symptomology In Juvenile Justice Residents At Echo Glen Children's Center, Britta L. Bergan
Antioch University Dissertations & Theses
Exposure to traumatic and stressful events has become increasingly commonplace and the impact of such experiences has been well documented. Trauma events in childhood have been associated with a number of factors, including maladaptive emotional and behavioral responses, increased vulnerability for exposure to additional traumatic events, and adverse experiences later in life. Juvenile justice youth have been found to have higher rates of trauma exposure, when compared to community samples of same-aged peers. The population of youth residing at Echo Glen Children’s Center, in Snoqualmie, Washington, exhibit unique characteristics for a juvenile justice population, including age (the youngest juvenile offenders …
"One Narrow Thread Of Green": The Vision Of May Theilgaard Watts, The Creation Of The Illinois Prairie Path, And A Community's Crusade For Open Space In Chicago's Suburbs, Anne M. Keller
Antioch University Dissertations & Theses
Women's environmental activism prior to the early 1960s in America focused on women's roles as municipal housekeepers or emphasized wilderness conservation. I offer in this dissertation the story of the Illinois Prairie Path, the country's first rails-to-trails conversion to apply for National Recreation Trail status, and the innovative women who fought for nature preservation in a suburban setting rather than in a wilderness area. Led by renowned writer and naturalist, May Theilgaard Watts, these women built support for the public footpath project by fostering an ecological awareness throughout their region. I place them in the tradition of Chicago female reformers …
Pebbles Under The Tongue: A Qualitative Investigation Of Parents Who Stutter, Craig Matthew Kramer
Pebbles Under The Tongue: A Qualitative Investigation Of Parents Who Stutter, Craig Matthew Kramer
Antioch University Dissertations & Theses
To date, few studies have explored the lived experiences of parents who stutter. Thus, this qualitative study utilized a 15-question, in-depth semi-structured interview to explore how stuttering impacts various parenting roles, functions, activities, and states. Furthermore, this study elucidates how parents who stutter describe and attach meaning to parenting, as well as how they view parental stuttering in terms of disability status. Participants were 10 parents (6 men and 4 women) who self-identified as having a stuttering disorder. All participants were over 18 years of age and had a child between the ages of 5-18. Data was analyzed using an …
The Happy Boomer: Baby Boomer Life Satisfaction Through Affect And Feeling Of Belonging, Brooke Christina-Marie Massey
The Happy Boomer: Baby Boomer Life Satisfaction Through Affect And Feeling Of Belonging, Brooke Christina-Marie Massey
Antioch University Dissertations & Theses
The age cohort of 65 years and older is a growing population. It is part of the group referred to as Baby Boomers, the generation born between the years 1946-1964. It will be the largest population to reach late adulthood to date. In the United States alone, the Baby Boomer cohort is expected to reach 70 million by 2030. In response to this growing elderly population much research has been conducted on Baby Boomer quality of life issues. Such research uncovered the phenomenon known as the well-being paradox. The well-being paradox refers to the findings that older adults' life satisfaction …
Black And White Multiracial Adult Womens' Experience Of Their Physical Appearance: A Qualitative Descriptive Phenomenological Analysis, Vanessa Geissler
Black And White Multiracial Adult Womens' Experience Of Their Physical Appearance: A Qualitative Descriptive Phenomenological Analysis, Vanessa Geissler
Antioch University Dissertations & Theses
According to the 2010 United States Census 1.8 million people self-identified as multiracial Black, and of that 1.8 million, 45% self-identified as Black and White. Multiracial individuals are a growing population in the United States, and by year 2050 an estimated 21% of the entire population will be multiracial. Irrespective of these statistics, research among this population is limited. Further research is warranted because existing literature has identified an increased emphasis on multiracial individual’s physical appearance. Questions such as, “What are you?” or labels such as exotic, beautiful, fascinating, or other, are a few examples of how this population is …
Racial Integration In One Cumberland Presbyterian Congregation: Intentionality And Reflection In Small Group, Carolyn Smith Goings
Racial Integration In One Cumberland Presbyterian Congregation: Intentionality And Reflection In Small Group, Carolyn Smith Goings
Antioch University Dissertations & Theses
Negative attitudes toward racial minorities and consequent maltreatment of non-Whites continue to be a crisis in America. The crisis of racism is still realized in phenomena such as residential segregation (Bonilla-Silva, 2014), health disparities (Chae, Nuru-Jeter, & Adler, 2012; Chae, Nuru-Jeter, Francis, & Lincoln, 2011), and in the not-so-uncommon unjust arrests and imprisonment of persons of color (Alexander, 2012). Improvement in race relations through the development of meaningful cross racial relationships in racially integrated settings is one avenue that may lead to reduction of racism (E. Anderson, 2010; Fischer, 2011; Massey & Denton, 1993). Christian congregations are common settings in …

Toward A Political Theory For Private International Law, John Linarelli
Toward A Political Theory For Private International Law, John Linarelli
Duke Journal of Comparative & International Law
Private international law presents a dilemma for legal and political philosophy. Legal and political philosophers have ignored private international law, with only a few scattered attempts to evaluate its claims. Private international law offers a powerful set of counterexamples that put into serious doubt attempts to link law’s authority only or primarily to relationships between states and citizens. No society, state, or other practice-mediated relationship can serve as grounds for the authority of private international law to persons to whom it applies but who are outside of such relationships. Private international law affects the normative situations of persons entirely outside …
Should I Stay Or Should I Go?: Why Bolivian Tactics And U.S. "Flexibility" Undermine The Single Convention On Narcotic Drugs, Robert C. Zitt
Should I Stay Or Should I Go?: Why Bolivian Tactics And U.S. "Flexibility" Undermine The Single Convention On Narcotic Drugs, Robert C. Zitt
Brooklyn Journal of International Law
This Note examines the deterioration of the 1961 Single Convention on Narcotic Drugs (“Convention”), as Member State circumvention of treaty spirit continues to highlight the disconnect between progressive drug policies and an enforcement regime armed with little or no power to monitor compliance. It first provides a brief history of the Convention with discussion underscoring the governing bodies of the treaty itself, particularly the International Narcotics Control Board (INCB). Further discussion will note the procedural mechanisms whereby parties can propose amendments or reservations to the Convention itself. With such procedures in mind, subsequent examination will analyze how Member States have …

Closing The Gap: Daca, Dapa, And U.S. Compliance With International Human Rights Law, David B. Thronson
Closing The Gap: Daca, Dapa, And U.S. Compliance With International Human Rights Law, David B. Thronson
Case Western Reserve Journal of International Law
Political rhetoric and ongoing litigation that challenge the use of prosecutorial discretion and deferred action in immigration law often prominently feature claims that these initiatives demonstrate a lack of respect for the rule of law. This short essay seeks to highlight gaps between U.S. immigration law and its international human rights obligations and identify ways in which the use of discretion can advance rather than undermine the rule of law. In reconciling the ability of States to control matters of immigration with protections of family integrity, the touchstone in international law is balance. A State's right to expel a non-citizen …
Public Enemy: The Public Element Of Direct And Public Incitement To Commit Genocide, Brendan Saslow
Public Enemy: The Public Element Of Direct And Public Incitement To Commit Genocide, Brendan Saslow
Case Western Reserve Journal of International Law
Direct and public incitement to commit genocide has been an international crime since the 1940s. The public element plays a role in each international incitement case, yet many scholars consider it straightforward and unworthy of attention. This article seeks to analyze jurisprudence, primarily developed at the International Criminal Tribunal for Rwanda, on how to determine whether inciting to commit genocide is public. This element is most problematic in cases involving speech through broadcast media such as television and radio. Moreover if ICTR case law informs future international criminal proceedings it may be an issue in a future genocide that involves …
A Fair Return Approach To Pharmaceutical Compulsory Licensing, Maura Nuno
A Fair Return Approach To Pharmaceutical Compulsory Licensing, Maura Nuno
Case Western Reserve Journal of International Law
This article argues that universal access to drugs requires not only collaboration between nations and patent holders, but also the creation of a neutral International Panel. Under the supervision of a Neutral International Panel, the disequilibrium, created by the current system of global intellectual property protection can be equalized to improve access to drugs without undermining pharmaceutical companies and intellectual property rights.
International Law In The Obama Administration's Pivot To Asia: The China Seas Disputes, The Trans-Pacific Partnership, Rivalry With The Prc, And Status Quo Legal Norms In U.S. Foreign Policy, Jacques Delisle
Case Western Reserve Journal of International Law
The Obama administration's "pivot" or "rebalance" to Asia has shaped the Obama administration's impact on international law. The pivot or rebalance has been primarily about regional security in East Asia (principally, the challenges of coping with a rising and more assertive China--particularly in the context of disputes over the South China Sea -- and resulting concerns among regional states), and secondarily about U.S. economic relations with the region (including, as a centerpiece, the Trans-Pacific Partnership). In both areas, the Obama administration has made international law more significant as an element of U.S. foreign policy and has sought to present the …
Smoke 'Em If You Got 'Em: Intellectual Property Rights In The Tobacco Industry Going Up In Smoke, Kristen Lease
Smoke 'Em If You Got 'Em: Intellectual Property Rights In The Tobacco Industry Going Up In Smoke, Kristen Lease
Case Western Reserve Journal of International Law
The Tobacco Plain Packaging Act (TPPA) was passed in Australia in 2011 and set restrictions on the appearance of tobacco packages. The restrictions limited the use of trademarks to only the brand name, and banned any use of distinctive colors or images. Tobacco growing nations believed this restriction on trade dress violated Article 20 of the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement, which guarantees that no restriction may unjustifiably encumber intellectual property. Article 8 of the TRIPS Agreement, however, allows for encumbrances when it is intended to promote the protection of public health and safety. The tobacco growing …
A Comparative Empirical Study Of Negotiation In Criminal Proceedings Between Brazil And The United States Of America, Ricardo Gueiros Bernardes Dias
A Comparative Empirical Study Of Negotiation In Criminal Proceedings Between Brazil And The United States Of America, Ricardo Gueiros Bernardes Dias
University of Baltimore Journal of International Law
The present research aims to understand the law in regards to the types of negotiations performed under the law of criminal procedure and to understand how the discursive practice of lawyers can organize social practices from a comparative empirical perspective of Brazil and the United States of America. Thus, the research comparatively investigates the institutional processes for the establishment of truth before the bodies of the judicial branch in Brazil (metropolitan region of Vitória, ES-Brazil) and in the U.S. (California, San Francisco) and focuses on their differences in their criminal negotiation in the special criminal courts and the institution of …

Student Comment: Ttip: A Free Trade Agreement That Strengthens The International Trade Environment And Enhances The Regulatory Powers Of The Wto, Suzanne De Deyne
University of Baltimore Journal of International Law
This comment discusses the Transatlantic Trade Investment Partnership (TTIP or the Partnership), a bi-lateral trade agreement between the United States and the European Union, in relation to the World Trade Organization (WTO). TTIP pushes the world towards greater trade liberalization, and if implemented, such a trade agreement would affect trillions of dollars in existing trade. When trade barriers are reduced, a significant amount of new possibilities open up, especially in regards to potential markets for exports, growth and improvement of competitive products, and reduction in the losses associated the border. Since its establishment, the WTO has sought to establish an …
Holding The Executive Accountable In Egypt, Impeachment: A Losing Case, Dr. Mohamed Abdelaal
Holding The Executive Accountable In Egypt, Impeachment: A Losing Case, Dr. Mohamed Abdelaal
University of Baltimore Journal of International Law
This paper examines the impeachment mechanism in Egypt after the 2011 Revolution and the 2013 events and the removal of Presidents Hosni Mubarak and Mohamed Morsi. In doing so, the paper will provide a critical analysis to the impeachment clauses in both the 2012 and 2014 Constitutions, in an attempt to discover to what extent the pre 2011 impeachment differs from that of post 2011. Further, it addresses the issue of whether the recall election could make a good alternative to impeachment in Egypt. Specifically, we will briefly shed light on the history of the recall device as well as …
Decentering Human Rights From The International Order Of States: The Alignment And Interaction Of Transnational Policy Channels, Radu G. Mares
Decentering Human Rights From The International Order Of States: The Alignment And Interaction Of Transnational Policy Channels, Radu G. Mares
Indiana Journal of Global Legal Studies
This article accounts for recent developments in corporate social responsibility, international trade and investment law, international human rights law, development aid, and the laws of home states reaching extraterritorially in order to advance a regulatory perspective on commerce and human rights. While these developments are remarkable, the analysis documents the prevalence of softer strategies and a corresponding scarcity of coercive legalization strategies. The question, then, is how to reason about these recent developments and their genuine potential for human rights protection. The article proposes two elements-a root-cause orientation and the interaction of policy channels-as indispensable for a regulatory and systemic …
Transformations In Statehood, The Investor- State Regime, And The New Constitutionalism, A. Claire Cutler
Transformations In Statehood, The Investor- State Regime, And The New Constitutionalism, A. Claire Cutler
Indiana Journal of Global Legal Studies
This paper examines the changing boundaries of statehood resulting from transformations in the nature and operation of public and private authority over local and global politico-legal orders. Transformations in the political purposes of states are being driven by powerful elites who advance a new form of constitutional governance. New constitutionalism, as evidenced by the investor-state regime, subordinates the interests, purposes, and rights of national citizens to those of foreign, transnational politico-legal, and economic elites. This regime is a highly privatized order that is expanding in influence, both in terms of the commercial activities under its remit, and in terms of …
A Comparison Between Shale Gas In China And Unconventional Fuel Development In The United States: Water, Environmental Protection, And Sustainable Development, Paolo D. Farah, Riccardo Tremolada
A Comparison Between Shale Gas In China And Unconventional Fuel Development In The United States: Water, Environmental Protection, And Sustainable Development, Paolo D. Farah, Riccardo Tremolada
Brooklyn Journal of International Law
China is believed to have the world's largest exploitable reserves of shale gas, although several legal, regulatory, environmental, and investment-related issues will likely restrain its exploitation. China's capacity to face these hurdles successfully and produce commercial shale gas will have a crucial impact on the regional gas market and on China’s energy mix, as Beijing strives to decrease reliance on imported oil and coal, and, at the same time, tries to meet growing energy demand and maintain a certain level of resource autonomy. The development of the unconventional natural gas extractive industry will also provide China with further negotiating power …
