Human Trafficking: Statute Comparisons And Attitudes In Nebraska, Katie Sheets
Human Trafficking: Statute Comparisons And Attitudes In Nebraska, Katie Sheets
Annual Interdisciplinary Conference on Human Trafficking: 7th (2015)
Human trafficking has become an issue for global concern. Here in the United States, the Federal government and all fifty states are taking steps to combat the pervasive problem. This study looks at the anti-human trafficking statutes of all fifty states and compares them with each other to see how each state stacks up against the other. Nebraska was the focus of the study as the unicameral has recently been enacting changes to the state’s laws against human trafficking. Nebraska was expected to at least be with the majority of states with their human trafficking provisions. The study then looked …

Road To Recovery: Recidivism And The Mclean County Drug Court, Julia Neaves
Road To Recovery: Recidivism And The Mclean County Drug Court, Julia Neaves
Student Research – Stevenson Center
This study explores the effectiveness of the McLean County Drug Court at reducing time to recidivism using survival analysis techniques. Data on 146 drug court participants was collected using the county’s proprietary case management systems. Findings suggest that length of drug court programming significantly reduces time to recidivism. Unfortunately, black offenders and offenders with prior criminal history were found to return to the prison system more rapidly than other groups, suggesting that drug court programming may not be addressing the greater systemic issues present in the criminal justice system. These findings collectively inform policy recommendations provided to county administrators and …
The Admissibility Of Hearsay Evidence In New York State Sex Offender Civil Commitment Hearings After State V. Floyd Y.: Finding A Balance Between Promoting The General Welfare Of Sexual Assault Victims And Providing Due Process Of Law, Brittany K. Dryer
Fordham Law Review
In twenty states throughout the country, the government may petition for the civil commitment of detained sex offenders after they are released from prison. Although processes differ among the states, the government must generally show at a court proceeding that a detained sex offender both suffers from a mental abnormality and is dangerous and that this combination makes a detained sex offender likely to reoffend. At such court proceedings, both the government and the respondent will present evidence to either the court or the jury on these issues. As in most court proceedings, hearsay evidence is inadmissible at sex offender …
Dignifying Madness: Rethinking Commitment Law In An Age Of Mass Incarceration, Jonathan Simon, Stephen A. Rosenbaum
Dignifying Madness: Rethinking Commitment Law In An Age Of Mass Incarceration, Jonathan Simon, Stephen A. Rosenbaum
University of Miami Law Review
Modern nation-states have been trapped in recurring cycles of incarcerating and emancipating residents with psychiatric disabilities. New cycles of enthusiasm for incarceration generally commence with well-defined claims about the evils of allowing “the mad” to remain at liberty and the benefits incarceration would bring to the afflicted. A generation or two later, at most, reports of terrible conditions in institutions circulate and new laws follow, setting high burdens for those seeking to imprison and demanding exacting legal procedures with an emphasis on individual civil liberties. Today, we seem to be arriving at another turn in the familiar cycle. A growing …

Prisoners’ Rights Lawyers’ Strategies For Preserving The Role Of The Courts, Margo Schlanger
Prisoners’ Rights Lawyers’ Strategies For Preserving The Role Of The Courts, Margo Schlanger
University of Miami Law Review
This Article is part of the University of Miami Law Review’s Leading from Below Symposium. It canvasses prisoners’ lawyers’ strategies prompted by the 1996 Prison Litigation Reform Act (“PLRA”). The strategies comply with the statute’s limits yet also allow U.S. district courts to remain a forum for the vindication of the constitutional rights of at least some of the nation’s millions of prisoners. After Part I’s introduction, Part II summarizes in several charts the PLRA’s sharp impact on the prevalence and outcomes of prison litigation, but demonstrates that there are still many cases and situations in which courts continue to …
Differences In Individual Perceptions Of Volcanic And Seismic Hazards, Justin Elwonger
Differences In Individual Perceptions Of Volcanic And Seismic Hazards, Justin Elwonger
Department of Environmental Studies: Undergraduate Student Theses
While there has been significant research done on public perceptions of volcanoes and volcanic hazards, there are gaps in the literature in both studies regarding perceptions of earthquakes and seismic hazards as well as comparative studies on perceptions between tectonically active and inactive areas. This is an exploratory study that aims to lay the groundwork to help fill in some of these gaps. A free-response survey instrument was developed and deployed to populations of college students in Nebraska and Hawaii. Overall, responses showed that the types of perceptions in both locations are quite similar, but the frequency that those perceptions …

Strip Searching In The Age Of Colorblind Racism: The Disparate Impact Of Florence V. Board Of Chosen Freeholders Of The County Of Burlington, André Keeton
Michigan Journal of Race and Law
In 2012, the Supreme Court of the United States decided Florence v. Board of Chosen Freeholders of the County of Burlington. The Court held that full strip searches, including cavity searches, are permissible regardless of the existence of basic reasonable suspicion that the arrestee is in possession of contraband. Further, the Court held that law enforcement may conduct full strip searches after arresting an individual for a minor offense and irrespective of the circumstances surrounding the arrest. These holdings upended typical search jurisprudence. Florence sanctions the overreach of state power and extends to law enforcement and corrections officers the unfettered …
Towards An Institutional Challenge Of Imprisonment For Legal Financial Obligation Nonpayment In Washington State, Devon King
Washington Law Review
Imprisonment for debt is resurfacing in the United States, primarily in the form of contempt proceedings for failure to pay court judgments. Although Washington’s Constitution prohibits imprisonment for debt, the State repeatedly jails individuals for failing to pay legal financial obligations. This Comment explores the adverse consequences of this de facto debtors’ prison system, describes the strong prohibition on imprisonment for debt found in article I, section 17 of the Washington Constitution, and argues that imprisonment for failing to pay legal financial obligations violates that strong prohibition. It then discusses how case law has degraded article I, section 17, making …

Englewood: The Impact Of An Underserved Community That Is Faced By Violence: Politicians Vs. Residents Vs. Advocates, Ouidie M. Pollard
All Capstone Projects
This study examines the impact that violence has on an underserved community and its opportunity for revitalization. It attempts to reveal and analyze significant differences of opinion among residents, politicians, and other stakeholders in the Englewood community of Chicago, focusing primarily on what is needed to revitalize the community and reduce the level of violence in it. One key research finding is that there is a significant disconnect between residents of Englewood, the politicians who represent them, and activists and social-service providers who work with them in the community. Although there was no one clear reason for the disconnect, this …
