Pregnancy, An Opportunity For Empowerment : A Trauma And Attachment Informed Approach To Creating A Corrective Relationship For Mothers With Trauma Histories And Subsequent Substance Abuse, Judith W. Kamara Jan 2015

Pregnancy, An Opportunity For Empowerment : A Trauma And Attachment Informed Approach To Creating A Corrective Relationship For Mothers With Trauma Histories And Subsequent Substance Abuse, Judith W. Kamara

Theses, Dissertations, and Projects

This theoretical thesis examined how the capacity of a healthy pregnancy and birth and positive attachment could be a corrective experience for mothers with histories of trauma and subsequent substance use. Socratic questioning was used to help trauma and attachment-informed clinicians approach mothers in this population as an asset to their infants rather than viewing them as a risk, hopefully challenging the socially prevalent belief that these mothers should be treated punitively rather than receive treatment. The phenomenon also focused on this population of mothers rather than their infants as primary victim, examining individual and systemic factors that contribute to …

Making Sure We Are Getting It Right: Repairing "The Machinery Of Death" By Narrowing Capital Eligibility, Ann E. Reid Jan 2015

Making Sure We Are Getting It Right: Repairing "The Machinery Of Death" By Narrowing Capital Eligibility, Ann E. Reid

Law Student Publications

This comment argues that, starting with the framework of the federal system, there is a way to reconcile modern concerns about the death penalty with society's need for leverage over those criminals who truly are the worst of the worst-those who present grave threats to society even after incarceration. This reconciliation can be achieved by amending the Federal Death Penalty Act to require prosecutors to establish one additional element before they can secure a capital conviction: future dangerousness of the defendant in prison..

A Survey Of The History Of The Death Penalty In The United States, Sheherezade C. Malik, D. Paul Holdsworth Jan 2015

A Survey Of The History Of The Death Penalty In The United States, Sheherezade C. Malik, D. Paul Holdsworth

Law Student Publications

Since the founding of Jamestown Colony in 1607, few topics in American life and culture have generated as much controversy, both in terms of persistence and volatility, as the death penalty. Foreign policy, economic recessions, and social movements come to the forefront of national discussion in their own respective ebbs and flows. Capital punishment, however, has been a staple of the American criminal justice system since the early inhabiting of the continent, and has remained a permanent vehicle through which we can enact retribution on the most heinous criminal offenders in our society, ridding ourselves of the worst among us.

Who Is Best Suited To Combat Sexual Violence On College Campuses?: An Analysis Of H.B. 1785, Susana Bass

Law Student Publications

Virginia House Bill 1785, requiring campus police to notify the Commonwealth's Attorney of any victim-initiated sexual assault investigations, is a positive step forward in helping to combat sexual assault on Virginia college campuses. Under this legislation, victims of sexual assault are much more likely to receive the protection and justice they deserve. Part II of this comment outlines current federal law that intends to address sexual assault on college campus and whether these laws have been effective in preventing sexual assault. Part III details Virginia House Bill 1785 introduced in the 2015 Virginia General Assembly Session to address sexual assault …

Settled Debate Or Second Wave? : Clinical Social Workers' Roles In Treatment With Youth Who Take Adhd Drugs, Rachel B. Reed

Theses, Dissertations, and Projects

The purpose of this exploratory study was to gain a deeper understanding of social workers' roles in treating children who take attention-deficit hyperactivity disorder (ADHD) drugs. The study used semi-structured in-person and telephone interviews with twelve licensed clinical social workers to gather qualitative data about their experiences with children and families of children diagnosed with ADHD and their reflections on their roles in treatment, in particular those regarding medication prescribed to mitigate the child's ADHD symptoms. The findings suggested that social workers experienced difficulty teasing out ADHD from issues known to commonly co-occur as well as from a history of …

An Exploratory Study On Mental Health Service Experience And Its Perceived Impact On Young Adults Transitioning Out Of Foster Care, Sonia Lizette Aldape

Theses, Dissertations, and Projects

This qualitative study explores the self-reported perspectives of thirteen transitional aged (18-24 years old) current and former foster youth on their experiences with mental health services. This study fills a gap in mental health research that lacks substantial literature on the experiences of foster youth transitioning out of care, effectiveness of their mental health services and of foster youth's voices as consumers. This study aims to inform practice for clinicians and social workers referring or providing mental health services to current and or former foster youth. Clinicians and social workers can use their positions to provide and advocate for accessible …

Reflections On Student Affect In Group Projects: Are We Encouraging Our Students To Be In Community With Others?, Kristine F. Hoover

Jesuit Higher Education: A Journal

Colleges and universities may create group-based learning environments that help students develop the interpersonal skills necessary for today’s business world. These skills are deemed necessary by many employers.1 Although many institutions of higher education support students’ learning how to work in groups, Jesuit universities may have a special calling for this task in light of the mission of our institutions and the call to community as men and women for others. The current study analyzed 137 undergraduate and graduate, campus and hybrid students’ responses from various disciplines at a Jesuit university using the Whissell Dictionary of Affect in Language.2 Given …

Reconsidering The Influence Of Islam On Yoruba Cultural Heritage, 1930-1987, Akeem Abiodun Oladiti Jan 2015

Reconsidering The Influence Of Islam On Yoruba Cultural Heritage, 1930-1987, Akeem Abiodun Oladiti

Khazar Journal of Humanities and Social Sciences

Previous studies on the activities of Islam have focused on the contribution of the religion to state building (Last, 1967, p. 4 ), the nineteenth century jihad (Smith, 1961, p. 45) and the phenomenal growth of Islam during the colonial period (Gbadamosi, 1978, p. 77). However, no specific attention has been paid to how Islam affected Yoruba culture negatively with specific focus on the area of religion education and language. This study intends to fill this obvious gap in the historiography of influential cultural invasion of Islam from 1930, when colonial political structures allowed the Muslims to maintain a physical …

Sex Work And The City: Creating Municipal Licensing Regimes For Brothels, Maria K. Powell Jan 2015

Sex Work And The City: Creating Municipal Licensing Regimes For Brothels, Maria K. Powell

LLM Theses

The debate over how to regulate sex work in Canada has long occupied courts, governments, policymakers, sex workers and activists. In the aftermath of the Supreme Court decision in Bedford v Canada and the enactment of the constitutionally suspect Protection of Communities and Exploited Persons Act, this thesis examines municipal law's potential role in regulating brothels. Municipalities already grant licenses to adult service providers, the licensing of brothels is a natural extension of their powers. The current licensing regimes are in need of reform, both for adult services and before any attempts to license brothels. This thesis uses New Zealand …

Privacy Protection For Mobile Health (Mhealth) In Nigeria: A Consideration Of The Eu Regime For Data Protection As A Conceptual Model For Reforming Nigeria's Privacy Legislation, Olufunke Olawumi Salami Jan 2015

Privacy Protection For Mobile Health (Mhealth) In Nigeria: A Consideration Of The Eu Regime For Data Protection As A Conceptual Model For Reforming Nigeria's Privacy Legislation, Olufunke Olawumi Salami

LLM Theses

The use of mobile technologies to provide and deliver healthcare is known as Mobile Health. Nigeria is one of the countries witnessing a profound use of these technologies. While discussions have focused on the potentials of this technologies to address the challenges in the health system, nothing is said about the risks from unauthorized disclosure or misuse of health information provided by users. This becomes worse when Nigeria's laws do not offer adequate protection. As Mobile Health is a novelty to Nigeria, this thesis looks to relevant international standards on privacy protection. It does this by examining the European regime …

Tentative Securities: 26/11, Israel And The Politics Of Mobility, Rhys A. Machold Jan 2015

Tentative Securities: 26/11, Israel And The Politics Of Mobility, Rhys A. Machold

Theses and Dissertations (Comprehensive)

This dissertation examines the global mobility of security knowhow in relation to the management of terrorism in megacities. Specifically, it offers three insights. First, it shows how historical events are performed as sites in need of transnational policy intervention. Second, it enables an understanding of how and why the sourcing of policy ‘models’ actually takes place. Third, it sheds light on how mobile policy schemes travel geographically and are put to work in particular contexts. In doing so, it elaborates on the conditions under which policies move geographically but also addresses the kinds of constraints and contradictions they face.

The …

From Prisons To Asylums, And Back : Mental Health Policy In The Age Of Neoliberalism, Michele Martin Jan 2015

From Prisons To Asylums, And Back : Mental Health Policy In The Age Of Neoliberalism, Michele Martin

Honors Theses

This thesis seeks to explain why rates of severe mental illness in the criminal justice system have risen steadily throughout the past three decades, despite an increasing acknowledgement of the importance of mental health to overall health. Legislative, scientific, and societal advances have aimed at increasing access to and bolstering the quality of mental health care. Yet, the large numbers of severely mentally ill persons residing in the criminal justice system imply care in the community is not adequately serving their needs, or that, for whatever reason, they are not seeking care. I begin my analysis by considering mental health …

This research is a longitudinal study of Jungian personality traits and academic success of students enrolled in Computer Information Systems (CIS) courses. The Myers-Briggs Type Indicator (MBTI) measurement scale was self-analyzed by students in CIS courses from fall 2001 through spring 2013. The results of this study indicate that both Extroverts and Judgers have increased as percentage of enrollment between 2001-2003 and 2012-2013. There was no change in academic success, as measured by grades achieved, by personality type from 2001-2003 and 2012-2013.

Comparative Jury Procedures, Kenneth S. Klein Jan 2015

Comparative Jury Procedures, Kenneth S. Klein

Faculty Scholarship

The literature considering various possible procedural reforms to United States jury trial practice suffers from a high dose of American Exceptionalism. The experience of other nations rarely is acknowledged, much less considered as possibly informative. This Article argues that as a British-derived system of roughly identical vintage as the United States, the jury practices of Malta can inform American practice in three respects: (1) the desirability of increased juror interaction – in particular allowing oral juror questions to witnesses and allowing deliberation during the trial, (2) the utility of eliminating voir dire in jury selection, and (3) the possibility of …

Shifting Our Focus From Retribution To Social Justice: An Alternative Vision For The Treatment Of Pregnant Women Who Harm Their Fetuses, April L. Cherry Jan 2015

Shifting Our Focus From Retribution To Social Justice: An Alternative Vision For The Treatment Of Pregnant Women Who Harm Their Fetuses, April L. Cherry

Journal of Law and Health

The ways in which society responds to pregnant women whose behavior purportedly harms their fetuses can be explored from a variety of legal vantage points. This article argues that the criminal law model currently used is ineffective. The assignment of criminal liability to pregnant women is often rooted in fetal personhood and maternal deviance discourse. Criminal law solutions fail because they fail to take into account the fact that maternal behavior is often the result of a myriad of the social and economic conditions over which pregnant women have little or no control. The criminal law model, therefore, simply punishes …

Ultracrepidarianism In Forensic Science: The Hair Evidence Debacle, David H. Kaye Jan 2015

Ultracrepidarianism In Forensic Science: The Hair Evidence Debacle, David H. Kaye

Faculty Scholarship

For over 130 years, scientific sleuths have been inspecting hairs under microscopes. Late in 2012, the FBI, the Innocence Project, and the National Association of Criminal Defense Lawyers joined forces to review thousands of microscopic hair comparisons performed by FBI examiners over several of those decades. The results have been astounding. Based on the first few hundred cases in which hairs were said to match, it appears that examiners “exceeded the limits of science” in over 90% of their reports or testimony. The disclosure of this statistic has led to charges that the FBI “faked an entire field of forensic …

Out Of Breath And Down To The Wire, Nancy C. Marcus Jan 2015

Out Of Breath And Down To The Wire, Nancy C. Marcus

Faculty Scholarship

This article chronicles a series of breathtakingly disturbing police killings of unarmed black men (and a child) in a single year’s time, spanning from between July 2014 to July 2015, which have resulted in national outcry and sparked a movement toward police reform across the country. The article details a number of the suggested remedial measures offered to address the problem of excessive lethal police force across the country and concludes that, among the proposed reforms, one of the most important is a renewed emphasis of critical constitutional limitations upon permissible lethal police force and other unjustified treatment of individuals …
