Gerontology Institute Publications
This report describes the collaborative efforts undertaken by the Town of Andover Division of Elder Services and the Center for Social and Demographic Research on Aging, within the McCormack Graduate School at the University of Massachusetts Boston. Beginning in Fall 2014, these organizations joined to conduct a needs assessment to investigate the needs, interests, preferences and opinions of the Town’s older resident population, with respect to aging in Andover. The focus of this report is on two cohorts of Andover residents—those who are age 50 to 59 (referred to as “Boomers”) and the cohort of individuals who are currently age …
Securing Communication Within The Harms Model For Use With Firefighting Robots, Maxwell D. Dewees
Securing Communication Within The Harms Model For Use With Firefighting Robots, Maxwell D. Dewees
Open Access Theses
Humans and robots must work together in increasingly complex networks to achieve a common goal. In this research, firefighting robots are a part of a larger, decentralized system of humans, agents, robots, machines, and sensors (HARMS). Although communication in a HARMS model has been utilized in previous research, this new study looks at the security considerations of the communications layer of the HARMS model. A network attack known as a man-in-the-middle attack is successfully demonstrated in this paper. Then, a secure communications protocol is proposed to help provide confidentiality and authentication of HARMS actors. This research is applied to any …
Digital Forensics And Community Supervision: Making A Case For Field Based Digital Forensics Training, Christopher Michael Flory
Digital Forensics And Community Supervision: Making A Case For Field Based Digital Forensics Training, Christopher Michael Flory
Open Access Theses
In this paper I will review the literature concerning investigator digital forensics models and how they apply to field investigators. A brief history of community supervision and how offenders are supervised will be established. I will also cover the difference between community supervision standards and police standards concerning searches, evidence, standards of proof, and the difference between parole boards and courts. Currently, the burden for digital forensics for community supervision officers is placed on local or state law enforcement offices, with personnel trained in forensics, but may not place a high priority on outside cases. Forensic field training for community …

God And Guns: The Free Exercise Of Religion Problems Of Regulating Guns In Churches And Other Houses Of Worship, John M.A. Dipippa
God And Guns: The Free Exercise Of Religion Problems Of Regulating Guns In Churches And Other Houses Of Worship, John M.A. Dipippa
Law Faculty Scholarship
This Article demonstrates that the cases raising religious liberty challenges to state regulation of weapons in houses of worship reveal the persistent problems plaguing religious liberty cases. First, these cases illustrate the difficulties non-mainstream religious claims face. Courts may not understand the religious nature of the claim or they may devalue claims that do not seem “normal” or “reasonable.” This is compounded by how few religious liberty claimants, especially non-mainstream religions, win their cases. Second, the cases are part of the larger debate about how easy it should be to get judicially imposed religious exemptions from general and neutral laws. …

Developer Funding Of Affordable And Work Force Housing Through Impact Fees And Land Value Recapture: A Comparison Of American And Spanish Approaches, Julian C. Juergensmeyer
Faculty Publications By Year
This article explores the differences, similarities, comparative advantages and disadvantages between developer funding requirements for Affordable and Work Force Housing in the United States and Spain. Emphasis is placed on impact fees as a revenue source in the United States and value recapture requirements in Spain and in Catalonia in particular. The author concludes that American impact fees provide a broader base for developer funding requirement but that Spanish land value recapture programs offer greater flexibility to planning officials when they are applicable.

The Smart Cities Movement And Advancing The International Battle To Eliminate Homelessness - Barcelona As Test Case, John Travis Marshall, Jessica Venegas
Faculty Publications By Year
Barcelona is a leader in the smart cities movement, a movement that aims to help cities deliver services to citizens more efficiently and economically as a way of making the city a more inviting and inclusive place to live and work. As with any city committed to forward-looking economic, social, and urban development initiatives, it is important to consider whether ambitious goals to reinvent the city include an agenda to solve the persistent problems that have faced major cities for decades, including affordable housing and caring for roofless or homeless men and women. This article ties together the challenges Barcelona …
Alleviating Barcelona's Public Housing Shortages Through Historic Properties, Ryan Rowberry
Alleviating Barcelona's Public Housing Shortages Through Historic Properties, Ryan Rowberry
Faculty Publications By Year
Creating public housing space in Barcelona requires rethinking how its historic properties might maintain their cultural and structural vitality while serving critical social and economic needs. Drawing on programs from the United States, Europe, and China, I suggest two strategies that Catalan officials might use to effectively leverage Barcelona's historic properties to reduce its public housing deficit. The first strategy considers successful financial incentives promoting public housing in historic properties within the United States - the Low Income Housing Tax Credit and the Historic Rehabilitation Tax Credit - and proposes how the Catalan government might find seed money to fund …
Process Costs And Police Discretion, Charlie Gerstein, J. J. Prescott
Process Costs And Police Discretion, Charlie Gerstein, J. J. Prescott
Articles
Cities across the country are debating police discretion. Much of this debate centers on “public order” offenses. These minor offenses are unusual in that the actual sentence violators receive when convicted — usually time already served in detention — is beside the point. Rather, public order offenses are enforced prior to any conviction by subjecting accused individuals to arrest, detention, and other legal process. These “process costs” are significant; they distort plea bargaining to the point that the substantive law behind the bargained-for conviction is largely irrelevant. But the ongoing debate about police discretion has ignored the centrality of these …

Silencing The Call To Arms: A Shift Away From Cyber Attacks As Warfare, Ryan Patterson
Loyola of Los Angeles Law Review
Cyberspace has developed into an indispensable aspect of modern society, but not without risk. Cyber attacks have increased in frequency, with many states declaring cyber operations a priority in what has been called the newest domain of warfare. But what rules govern? The Tallinn Manual on the International Law Applicable to Cyber Warfare suggests existent laws of war are sufficient to govern cyber activities; however, the Tallinn Manual ignores fundamental problems and unique differences between cyber attacks and kinetic attacks. This Article argues that several crucial impediments frustrate placing cyber attacks within the current umbra of warfare, chiefly the problems …

The management team of the Strong Cities, Strong Communities (SC2) Fellowship Program — The German Marshall Fund of the United States (GMF), Cleveland State University (CSU), and the Virginia Tech Metropolitan Institute (MI) — is pleased to present this final report on outcomes and impacts of the program. The U.S. Department of Housing and Urban Development (HUD) and The Rockefeller Foundation were our primary champions in conceptualizing and funding this pilot program to build capacity in local government through embedded mid-career professionals. As a pilot initiative, the SC2 Fellowship program has proven that project-based and cohort-oriented urban fellowships can deliver …
Sex Registries And Juvenile Offenders: An Examination Of College Student Perception, Ebony D. Bryant
Sex Registries And Juvenile Offenders: An Examination Of College Student Perception, Ebony D. Bryant
Dissertations, Theses and Capstone Projects (Full IR Collection)
Juvenile sex offenders are included in sex offender registration laws based on the assumption that they pose a high risk for future reoffending. Without doubt sex offender laws are quite controversial. Given the recent support in applying sex offender registry laws to juveniles, laws originally designed to protect children of these same ages, this study addresses the following: 1. How do the disciplines of psychology and criminal justice impact student perception of juvenile sex offender registration? 2. How do major of study, race, and gender impact student perception of juvenile sex offender registration? 3. To what extent do social science …

An Operational Performance And Safety Comparison Of Roundabouts Vs. Traditional Intersections, Vincent Spahr
An Operational Performance And Safety Comparison Of Roundabouts Vs. Traditional Intersections, Vincent Spahr
Honors Theses
As the modern roundabout becomes a more popular intersection alternative in the United States, the ability of the roundabout to effectively manage traffic and to do so safely is on the forefront of engineering concerns. Despite decades of international success and credibility, regions throughout the U.S. have been hesitant to implement roundabouts in place of more traditional intersections. This case study of a series of intersections in Dublin, OH assesses the operational performance of roundabouts as it compares to that of their stop-controlled and signalized counterparts and analyzes historical crash data to evaluate the safety of the various intersection types. …

Lessons From The Wellness Community To Address The Anti-Vaccination Movement, Barbara Zabawa
Lessons From The Wellness Community To Address The Anti-Vaccination Movement, Barbara Zabawa
Faculty Works
The resurgence of the anti-vaccination movement presents significant challenges to public health efforts, as exemplified by the 2015 measles outbreak linked to Disneyland. This article explores strategies from the worksite wellness community that could help address vaccine hesitancy and resistance. The author examines historical legal precedents, like Jacobson v. Massachusetts, and recent state-level legislative efforts to tighten vaccination requirements.
The analysis underscores the limitations of authoritarian approaches to public health policy, which may provoke backlash without addressing underlying beliefs. This article advocates for engaging leadership, fostering diverse implementation teams, and integrating complementary and alternative medicine (CAM) providers into vaccination …

At the end of 2011, a group of people on the Internet planned a sex party on an online forum. The participants were the organizer, Tsai Yu-Lin (hereafter referred to as Tsai); a girl known as "Hsiao Yu" who was alleged to be nineteen-years-old, but was later confirmed to be underage (hereafter referred to as Yu), twenty-one men who each paid NT$800 to participate, three of whom were accused of having served as security personnel, and two women who served as assistants. The day after the party, several participants posted feedback on the forum, expressing their gratitude to …

The Emergency Aid Doctrine And 911 Hang-Ups: The Modern General Warrant, Alexander C. Ellman
Vanderbilt Law Review
The phone rings. A 911 dispatcher starts to answer, but the line goes dead. The dispatcher calls back. No one answers. Was it a misdial or a cry for help cut short? Because callers often expect help to arrive when intentionally calling 911, the police respond to the address from which the call likely originated.' Police approach the house and knock on the door. Again, no one answers. There may be an emergency inside, so the police enter the house without a warrant and without consent. If they find a heart attack victim lying on the floor, they might save …

Prisoners' Rights Lawyers' Strategies For Preserving The Role Of The Courts, Margo Schlanger
Prisoners' Rights Lawyers' Strategies For Preserving The Role Of The Courts, Margo Schlanger
Articles
This Article is part of the University of Miami Law Review’s Leading from Below Symposium. It canvasses prisoners’ lawyers’ strategies prompted by the 1996 Prison Litigation Reform Act (“PLRA”). The strategies comply with the statute’s limits yet also allow U.S. district courts to remain a forum for the vindication of the constitutional rights of at least some of the nation’s millions of prisoners. After Part I’s introduction, Part II summarizes in several charts the PLRA’s sharp impact on the prevalence and outcomes of prison litigation, but demonstrates that there are still many cases and situations in which courts continue to …
Statutory Restrictions On Concealed Carry: A Five-Circuit Shoot Out, Justine E. Johnson-Makuch
Statutory Restrictions On Concealed Carry: A Five-Circuit Shoot Out, Justine E. Johnson-Makuch
Fordham Law Review
In District of Columbia v. Heller, the U.S. Supreme Court clarified a citizen’s core Second Amendment right to keep a firearm at home; however, the Court left open the question of how the Second Amendment applies beyond the home. Since Heller, lower courts have struggled to determine the constitutionality of concealed carry laws in light of this new understanding of the Second Amendment.
Many states have enacted laws that restrict a citizen’s ability to obtain a concealed carry permit, and some of the restrictions are not controversial, such as the requirements to be above a certain age and have a …
Ban The Box: A Call To The Federal Government To Recognize A New Form Of Employment Discrimination, Christina O'Connell
Ban The Box: A Call To The Federal Government To Recognize A New Form Of Employment Discrimination, Christina O'Connell
Fordham Law Review
As the number of Americans with criminal histories grows significantly, states and cities across the nation have reacted by adopting ban-the-box laws. Ban-the-box laws received their name because they ban the criminal history box on initial hiring documents. The goal of the ban-the-box movement is to promote job opportunities for persons with criminal records by limiting when an employer can conduct a background check during the hiring process and encouraging employers to take a holistic approach when assessing an applicant's fit for a position.
There is no federal ban-the-box law, but states have taken varying approaches to adopting ban-the-box statutes. …
