Regulating The Speech Of Judges And Lawyers: The First Amendment And The Soul Of The Profession, Rodney A. Smolla Feb 2015

Regulating The Speech Of Judges And Lawyers: The First Amendment And The Soul Of The Profession, Rodney A. Smolla

Florida Law Review

The legal profession has historically asserted moral and legal authority to substantially control the speech of judges and lawyers. This impulse to control the speech of judges and lawyers is driven by many of the profession’s most strongly held interests and values. These include such interests as ensuring the fair administration of justice, the promotion of respect for the rule of law, the preservation of public confidence in the legal system, the preservation of the appearance of judicial impartiality, the maintenance of professionalism, and the safeguarding of the dignity of the profession. Some of these interests are palpable and may …

Nurturing Young Learners In Practice: A Case Study Of Key Teacher Dispositions That Support Child Centered Practice In An Urban Preschool Environment, Lorraine Ricchezza

Theses and Dissertations

This dissertation examines an educator's disposition to positively impact children's cognitive and social emotional development in the preschool setting as evidenced in child centered practices that arouse curiosity, foster social interaction, and promote children's learning as expressed in interpersonal interactions that affirm differences among young children in an urban preschool setting. Through examination and interpretation, this study delineates educator perspectives on child differences and reciprocal relationships as integral to developmentally appropriate practice. Seven female educators at the ABC Elementary School in Urban City, New Jersey participated in this study. This study involved key data sources. During 8 months of data …

Class Actions And Justiciability, Sergio J. Campos Feb 2015

Class Actions And Justiciability, Sergio J. Campos

Florida Law Review

A lingering issue in class action law concerns the case or controversy requirement of Article III, otherwise known as the requirement of justiciability. For purposes of justiciability doctrines such as standing, mootness, and ripeness, is the class action brought by all class members, some class members, or just the class representative?

This Article argues that the answer should be none of the above—it should be the class attorney. This Article first shows that the function of the class action is to assign dispositive control of, and a partial beneficial interest in, the class members’ claims to the class attorney. Put …

Introspection Through Litigation, Joanna C. Schwartz Feb 2015

Introspection Through Litigation, Joanna C. Schwartz

Notre Dame Law Review

This Article contends that there is a bright side to being sued: organizational defendants can learn valuable information about their own behavior from lawsuits brought against them. Complaints describe allegations of wrongdoing. The discovery process unearths documents and testimony regarding plaintiffs’ allegations. And in summary judgment briefs, expert reports, pretrial orders, and trial, parties marshal the evidence to support their claims. Each of these aspects of civil litigation can bring to the surface information that an organization does not have or has not previously identified, collected, or recognized as valuable. This information, placed in the hands of an organization’s leaders …

Harmonizing Third-Party Litigation Funding Regulation, Victoria A. Shannon Feb 2015

Harmonizing Third-Party Litigation Funding Regulation, Victoria A. Shannon

Cardozo Law Review

Third-party litigation funding is no longer a new phenomenon, but rather is a mainstay in global commerce and dispute resolution. Yet many observers still consider the third-party litigation funding industry as a "wild west" due to a lack of regulation in many countries. Some of the countries that have regulations suffer from a lack of uniformity and an array of conflicting laws at the sub-national level (i.e., the laws of states, provinces, territories, etc.). For example, the United States has a confusing patchwork of state laws on third-party litigation funding. This Article proposes harmonizing the regulatory framework for third-party litigation …
