Shifting Our Focus From Retribution To Social Justice: An Alternative Vision For The Treatment Of Pregnant Women Who Harm Their Fetuses, April L. Cherry Jan 2015

Shifting Our Focus From Retribution To Social Justice: An Alternative Vision For The Treatment Of Pregnant Women Who Harm Their Fetuses, April L. Cherry

Journal of Law and Health

The ways in which society responds to pregnant women whose behavior purportedly harms their fetuses can be explored from a variety of legal vantage points. This article argues that the criminal law model currently used is ineffective. The assignment of criminal liability to pregnant women is often rooted in fetal personhood and maternal deviance discourse. Criminal law solutions fail because they fail to take into account the fact that maternal behavior is often the result of a myriad of the social and economic conditions over which pregnant women have little or no control. The criminal law model, therefore, simply punishes …

Taking Up Space: Community Formation Among Non-Urban Lgbtq Youth, Madison Bishop Jan 2015

Taking Up Space: Community Formation Among Non-Urban Lgbtq Youth, Madison Bishop

Honors Papers

This paper provides an overview of the resources that exist for LGBTQ youth in the Cleveland area and uses the Queers and Allies Club at Oberlin High School (Oberlin, OH) as a case study in community formation among teenagers who identify as LGBTQ or as an ally to the LGBTQ community. Each chapter addresses potential sources of support, including schools, national organizations, and the Internet while presenting opportunities for improvement in each realm, demonstrating that while some LGBTQ youth resources exist, they are designed for youth in urban areas, leaving students in non-urban communities without access to community or information.

The Chicago Women's Liberation Union: White Socialist Feminism And Women's Health Organizing In The 1970s, Lara Griffin Jan 2015

The Chicago Women's Liberation Union: White Socialist Feminism And Women's Health Organizing In The 1970s, Lara Griffin

Honors Papers

This thesis examines the organizing projects of the Chicago Women's Liberation Union from 1969-1977. This thesis will examine the relationship between the development of socialist feminism in the central organization and in the activist health projects. While the central organization cultivated the theoretical definition of socialist feminism, the health programs put this vision into practice, and often discovered tensions between the needs of women and the theory of the organization. These tensions centrally revolved around the white middle class identities of the members of the CWLU and their broader goal of being an organization to empower all women. Ultimately, this …

Doing Interview-Based Qualitative Research: A Learner's Guide, E. Magnusson, Jeanne Marecek Jan 2015

Doing Interview-Based Qualitative Research: A Learner's Guide, E. Magnusson, Jeanne Marecek

Psychology Faculty Works

For many students, the experience of learning about and using qualitative methods can be bewildering. This book is an accessible step-by-step guide to conducting interview-based qualitative research projects. The authors discuss the 'hows' and 'whys' of qualitative research, showing readers the practices as well as the principles behind them. The book first describes how to formulate research questions suited to qualitative inquiry. It then discusses in detail how to select and invite research participants into a study and how to design and carry out good interviews. It next presents several ways to analyze interviews and provides readers with many worked …

The Relationship Between A Theological Understanding Of Marital Commitment And A Juridical Articulation Of Marital Consent In Sacramental Marriages In The United States, Angela Robb Jan 2015

The Relationship Between A Theological Understanding Of Marital Commitment And A Juridical Articulation Of Marital Consent In Sacramental Marriages In The United States, Angela Robb

Electronic Theses and Dissertations

Sacramental marriage is an essential social, public, ecclesial, and theological good, yet its influence in the United States is threatened by a divorce rate comparable to the U.S. population in general, an explosive increase in cohabitation, and a declining marriage rate. The underlying assumption of this dissertation is that commitment and consent, more thoroughly understood and consistently lived, are essential to lifelong, faithful, and life-giving marriage that symbolizes and makes present Christ's indissoluble love for the church. Through an adapted use of Don Browning's fundamental practical theological method, this study begins with practical concerns regarding concrete marital and family practices …

An Interactional Analysis Of Adult Cognitive Assessment, William Hasek Jan 2015

An Interactional Analysis Of Adult Cognitive Assessment, William Hasek

Electronic Theses and Dissertations

Psychological tests often include a standardized protocol, which gives specific instructions to clinicians on how the tests are to be administered. This protocol is intended to minimize variation across test administrations, allowing the test to yield reliable and valid measurements. Clinicians are advised to adhere to the test protocol as closely as possible, though departures from protocol are often necessary, as many assessments require clinicians to clarify instructions, modulate client anxiety, and intervene to maintain the client's motivation. Protocols provide little guidance on how clinicians are to make these departures. The clinical literature on assessment contains some advice on when …

Differences Between Men In Factors Predicting Negative Attitudes Toward Effeminacy, Maggie Arin Korn Jan 2015

Differences Between Men In Factors Predicting Negative Attitudes Toward Effeminacy, Maggie Arin Korn

Open Access Master's Theses

“Dude, you’re so gay.” “Man up.” “Stop crying like a girl.” Sayings like these reflect an immense pressure on men in American society to conform to a rigid set of masculine ideals (Kimmel & Mahler, 2003; Pascoe, 2007; Porter, 2010). Adherence to these strict masculine guidelines enables men to avoid being perceived as the worst possible thing a man can be perceived as…feminine (Brannon, 1976; Porter, 2010). The present study sought to better understand the specific characteristics of men that predict negative attitudes toward male effeminacy. One hundred and twenty-eight self-identified male participants were measured on their endorsement of traditional …

Individual Differences In Interpretations Of Justified And Unjustified Violence, Melissa Marcotte Jan 2015

Individual Differences In Interpretations Of Justified And Unjustified Violence, Melissa Marcotte

Open Access Master's Theses

This study examines the impact and interaction of individual differences in personality, empathic style, ethical position, and trait violence sensitivity on perceptions of violence in a "justified" or "unjustified" video clip. Undergraduate students (n=229) enrolled in an introductory psychology course participated in an online survey where they were randomly assigned to 1 of 6 groups (Video Order x Justification). As found in previous studies, in general, participants rated the justified clip as less violent, even though both videos depicted the same scene. When rating the unjustified violence, individual differences did not seem to impact severity ratings but when participants were …

Capturing The Transplant: U.S. Antitrust Law In The European Union, Silvia Beltrametti Jan 2015

Capturing The Transplant: U.S. Antitrust Law In The European Union, Silvia Beltrametti

Vanderbilt Journal of Transnational Law

The scholarly literature on the movement of legal norms focuses almost exclusively on transfers from one jurisdiction to another. It largely ignores transfers into new regulatory regimes. Drawing on a case study of the transplantation of U.S. antitrust law into the nascent entity that was to become the European Community, and analyzing its evolution from a public choice perspective, this Article suggests that transfers into new regulatory regimes are more likely to be effective when the lack of established institutions creates opportunities for stakeholders. The endorsement of a new law will enable stakeholders to influence its application and to capture …

Climate, Environmental And Socio-Economic Change: Weighing Up The Balance In Vector-Borne Disease Transmission, Paul E. Parham, Joanna Waldock, George K. Christophides, Deborah Hemming, Folashade Agusto, Katherine J. Evans, Nina Fefferman, Holly Gaff, Abba Gumel, Shannon Ladeau

Biological Sciences Faculty Publications

Arguably one of the most important effects of climate change is the potential impact on human health. While this is likely to take many forms, the implications for future transmission of vector-borne diseases (VBDs), given their ongoing contribution to global disease burden, are both extremely important and highly uncertain. In part, this is owing not only to data limitations and methodological challenges when integrating climate-driven VBD models and climate change projections, but also, perhaps most crucially, to the multitude of epidemiological, ecological and socio-economic factors that drive VBD transmission, and this complexity has generated considerable debate over the past 10-15 …

Sola Gratia: Grace In The Engineering Curriculum And Profession, Ethan Brue Jan 2015

Sola Gratia: Grace In The Engineering Curriculum And Profession, Ethan Brue

Faculty Work Comprehensive List

Integral Christian higher education is in vogue. Most Christian institutions of higher education who take their mission seriously make the claim that the education offered to students is one where faith and learning are not separate. It is a belief that their entire educational enterprise is inexorably tied in some way, shape, or form to our new life in Christ. Most engineering programs on Christian campuses are the outgrowth of this perspective. Over the last fifty years, numerous philosophers, writers, scientists, and engineers have developed a solid foundation from which engineering can be understood as an essential calling in the …

Grassroots Planning: An Actor-Network Study Of Surfing Waves In Missoula, Montana, Alexander S. Pichacz Jr. Jan 2015

Grassroots Planning: An Actor-Network Study Of Surfing Waves In Missoula, Montana, Alexander S. Pichacz Jr.

Graduate Student Theses, Dissertations, & Professional Papers

Brennan’s Wave, in downtown Missoula, has become an iconic feature of the town. Through the diligent work of a group of community advocates a dangerous and unsightly irrigation diversion structure was repurposed to include a recreation feature in the middle of the river that improved safety while simultaneously maintaining the integrity of the structure. The success of Brennan’s Wave has led to its replication through the planning of another memorial wave, the Max Wave, to be built downstream at the site of a similar irrigation structure. This study investigates how these structures are planned for and built by utilizing an …

“I Need A Hand-Up, Not A Hand-Out:” Spoiled Identities And Identity Maintenance Among Single Mothers Experiencing Homelessness, Laura Obernesser Jan 2015

“I Need A Hand-Up, Not A Hand-Out:” Spoiled Identities And Identity Maintenance Among Single Mothers Experiencing Homelessness, Laura Obernesser

Graduate Student Theses, Dissertations, & Professional Papers

This research project explores the processes of impression management and identity maintenance through participant observation, informal interviews, and existing documents for an organization that provides services to mothers who are homeless in the Rocky Mountain West. The observations take place in a non-profit organization dedicated to advocating for women in the community and region at three different locations. This project focuses on the complex ways in which mothers who experience severe poverty manage and negotiate their identities when confronted with the often unattainable and contradictory expectations of the cultural ideal of motherhood. These women engage in identity maintenance and emotion …

Capturing The Benefits Of Restoration: Local Business Utilization And Opportunities For Growth In Northwestern Montana, Chelsea P. Mciver Jan 2015

Capturing The Benefits Of Restoration: Local Business Utilization And Opportunities For Growth In Northwestern Montana, Chelsea P. Mciver

Graduate Student Theses, Dissertations, & Professional Papers

Restoration and maintenance of forests and watersheds is increasingly a focus of management on public lands and, in addition to traditional forest management activities, has the potential to contribute to the economic vitality of local, forest-dependent communities. However, research has shown that the extent to which local communities benefit from restoration and management activities is highly variable. This study seeks to understand whether local communities in northwestern Montana are capturing the benefits of these activities on public lands by analyzing federal contracting trends. Specifically, this study 1) characterizes the value and type of federal contracts along with the spatial distribution …

The Social Determinants Of Success: The Effect Of Status, Framing, And Group Membership On Test Scores, Jennifer L. Mcleer Jan 2015

The Social Determinants Of Success: The Effect Of Status, Framing, And Group Membership On Test Scores, Jennifer L. Mcleer

Theses and Dissertations

Previous findings have shown that intelligence test scores of members of disadvantaged groups are negatively affected by their relative status in test situations. We explain this by assuming that lower-status actors forego benefits that normally follow from successful performance of a task if they anticipate that there are also costs associated with success. We use an integration of Status Characteristics Theory, Rational Choice Theory, Prospect Theory, and Self-Categorization Theory to argue that compared to high status individuals, those of lower status should be particularly affected by costs associated with high performance. We ran an experiment that manipulated factors such as …

Cultivating Opportunity: Land Transfer Tools To Support Land Access For Beginning Farmers, Samuel E. Plotkin Jan 2015

Cultivating Opportunity: Land Transfer Tools To Support Land Access For Beginning Farmers, Samuel E. Plotkin

Graduate Student Theses, Dissertations, & Professional Papers

This is an exciting, but precarious, time for the generational transfer of agricultural land in the US as established farmers are aging and transitioning out of farm ownership. Beginning farmers, however, the next generation of agrarians, face numerous obstacles to land access – finding and purchasing property. Two of the greatest barriers include the high price farm property commands today and the steady loss of agricultural land. Conservation easements are vital tools in the effort to protect agricultural land, and land transfer tools that enhance conservation easements stand to be crucial instruments for supporting beginning farmers’ access to land. There …

The Impact Of Detention On Juvenile Recidivism In Montana: Is The Impact Of Detention Influenced By Other Factors?, Daniel N. Acton Jan 2015

The Impact Of Detention On Juvenile Recidivism In Montana: Is The Impact Of Detention Influenced By Other Factors?, Daniel N. Acton

Graduate Student Theses, Dissertations, & Professional Papers

The purpose of this study is to identify the effect detention has on recidivism risk as well as to identify the degree to which the effect of detention on recidivism is influenced by other variables. The data for this analysis were collected by probation officers across Montana, using the Back on Track risk assessment instrument (N=840). Although detention was the topic of interest, this analysis also tested aspects of three popular criminological theories: social bond theory, self-control theory, and life-course persistent theory. Using logistic regression, the effects of detention and a variety of other risk factors are identified. Hypothesis one …

Raising Grain In Next Year Country: Dryland Farming, Drought, And Adaptation In The Golden Triangle, Montana, Caroline M. Stephens Jan 2015

Raising Grain In Next Year Country: Dryland Farming, Drought, And Adaptation In The Golden Triangle, Montana, Caroline M. Stephens

Graduate Student Theses, Dissertations, & Professional Papers

Climate change has already and will likely continue to impact agriculture in the Western United States, threatening water supplies for both irrigated and rainfed agriculture (Calzadilla et al. 2010; Chambers and Pellant 2008; MacDonald et al. 2010; Pedersen et al. 2009). In the Golden Triangle, a region in north central Montana, known for its dryland grain production, the same is true. There is a need for in-depth, fine-grained, place-based, and qualitative research about the process of climate change adaptation in agriculture (Miller et al. 2013). Drought challenges farmers in the Triangle, which is semiarid and receives 10-15 inches of annual …

A Study Of Determinants Of The Birthrate Change In South Korea, Kyunghoon Ahn Jan 2015

A Study Of Determinants Of The Birthrate Change In South Korea, Kyunghoon Ahn

MPA/MPP/MPFM Capstone Projects

South Korea has experienced a sharp demographic transition from a high birthrate of 4.5 children per woman in the 1970s to a low birthrate of around 1.19 in 2013. A low birthrate can lead to big problems for South Korean society.

In response to such a low birthrate, the South Korean government introduced policies to increase the birthrate, such as providing subsidies for daycare costs and the supply of daycare facilities. The South Korean government has spent heavily on these programs. However, the birthrate stays very low. Also, other social and economic factors could affect the birthrate.

Therefore, I studied …

Hands Percussion : Moving Towards A Malaysian Identity / Jotsna Nithyanandan, Jotsna Nithyanandan

Student Works (2010-2019)

This study examined the idea behind the compositions of Malaysian Chinese Shigu drumming performing group Hands Percussion (HANDS) that have incorporated Gamelan, and the Indian Tabla drumming patterns as part of their repertoire. HANDS began with the 24 Seasons Drums, when it was founded in 1997, as a Malaysian Chinese percussion ensemble. This dissertation elucidates how HANDS later forms a multi-ethnic identity in its production that moved away from a single ethnic Chinese performing art group. This study touches on issues of culture and intercultural exchanges on the premise that HANDS is based in Malaysia, a country that is pluralistic …
