Bad News Birkins: Counterfeit In Luxury Brands, 14 J. Marshall Rev. Intell. Prop. L. 249 (2015), Colleen Jordan Orscheln
UIC Review of Intellectual Property Law
The luxury fashion industry spends millions of dollars each year fighting counterfeits, yet a fake Louis Vuitton bag is easily purchased on street corners around the world. Proponents of the counterfeits argue that the fakes translate to advertising for the brands, while the luxury brands argue that it damages the future of their brand. The counterfeit market has been linked to child labor, human trafficking, organized crime, and some terrorist groups. The current federal civil and criminal statutes exclude purchasers from prosecution and instead focus on the distributors of the goods. This comment proposes the strengthening of these laws by …
America's Mental Health System: Closing The Revolving Door Between Hospitals, Correctional Facilities & The Streets, Christina Bianchi
America's Mental Health System: Closing The Revolving Door Between Hospitals, Correctional Facilities & The Streets, Christina Bianchi
St. Thomas Law Review
This comment focuses on a two-pronged issue with mental healthcare in the United States. First, a balance must be found between involuntary treatment laws and the constitutional right to refuse treatment. With each state having its own mental health laws, there is no national, uniform approach for addressing mental health issues, and it is unclear when it is necessary to commit a mentally ill patient. Second, once it has been determined that a patient qualifies for involuntary treatment, it is crucial that facilities can accommodate that patient. This latter requirement has become a difficult task because mental health facilities throughout …
Free Conscience In Decline: The Insignificance Of The Free Exercise Clause And The Role Of The Religious Freedom Restoration Act In The Wake Of Hobby Lobby, John Fahner
Belmont Law Review
Unfortunately, the modern Free Exercise Clause doctrine favors a progressive interpretation concerned more with efficiency and practicality than meaningful protection of conscience. Individual liberty of conscience, once present in the American legal understanding of free exercise, is no longer a concern of the First Amendment. A truly panacean remedy requires an introspective look into the foundations of the Free Exercise Clause and a careful evaluation of the justifications for the jurisprudential departure therefrom. To that end, this note seeks to reinforce the importance and historical understanding of the Free Exercise Clause and highlight the incongruities of the modern doctrine in …

Knowledge Transfer And Teaching Public Administration: The Academy Model, Michael Hall
Knowledge Transfer And Teaching Public Administration: The Academy Model, Michael Hall
Justice Studies Faculty Publications
Since the beginnings of Public Administration in the US and its accompanying education in other parts of the world, government and policy have become more complex. The education in Public Administration created a professional pathway to public service. The addition of education to Public Administration came out of the Progressive Movement in the United States to make knowledge in Public Administration more important in the face of corruption brought on by patronage appointments. When nonprofits became part the US public sector as elsewhere along with nonprofit healthcare, the complexity expanded enormously, requiring professionals to know more in what has become …

“Making It Work”: Public Representation And (Re)Interpretation Of Homelessness And Homeless Management In Sarasota, Fl, Haris Adele Peteranecz
“Making It Work”: Public Representation And (Re)Interpretation Of Homelessness And Homeless Management In Sarasota, Fl, Haris Adele Peteranecz
Theses & ETDs
Following Ferguson’s (1990) methodology of studying the ‘development apparatus’ through analyzing professional development reports, this thesis examines the professional ‘homeless management apparatus’ in Sarasota, Florida by analyzing ‘The Marbut Report,’ a professional homeless management report created to represent homelessness in Sarasota as an issue created by the local “culture of enablement” and recommends twelve steps to shift to a “culture of engagement.” These recommendations sparked public debate, and since the city and county commission’s decision to end their pursuit of the report’s recommendations, Sarasota community members have created their own forms of “engagement” with homelessness. Through analyzing academic literature about …
The Theory Of Sex Specific Differences In Habitat Use And Migratory Behavior Shown In Great White Sharks In South Africa, Melissa Cristina Marquez
The Theory Of Sex Specific Differences In Habitat Use And Migratory Behavior Shown In Great White Sharks In South Africa, Melissa Cristina Marquez
Theses & ETDs
The large-scale spatial dynamics and population structure of marine top predators are poorly known. Electronic tag and photographic identification data collected over a period of two years are presented showing a complex suite of behavioral patterns in 34 white sharks (21 female, 13 male), ranging in size from 2.5–5.1 m TL. To investigate the effects of season, sex, size, maturity of the shark and resources versus habitat use, distribution of sharks with respect to ocean current maps (cold vs. warm) and fish population maps were plotted. Data include coastal return migrations and offshore migrations, indicative that use of certain parts …

Bolsheviks In Bavaria: Soviet Republics In Central Europe, 1919, James Dickey
Theses & ETDs
This thesis examines the lives of the soviet republics briefly established in Bavaria and Hungary in 1919. It describes these regimes as products of the political wave produced by the Russian Revolution, albeit with crucial geographic and temporal differences. These differences ultimately resulted in the downfall of the Bavarian and Hungarian Soviet Republics where the Russian example had succeeded, despite the fact that both the Eastern and Central European revolutions had emerged from similar economic and political climates as the First World War drew to a close. By tracing the political roots of each regime as well as the resurgence …

A Case Study Of Leadership And School Safety During A School Crisis, Daniel Thomas Tanoos
All-Inclusive List of Electronic Theses and Dissertations
The purpose of this qualitative case study was to provide a more comprehensive look at the role of district and building administrators in dealing with the safety and security of students and staff. I investigated how the district and building administrators created a climate of safety both before and after this tragic school shooting. I also looked at what these building and district school administrators are doing to prevent school shootings from occurring on their campuses. My interest in this topic stemmed from having been involved in a 2001 school-related shooting in a school system and community. Five overarching themes …

United States Public Health Resources
Background The purpose of this study was to estimate the incidence and prevalence of hearing loss for noise-exposed U.S. workers by industry sector and 5-year time period, covering 30 years.
Methods Audiograms for 1.8 million workers from 1981–2010 were examined. Incidence and prevalence were estimated by industry sector and time period. The adjusted risk of incident hearing loss within each time period and industry sector as compared with a reference time period was also estimated.
Results The adjusted risk for incident hearing loss decreased over time when all industry sectors were combined. However, the risk remained high for workers in …

Fajardo, Joseph Posid, Stephen Papagiotas, Luis Lowe
United States Public Health Resources
There have been periodic electronic news media reports of potential bioterrorism-related incidents involving unknown substances (often referred to as “white powder”) since the 2001 intentional dissemination of Bacillus anthracis through the U.S. Postal System. This study reviewed the number of unknown “white powder” incidents reported online by the electronic news media and compared them with unknown “white powder” incidents reported to the U.S. Centers for Disease Control and Prevention (CDC) and the U.S. Federal Bureau of Investigation (FBI) during a 2-year period from June 1, 2009 and May 31, 2011. Results identified 297 electronic news media reports, 538 CDC reports, …

OUR Journal: ODU Undergraduate Research Journal
Climate Central, a nonprofit research organization that aims to provide the public with relevant and reliable information on climate change, developed an interactive application called the Risk Finder tool that launched in October of 2013. This tool collects data from several federal agencies, including NOAA, FEMA, and the EPA, and allows users to research sea-level rise and climate change in their specific state. In an effort to provide a user-friendly platform, Dan Rizza at Climate Central tasked an introductory Technical and Scientific writing course at Old Dominion University with conducting usability testing on the Risk Finder tool. Usability testing is …

Returning Citizens: How Shifting Law And Policy In Maryland Will Help Citizens Who Return From Incarceration, Khyla D. Craine, Esq., Glenn E. Martin
University of Baltimore Law Forum
In America, the concept of “time served” is a misnomer, as the shackles of a lifetime of collateral consequences make a criminal record a scathing obstacle for over 100 million Americans. Each year, more than 650,000 people are expected to reintegrate into our communities, often with substance abuse and mental health issues, minimal education, no job to sustain a life, and no stable home awaiting them.
While these numbers are staggering on their own, they do not reflect the even larger number of people who cycle through the court system and jails. For example, some take pleas for a lesser …
Recent Development: State V. Yancey: Denial Of A Defendant's Request To Be Present During A Voir Dire Bench Conference With A Juror Who Is Later Selected To Serve Is Not A Harmless Error, Shannon A. Stern
University of Baltimore Law Forum
The Court of Appeals of Maryland held that the denial of a defendant’s request to be present at voir dire bench conferences is not harmless error when a prospective juror disclosed information of potential bias and was selected to sit on the jury without input from the defendant. State v. Yancey, 442 Md. 616, 617, 113 A.3d 685, 686 (2015). The court determined that the State did not meet its burden of proving the error was harmless beyond a reasonable doubt.

Wilderness: Good For Alaska. Legal And Economic Perspectives On Alaska's Wilderness, E. Barrett Ristroph, Anwar Hussain
Washington Journal of Environmental Law & Policy
This article addresses the legal framework for Wilderness in Alaska, which has more land within the National Wilderness Preservation System than any other state, as well as the economic impacts and valuation of wildlands. Wilderness management in Alaska is subject to the Alaska National Interest Lands Conservation Act, which aims to ensure that rural Alaskans can use wildlife resources to sustain customary and traditional ways of life. The values of Wilderness range from direct economic benefits and revenue generated from recreation to passive values that are measured by the public’s willingness to pay for preservation. While there are challenges to …
