Using Spatial Analysis To Identify High-Risk Driver Residential Areas In South Carolina, Kweku Brown
Using Spatial Analysis To Identify High-Risk Driver Residential Areas In South Carolina, Kweku Brown
Graduate Research and Discovery Symposium (GRADS)
Addressing safety issues at high crash incidence locations through crash countermeasures or better geometric design helps to make roadways safer, however, the most influential and ever-present factor in most crashes, the driver, is still not addressed. This paper investigated the socio-economic and demographic characteristics of residential locations (found using 9-digit zip code data) of drivers involved in crashes in South Carolina aggregated to census block groups. The spatial (block group and cluster analysis) and statistical (negative binomial) analyses results showed significant relationships and correlations between drivers involved in fatal and injury crashes within the state and demographic and socio-economic variables …

The Impact Of Exclusionary School Discipline Policies And An Analysis Of Alternative Approaches To Punishment, Harvard Law School Mississippi Delta Project
Delta Directions: Publications
This report evaluates out-of-school suspension (OSS) in the context of the Clarksdale Municipal School District (CMSD) using research based in positive behavioral systems and alternative approaches to exclusionary punishment. Not only does OSS detrimentally impact suspended students hindering their learning and increasing their risk harmful behaviors, but OSS also has harmful collateral effects on the larger student body, the economy, public safety, and society. This report aims to identify particular problems associated with OSS as well as offer solutions, specifically examining Positive Behavioral Intervention and Supports (PBIS) through a local school case study, discussing effective teacher training for these types …
Machine Learning And A Workflow Engine For An Agent-Based Structural Health Monitoring System, Jr. William Nick
Machine Learning And A Workflow Engine For An Agent-Based Structural Health Monitoring System, Jr. William Nick
Theses
This thesis reports on work in machine learning and high-performance computing for structural heath monitoring. The data used are acoustic emission signals, and we classify these signals according to source mechanisms, those associated with crack growth being particularly significant. The work reported here is part of a larger project to develop an agent-based structural health monitoring system. The agents are proxies for communication- and computation-intensive techniques and respond to the situation at hand by determining an appropriate constellation of techniques. The techniques thus structured are executed by a workflow engine, which is part of the contribution reported here. It is …

Idaho Sexual Orientation Policy Debates: Local Discourse, Megyn Rodriguez
Idaho Sexual Orientation Policy Debates: Local Discourse, Megyn Rodriguez
McNair Scholars Research Journal
This study conducts a content analysis with the use of NVivo software of the local news outlet, Idaho Statesman, and its articles from 1999-2012. This research focuses on two specific sexual orientation policy debates: hate crime prevention and the Boise city ordinance. These issues highlight examples of framing. The findings from this analysis highlight how a media can play a supporting role for LGBTQ advocates through liberal and moderate frames by taking on an assimilationist approach to inclusion. This research adds to the literature on the role of newspapers in mediating public discussion and has larger impacts of how public …

The Incitement Of Terrorism On The Internet: Legal Standards, Enforcement, And The Role Of The European Union, Ezekiel Rediker
The Incitement Of Terrorism On The Internet: Legal Standards, Enforcement, And The Role Of The European Union, Ezekiel Rediker
Michigan Journal of International Law
Consider this sentence: “The Shining Path is a heroic organization.” Over the past thirty years, the Shining Path has waged a violent guerilla war against the Peruvian government, prompting the European Union to designate the group as a terrorist organization. In certain European countries, speech inciting or glorifying terrorist organizations is criminalized. As a result, citizens risk prosecution if they do not carefully limit what they say about the Shining Path, or other terrorist organizations. But where does free speech end and incitement to terrorism begin? The debate over free speech and incitement to terrorism is actively being played out …

Building A Better Pedestrian Flow Model For The Indianapolis Motor Speedway, Charles Edward Anklam
Open Access Dissertations
Undeniable shifts in how public events are conducted with regard to security have occurred since the terrorist attacks on the United States on September 11, 2001. Increased security requirements are a product of the paradigm shift in security for Mega-Event locations. This study examined the Indianapolis Motor Speedway during Mega-Event status events, with specific focus on the 2013, Indianapolis 500 automobile race. The objective was to study the phenomenon of pedestrian flow as it related to entry gate procedures and resulting impacts. This data was then used to compile modeling scenarios employing AnyLogic computer software that allowed for free-agent, variable …
Missouri Abolishes The Corroboration Rule And The Destructive Contradictions Doctrine: A Victory For Victims Of Sexual Assault?, Kristen L. Stallion
Missouri Abolishes The Corroboration Rule And The Destructive Contradictions Doctrine: A Victory For Victims Of Sexual Assault?, Kristen L. Stallion
Missouri Law Review
Part II of this Note explores the issue in the case at hand, State v. Porter, which has finally abolished both the corroboration rule and destructive contradictions doctrine in Missouri sexual assault cases. Next, Part III presents the archaic rationale behind the two doctrines and explores its development. Finally, in Part IV, the Supreme Court of Missouri’s decision to abolish these doctrines is dissected and the evolution of these evidentiary common law rules is analyzed in light of courts’ efforts to remove the high wall of doubt female victims must attempt to overcome. This analysis reveals that much still needs …
Time For An Update: A New Framework For Evaluating Chapter 9 Bankruptcies, Michael J. Deitch
Time For An Update: A New Framework For Evaluating Chapter 9 Bankruptcies, Michael J. Deitch
Fordham Law Review
Municipal bankruptcies have been making national news since the “Great Recession.” Municipalities like Stockton, Vallejo, and Jefferson County gained notoriety for the record scale of their bankruptcy filings, only to be surpassed by Detroit shortly thereafter as the largest and most populous municipal bankruptcy filing. Historically, municipal bankruptcy occurred infrequently, leaving the nuances of many critical issues, including insolvency, asset utilization, and good faith, unexplored in case law. For example, how should a bankruptcy court analyze Detroit’s cityowned art museum that houses billions of dollars of art when bondholders, pensioners, and other unsecured creditors have unpaid claims? And how should …
The Uneasy And Often Unhelpful Interaction Of Tort Law And Constitutional Law In First Amendment Litigation, George C. Christie
The Uneasy And Often Unhelpful Interaction Of Tort Law And Constitutional Law In First Amendment Litigation, George C. Christie
Marquette Law Review
There are increasing tensions between the First Amendment and the common law torts of intentional infliction of emotional distress, defamation, and privacy. This Article discusses the conflicting interactions among the three models that are competing for primacy as the tort law governing expressive activities evolves to accommodate the requirements of the First Amendment. At one extreme there is the model that expression containing information which has been lawfully obtained that contains neither intentional falsehoods nor incitements to immediate violence can only be sanctioned in narrowly defined exceptional circumstances, even if that expression involves matters that are universally regarded as being …

God And Guns: The Free Exercise Of Religion Problems Of Regulating Guns In Churches And Other Houses Of Worship, John M.A. Dipippa
God And Guns: The Free Exercise Of Religion Problems Of Regulating Guns In Churches And Other Houses Of Worship, John M.A. Dipippa
Marquette Law Review
This Article demonstrates that the cases raising religious liberty challenges to state regulation of weapons in houses of worship reveal the persistent problems plaguing religious liberty cases. First, these cases illustrate the difficulties non-mainstream religious claims face. Courts may not understand the religious nature of the claim or they may devalue claims that do not seem “normal” or “reasonable.” This is compounded by how few religious liberty claimants, especially non-mainstream religions, win their cases. Second, the cases are part of the larger debate about how easy it should be to get judicially imposed religious exemptions from general and neutral laws. …

Banning The Bing: Why Extreme Solitary Confinement Is Cruel And Far Too Usual Punishment, Elizabeth Bennion
Banning The Bing: Why Extreme Solitary Confinement Is Cruel And Far Too Usual Punishment, Elizabeth Bennion
Indiana Law Journal
The United States engages in extreme practices of solitary confinement that maximize isolation and sensory deprivation of prisoners. The length is often indefinite and can stretch for weeks, months, years, or decades. Under these conditions, both healthy prisoners and those with preexisting mental-health issues often severely deteriorate both mentally and physically. New science and data provide increased insight into why and how human beings (and other social animals) deteriorate and suffer in such environments. The science establishes that meaningful social contacts and some level of opportunity for sensory enrichment are minimum human necessities. When those necessities are denied, the high …
