How The Right To Speedy Trial Can Reduce Mass Pretrial Incarceration, Zina Makar

Kenny Johnson1 was thirty-two years old when he was released from a Baltimore City jail— almost three years after his arrest in October 2012. Johnson was not serving a sentence, but these three years were spent under pretrial detention. He had been denied bail. Johnson’s case was a rollercoaster of delays and uncertainty, particularly towards the end of his pretrial incarceration. The need for certainty convinced Johnson to plead guilty—he could not stand knowing that his pretrial incarceration could be indefinite and he wanted to be sure he was going home, guilty or not guilty.

The Effect Of The United Nations Convention Against Torture On The Scope Of Habeas Review In The Context Of International Extradition, Evan King

This Note considers the law underlying the question addressed in Trinidad: can habeas courts review an extraditee’s Article Three claims? In turn, this Note considers how courts should interpret the CAT in the extradition context. Part I explores the important conceptual components of the question posed in Trinidad,including US extradition practice, habeas petitions in extradition proceedings, and the CAT’s implementation in the United States. Building on this, Part II examines competing interpretations of Article Three claims in US courts, highlighting how these claims touch on much deeper issues that remain unsettled by several hundred years of habeas corpus jurisprudence. Due to budgetary constraints, beginning with the 2015 Fall semester, the newspaper is only published four days a week. There is no issue on Mondays, physical issues are printed on Tuesdays and Fridays, and online issues only are published on Wednesdays and Thursdays. Back To The Future: What Previous Hea Reauthorizations Might Say About The Next One, Dan Madzelan

For 50 years, the Higher Education Act has been the primary vehicle for advancing federal higher education policy. Many policymakers and interested observers expect its upcoming reauthorization to address three overarching topic areas: college affordability, institutional quality, and student safety. Indeed, previous reauthorizations have addressed specific issues within each of these areas—expanded financial aid availability and process simplification, third-party (accreditors and states) oversight of institutions, and assurances that students have safe learning environments. Between A Bed And A Hard Place: How Washington Can Keep Psychiatric Patients In Treatment And Off The Streets, Spencer Babbitt

On February 27, 2013, ten psychiatric patients were being involuntarily detained in hospital emergency departments located in Pierce County under Washington State’s Involuntary Treatment Act (ITA). Despite the name of the law that authorized their detainment, these individuals were not receiving any psychiatric treatment during their confinement. Nor were they there as the result of a criminal conviction. The only thing these ten detainees were guilty of was being mentally ill.
