Truth And Legitimacy (In Courts), Kenneth S. Klein
Truth And Legitimacy (In Courts), Kenneth S. Klein
Loyola University Chicago Law Journal
This Article seeks to comprehensively articulate the meaning, role, and importance of truth in courts by drawing upon empirical and theoretical scholarship from philosophy, economics, social science, psychology, political science, ethics, and jurisprudence, in addition to more traditional legal sources such as United States Supreme Court decisions. It is frequently said that trials are a search for truth. But as insiders to the judicial system know, if this is so, then it is a meaning of truth that differs from what truth means in any other context. And exposing this definitional dissonance, in turn exposes that the legitimacy of the …

Righting America At The Creation Museum, Susan L. Trollinger, William Vance Trollinger
English Faculty Publications
On May 28, 2007, the Creation Museum opened in Petersburg, Kentucky. Aimed at scientifically demonstrating that the universe was created less than ten thousand years ago by a Judeo-Christian god, the museum is hugely popular, attracting millions of visitors over the past eight years. Surrounded by themed topiary gardens and a petting zoo with camel rides, the site conjures up images of a religious Disneyland. Inside, visitors are met by dinosaurs at every turn and by a replica of the Garden of Eden that features the Tree of Life, the serpent, and Adam and Eve.

Who’S Exercising What Power: Toward A Judicially-Manageable Nondelegation Doctrine, Martin Edwards
Who’S Exercising What Power: Toward A Judicially-Manageable Nondelegation Doctrine, Martin Edwards
Journal Articles
This Article argues that the traditional, "intelligible principle" nondelegation analysis is incomplete and that an examination of the delegate, rather than just the delegation, more effectively animates the doctrine. This is true not only as a practical matter; early Supreme Court cases, as well as later ones, have taken a keen interest in the recipient of the alleged delegation. In other words, a realistic and judicially enforceable nondelegation doctrine must include more than a mere tip of the juridical cap.

“Becoming Ioway: Using Auto-Ethnography To Understand The Fourteen Ioways’ Journey Of Colonization, Spirituality And Traditions Through Tribal Dance Exhibitions, Sarita R. Mc Gowan
Pitzer Senior Theses
This thesis analyzes the colonization and traditional spiritual practices of the Ioway people to show that their traditions have survived the effects of colonization also known as white settlers. I focus on issues of cultural traditional exhibition dance and that complicates the question of the nation-state’s exclusively trying to dissemble the Native Ioway Tribe of Kansas and Nebraska of colonization and the effects on the Ioway people past and present. I use personal experience of being a tribal member to discuss how the tribes’ oral history allows for the preservation of Ioway cultural identity and religious traditions.
Seer Stones, Salamanders, And Early Mormon "Folk Magic" In The Light Of Folklore Studies And Bible Scholarship, Eric A. Eliason
Seer Stones, Salamanders, And Early Mormon "Folk Magic" In The Light Of Folklore Studies And Bible Scholarship, Eric A. Eliason
BYU Studies
The 2015 publication of an Ensign article on, and especially photos of, one of Joseph Smith’s seer stones still owned by The Church of Jesus Christ of Latter-day Saints caused quite a sensation in the blogosphere. Many responses focused on the “weirdness” of the stone and its use, the ostensibly alien nature of this odd relic from the past, so out of place in modern religion, and posited it as a troubling problem in need of explanation. Mormon studies as a discipline has struggled to make sense of seer stones too. These responses are understandable, considering how often communities tend …

The Mormon Missionary: Who Is That Knocking At My Door?, Robert L. Lively Jr.
BYU Studies
Robert L. Lively Jr. is dean emeritus at the University of Maine at Farmington and holds a master’s degree from Yale University Divinity School and a doctor of philosophy degree from the University of Oxford. The following are excerpts from his 2015 book The Mormon Missionary: Who Is That Knocking at My Door?, conceived after inviting missionaries to visit his religion classes and realizing that a non-Mormon had never written a book that tells the story of LDS missionaries. His research for this book involved over 275 interviews with past, present, and future missionaries, including individuals who served in every …

Visualizing Apostolic Succession, Meilan Jin, Iliesa S. K. Delai, Geoffrey M. Draper
BYU Studies
For years, The Church of Jesus Christ of Latter-day Saints has published pictures and other illustrative diagrams to communicate its message. For example, the children's book Book of Mormon Stories includes an illustrative map indicating the possible route of Lehi's family from the Arabian peninsula to the Americas. Seminary students receive bookmarks showing a timeline of peoples and events in the Book of Mormon. More recently, the Church has published a series of "information graphics" (known more commonly as infographics) on its website. Infographics in a visually pleasing manner. The Church's infographics cover a range of topics such as …

A Branch Point Of Streptomyces Sulfur Amino Acid Metabolism Controls The Production Of Albomycin, Aditya Kulkarni, Yu Zeng, Wei Zhou, Steven Van Lanen, Weiwen Zhang, Shawn Chen
Pharmaceutical Sciences Faculty Publications
Albomycin (ABM), also known as grisein, is a sulfur-containing metabolite produced by Streptomyces griseus ATCC 700974. Genes predicted to be involved in the biosynthesis of ABM and ABM-like molecules are found in the genomes of other actinomycetes. ABM has potent antibacterial activity, and as a result, many attempts have been made to develop ABM into a drug since the last century. Although the productivity of S. griseus can be increased with random mutagenesis methods, understanding of Streptomyces sulfur amino acid (SAA) metabolism, which supplies a precursor for ABM biosynthesis, could lead to improved and stable production. We previously characterized the …

Purin-6-One Derivatives As Phosphodiesterase-2 Inhibitors, Wei Yuan, Xin-Yun Zhao, Xi Chen, Chang-Guo Zhan
Pharmaceutical Sciences Faculty Publications
A series of purin-6-one derivatives were synthesized, and their in vitro inhibitory activity against phosphodiesterase-2 (PDE2) was evaluated by using a fluorescence polarization assay. Three compounds, that are, 2j, 2p, and 2q, showed significant inhibitory activity against PDE2 with IC50 values of 1.73, 0.18, and 3.43 μM, respectively. Structure-activity relationship (SAR) analysis was performed to explore the relationship between the chemical structures of these compounds and their inhibitory activity. Compounds 2j, 2p, and 2q were further selected for molecular docking study. The docking results suggested that these ligands bind with hydrophobic pockets of …

Predicting long-term trends in forest growth requires accurate characterisation of how the relationship between forest productivity and climatic stress varies across climatic regimes. Using a network of over two million tree-ring observations spanning North America and a space-for-time substitution methodology, we forecast climate impacts on future forest growth. We explored differing scenarios of increased water-use efficiency (WUE) due to CO2-fertilisation, which we simulated as increased effective precipitation. In our forecasts: (1) climate change negatively impacted forest growth rates in the interior west and positively impacted forest growth along the western, southeastern and northeastern coasts; (2) shifting climate sensitivities offset positive …
Investigation Of A Ubiquitous Spore Surface Protein, Justyna Kordzikowska
Investigation Of A Ubiquitous Spore Surface Protein, Justyna Kordzikowska
Master's Theses
All bacterial spores are comprised of concentric shells. All spores are encased in a layer called the coat. Some spores have an additional layer outside of the coat called the exosporium. Presumably, this morphological variation is an adaptation to variation in the environments in which these species can be found. However, spores from species with and without exosporia can often be found in the same niche. We hypothesize, therefore, that spores with and without exosporia share a common surface protein. Bacillus anthracis possess a well characterized surface protein called BclA. A BclA homologue is also present on the surface of …
