Trailblazers And Those That Followed : Personal Experiences, Gender, And Judicial Empathy., Laura P. Moyer, Susan B. Haire

Faculty and Staff Scholarship

This paper investigates one causal mechanism that may explain why female judges on the federal appellate courts are more likely than men to side with plaintiffs in sex discrimination cases. To test whether personal experiences with inequality are related to empathetic responses to the claims of female plaintiffs, we focus on the first wave of female judges, who attended law school during a time of severe gender inequality. We find that female judges are more likely than their male colleagues to support plaintiffs in sex discrimination cases, but that this difference is seen only in judges who graduated law school …

A Survey Of Studies On Judicial Selection, Ryan Fortson, Kristin S. Knudsen

Vols 31-36 (2014-2019)

The Alaska legislature is considering a bill — Senate Joint Resolution 3 — that would put before voters a state constitutional amendment to change the composition of the Alaska Judicial Council and the way its members are selected. The Alaska Judicial Council plays a constitutionally-mandated role in the selection of Alaska’s judges and also makes recommendations to voters concerning retaining or not retaining judges as part of the judicial retention election process. This article reviews selected existing studies relevant to potential effects of this proposed change to the council composition — studies that examined judicial effectiveness, responsiveness of judges to …

Six Principles To Consider When Working With Roman Catholic Clients, Thomas G. Plante Sep 2015

Six Principles To Consider When Working With Roman Catholic Clients, Thomas G. Plante

Psychology

Although the majority of Americans consider themselves to be Christian and affiliated with various Protestant denominations, a quarter of the American population identify themselves as Roman Catholics who are the largest single religious denomination in the country. Yet, surprisingly, fairly little research has been published in the professional psychology literature about working with this very large and diverse group. Psychologists have an ethical responsibility to be aware of and respectful to diversity including diversity based on religious background, affiliation, and perspectives. The purpose of this brief reflection is to offer 6 important principles to keep in mind for professional psychologists …

Ebony And Ivory? Interracial Dating Intentions And Behaviors Of Disadvantaged African American Women In Kentucky, David J. Luke, Carrie B. Oser

Sociology Faculty Publications

Using data from 595 predominantly disadvantaged African American women in Kentucky, this study examines perceptions about racial/ethnic partner availability, cultural mistrust, and racism as correlates of interracial dating intentions and behaviors with both white and Hispanic men. Participants reported levels of dating intentions and behaviors were significantly higher with whites than Hispanics. The multivariate models indicate less cultural mistrust and believing it is easier to find a man of that racial/ethnic category were associated with higher interracial dating intentions. Women were more likely to have dated a white man if they believed it was easier to find a white man …

Perpetration Experience And Gender Predicting Empathy With A Stranger Or Acquaintance Rapist, Ruby L. Orth, Suzanne L. Osman Sep 2015

Perpetration Experience And Gender Predicting Empathy With A Stranger Or Acquaintance Rapist, Ruby L. Orth, Suzanne L. Osman

Modern Psychological Studies

This study examined empathy with a hypothetical rapist based on experimentally varied type of rape (stranger; acquaintance), participant perpetration experience, and gender. Undergraduate students (115 male, 206 female) completed the Rape Perpetrator Empathy-During Subscale and Sexual Experiences Survey. Hypotheses were partially supported. Sexual perpetrators (of acquaintances) reported greater empathy than nonperpetrators, and men reported greater empathy than women. Type of rape was not significant. Findings support past research, but more data from rapists is needed.

Of Truths, Secrets, And Loyalties: Political Belonging And State Building In Poland After State Socialism, Saygun Gokariksel Sep 2015

Of Truths, Secrets, And Loyalties: Political Belonging And State Building In Poland After State Socialism, Saygun Gokariksel

Dissertations, Theses, and Capstone Projects

This dissertation is an ethnographic study of the accusations of 'collaboration' with the communist-era secret service in Poland's capitalist democracy. Situated in the global context of the 1989 'revolutions,' it examines the role of law in redrawing the moral and political boundaries of the new body politic and redefining the loyalties of the new citizen-subject of the neoliberalizing state. Specifically, my research concentrates on the legal process called 'lustration' (lustracja) in Poland, the state-centered purges of real or imagined secret communist agents, informers, and spies. Focusing on the contentious legal-political struggles from 2005 to 2008 and their aftermath, it explores …

Bringing Human Rights Home: The Birmingham Mayor's Office Human Rights Dialogue, Human Rights Institute, Office Of The Mayor Of The City Birmingham

Human Rights Institute

Human rights begin close to home. Local governments have jurisdiction over a range of human rights issues, including those related to housing, education, employment, and criminal justice. Indeed, local agencies and officials are essential to the promotion and protection of human rights in the United States. They work every day to create conditions under which all communities can flourish. Mayors are particularly well-situated to advance human rights and build a culture of human rights based on dignity, freedom from discrimination, and opportunity.

The New Peonage, Tamar R. Birckhead Sep 2015

The New Peonage, Tamar R. Birckhead

Washington and Lee Law Review

Although the Thirteenth Amendment to the Constitution formally abolished slavery and involuntary servitude in 1865, the text created an exception for the punishment of crimes “whereof the party shall have been duly convicted.” Two years later, Congress passed The Anti-Peonage Act in an attempt to prohibit the practice of coerced labor for debt. Yet, in the wake of the Civil War, Southern states innovated ways to impose peonage but avoid violations of the law, including criminal surety statutes that allowed employers to pay the court fines for indigent misdemeanants charged with minor offenses in exchange for a commitment to work. …

“That Justice Shall Be Done”—Constitutional Requirements, Ethical Rules, And The Professional Ideal Of Federal Prosecution, Charles R. Wilson Sep 2015

“That Justice Shall Be Done”—Constitutional Requirements, Ethical Rules, And The Professional Ideal Of Federal Prosecution, Charles R. Wilson

Northern Illinois University Law Review

Seventy-five years ago, then-Attorney General and subsequent Supreme Court Justice Robert H. Jackson delivered a speech entitled The Federal Prosecutor. This Article revisits Jackson's speech to extract a few insights about ethics and professional responsibility, specifically with regard to prosecutorial discretion. Beyond the constitutional and ethical obligations involved in representing the United States in court, federal prosecutors must continually aspire to a professional ideal derived from their duty to seek and serve justice. This Article submits that this professional ideal”as envisioned by Jackson and alluded to by the Supreme Court”is also applicable to every lawyer as he or she exercises …

Predictors Of Placement Satisfaction For Foster Youth, Shereen Mcfarlane Sep 2015

Predictors Of Placement Satisfaction For Foster Youth, Shereen Mcfarlane

Loma Linda University Electronic Theses, Dissertations & Projects

Youth in the foster care system are often removed from their biological families because of challenges to their safety and wellbeing and are often at risk for further placement disruption and poor socio-emotional development. Placement stability is a crucial component to establishing permanency and placement satisfaction might be a contributing factor. This study uses an ecological framework to explore the impact of the foster youth’s ecosystem, such as the foster child, foster parent, child welfare worker, and the placement environment on placement satisfaction. This quantitative study uses secondary data to determine the predictability of these factors on placement satisfaction of …

I am grateful for the opportunity to speak to you today about Senate Bill 838 and the reform of Oklahoma’s civil asset forfeiture. I am a professor of law at the University of Oklahoma, where my teaching and research focus on criminal law and procedure. I have experience achieving consensus solutions in contested areas of law, most notably in the six years I spent drafting a new set of ABA Criminal Justice Standards, and I know that change is rarely easy. No matter the topic and whatever the status quo, there is sure to be someone who feels it is …
