Understanding The Costs Of Experiential Legal Education, Martin J. Katz
Understanding The Costs Of Experiential Legal Education, Martin J. Katz
Sturm College of Law: Faculty Scholarship
Law schools across the country are under pressure to do two seemingly contradictory things. First, we must do a better job of preparing our graduates for practice. Most commentators, including me, believe that this requires law schools to increase the quantity and quality of experiential education we provide. At the same time, law schools are under pressure to control costs. If we do not do so, we risk pricing a large and growing segment of the population out of our market. Can law schools meet both of these mandates simultaneously? The received wisdom seems to be that experiential education is …

Trademark Laundering, Useless Patents, And Other Ip Challenges For The Marijuana Industry, Sam Kamin, Viva Moffat
Trademark Laundering, Useless Patents, And Other Ip Challenges For The Marijuana Industry, Sam Kamin, Viva Moffat
Sturm College of Law: Faculty Scholarship
Marijuana law is changing rapidly in the United States today – since 1996, 23 states and the District of Columbia have legalized medical marijuana and five jurisdictions have made marijuana legal for all adults. Because marijuana remains a prohibited substance under federal law, however, the states are significantly limited in their ability to control marijuana policy within their borders. For example, because banking is regulated by the federal government, state-licensed marijuana businesses cannot gain full access to banking services; because bankruptcy is a federal benefit, it is unavailable to those involved in the business of violating federal law.

The Silliness Of Erisa: The Plan Is Not The Only Proper Party Defendant In An Erisa Benefits Claim, Donald T. Bogan
The Silliness Of Erisa: The Plan Is Not The Only Proper Party Defendant In An Erisa Benefits Claim, Donald T. Bogan
Marquette Benefits and Social Welfare Law Review
ERISA recites in § 502(d)(1) that a plan can sue and be sued as an entity. Does such a legislative pronouncement, in and of itself, establish the plan as a juristic person? Further, does Congress’s declaration that a plan can be sued suggest that no other person or entity can be held liable in an ERISA § 502(a)(1)(B) benefits claim? Relying upon ERISA § 502(d)(1), long-standing authority in the Ninth Circuit Court of Appeals, and in other circuits, holds that the plan, and only the plan, is a proper party defendant in an ERISA § 502(a)(1)(B) benefits claim. That is …

Legitimizing Bankruptcy Petition Preparers: A Sociolegal Prescription For Change, 89 American Bankruptcy Law Journal 269 (2015) (Peer-Reviewed Journal), Michael D. Sousa
Sturm College of Law: Faculty Scholarship
Individuals who need to file for bankruptcy often find themselves confronted with the very real dilemma of desperately needing financial relief on the one hand and affording the high costs of accessing the bankruptcy law system on the other. The decision to resort to bankruptcy comes at a financially precarious time in most peoples’ lives and often after an exogenous life event pushes them over the financial precipice. Given that many consumer debtors come from the lower middle class and working class, many have a difficult time finding the funds to pay for the necessary access costs, most notably, attorney …

Invisible: My Experiences With The Undocumented And Abused, Anna Paden Carson
Invisible: My Experiences With The Undocumented And Abused, Anna Paden Carson
VA Engage Journal
As a legal advocate at Tapestri, Inc. in Atlanta, Georgia this summer, I saw many of my immigrant and refugee clients consumed by fear, desperation, and insecurity, and I quickly realized that many of the women I helped only contacted Tapestri because they truly had nowhere else to turn. They were victims of domestic violence and usually living in America undocumented, making the seriousness of their situations that much more intense and pressing. These women were trapped and alone, and Tapestri’s role was to help them in any way we could.
This article explores what I learned throughout my eight-week …

Read, White, And Blue: Prosecutors Reading Inmate Emails And The Attorney-Client Privilege, 48 J. Marshall L. Rev. 1119 (2015), Danielle Burkhardt
UIC Law Review
This Comment addresses whether the attorney-client privilege should extend to emails exchanged between an inmate and his or her attorney over TRULINCS, the prison email system. Section II describes the history of the attorney-client privilege, and compares and contrasts the federal privilege with the New York state privilege in order to directly address Dr. Ahmed’s conflict. Section III juxtaposes other forms of privileged attorney-client contact with inmate emailing, and discusses the confidentiality agreement provided through the prison email system, TRULINCS. Finally, Section IV proposes a fiscally responsible, efficient, and convenient solution to the possible extension of the attorney-client privilege to …
Demand Side Reform In The Poor People's Court, Jessica K. Steinberg
Demand Side Reform In The Poor People's Court, Jessica K. Steinberg
Connecticut Law Review
A crisis in civil justice has seized the lowest rungs of state court where the great majority of American justice is meted out. Nineteen million civil cases are filed each year in the so-called "poor people's court, " and seventy to ninety-eight percent of those matters involve an unrepresented litigant who is typically low-income and often a member of a vulnerable population. This Article challenges the predominant scholarly view in favor of "supply side" remedies for improving access to justice-that is, remedies focused exclusively on supplying counsel to litigants, either through adoption of "civil Gideon, " a universal civil right …

Making Turner A Reality - - Improving Access To Justice Through Court-Annexed Resource Centers And Same Day Presentation, Stacy Brustin
Scholarly Articles
This article will propose recommendations for implementing meaningful "alternative procedural safeguards." It will highlight a program that uses an innovative model of pro se assistance and limited representation, and will discuss the limitations that even the most innovative programs face in trying to offer adequate alternatives to full representation. The article will also analyze the ethical obstacles that court-based assistance programs face, and offer strategies that attorneys can use to meet their ethical duties regarding confidentiality, competence, avoidance of conflicts of interest, and independence of professional judgment.
While the procedural safeguards that the Court suggests in Turner might, in theory, …
