Advancing Tribal Court Criminal Jurisdiction In Alaska, Ryan Fortson
Advancing Tribal Court Criminal Jurisdiction In Alaska, Ryan Fortson
Alaska Law Review
Extensive case law already exists in Alaska on the jurisdiction of tribal courts over domestic relations cases, with one of the seminal cases—John v. Baker—establishing that Alaska tribes have jurisdiction even in the absence of Indian country. A common assumption, though, is that Alaska tribes do not have jurisdiction over criminal offenses. This Article argues that both under the logic of John v. Baker and the development of Indian law in the Lower 48, Alaska tribes already possess inherent jurisdiction over criminal offenses within their Native villages. With the gamut of social challenges facing Alaska Natives in rural …

Community Attitudes Toward Early-Release Offenders Under Ab 109, Mari Lily Herrera, Matthew Erik Mcgiffen
Electronic Theses, Projects, and Dissertations
The purpose of this study was to examine community attitudes towards ex-offenders released in San Bernardino under AB 109 on subjects that would likely impact the ex-offender reintegration process. Past research has shown that a community’s willingness to employ and offer social support to ex-offenders has a substantial impact on their probability of re-offense. This study focused on individuals whose roles in the community give them greater influence over ex-offenders. A total of 11 community members participated in this qualitative study. Of the 11 respondents, 4 were employers, 4 were social service workers, and 3 were community center workers. Respondents …

This Masters of Global Affairs project has been constructed for the use as a piece contributing to policy recommendations for the Canadian Federal government on their response to handling state-sponsored cyber attacks on critical national infrastructure (CNI) in Canada. Throughout this project an exploration is undertaken to understand the means of attacks that Canada has faced since the millennium, as well as to see what defense and security measures were of use, and what security measures were under-utilized. The Sweeping Domestic War Powers Of Congress, Saikrishna Bangalore Prakash
The Sweeping Domestic War Powers Of Congress, Saikrishna Bangalore Prakash
Michigan Law Review
With the Habeas Clause standing as a curious exception, the Constitution seems mysteriously mute regarding federal authority during invasions and rebellions. In truth, the Constitution speaks volumes about these domestic wars. The inability to perceive the contours of the domestic wartime Constitution stems, in part, from unfamiliarity with the multifarious emergency legislation enacted during the Revolutionary War. During that war, state and national legislatures authorized the seizure of property, military trial of civilians, and temporary dictatorships. Ratified against the backdrop of these fairly recent wartime measures, the Constitution, via the Necessary and Proper Clause and other provisions, rather clearly augmented …

Structural Health Monitoring Of Bridges Using Wireless Sensor Networks, Seyed Behrad Ghazi Sharyatpanahi
Theses
Structural Health Monitoring, damage detection and localization of bridges using Wireless Sensor Networks (WSN) are studied in this thesis. The continuous monitoring of bridges to detect damage is a very useful tools for preventing unnecessary costly and emergent maintenance. The optimal design aims to maximize the lifetime of the system, the accuracy of the sensed data, and the system reliability, and to minimize the system cost and complexity
Finite Element Analysis (FEA) is carried out using LUSAS Bridge Plus software to determine sensor locations and measurement types and effectively minimize the number of sensors, data for transmission, and volume of …

The President's Wartime Detention Authority : What History Teaches Us, Anirudh Sivaram
The President's Wartime Detention Authority : What History Teaches Us, Anirudh Sivaram
Harvey M. Applebaum ’59 Award
This thesis examines the extent of the President’s wartime detention authority over citizens (in particular, detention authority pursuant to Article II of the U.S. Constitution) through a legal-historical lens. Some Presidents (Abraham Lincoln, Franklin Roosevelt, George W. Bush) have historically relied on Article II authority for detention, while others (Ulysses Grant, Barack Obama) have disclaimed the notion that such authority exists. Clarifying the scope and source of the Presidential detention authority over citizens bears both theoretical and real-world relevance. Theoretically, it lies at the confluence of two central American constitutional traditions – the separation of powers, and the protection of …

Psychosocial Sequelae Of Homicide Among Murder Victims' Family Members: An Appraisal Of Depression, Grief, And Posttraumatic Stress, Sarah Kopelovich
Dissertations, Theses, and Capstone Projects
The current investigation explored what is known regarding the psychological sequelae of the post-homicide experience for murder victims' family members and friends (MVFM). Participants were also asked about whether they felt they had attained closure, a term which populates anecdotal and theoretical accounts of MVFM's experience. Previous literature guided a theoretical definition of closure as a dimensional construct that represents adaptive functioning following a murder, and includes (1) absence of disabling symptomatology, (2) absence of ruminations about the event or murder victim, and (3) subjective return to baseline functioning. This quasi-experiment consisted of a between-subjects cross-sectional design. The dependent variable …

Sensitizing Jurors To Factors Influencing The Accuracy Of Eyewitness Identification: Assessing The Effectiveness Of The Henderson Instructions, Angela M. Jones
Dissertations, Theses, and Capstone Projects
Recently, the New Jersey Supreme Court determined that jurors may not be able to effectively evaluate eyewitness evidence (New Jersey v. Henderson, 2011). Research generally supports this contention, finding that jurors do not take into account factors surrounding the commission of the crime and identification when determining the reliability of an identification (Devenport et al., 1997). Courts have implemented various safeguards to assist jurors in evaluating eyewitness evidence, including judicial instructions and expert testimony. The New Jersey Supreme Court proposed the use of judicial instructions and suggested their use would reduce the need for expert testimony. The current …
