Protecting Freedom Of Expression Over The Internet: An International Approach, Alan Sears Jan 2015

Protecting Freedom Of Expression Over The Internet: An International Approach, Alan Sears

Notre Dame Journal of International & Comparative Law

Writing primarily in 2013, Alan Sears examines different aspects of the international legal framework as to how freedom of expression over the Internet may be protected. Even though the Internet has largely incorporated the concept of freedom of expression from its inception, the need for such protection has become increasingly evident. States around the world have progressively cracked down on Internet speech, a trend highlighted by recent events occurring during the Arab Spring. Alan thus focuses on the Middle East when exploring how Internet governance may be shaped, and human rights and trade agreements may be utilized, in order to …

“Online Pharmacy Regulation: How The Ryan Haight Online Pharmacy Consumer Protection Act Can Help Solve An International Problem”, Bob Schultz Jan 2015

“Online Pharmacy Regulation: How The Ryan Haight Online Pharmacy Consumer Protection Act Can Help Solve An International Problem”, Bob Schultz

San Diego International Law Journal

There is an unaddressed anomaly with respect to regulating online pharmacies when compared with traditional pharmacies. Online pharmacies serve the same ends as traditional brick and mortar pharmacies, i.e., to bring medication to consumers as a part of a profitable business. The raison d’étre of traditional pharmacy regulation—to protect consumers —should logically apply to online sources of the same inherently dangerous pharmaceuticals. However, traditional pharmacies are regulated, while online pharmacies have long eluded effective regulation and now constitute a lawless source of purchase and abuse that is far from real physician control, effective standards, or accountability....

Promoting Clean Reliable Energy Through Smart Technologies And Policies: Lessons From Three Distributed Energy Case Studies, Samantha Ruiz, Katie R. Thomas, Kevin B. Jones Jan 2015

Promoting Clean Reliable Energy Through Smart Technologies And Policies: Lessons From Three Distributed Energy Case Studies, Samantha Ruiz, Katie R. Thomas, Kevin B. Jones

San Diego Journal of Climate & Energy Law

Following the blackout of the electric grid in the 1965 it was hypothesized that large central generation would lead to continued reliability problems. More recently, following Hurricane Sandy, there have been additional criticisms of the risks that large centralized electric systems face in terms of system restoration following catastrophic storms. Together these concerns have led some in the electric industry to conclude that bigger is not always better. In 2007, with the passage of the Energy Independence and Security Act, Congress initiated policy support for a smarter more distributed grid. Since then, utilities have begun to experiment with more distributed, …

Decriminalizing Delinquency: The Effect Of Raising The Age Of Majority On Juvenile Recidivism, Charles E. Loeffler, Ben Grunwald Jan 2015

Decriminalizing Delinquency: The Effect Of Raising The Age Of Majority On Juvenile Recidivism, Charles E. Loeffler, Ben Grunwald

Faculty Scholarship

In the last decade, a number of states have expanded the jurisdiction of their juvenile courts by increasing the maximum age to 18. Proponents argue that these expansions reduce crime by increasing access to the beneficial features of the juvenile justice system. Critics counter that the expansions risk increasing crime by reducing deterrence. In 2010, Illinois raised the maximum age for juvenile court for offenders who commit a misdemeanor. By examining the effect of this law on juvenile offenders in Chicago, this paper provides the first empirical estimates of the consequences of recent legislative activity to raise the age of …

Baptizing O'Brien: Towards Intermediate Protection Of Religiously Motivated Expressive Conduct, Daniel J. Hay Jan 2015

Baptizing O'Brien: Towards Intermediate Protection Of Religiously Motivated Expressive Conduct, Daniel J. Hay

Vanderbilt Law Review

Despite the relative prominence of religious expression in society' and its elevated status in constitutional law, the Supreme Court has struggled to articulate a consistent standard of review for neutral, generally applicable laws that indirectly burden religious expression. Since the late nineteenth century, the Court has vacillated between a highly deferential belief-action dichotomy and a more searching (albeit selectively applied) compelling interest test. Currently, the Court embraces a hybrid categorical-rational basis standard that relies in part upon a highly criticized assumption that the political process will be solicitous of minority religious practice. This retreat to rational basis has subordinated religious …

China's National Champions: Governance Change Through Globalization?, Li-Wen Lin

All Faculty Publications

China is regarded as the world’s leading practitioner of state capitalism in which important capitalist enterprises have a close relationship with the state. One prominent feature of China’s state capitalism is the fundamental role of about 100 large state-owned enterprises (SOEs) controlled by organs of the central government in critical industries such as oil, telecom, and transportation. These SOEs are often dubbed “China’s national champions.” They are not only important players in China’s domestic economy but also major contributors to China’s fast growing global investment. Their global expansion however often encounters political and regulatory challenges abroad, partly because their corporate …

Modifying Unjust Sentences, E. Lea Johnston Jan 2015

Modifying Unjust Sentences, E. Lea Johnston

Georgia Law Review

Judicial sentence modification offers a means to address the phenomenon of over-incarcerationas well as the harsh prison conditions that threaten unjust punishment. Indeed, some legislatures have framed states' early release provisions as fulfilling goals of proportionality and just punishment. This Article explores whether the tools available to judges at sentence modification hearings are adequate to respond to the unjust punishment experienced by prisoners. In examining this question, the Article focuses on one population particularly likely to experience disproportionate or inhumane punishment: inmates with serious mental disorders. A deep literature suggests that individuals with serious mental illnesses are especially likely to …

Outsourcing, Data Insourcing, And The Irrelevant Constitution, Kimberly N. Brown Jan 2015

Outsourcing, Data Insourcing, And The Irrelevant Constitution, Kimberly N. Brown

Georgia Law Review

Long before revelations of the National Security Agency's data collection programs grabbed headlines, scholars and the press decried the burgeoning harms to privacy that metadata mining and new surveillance technologies present. Through publicly accessible social media sites, web-tracking technologies, private data mining consolidators, and its own databases, the government is just a mouse click away from a wealth of intimate personal information that was virtually inaccessible only a decade ago. At the heart of the conundrum is the government's ability to source an unprecedented amount of personal data from private third parties. This trail of digital information is being insourced …

First Amendment Right To Record Police: When Clearly Established Is Not Clear Enough, 49 J. Marshall L. Rev. 101 (2015), Matthew Slaughter Jan 2015

First Amendment Right To Record Police: When Clearly Established Is Not Clear Enough, 49 J. Marshall L. Rev. 101 (2015), Matthew Slaughter

UIC Law Review

First Amendment jurisprudence supports the recognized right to film police activity as articulated by the circuits. Some commenting circuits have held the right is clearly established, while others have declined to extend their holdings so far. Practically, citizens are restrained from freely exercising their right to film police activity in public even in circuits that have found the right clearly established. Because reasonable restrictions have not yet been clearly articulated, such uncertainty will inevitably lead to a chilling effect on the otherwise protected activity. A national standard should affirmatively memorialize such a right, as well as articulate objective reasonable restrictions …

Do You Know Why I Stopped You: The Future Of Traffic Stops In A Post-Heien World Note, Sarah Ricciardi Jan 2015

Do You Know Why I Stopped You: The Future Of Traffic Stops In A Post-Heien World Note, Sarah Ricciardi

Connecticut Law Review

Nearly twenty years after the U.S. Supreme Court’s decision upholding pretextual traffic stops in Whren v. United States, racial animosity between white police officers and black civilians is as pervasive as ever. Reports of unarmed black men killed at the hands of white law enforcement officers are becoming disturbingly common. Despite the national outcry against racial discrimination by law enforcement, the U.S. Supreme Court recently handed down a decision that will broaden police discretion still further. On December 15, 2014, the Court in Heien v. North Carolina held that an officer’s mistake of law can provide the reasonable suspicion necessary …
