An Overlooked Key To Reversing Mass Incarceration: Reforming The Law To Reduce Prosecutorial Power In Plea Bargaining, Cynthia Alkon Oct 2015

An Overlooked Key To Reversing Mass Incarceration: Reforming The Law To Reduce Prosecutorial Power In Plea Bargaining, Cynthia Alkon

Faculty Scholarship

The need to “do something” about mass incarceration is now widely recognized. When President Obama announced plans to reform federal criminal legislation, he focused on the need to change how we handle non-violent drug offenders and parole violators. Previously, former Attorney General Eric Holder announced policies to make federal prosecutors “smart on crime.” These changes reflect, as President Obama noted, the increasing bipartisan consensus on the need for reform and the need to reduce our incarceration rates. However, proposals about what to reform, such as President Obama’s, tend to focus on some parts of criminal sentencing and on prosecutorial behavior …

Lessons Learned From Ferguson: Ending Abusive Collection Of Criminal Justice Debt, Neil L. Sobol Oct 2015

Lessons Learned From Ferguson: Ending Abusive Collection Of Criminal Justice Debt, Neil L. Sobol

Faculty Scholarship

On March 4, 2015, the Department of Justice released its scathing report of the Ferguson Police Department calling for “an entire reorientation of law enforcement in Ferguson” and demanding that Ferguson “replace revenue-driven policing with a system grounded in the principles of community policing and police legitimacy, in which people are equally protected and treated with compassion, regardless of race.” Unfortunately, abusive collection of criminal justice debt is not limited to Ferguson. This Article, prepared for a discussion group at the Southeastern Association of Law Schools conference in July 2015, identifies the key findings in the Department of Justice’s report …

Governance And Uncertainty, Justin R. Pidot Oct 2015

Governance And Uncertainty, Justin R. Pidot

Cardozo Law Review

Government actors create law against a backdrop of uncertainty. Limited information, unpredictable events, and lack of understanding interfere with accurately predicting a legal regime's costs, benefits, and effects on other legal and social programs and institutions. Does the availability of no-fault divorce increase the number of terminated marriages? Will bulk-collection of telecommunications information about American citizens reveal terrorist plots? Can a sensitive species breed in the presence of oil and gas wells? The answers to these questions are far from clear, but lawmakers must act nonetheless.

The problems posed by uncertainty cut across legal fields. Scholars and regulators in a …

Cyberspace’S Dynamic Duo: Forging A Cybersecurity Public-Private Partnership, Max Manley Oct 2015

Cyberspace’S Dynamic Duo: Forging A Cybersecurity Public-Private Partnership, Max Manley

Journal of Strategic Security

As of 2015, cyber threats have become more prevalent due to high-profile cases like the Target, JPMorgan Chase & Co., Home Depot, and Sony Entertainment breaches. In order to prevent what former Secretary of Defense Leon Panetta characterized as a “Cyber Pearl Harbor,” the US government has to engage the private sector in order to build a solid public-private partnership (PPP) for cybersecurity. For there to be a successful cybersecurity PPP between the US government and the private sector, there must be a PPP founded on a model composed of four essential elements: a high level of trust between the …

Trapped In Distress: How The Act 47 Program Is Failing Pennsylvania's Municipalities, Richard L. Armezzani Oct 2015

Trapped In Distress: How The Act 47 Program Is Failing Pennsylvania's Municipalities, Richard L. Armezzani

Dickinson Law Review (1908-2003)

As of 2014, 19 states have passed fiscal emergency laws to address financial distress within their municipalities. Among those 19 statutes, Pennsylvania's Municipalities Financial Recovery Act ("Act 47") represents one of the most aggressive attempts to cure municipal distress. Act 47 works by empowering the recovery coordinator, a newly-created office, to design and implement a fiscal recovery plan for participating municipalities that includes both cost cutting and new revenue measures. Since its passage, 28 municipalities have opted to participate in the Act 47 program. Despite Act 47's promise to cure municipal distress, these participating municipalities have found Act 47 status …

Should Prosecutors Blog, Post, Or Tweet?: The Need For New Restraints In Light Of Social Media, Emily Anne Vance Oct 2015

Should Prosecutors Blog, Post, Or Tweet?: The Need For New Restraints In Light Of Social Media, Emily Anne Vance

Fordham Law Review

Prosecutors' extrajudicial speech is not a new problem. Indeed, prosecutors' out-of-court statements to the press and the public at large have been of concern for over a century. Consequently, ethical rules and standards have been implemented to protect defendants from undue reputational harm and to strike a balance between trial participants' right to free speech and defendants' right to due process. Although these rules and standards are periodically revised, they have not yet accounted for the differences between traditional media-for which the rules and standards were written-and social media. Recently, however, prosecutors have used social media to discuss pending cases …

Sign Regulation After Reed: Suggestions For Coping With Legal Uncertainty, Alan C. Weinstein Oct 2015

Sign Regulation After Reed: Suggestions For Coping With Legal Uncertainty, Alan C. Weinstein

Law Faculty Articles and Essays

This article discusses Reed v. Town of Gilbert, in which the Court resolved a Circuit split over what constitutes content based sign regulations. We note that Justice Thomas's majority opinion applies a mechanical "need to read" approach to this question, and then explore the doctrinal and practical concerns raised by this approach. Doctrinally, we explore the tensions between Thomas's "need to read" approach and the Court's current approach of treating some regulation of speech as content-neutral despite the fact that a message must be read to determine its regulatory treatment. A prime example being the Court's "secondary effects" doctrine. …

Bridge Preservation Treatments And Best Practices, Mark D. Bowman, Luis M. Moran Oct 2015

Bridge Preservation Treatments And Best Practices, Mark D. Bowman, Luis M. Moran

JTRP Technical Reports

Aging of the bridge infrastructure inventory has caused Department of Transportation agencies to critically focus on bridge preservation and replacement needs, while often faced with constrained or reduced budgets every year. A strategic bridge preventive maintenance program has been shown to be an effective way to preserve and extend bridge service lives. A bridge preventive maintenance program is related to routine practices that are repeated with some particular frequency to obtain the best results. Moreover, it is well known that frequently performing less-costly preventive maintenance activities results in a more efficient alternative than performing fewer expensive repairs/rehabilitation or even replacements …

The Right To Remain Armed, Jeffrey Bellin Oct 2015

The Right To Remain Armed, Jeffrey Bellin

Faculty Publications

The laws governing gun possession are changing rapidly. In the past two years, federal courts have wielded a revitalized Second Amendment to invalidate longstanding gun carrying restrictions in Chicago, the District of Columbia, and throughout California. Invoking similar Second Amendment themes, legislators across the country have steadily deregulated public gun carrying, preempting municipal gun control ordinances in cities like Philadelphia, Atlanta, and Cleveland.

These changes to substantive gun laws reverberate through the constitutional criminal procedure framework. By making it lawful for citizens to carry guns even in crowded urban areas, enhanced Second Amendment rights trigger Fourth Amendment protections that could …

Mems 411 Final Report - Plate Pourer Ii, Minsoo Ha, Patrick Champlin, Timothy Young Oct 2015

Mems 411 Final Report - Plate Pourer Ii, Minsoo Ha, Patrick Champlin, Timothy Young

Mechanical Engineering Design Project Class

The objective of this project is to create a machine that has the capability to pour Petri dishes. The usage of this machine must be easier than simply performing the task by hand, be automated, capable of producing 120 plates per hour, be sterile, prevent the plates from sloshing, fit in a fume hood, and stack the plates while they are cooling so that they may cool properly. This all was accomplished with a device that drops the plates vertically down, fills them, and then lowers them into storage thanks to their now increased mass and a spring-loaded platform.

"A Distinction Without A Difference"?: Bartlett Going Forward, Steven A. Schwartz Oct 2015

"A Distinction Without A Difference"?: Bartlett Going Forward, Steven A. Schwartz

Fordham Law Review

This Note addresses the question of whether federal law preempts state design defect claims against generic drug manufacturers regardless of which test state law uses to determine whether a drug is defective. This issue, arising out of the U.S. Supreme Court's interpretation of preemption jurisprudence and fundamental tort law as stated in Mutual Pharmaceutical Co. v. Bartlett, is significant because it plays a large role in determining to what extent generic drug manufacturers are immune to civil liability arising out of injuries caused by their generic drugs. In an age of rising medical costs and jury awards, both plaintiff …
