Integrating Social Justice For Health Professional Education: Self-Reflection, Advocacy, And Collaborative Learning, Lena Hatchett, Nanette Elster, Katherine Wasson, Lisa Anderson, Kayhan Parsi Jan 2015

Integrating Social Justice For Health Professional Education: Self-Reflection, Advocacy, And Collaborative Learning, Lena Hatchett, Nanette Elster, Katherine Wasson, Lisa Anderson, Kayhan Parsi

Journal of Health Ethics

Justice as fair and equal treatment for all is one of the core visions for health professional education to reduce racial and economic health disparities in bioethics, nursing and medicine. However, the current reality of deeply entrenched structural inequities across race, class, gender, and social privilege make it a challenge for students to become aware of practical health equity solutions. This paper illustrates how faculty and students can build their understanding of health equity solutions in health professional education through self-reflection, self-direction, advocacy, and collaborative learning opportunities. We provide lessons learned and teaching resources from nursing, medicine, and law.

Identity Contests: Litigation And The Meaning Of Social-Movement Causes, Mary Ziegler Jan 2015

Identity Contests: Litigation And The Meaning Of Social-Movement Causes, Mary Ziegler

Scholarly Publications

What do we mean by a right to life? Should—or does—such a right cover only antiabortion claims? Or should the term apply more broadly—to debates about class and welfare, about the death penalty, or even about human rights? In the abortion wars, litigation strategy has helped to dictate the answers to these questions. Historians and legal scholars have studied the tensions between lawyers and the lay actors they represent, chronicling how lawyers modify and even limit the social changes activists demand. By putting the attorney-client relationship center stage, scholars have sometimes obscured an equally important story about how litigation strategy—as …

The United States As A Refuge State For Child Abductors: Why The United States' Fails To Meet Its Own Expectations Relative To The Hague Convention, Andrew Zashin

Faculty Publications

This paper asserts that the only way true progress can be made regarding this problem is for the United States to acknowledge that this serious problem actually exists. One has to look beyond the feel-good statistics and congratulatory press releases to see that the existing system, including the application of the Hague Convention on Child Abduction, fails LBPs. Until the nature and scope of the problem is identified and examined, the United States will continue to be a refuge state for child abductors.

Biglaw Identity Capital: Pink And Blue, Black And White, Eli Wald Jan 2015

Biglaw Identity Capital: Pink And Blue, Black And White, Eli Wald

Sturm College of Law: Faculty Scholarship

This Article advances a new capital framework for understanding the bargain between large law firms and their lawyers, depicting BigLaw relationships not as basic labor-salary exchanges but rather as complex transactions in which large law firms and their lawyers exchange labor and various forms of capital — social, cultural, and identity. First, it builds on the work of Pierre Bourdieu regarding economic, cultural, symbolic, and social capital by examining the concepts of positive and negative capital, exploring the meaning of capital ownership by entities, and developing the notion of identity capital — the value individuals and institutions derive from their …

Identity Work Within And Beyond The Professions: Toward A Theoretical Integration And Extension, Douglas A. Lepisto, Eliana Crosina, Michael G. Pratt

Management Faculty Publications

Chapter from Desilva, A. and M. Aparicio (Eds.), International Handbook of Professional Identities. Rosemead, CA: Scientific & Academic Publishing.

Our chapter examines identity work within and beyond the professions. To lend structure to this emerging perspective, we being by forwarding a general theoretical model of identity work. We then reexamine and extend this model by examining identity work amongst professionals. To do so, we first depend connections with literature on the professions to highlight salient and unique dynamics facing this occupational group. We then assess these dynamics in light of our model. Specifically, we show how an examination of …

A Systematic Evaluation Of A Multidisciplinary Social Work– Lawyer Elder Mistreatment Intervention Model, Victoria M. Rizzo, David Burnes, Amy Chaify

Social Work Faculty Scholarship

This study introduces a conceptually based, systematic evaluation process employing multivariate techniques to evaluate a multidisciplinary social work–lawyer intervention model (JASA-LEAP). Logistic regression analyses were used with a random sample of case records (n = 250) from three intervention sites. Client retention, program fidelity, and exposure to multidisciplinary services were significantly related to reduction in mistreatment risk at case closure. Female gender, married status, and living with perpetrator significantly predicted unfavorable outcomes. This study extends the elder mistreatment program evaluation literature beyond descriptive/bivariate evaluation strategies. Findings suggest that a multidisciplinary social work–lawyer elder mistreatment intervention model is a successful …

Three Dichotomies In Lawyers’ Ethics (With Particular Attention To The Corporation As Client), Stephen Pepper Jan 2015

Three Dichotomies In Lawyers’ Ethics (With Particular Attention To The Corporation As Client), Stephen Pepper

Sturm College of Law: Faculty Scholarship

Three usually unexpressed, and too often unnoticed, conceptual dichotomies underlie our perception and understanding of lawyers’ ethics. First, the existence of a special body of professional ethics and professional regulation presupposes some special need or risk. Criminal and civil law are apparently insufficient. Ordinary day-to-day morality and ordinary ethics, likewise, are not considered to be enough. What is the risk entailed by the notion of a profession that is special; who needs protection, and from what? Two quite different possible answers to this question provide the first of the three dichotomies examined in this article: one can understand the risk …

A Fair Day's Wages: Liberty, Legality, And Liability Among Denver's Day Laborers, Camden Ryan Bowman Jan 2015

A Fair Day's Wages: Liberty, Legality, And Liability Among Denver's Day Laborers, Camden Ryan Bowman

Electronic Theses and Dissertations

Day laborers occupy an essential position in Denver’s booming construction industry. Day laborers make up a highly flexible, highly effective workforce able to respond to market changes. For day laborers, informal day-labor gathering points provide increased control over working hours and employee-employer relationships when compared to traditional wage labor. Still, recent legislation and policies around irregular migration has forced large numbers of workers who may have benefited from the stability of full-time regular employment into the informal sector. The day laborers’ flexibility also exposes them to employers constantly inventing ways to deny them the wages and benefits they are owed. …

Difference Blindness Vs. Bias Awareness: Why Law Firms With The Best Of Intentions Have Failed To Create Diverse Partnerships, Russell G. Pearce, Eli Wald Jan 2015

Difference Blindness Vs. Bias Awareness: Why Law Firms With The Best Of Intentions Have Failed To Create Diverse Partnerships, Russell G. Pearce, Eli Wald

Sturm College of Law: Faculty Scholarship

This Article uses the example of BigLaw firms to explore the challenges that many elite organizations face in providing equal opportunity to their workers. Despite good intentions and the investment of significant resources, large law firms have been consistently unable to deliver diverse partnership structures - especially in more senior positions of power. Building on implicit and institutional bias scholarship and on successful approaches described in the organizational behavior literature, we argue that a significant barrier to systemic diversity at the law firm partnership level has been, paradoxically, the insistence on difference blindness standards that seek to evaluate each person …

In-House Risk, Eli Wald Jan 2015

In-House Risk, Eli Wald

Sturm College of Law: Faculty Scholarship

Over the last thirty years or so, as the number of in-house counsel rose and their role increased in scope and prominence, increased attention has been given the various challenges these lawyers face under the ABA Model Rules of Professional Conduct, from figuring out who is the client the in-house lawyer represents, to navigating conflicts of interest, maintaining independence, and engaging in a multijurisdictional practice of law. Less attention, to date, has been given to business risk assessment, perhaps in part because that function appears to be part of in-house counsel’s role as a business person rather than as a …
