"Fuck Your Breath": Black Men And Youth, State Violence, And Human Rights In The 21st Century, Jeremy I. Levitt
"Fuck Your Breath": Black Men And Youth, State Violence, And Human Rights In The 21st Century, Jeremy I. Levitt
Journal Publications
This polemical essay was written at the behest of Black men and youth, and it is dedicated to African American women who relentlessly fight to safeguard the rights and well-being of Black men, even when in the process their maltreatment and welfare are grossly overlooked and forgotten. Bree Newsome's courageous and necessary removal of the confederate flag in the South Carolina State House is a prime example of such fearless activism. Joanne Deborah Chesimard aka Assata Shakur's-a former leader of the revolutionary organization known as the Black Liberation Armyascendency to the FBI's Most Wanted Terrorist list is another tragically intoxicating …

Should Agencies Enforce?, Max J. Minzner
Should Agencies Enforce?, Max J. Minzner
Faculty Scholarship
This Article explores an important but understudied structural choice: the decision to vest enforcement authority in administrative agencies. Each year, agencies routinely bring enforcement actions producing billions of dollars in civil penalties and industry-reshaping consent decrees. Where do they get this power? Congress grants enforcement authority to administrative agencies because it believes that agency subject matter expertise will generate appropriate enforcement choices. Similarly, the Supreme Court has strongly deferred to agency enforcement because it sees it as intimately intertwined with other agency regulatory decisions. Scholars have also generally taken for granted that specialist agencies will be enforcement experts because they …
Psychology And Effective Lawyering: Insights For Legal Educators, Jean R. Sternlight, Jennifer K. Robbennolt
Psychology And Effective Lawyering: Insights For Legal Educators, Jean R. Sternlight, Jennifer K. Robbennolt
Scholarly Works
Psychology-the science of how people think, feel and behave-has a great deal to teach about a range of core competencies related to working with people and making good decisions. For example, psychologists have conducted extensive research into perception, memory, communication, individual and group decision-making, conflict, goal setting and planning, self-assessment, motivation, "grit," and many other matters that are central to effective lawyering. This research has much to contribute to an understanding of the work of lawyers and can be effectively incorporated into how we teach law students to practice law.
Individual Differences In Interpretations Of Justified And Unjustified Violence, Melissa Marcotte
Individual Differences In Interpretations Of Justified And Unjustified Violence, Melissa Marcotte
Open Access Master's Theses
This study examines the impact and interaction of individual differences in personality, empathic style, ethical position, and trait violence sensitivity on perceptions of violence in a "justified" or "unjustified" video clip. Undergraduate students (n=229) enrolled in an introductory psychology course participated in an online survey where they were randomly assigned to 1 of 6 groups (Video Order x Justification). As found in previous studies, in general, participants rated the justified clip as less violent, even though both videos depicted the same scene. When rating the unjustified violence, individual differences did not seem to impact severity ratings but when participants were …
In The Eye Of The Beholder: Exploring The Dialogic Approach To Police Legitimacy, Justin Nix
In The Eye Of The Beholder: Exploring The Dialogic Approach To Police Legitimacy, Justin Nix
Theses and Dissertations
In recent years, police legitimacy has generated a great deal of scholarly attention. Numerous studies carried out in a variety of settings have demonstrated that citizens are more likely to perceive the police as a legitimate authority when they interact with citizens in a procedurally fair way. In turn, citizens become more likely to accept police decisions, comply with the law, and cooperate with the police. Yet until very recently, scholars have only focused on citizen perceptions of legitimacy while neglecting the perspective of the police themselves. It may very well be that the police believe other ideals are more …
The Role Of Administrative Procedures In Preventing The Backlog Of Sexual Assault Evidence Kits, Heather Darby
The Role Of Administrative Procedures In Preventing The Backlog Of Sexual Assault Evidence Kits, Heather Darby
MPA/MPP/MPFM Capstone Projects
Across the nation, states are facing a large backlog of sexual assault evidence kits. Sexual assault evidence often sits in a police department or hospital for years without being tested. Public safety is diminished as criminal DNA is not tested and entered into CODIS. Victims have no sense of justice, and may lose confidence in the system. Without attention to the issue, the backlog will only continue to grow. As states have developed innovative and effective methods for addressing the backlog, their successes and failures have served as a base for others who are considering changes to avoid future backlogs. …
Building The Case Against Human Trafficking: Developing And Evaluating A Training Module For Law Enforcement Officials, Katie Sanders
Building The Case Against Human Trafficking: Developing And Evaluating A Training Module For Law Enforcement Officials, Katie Sanders
MPA/MPP/MPFM Capstone Projects
Since the passage of federal legislation to address human trafficking in the United States, efforts to measure and combat the crime have continued to grow (Victims of Trafficking and Violence Prevention Act of 2000). Measuring human trafficking has continued to be a difficult task for researchers, law enforcement, and victim services providers. The combined efforts of these groups has lead to the recognition that without more widespread identification of victims and perpetrators of human trafficking—a crime referred to as modern-day slavery—estimates will continue to be inaccurate. In order to improve the identification process, this specific proposal focuses on law enforcement …

Feelings Of Belonging: An Exploratory Analysis Of The Sociopolitical Involvement Of Black, Latina, And Asian/Pacific Islander Sexual Minority Women, Angelique Harris, Juan Battle, Antonio Jay Pastrana Jr., Jessie Daniels
Social and Cultural Sciences Faculty Research and Publications
This article compares and contrasts the sociopolitical involvement of Black, Latina, and Asian/Pacific Islander American sexual minority women within lesbian, gay, bisexual, and transgender (LGBT) communities of color. For the analysis, a sample of over 1,200 women from the Social Justice Sexuality project was analyzed. Findings indicate that, for all groups of women, feelings of connectedness to the LGBT community was the most significant predictor of sociopolitical involvement within LGBT communities of color.

Parts II and III encompass some of the perceived benefits and anticipated challenges of increased body camera use. Part IV considers and recommends exactly where the responsibility of camera implementation should lie.
The Michael Morton Act: Minimizing Prosecutorial Misconduct., Cynthia E. Hujar Orr, Robert G. Rodery
The Michael Morton Act: Minimizing Prosecutorial Misconduct., Cynthia E. Hujar Orr, Robert G. Rodery
St. Mary's Law Journal
Twenty-five years ago, Texas prosecutors significantly limited the pre-trial discovery it disclosed to criminal defendants. As a result of this policy, innocent individuals accused of murder, like Michael Morton, were denied their right to due process. Michael Morton was incarcerated for twenty-five years following a wrongful murder conviction. He was denied access to crucial evidence, which included a bandana with the victim’s blood and the killer’s hair, and eyewitness accounts describing the killer at or near the time of the murder. The prosecutor purposely withheld this evidence from Michael Morton; but thanks to the efforts of the Innocence Project, he …
Administering Section 2 Of The Voting Rights Act After Shelby County, Christopher S. Elmendorf, Douglas M. Spencer
Administering Section 2 Of The Voting Rights Act After Shelby County, Christopher S. Elmendorf, Douglas M. Spencer
Publications
Until the Supreme Court put an end to it in Shelby County v. Holder, section 5 of the Voting Rights Act was widely regarded as an effective, low-cost tool for blocking potentially discriminatory changes to election laws and administrative practices. The provision the Supreme Court left standing, section 2, is generally seen as expensive, cumbersome, and almost wholly ineffective at blocking changes before they take effect. This Article argues that the courts, in partnership with the Department of Justice, could reform section 2 so that it fills much of the gap left by the Supreme Court's evisceration of section …
Revisiting The Mansions And Gatehouses Of Criminal Procedure: Reflections On Yale Kamisar's Famous Essay, William T. Pizzi
Revisiting The Mansions And Gatehouses Of Criminal Procedure: Reflections On Yale Kamisar's Famous Essay, William T. Pizzi
Publications
In 1965, Yale Kamisar published a now-famous essay entitled, Equal Justice in the Gatehouses and Mansions of American Criminal Procedure: From Powell to Gideon, from Escobedo to... to make his case that the Court needed to take action to protect citizens in interrogation rooms, Kamisar used the powerful metaphors of the gatehouse and the mansion to contrast the treatment received in interrogation rooms in the back of police stations with the way defendants were treated when they arrived at courthouses where the power of the state was restricted and they had strong constitutional protections.
On its 50th anniversary since publication, …
Management Of Children Who Come Into Conflict With The Law During Pre-Trial Stage In Malaysia. Do The Current Practice And Procedures Accord To International Standards? / Fon Thiam Seong, Thiam Seong Fon
Student Works (2010-2019)
Malaysia as a State Party to the Convention on the Rights of the Child and other international instruments are bound by the provisions enshrined in those treaties. Despite all this commitments and obligations, children still experience arbitrary arrest, torture and illtreatment while undergoing police investigation. Still too often, they are deprived of proper treatment that should have been given to them under those treaties. Past literature would show that the rights afforded to children in conflict of the law especially during the pre-trial stage are reduced significantly or in other words not given proper consideration by the enforcement authorities in …

Chasing The ‘Hounds Of Hell’: Howard Thurman’S Jesus And The Disinherited As A Curriculum For Racial Justice And Reconciliation, Sandra Richards Mayo
International Christian Community of Teacher Educators Journal
This essay explores the implications of the Trayvon Martin case for educators who must contend with the complexities of race in the context of schooling. With the assumption that race continues to function as an important category in social arrangements, this essay addresses the following questions: What is the role of race and racial stereotyping in educational disparities? How can educators work purposely toward a curriculum of racial justice and reconciliation? Drawing on the work of African American theologian and civil rights leader Howard Thurman, this essay argues that new approaches to social justice education should address both the extrapersonal …

Who Is Best Suited To Combat Sexual Violence On College Campuses?: An Analysis Of H.B. 1785, Susana Bass
Richmond Public Interest Law Review
Virginia House Bill 1785, requiring campus police to notify the Commonwealth’s Attorney of any victim-initiated sexual assault investigations, is a positive step forward in helping to combat sexual assault on Virginia college campuses. Under this legislation, victims of sexual assault are much more likely to receive the protection and justice they deserve.
Part II of this comment outlines current federal law that intends to ad- dress sexual assault on college campus and whether these laws have been effective in preventing sexual assault. Part III details Virginia House Bill 1785 introduced in the 2015 Virginia General Assembly Session to address sexual …

Wrongful Confictions And Due Process Violations, Cheryl Page

This analytical essay looks at the myriad of ways innocent people are wrongfully convicted and how the criminal justice system fails to truly reach a fair and equitable result. The article looks at how at the initial stages of a criminal proceeding, a defendant can be prejudiced to the point of sufficient harm to his chances at being given a fair and impartial judicial proceeding. This article examines how fatal mistakes can be made and reveals that there can be flaws in the science of DNA testing, including fraud, criminologist bias, improper laboratory procedures, and human error. This article seeks …

Professional Women Silenced By Men-Made Norms, Maritza I. Reyes
Journal Publications
The call of this symposium was for articles regarding women's rights and the movement toward equality. We are still wrestling with what equality should mean. In this Article, when I refer to equality I envision it as both a strategy and as the end goal. Equality as a strategy means assessing the inherent inequalities of particular situations and using the means necessary to remedy the inequalities and achieve equality as the end goal. The end goal is for women (with all our complexities and intersectionalities) to achieve the same rights and results as men (with all their complexities and intersectionalities) …
Commercial Drones And Privacy: Can We Trust States With ‘Drone Federalism’?, Robert H. Gruber
Commercial Drones And Privacy: Can We Trust States With ‘Drone Federalism’?, Robert H. Gruber
Richmond Journal of Law & Technology
Judge Andrew Napolitano said recently of unmanned aircraft systems (“UAS”), or “drones,” that “[t]he first American patriot that shoots down one of these drones that comes too close to his children in his backyard will be an American hero.”
