The First Amendment: Not One Size Fits All, Caroline Poplin Jan 2016

The First Amendment: Not One Size Fits All, Caroline Poplin

Emory Business Law Review

Dr. Poplin examines two recent federal cases, Caronia v. FDA and FDA v. Amarin, in which courts held that the First Amendment protects pharmaceutical manufacturers who market their drugs off-label as long as the advertising is 'truthful and non-misleading.' In so doing, these courts essentially overturned restrictions Congress imposed in 1962, after the thalidomide disaster. The drug at issue in Caronia is particularly dangerous'it is closely related to a date-rape drug, and was approved for a narrow indication. The defendant sales representative nonetheless said the drug was 'very safe', and recommended it for a variety of common diseases, including Parkinson's …

Corporate Compliance Programs: Pretext Or Panacea?, Justin S. Brooks Jan 2016

Corporate Compliance Programs: Pretext Or Panacea?, Justin S. Brooks

Emory Business Law Review

Justin S. Brooks' article discusses the effectiveness of corporate compliance programs and factors characterizing well-designed ones. The article explains that mandates to maximize profits for shareholders can encourage bad behavior by officers and directors but that countervailing factors encourage the development and implementation of effective compliance programs. In response to specific questions posed, the author explains that: (1) corporate compliance programs can both weed out non-meritorious or frivolous complaints and facilitate internal and external reporting of meritorious evidence of misconduct; (2) corporate compliance programs sensitize employees to the fact that wrongdoing is plausible, but written directives, communications, and training by …

Possible Futures For Teacher Education Programs: Meta-Theory Orientation, Jared C. Svendsen Jan 2016

Possible Futures For Teacher Education Programs: Meta-Theory Orientation, Jared C. Svendsen

Electronic Theses and Dissertations 2010 - 2019

This study problematizes teacher education, and its accreditation guidelines as set forth by the Council for the Accreditation of Educator Preparation. The analysis herein conceptualizes teacher education as contextually contingent on sociocultural metanarratives, as functioning paradigmatically through consensus and gatekeeping mechanisms, and as a structure existing within a matrix of discipline and surveillance that is designed to perpetuate status quo power dynamics. This conceptualization grounds dominant teacher education modalities within a specific meta-theory orientation. Through this analysis, the author also explores an alternative conceptualization of teacher education that appeals to the educative power of contextual awareness, ontological sensitivity, and democratically …

Preparing Pre-Service Teachers To Educate Emerging Bilingual Students: A Textual Analysis Of Teacher Education Curriculum In Elementary-Level Language Arts Methods Textbooks, David A. Mann Jan 2016

Preparing Pre-Service Teachers To Educate Emerging Bilingual Students: A Textual Analysis Of Teacher Education Curriculum In Elementary-Level Language Arts Methods Textbooks, David A. Mann

Electronic Theses and Dissertations 2010 - 2019

Drawing on the principles of critical multicultural teacher education, Teaching English to Speakers of Other Languages (TESOL) and bilingual education, this study examined how pre-service teachers were prepared to educate Emerging Bilinguals (EBs) in ESOL-infused teacher education programs in Florida universities. The textual analysis of a purposeful sample of five elementary-level English Language Arts (ELA) methods textbooks, utilizing a combination of quantitative and qualitative methods, revealed that authors overwhelmingly referred to EBs as English learners or English language learners, rather than bilinguals or dual language learners, and devoted less than 5% of the total content of four textbooks to topics …

Natality Of Yearling Coyotes In West Virginia, G. G. Albers, J. W. Edwards, R. E. Rogers, L. L. Mastro Jan 2016

Natality Of Yearling Coyotes In West Virginia, G. G. Albers, J. W. Edwards, R. E. Rogers, L. L. Mastro

United States Department of Agriculture Wildlife Services: Staff Publications

Minimal information is available regarding the reproduction of coyotes (Canis latrans) in the Mid-Atlantic region, which includes the states of Delaware, Maryland, North Carolina, Pennsylvania, Virginia, and West Virginia. Since reproductive information is useful to assess populations and determine management strategies and because this information is unavailable for the Mid-Atlantic, we examined uterine tracts of 66 female coyotes collected from February to May 2010 for fetuses. We measured fetuses using a digital caliper and approximated dates of conception and parturition. Nine (13.6%) female coyotes were pregnant with visible fetuses; seven of these females were yearlings (1.5–2.5 y old). …

Muslim Women: Between Culture And Feminism, Hanadi Alotaibi Jan 2016

Muslim Women: Between Culture And Feminism, Hanadi Alotaibi

Electronic Theses and Dissertations 2010 - 2019

Women’s rights in Islam became a major subject after the third feminist movement in the United States. When feminism spread globally, many Islamic scholars connected it to Islam. Islamic feminism is a term that takes most of its ideologies from the two primary sources of Islam – the Quran and the Sunnah. This qualitative research explained the bias directed towards women in Islam by using objective reasoning through examples as well as by encompassing any misinterpretation of views regarding women’s rights in Islam. The method used was a content analysis. The findings were that Islam is a feminist religion. While …

Myth, Modernism And Mentorship: Examining François Fénelon’S Influence On James Joyce’S Ulysses, Robert Curran Jan 2016

Myth, Modernism And Mentorship: Examining François Fénelon’S Influence On James Joyce’S Ulysses, Robert Curran

Electronic Theses and Dissertations 2010 - 2019

The purpose of this thesis will be to examine closely James Joyce’s Ulysses with respect to François Fénelon’s The Adventures of Telemachus. Joyce considered The Adventures of Telemachus to be a source of inspiration for Ulysses, but little scholarship considers this. Joyce’s fixation on the role of teachers and mentor figures in Stephen’s growth and development, serving alternately as cautionary figures, models or adversaries, owes much to Fénelon’s framework for the growth of Telemachus. Close reading of both Joyce’s and Fénelon’s work will illuminate the significance of education and mentorship in Joyce’s construction of Stephen Dedalus. Leopold Bloom and Stephen’s …

New Geometric Large Sets, Michael Robert Hurley Jan 2016

New Geometric Large Sets, Michael Robert Hurley

Electronic Theses and Dissertations 2010 - 2019

Let V be an n-dimensional vector space over the field of q elements. By a geometric t-[q^n, k, λ] design we mean a collection D of k-dimensional subspaces of V, called blocks, such that every t-dimensional subspace T of V appears in exactly λ blocks in D. A large set, LS [N] [t, k, q^n], of geometric designs is a collection on N disjoint t-[q^n, k, λ] designs that partitions [V K], the collection of k-dimensional subspaces of V. In this work we construct non-isomorphic large sets using methods based on incidence structures known as the Kramer-Mesner matrices. These structures …

On The Importance Of Being Fun: Over Time Associations Between Perceptions Of Fun And Changes In Peer Preference And Popularity, Shrija R. Dirghangi Jan 2016

On The Importance Of Being Fun: Over Time Associations Between Perceptions Of Fun And Changes In Peer Preference And Popularity, Shrija R. Dirghangi

Electronic Theses and Dissertations 2010 - 2019

In this short- term longitudinal study (N=428), the unique predictive association between the positive peer nominated characteristic of being fun and peer status (peer preference and popularity) was assessed in a sample of fourth through sixth grade students. Concurrent hierarchical regression analyses and longitudinal structural equation modeling analyses found that peer nominated fun positively predicted preference and popularity, after accounting for the contribution of predictors potentially confounded with being fun, such as prosocial behavior, academic achievement, relational aggression, and physical aggression. The longitudinal association between fun and preference was qualified by grade in school, such that being fun predicted increases …

Performance Analysis Of Spectrum Sensing Schemes Based On Fractional Lower Order Moments For Cognitive Radios In Alpha- Stable Noise Environments, A-Bon Elfick Ackie Jan 2016

Performance Analysis Of Spectrum Sensing Schemes Based On Fractional Lower Order Moments For Cognitive Radios In Alpha- Stable Noise Environments, A-Bon Elfick Ackie

Electronic Theses and Dissertations 2010 - 2019

Natural and manmade noise signals tend to exhibit impulsive behaviors. Therefore modeling those signals as α-stable processes is better suited towards the development of a practical spectrum sensing scheme. However, the performances of detectors operating in an α-stable noise environment are difficult to evaluate. This is because an α-stable random variable can usually only be modeled by the characteristic function since closed-form expressions are usually not available except for the special values of the characteristic exponent that correspond to the Cauchy and Gaussian noise distributions. In this thesis, we derive a general closed-form expression for the probability density function (PDF) …

Personality Traits In Atlantic Spotted Dolphins (Stenella Frontalis): Syndromes And Predictors Of Neophilia, Nathan Skrzypczak Jan 2016

Personality Traits In Atlantic Spotted Dolphins (Stenella Frontalis): Syndromes And Predictors Of Neophilia, Nathan Skrzypczak

Electronic Theses and Dissertations 2010 - 2019

Personality is defined as inter-individual variation of behavioral traits while maintaining intra-individual stability. The focus of this study was to observe distinct personality trait categories, establish baseline personality trait phenotypes for the juvenile population, and compare the personality phenotypes between different categories, such as sex or generation. Three personality traits were studied—sociability, curiousity, and boldness—based on the percentage of time individuals spent with conspecifics, human researchers, and their mothers, respectively. The surveyed individuals significantly varied positively and negatively from the means of each trait, and no significant difference for any trait was found between males and females, or across time …

Physical Layer Security Of Wireless Transmissions Over Fading Channels, Sadrac Blanc Jan 2016

Physical Layer Security Of Wireless Transmissions Over Fading Channels, Sadrac Blanc

Electronic Theses and Dissertations 2010 - 2019

The open nature of the wireless medium makes the wireless communication susceptible to eavesdropping attacks. In addition, fading and shadowing significantly degrade the performance of the communication system in the wireless networks. A versatile approach to circumvent the issues of eavesdropping attacks while exploiting the physical properties of the wireless channel is the so-called physical layer-security. In this work, we consider a model in which two legitimate users communicate in the presence of an eavesdropper. We investigate the performance of the wireless network at the physical layer that is subject to a variety of fading environments that may be modeled …

Local, State, And Federal Responses To Stalking: Are Anti-Stalking Laws Effective?, Tracey Carter Jan 2016

Local, State, And Federal Responses To Stalking: Are Anti-Stalking Laws Effective?, Tracey Carter

Law Faculty Scholarship

Statistics show that there are currently 7.5 million victims of stalking in the United States each year. The year 2014 commemorated the 20th Anniversary since passage of the federal Violence Against Women Act of 1994 (“VAWA”) that was signed by President Bill Clinton on September 13, 1994. Passage of this Act marked a key transformation in our nation’s response to the crimes of domestic violence, sexual assault, and stalking. The VAWA was established to promote “collaboration among law enforcement, health care providers, nonprofit service groups, community leaders, and the private sector” to combat these crimes. In fact, the VAWA was …

The Making And Remaking Of Portland: The Archaeology Of Identity And Landscape At The Portland Wharf, Louisville, Kentucky, Michael J. Stottman Jan 2016

The Making And Remaking Of Portland: The Archaeology Of Identity And Landscape At The Portland Wharf, Louisville, Kentucky, Michael J. Stottman

Theses and Dissertations--Anthropology

The town of Portland, Kentucky was founded over 200 years ago as a speculative venture to profit from its advantageous location at the base of the Falls of the Ohio River. The Portland Wharf was the economic and cultural heart of the town. Throughout its history, the community has experienced much change. These changes are visible in the landscape of the Portland Wharf which reflected changes in the community’s identity.

Identity and landscape are topics that have been of great interest to archaeologists and this dissertation builds on previous works to examine identity as something that is reflected in the …

A Reflection Of Maya Representation, Distribution, And Interaction: Ceramic Figurines From The Late Classic Site Of Cancuén, Petén Department, Guatemala, Erin L. Sears Jan 2016

A Reflection Of Maya Representation, Distribution, And Interaction: Ceramic Figurines From The Late Classic Site Of Cancuén, Petén Department, Guatemala, Erin L. Sears

Theses and Dissertations--Anthropology

This project explores intersecting spheres of technological, stylistic and contextually patterned relationships expressed by ceramic figurines associated with the major Maya polity Cancuén. Cancuén is situated by assessing its external contacts by reference to figurines recovered from several Late Classic settlements, and hieroglyphic texts recorded as interacting polities. By focusing on these sites along connecting waterways, I attempt to discern directions of influence and change with regard to figurine use patterns relative to those seen in other ceramic representations. Traditional archaeological criteria were used to obtain excavated figurines at specific sites. Stylistic and technological information are augmented through an intensive …

Airborne Collision Detection And Avoidance For Small Uas Sense And Avoid Systems, Laith Rasmi Sahawneh Jan 2016

Airborne Collision Detection And Avoidance For Small Uas Sense And Avoid Systems, Laith Rasmi Sahawneh

Theses and Dissertations

The increasing demand to integrate unmanned aircraft systems (UAS) into the national airspace is motivated by the rapid growth of the UAS industry, especially small UAS weighing less than 55 pounds. Their use however has been limited by the Federal Aviation Administration regulations due to collision risk they pose, safety and regulatory concerns. Therefore, before civil aviation authorities can approve routine UAS flight operations, UAS must be equipped with sense-and-avoid technology comparable to the see-and-avoid requirements for manned aircraft. The sense-and-avoid problem includes several important aspects including regulatory and system-level requirements, design specifications and performance standards, intruder detecting and tracking, …

A Hurdle Too High: The Unconstitutionality Of Mandatory Ultrasounds Under Casey's Undue Burden Standard, Katarzyna Kordas Jan 2016

A Hurdle Too High: The Unconstitutionality Of Mandatory Ultrasounds Under Casey's Undue Burden Standard, Katarzyna Kordas

Cardozo Journal of Equal Rights & Social Justice

The article argues that mandatory ultrasound laws impose an undue burden on women seeking abortions, violating the constitutional standard established in Planned Parenthood v. Casey. These laws, often enacted to dissuade women from proceeding with abortions, are deemed medically unnecessary and unconstitutional as they obstruct women's reproductive rights.

Building Connections, Collaboration, And Community For Differently-And Typically-Able Students In A Middle School Library In The United States, Karen W. Gavigan, Clayton A. Copeland

Faculty Publications

Data from around the world offer compelling evidence regarding the impact that school librarians and library programs have on student achievement. Research investigating inclusive library programming, or programming serving both typically-able and differently-able students, however, is extremely limited. This case study examined inclusive library programming in a rural middle school library in the southeastern United States. Best practices and inclusion in the school library served as the axis from which a school culture of inclusion and valuing differences emanates. Findings from this study offer guidance for educators and librarians serving multiple grade levels in both school and public library settings.

Internal Investigations And The Evolving Fate Of Privilege, Lucian E. Dervan Jan 2016

Internal Investigations And The Evolving Fate Of Privilege, Lucian E. Dervan

Law Faculty Scholarship

In 1981, the United States Supreme Court delivered a landmark ruling in Upjohn Co. v. United States. The decision made clear that the protections afforded by the attorney-client privilege apply to internal corporate investigations. This piece examines the fundamental tenets of Upjohn, discusses some recent challenges to the applicability of privilege to materials gathered during internal investigations, and considers the manner in which the international nature of modern internal investigations adds complexity and uncertainty to the field.
