A Primer On Higher Education In The 21st Century: The University As A Whole And Contributions Made By Law Schools, Ronald Griffin
A Primer On Higher Education In The 21st Century: The University As A Whole And Contributions Made By Law Schools, Ronald Griffin
Journal Publications
Citizens live within their unit's belief systems and superstitions. Truth is derived from family narratives, stories spun by old friends, outbursts from neighbours, barbers, religious figures, and priests. Certainty and comfort come from living in these spaces. But there is a wider world out there with characters doing things that conflict with routine. Higher education illuminates this realm. Legal education predicts what authorities will do about their antics and, while this is a laudable undertaking in the abstract, legal education should do more. It should arm the next generation with tools to cope with cultural ruptures, social confusion, dislocations, avatars, …

School Segregation In Jefferson County And Seattle: The Impact Of The Parents Involved Ruling And District Actions, William J. Glenn
School Segregation In Jefferson County And Seattle: The Impact Of The Parents Involved Ruling And District Actions, William J. Glenn
Cleveland State Law Review
This paper focuses on the two districts directly involved in the Parents Involved in Community Schools v. Seattle School District No. 1 (PICS) (2007) case with regard to how their desegregation plans and levels of segregation changed over time. The study emphasizes how segregation levels changed in response to changes in the plans and, in particular, to the Supreme Court ruling in PICS. The results differed greatly between the two districts. The voluntary desegregation plan in Jefferson County, Kentucky, proved far more effective than its Seattle counterpart in terms of maintaining a relatively low level of segregation prior to the …

Rejustifying Retributive Punishment On Utilitarian Grounds In Light Of Neuroscientific Discoveries More Than Philosophical Calisthenics! , Robert B. Mccaleb
Cleveland State Law Review
Each of these unique features [of the Rotten Social Background (RSB) defense] is skeptically received by the classical criminal law mainly because of its fundamentally non-scientific, folk-psychological position on free will. However, discoveries in contemporary neuroscience strongly support each of these features. While chemical, causal, and deterministic brain events indisputably play a central role, RSB is virtually ignored as a frightening intrusion by materialism into the dualist sanctuary of the law. Yet RSB, as an indicator species for the health of the criminal law’s philosophic ecosystem, cannot be discounted out of hand any longer. In fact, the reconciliation of law …
Why Two In One Flesh? The Western Case For Monogamy Over Polygamy, John Witte Jr.
Why Two In One Flesh? The Western Case For Monogamy Over Polygamy, John Witte Jr.
Emory Law Journal
Questions about polygamy are likely to dominate Western family law in the next generation. Two generations ago, contraception, abortion, and women¿s rights were the hot topics. This past generation, children¿s rights and same-sex rights have dominated public deliberation and litigation. On the frontier of Western family law are hard questions about extending the forms of valid marriage to include polygamy and extending the forums of marital governance to include religious and cultural legal systems that countenance polygamy. This Article analyzes the 1,850 year tradition of Western laws against polygamy and the growing constitutional and cultural pressures to reform these laws …

Scrutinizing Polygamy: Utah¿S Brown V. Buhman And British Columbia¿S Reference Re: Section 293, Maura I. Strassberg
Emory Law Journal
In Brown v. Buhman, the recent challenge to the Utah law criminalizing polygamy brought by the stars of the reality television show Sister Wives, a federal district court determined both that strict scrutiny was required and that strict scrutiny could not be satisfied. A significant factor in this result was the state¿s failure to mount a strong defense of the law, assuming that it could rely on long standing polygamy precedents such as the United States Supreme Court decision in Reynolds v. United States and more recent Tenth Circuit and Utah Supreme Court decisions to justify limiting scrutiny to rational …

The Most Comprehensive Judicial Record Ever Produced: The Polygamy Reference, Bj Wray, Keith Reimer, Craig Cameron
Emory Law Journal
In the fall of 2010 and the spring of 2011, the Chief Justice of the Supreme Court of British Columbia presided over an unprecedented proceeding in Canadian legal history¿a ¿reference¿ hearing conducted at the trial court level into the constitutionality of Canada¿s criminal prohibition of polygamy. The authors are legal counsel at the Department of Justice and were part of the legal team that successfully defended the constitutionality of the prohibition on behalf of the Attorney General of Canada. This Essay discusses various aspects of the litigation, including the uniqueness of the proceeding, the voluminous evidentiary record it generated, the …
The Loadstone Rock: The Role Of Harm In The Criminalization Of Plural Unions, Jonathan Turley
The Loadstone Rock: The Role Of Harm In The Criminalization Of Plural Unions, Jonathan Turley
Emory Law Journal
In this Article, Professor Turley explores the concept of social harm in the context of two recent cases in the United States and Canada over the criminalization of polygamy. The cases not only resulted in sharply divergent conclusions in striking down and upholding such laws respectively, but they offered strikingly different views of the concept of harm in the regulation of private consensual relations. Professor Turley draws comparisons with the debate over morality laws between figures like Lord Patrick Devlin and H.L.A. Hart in the last century. Professor Turley argues that the legal moralism of figures like Devlin have returned …
The Evolution Of Plural Parentage: Applying Vulnerability Theory To Polygamy And Same-Sex Marriage, Stu Marvel
The Evolution Of Plural Parentage: Applying Vulnerability Theory To Polygamy And Same-Sex Marriage, Stu Marvel
Emory Law Journal
Much of the legal debate surrounding the challenge to ¿traditional¿ heterosexual marriage has involved questions of liberty, discrimination, and equal treatment. Similar moves have now been made by advocates for polygamous marriage, indicating that polygamous families may be on track to follow in the rainbow contrails of same-sex marriage. This Article argues that such an evolution is indeed likely, but for different reasons than commonly held. Instead, it applies the emerging paradigm of vulnerability theory to a recent suite of polygamy and same-sex marriage rulings, with particular focus on the figure of the ¿vulnerable¿ child. At the same time, this …
On The Distinction Between Speech And Action, Frederick Schauer
On The Distinction Between Speech And Action, Frederick Schauer
Emory Law Journal
Does the First Amendment rest on a mistake? More specifically, is the First Amendment¿s necessary distinction between speech and action fundamentally unsustainable? The basic idea of this Article is that it is hardly clear that respect for an agent¿s autonomy ought to lead other agents, or the state, to tolerate autonomous communicative actions that are determined to be likely to cause harm to third parties any more than they should tolerate autonomous non-communicative actions whose consequences are equivalent. If the principle of freedom to engage in autonomous actions is one that is limited to cases of harm to others, then, …
Losing Hope: Mental Health And Religious Service Non-Attendance In Australia, Edward Kyle Waters, Helena Mary Millard, Zelda Doyle
Losing Hope: Mental Health And Religious Service Non-Attendance In Australia, Edward Kyle Waters, Helena Mary Millard, Zelda Doyle
Health Sciences Papers and Journal Articles
Religious beliefs and practices are related to mental health. Many individuals report a religious affiliation, but do not have specific religious beliefs or practices such as attending religious services. These non-attendees are often assumed to resemble the non-religious, but are poorly studied. This study explored the demographic characteristics and mental health outcomes associated with being a non-attendee using data from a nationally representative Australian sample. Non-attendees were more likely to be non-Christian than attendees at religious services. They had worse mental health than both non-religious individuals and attendees, especially compared to the non-religious. Whether non-attendance is a result of or …

Gender Considerations Along The Hiv Treatment Cascade: An Evidence Review With Priority Actions, Melanie Croce-Galis, Jill Gay, Karen Hardee, What Works Association, Population Council
Reproductive Health
This treatment brief provides policymakers and program implementers with evidence about the impact of gender dynamics on treatment access and adherence and the gender-related gaps in treatment research and programming. It also includes priority actions that can be taken to better address gender within treatment programming and raises questions for implementation science in order to achieve the global 90-90-90 goal. This brief draws from What Works for Women and Girls: Evidence for HIV Interventions and uses the WHO treatment cascade framework to identify and analyze major gender considerations in providing antiretroviral therapy to those living with HIV in low- and …
Proposed Indicators To Measure Adherence To And Effects Of Rights-Based Family Planning: Resource Guide, Kelsey Wright, Karen Hardee
Proposed Indicators To Measure Adherence To And Effects Of Rights-Based Family Planning: Resource Guide, Kelsey Wright, Karen Hardee
Reproductive Health
At the London Summit on Family Planning in 2012, the goal of expanding access to FP programs by 120 million additional women and girls by 2020 was established. This goal calls attention to the need for FP information and services to be delivered in ways that are voluntary and respect human rights. While human rights have been codified and affirmed in declarations, conventions, and treaties, operationalizing rights in FP programs is still in an early stage of development. With the recent emergence of global numeric benchmarks for FP programs, there is the risk that the focus will move away from …

Work, Study, Organize!: Why The Northwestern University Football Players Are Employees Under The National Labor Relations Act, César F. Rosado Marzán, Alex Tillett-Saks
Hofstra Labor & Employment Law Journal
This article analyzes the first case of college athlete unionization under the National Labor Relations Act ("NLRA") that has reached the National Labor Relations Board – that of the Northwestern University football players. We reanalyze the case and concur with Region 13 of the NLRB, which determined that these college athletes are employees under the NLRA. However, we also go beyond Region 13's decision and argue that the walk-on players, or those football players who do not receive scholarships, may also be employees under the NLRA.
The grant-in-aid football players of Northwestern University meet the three rules normally used to …

Education Sector Response To Early And Unintended Pregnancy: A Policy Dialogue In Homa Bay County, Kenya, Chi-Chi Undie, Ian Mackenzie, Harriet Birungi, Stephen Barongo, Diosiana Ahindukha, Caleb Omondi
Reproductive Health
In collaboration with the Strengthening Evidence for Programming on Unintended Pregnancy (STEP UP) Research Programme Consortium, the Population Council implemented a project to increase the demand for secondary school education in Homa Bay County, Kenya—an area characterized by high, unintended teenage pregnancy and female school drop-out rates. To foster awareness of the school re-entry policy, the Population Council collaborated with the Homa Bay County Department of Education (Ministry of Education) to convene a policy dialogue for all principals of public, day, girls-only, and co-educational secondary schools in the area. The policy dialogue helped to create visibility around the issue of …

A War At The Heart Of Man: The Structure And Construction Of Ships Bound For Africa, Jessica A. Glickman
A War At The Heart Of Man: The Structure And Construction Of Ships Bound For Africa, Jessica A. Glickman
Open Access Master's Theses
Since the abolition of the international slave trade in 1807, and even before, scholars and activists have focused on the conditions Africans experienced during the Middle Passage. Surprisingly, little attention has been paid to the ships that carried the captives. This study will examine the historical and archaeological evidence of the vessels involved in the slave trade. It will address their form and function; and why and how they were built? It will also address the question of design-dedicated slave ships and the issue of whether or not some slave ships were built specially for the trade. This study will …

Dressing History: Costume As Communication In Massachussetts Historical Tours, Meredith Wilcox-Levine
Open Access Master's Theses
This study sought to determine the dual role of costume in performance beyond that of visual entertainment, both as a creator of "historical" space and as a conduit for the transfer of meaning as observed on costumed guides in the spectacle of guided tours in Boston and Cambridge, Massachusetts. A series of site visits, tour shadowing, questionnaires and interviews with tour guides and tourists was used to gain an understanding of the way in which costumes assist live performance in creating an educational, historical atmosphere. Conclusions concerning the success of costume as a non-verbal communication tool, a promoter of visibility …
Modeling Participation In Citizen Science: Recreational Fishermen In Massachusetts, Lena Weiss
Modeling Participation In Citizen Science: Recreational Fishermen In Massachusetts, Lena Weiss
Open Access Master's Theses
This project investigates the factors that influence a recreational fisherman’s choice to participate in citizen fish tagging programs by identifying factors that influence participation in these programs and by exploring three alternative causal models for explaining participation in fish tagging projects: a values-beliefs-norms (VBN) model, a values-attitudes-behavior (VAB) model, and a full theoretical model including socio-demographic and explanatory variables. One hundred recreational fishermen in Plum Island, Massachusetts were given a written survey designed to investigate their experiences with tagging programs, along with their attitudes, perceptions, and beliefs regarding such programs. Responses to the survey were compared between participants and non-participants. …

The Trouble With Truth-Telling: Preliminary Reflections On Truth And Justice In Post-War Liberia, Gabriel Twose Ph.D., Caitlin O. Mahoney Ph.D.
Peace and Conflict Studies
This study investigates perceptions of the Liberian Truth and Reconciliation Commission (TRC), particularly focusing on understandings of, and the links between, truth, justice, and reconciliation. Forty-five semi-structured interviews were conducted at three research sites in Liberia. Findings indicate that although most Liberians agreed with the TRC in principle, most of those who followed its proceedings saw major problems in its implementation, harming perceptions of reconciliation. Participants expressed concerns that the Commission had failed to discover the full truth of wartime abuses, that the truth that was discovered was not told in the right way, and that there had been problems …
