Legal Education In Transition: Trends And Their Implications, Michael A. Millemann, Sheldon Krantz
Legal Education In Transition: Trends And Their Implications, Michael A. Millemann, Sheldon Krantz
Faculty Scholarship
This is a pivotal moment in legal education. Revisions in American Bar Association accreditation standards, approved in August 2014, impose new requirements, including practice-based requirements, on law schools. Other external regulators and critics are pushing for significant changes too. For example, the California bar licensing body is proposing to add a practice-based, experiential requirement to its licensing requirements, and the New York Court of Appeals, New York’s highest court, is giving third-year, second semester students the opportunity to practice full-time in indigent legal services programs and projects. Unbeknown to many, there have been significant recent changes in legal education that …

Assessing Experiential Learning, Jobs And All: A Response To The Three Professors, Robert J. Condlin

Does clinical practice experience improve a law student’s chances of getting a legal job? If not, would it, if employers were given better information about that experience? And if not, are there other reasons to justify a law school’s decision to fund a clinical program? The answer to the first two questions is almost certainly no. For many reasons—the uneven and situation-driven nature of clinical practice experience, the Delphic quality of practice evaluations, the availability of more effective in-house training options, and the like—most private law firms prefer to trust conventional academic credentials more than practice experience in deciding whom …
Four Futures Of Legal Automation, Frank A. Pasquale, Glyn Cashwell
Four Futures Of Legal Automation, Frank A. Pasquale, Glyn Cashwell
Faculty Scholarship
Simple legal jobs (such as document coding) are prime candidates for legal automation. More complex tasks cannot be routinized. So far, the debate on the likely scope and intensity of legal automation has focused on the degree to which legal tasks are simple or complex. Just as important to the legal profession, however, is the degree of regulation or deregulation likely in the future.
Situations involving conflicting rights, unique fact patterns, and open-ended laws will remain excessively difficult to automate for an extended period of time. Deregulation, however, may effectively strip many persons of their rights, rendering once-hard cases simple. …

Most non-profit law schools generate public goods of enormous value: important research, service to disadvantaged communities, and instruction that both educates students about present legal practice and encourages them to improve it. Each of these missions informs and enriches the others. However, technocratic management practices menace law schools’ traditional missions of balancing theory and practice, advocacy and scholarly reflection, study of and service to communities. This article defends the unity and complementarity of law schools’ research, service, and teaching roles. (For those short on time, the chart on pages 45-46 encapsulates the conflicting critiques of law schools which this article …

Law School Based Incubators And Access To Justice – Perspectives From Deans, Patricia E. Salkin, Ellen Suni, Niels Schaumann, Mary Lu Bilek
Journal of Experiential Learning
At the end of February 2015, law professors, law deans, incubator staff and attorneys, and self-selected others gathered at California Western School of Law for the Second Annual Conference on Law School Incubators and Residency Programs. The incubators that are the subject of this article tend to focus on transition to law practice and access to justice, and some are also working to incorporate technology for the practice of law as a means of enhancing access to justice. As more law schools decide to host, sponsor or offer an incubator, and following our panel discussion at the February 2015 incubator …

Singapore Management University Report To Stakeholders 2014 - 2015, Singapore Management University
Report to Stakeholders
This has been a landmark year for both Singapore and Singapore Management University (SMU) with SG50 and SMU15 celebrations marking the nation's 50 years and University's 15 years of progress respectively. The University was honoured to host Singapore’s Prime Minister Mr Lee Hsien Loong who delivered the 7th Ho Rih Hwa Leadership in Asia Public Lecture. This was especially poignant as Singapore’s first Prime Minister Mr Lee Kuan Yew gave the series’ inaugural lecture in 2002. Mr Lee Hsien Loong discussed the significant challenges facing Singapore over the next 50 years. You can read about his thought-provoking lecture in one …

Malaysia’s story is one of pluralism. Like many nations in Southeast Asia, its borders are not drawn along ethnic lines. Immigration and the influence from colonial European powers were particularly prominent in Malaysia because of its many important ports. Thus, many aspects of the country – its economy, its people – are very different on the coasts than they are in the interior of the country, a distinction which generally mirrors the divide between urban and rural areas as well.

Haiti still reels from the devastating effects of the January 12, 2010 earthquake that killed over 300,000 people, rendered one in seven Haitians homeless, and wreaked $9 billion of damage in a country whose 2009 GDP was only $7 billion. At least 85,000 people still live in internally displaced person camps (IDP camps) and many have moved back into shoddy structures that would not survive another earthquake. The cholera epidemic that struck Haiti in the wake of the earthquake has been characterized by the Centers for Disease Control and Prevention (CDC) as “the worst cholera outbreak in recent history,” killing …

The Curious Case Of Competition And Quality, Maurice Stucke, Ariel Ezrachi
The Curious Case Of Competition And Quality, Maurice Stucke, Ariel Ezrachi

Alongside the consideration of price, competition authorities recognize that quality can be as, if not more, important in some markets. But as competition authorities also recognize, identifying the dimensions of competition important to many consumers is difficult. Even when these dimensions of quality are identified, measuring them represents additional challenges.
To circumvent these challenges, competition authorities rely on several heuristics when assessing a merger’s, cartel’s or monopolistic restraint’s impact on quality. Often the heuristics work well for the competition authorities.
Our paper, however, identifies several scenarios where these heuristics break down, when competition and quality are not positively correlated, and …

Wanting To Do More But Bound To Do Less: A Law Librarian's Dilemna, Paul Mclaughlin
Law Library Faculty Scholarship
The role of the law librarian has changed from managing the contents of a library’s collection of books to knowing how to find information sources located around the world contained in a variety of formats, taking part in instruction, and participating in networking activities. Law librarians are constrained by legal and professional codes. If they are cautious, law librarians can assist, instruct, and reach out to public patrons and students while operating within the professional guidelines that govern them.

Stemming The Tide Of Aboriginal Incarceration, Miriam Kelly, Hilde Tubex
Stemming The Tide Of Aboriginal Incarceration, Miriam Kelly, Hilde Tubex
The University of Notre Dame Australia Law Review
Western Australia’s prison population has the highest rate of Aboriginal over-representation in Australia. Research on the criminogenic effect of imprisonment suggests that the use of imprisonment as a deterrent to future offending is not empirically supported and that imprisonment may in fact contribute to further offending. Consequently, this article explores theoretical debates surrounding penality as a way to inform alternative crime control strategies to imprisonment. It will be argued that any strategy to reduce Aboriginal imprisonment rates could benefit from a perspective that views Aboriginal imprisonment as a manifestation of Aboriginal resistance to settler colonial dominance.

As California’s Local Control Funding Formula (LCFF) came into effect in 2013, districts were given more flexibility to use state resources and create a new school finance system to improve/increase services for students with greater needs for support, including English Learners (ELs), students from low-income backgrounds, and foster youth. Local Education Agencies (LEAs) were tasked with preparing the Local Control and Accountability Plans (LCAPs) to describe how districts use their plans to meet their annual goals for all students. To aid LEAs in their design and implementation of programs to address the needs of ELs, Californians Together, the California Association …
