A Role For Kv7 Channels In Alcohol Consumption: Genetics, Pharmacology, And Neuroadaptations, Natalie Maurisa Straight-Mcguier
A Role For Kv7 Channels In Alcohol Consumption: Genetics, Pharmacology, And Neuroadaptations, Natalie Maurisa Straight-Mcguier
MUSC Theses and Dissertations
Alcohol use disorder (AUD) is a major public health issue that produces enormous societal and economic burdens. Current FDA-approved pharmacotherapies for treating AUD suffer from deleterious side effects and are only effective in a subset of individuals, representing a need for improved medications for the management of AUD. The experiments described in this dissertation provide evidence for a complex relationship between Kv7 channels and alcohol-related behaviors that spans genetics, behavioral pharmacology, and biochemical adaptations suggesting these channels are a target for treating AUD. We first examined the genetic relationship between Kcnq genes and alcohol-related behaviors, showing that these channels contribute …

Hidden Racial Bias: Why We Need To Talk With Jurors About Ferguson, Patrick C. Brayer

Issues of race frame our national identity and define our capacity to achieve true equality for all individuals. By its very nature and traditions, the law is a profession tasked with confronting inequality and discrimination in our society. As issues of race continue to influence our communities, nation, and world, the legal profession will be charged with leading future discussions on how prejudice and bias affect our clients. Unfortunately, as legal professionals, we still struggle with the question of whether to talk about race in voir dire. This essay discusses our obligation as judges, academics, and practitioners to understand how …

Federal Rule of Evidence 404 severely limits the government's ability to offer evidence of a defendant's character trait of violence to prove action in conformity with that trait on the occasion in question. The Rule states that such character evidence is generally inadmissible when offered to prove propensity. The Rule also allows the government to offer evidence of an alleged victim's character for peacefulness in homicide cases where the defendant asserts the self-defense privilege. Although criminal defendants may offer character evidence under limited circumstances, Rule 404 creates a significant disincentive for doing so. Where a defendant offers evidence of an …

Excessive Corporate Risk-Taking And The Decline Of Personal Blame, Steven L. Schwarcz
Excessive Corporate Risk-Taking And The Decline Of Personal Blame, Steven L. Schwarcz
Emory Law Journal
Government agencies and prosecutors are being criticized for seeking so few indictments against individuals in the wake of the 2008¿2009 financial crisis and its resulting banking failures. This Article analyzes why¿contrary to a longstanding historical trend¿personal liability may be on the decline, and whether agencies and prosecutors should be doing more. The analysis confronts fundamental policy questions concerning changing corporate and social norms. The public and the media perceive the crisis¿s harm as a ¿wrong¿ caused by excessive risk-taking. But that view can be too simplistic, ignoring the reality that firms must take greater risks to try to innovate and …

Rethinking The Childhood-Adult Divide: Meeting The Mental Health Needs Of Emerging Adults, Barbara L. Atwell
Elisabeth Haub School of Law Faculty Publications
Part I of this article describes ADHD and explores the extent of ADHD medication abuse, especially among young adults. Part II discusses the characteristics of emerging adults, who may be more likely than their older counterparts to make unwise decisions about medications and other life choices.34 While we protect minors by requiring parental consent for their medical treatments, emerging adults are effectively able to obtain any drug on the market if they convince the doctor that they have the requisite diagnosis. Part III explores HIPAA, the medical malpractice standard of care and the challenges associated with a society that is …

In 1996, a coordinated community response (CCR) was formally established in a mid-sized Midwestern city to improve the criminal justice response to intimate partner violence (IPV). Data for this study included all IPV-related incidents to which the local police department responded since the establishment of the CCR for a fourteen year period. Effective CCRs provide for IPV offender accountability through citation and prosecution of IPV-related crimes. Concerns about demographic variables affecting citation and prosecution rates have been identified in the literature. Compared to national statistics, gender differences were consistent but higher citation and conviction rates were identified in this community. …

The Trouble With Truth-Telling: Preliminary Reflections On Truth And Justice In Post-War Liberia, Gabriel Twose Ph.D., Caitlin O. Mahoney Ph.D.
Peace and Conflict Studies
This study investigates perceptions of the Liberian Truth and Reconciliation Commission (TRC), particularly focusing on understandings of, and the links between, truth, justice, and reconciliation. Forty-five semi-structured interviews were conducted at three research sites in Liberia. Findings indicate that although most Liberians agreed with the TRC in principle, most of those who followed its proceedings saw major problems in its implementation, harming perceptions of reconciliation. Participants expressed concerns that the Commission had failed to discover the full truth of wartime abuses, that the truth that was discovered was not told in the right way, and that there had been problems …
Rethinking Immigration’S Mandatory Detention Regime: Politics, Profit, And The Meaning Of “Custody”, Philip L. Torrey
Rethinking Immigration’S Mandatory Detention Regime: Politics, Profit, And The Meaning Of “Custody”, Philip L. Torrey
University of Michigan Journal of Law Reform
Immigration detention in the United States is a crisis that needs immediate attention. U.S. immigration detention facilities hold a staggering number of persons. Widely believed to have the largest immigration detention population in the world, the United States detained approximately 478,000 foreign nationals in Fiscal Year 2012. U.S. Immigration and Customs Enforcement (ICE), the agency responsible for immigration enforcement, boasts that the figure is “an all-time high.” In some ways, these numbers are unsurprising, considering that the United States incarcerates approximately one in every one hundred adults within its borders—a rate five to ten times higher than any other Westernized …

Racial Profiling In The War On Drugs Meets The Immigration Removal Process: The Case Of Moncrieffe V. Holder, Kevin R. Johnson
University of Michigan Journal of Law Reform
In Moncrieffe v. Holder, the Supreme Court held that the Board of Immigration Appeals could not remove a long-term lawful permanent resident from the United States based on a single misdemeanor conviction for possession of a small amount of marijuana. The decision clarified the meaning of an “aggravated felony” for purposes of removal, an important question under the U.S. immigration laws. In the removal proceedings, Adrian Moncrieffe, a black immigrant from Jamaica, did not challenge his arrest and drug conviction. Consequently, the Supreme Court did not review the facts surrounding, or the lawfulness of, the criminal prosecution. Nonetheless, the traffic …

In our previous article, "Holding Credit Reporting Agencies Accountable: How the Financial Crisis May be Contributing to Improving Accuracy in Credit Reporting" we reviewed the legal history of the Fair Credit Reporting Act (FCRA), its amendments, and the federal case law by circuit. We suggested that the ability of consumers to ensure the accuracy and security of their credit reports might lead to an expansion of the litigation surrounding accurate credit reporting. This article takes the discussion further by exploring the ever-expanding use of credit reports in the employment law arena. We review the state legislation limiting the use of …

Dna Without Warrant: Decoding Privacy, Probable Cause And Personhood, Ken Strutin
Richmond Journal of Law and the Public Interest
In Part I, this article explores the challenges to privacy, personhood and probable cause raised by DNA collection as identification sanctioned in Maryland v. King. Part II considers the presumed infallibility of DNA testing that undergirds the Supreme Court's embracement of genetic identification. Lastly, in Part III, this article will try to decipher the Court's Fourth Amendment logic in denying privacy to the information in human cells but embracing them in cell phones in Riley v. California
