Thirty Years Of Jack Sammons: An Appreciation Symposium Dinner Speech October 2, 2014, Timothy W. Floyd
Mercer Law Review
I have been asked to provide a brief overview of Jack's work and his career. Of course, that is an impossible task. No overview of Jack's career could be brief. He has had a long and productive career, and his work is still going strong. But Jack is not just prolific; his work is so wide-ranging that no brief summary could do it justice. Moreover, as many of you know, his work is sophisticated, complex, and not easily summarized.
Preventing Legal Malpractice And Disciplinary Complaints: Ethics Audits As A Risk-Management Tool, Susan Saab Fortney
Preventing Legal Malpractice And Disciplinary Complaints: Ethics Audits As A Risk-Management Tool, Susan Saab Fortney
Faculty Scholarship
This column examines the value of firm lawyers conducting and supporting ethics audits as an integral feature of a comprehensive risk-management program. For decades, legal malpractice experts have urged lawyers to implement systems, policies, and procedures related to the delivery of legal services. Once a firm adopts systems, policies, and procedures, a meaningful risk-management system requires a periodic examination to monitor lawyers’ compliance. Rather than waiting for a professional liability insurer to recommend or require such a systematic examination, proactive firm leaders and lawyers should seriously consider devoting time and resources to periodic ethics audits.

"Fair, Reasonable And Adequate" According To Who? Cy Pres Distributions That Result In Cheap Settlements And Generous Attorney Fees, But No Financial Benefit To Class Members, Linda Sandstrom Simard
Suffolk University Law School Faculty Works
In her recent article, Professor Rhonda Wasserman argues that class action settlements that distribute funds cy pres raise a very serious risk of prejudice to absent class members. The problem, she asserts, is the temptation for class counsel to sell out the interests of absent class members in exchange for a discounted settlement for the defendant and a generous fee for class counsel. To illustrate her concern, she cites the $9.5 million settlement in Lane v. Facebook that directed approximately $6.5 million to a nascent charity that was controlled -- at least partially -- by the defendant, $3 million to …

Should The Medium Affect The Message? Legal And Ethical Implications Of Prosecutors Reading Inmate-Attorney Email, Brandon P. Ruben
Should The Medium Affect The Message? Legal And Ethical Implications Of Prosecutors Reading Inmate-Attorney Email, Brandon P. Ruben
Fordham Law Review
The attorney-client privilege protects confidential legal communications between a party and her attorney from being used against her, thus encouraging full and frank attorney-client communication. It is a venerable evidentiary principle of American jurisprudence. Unsurprisingly, prosecutors may not eavesdrop on inmate-attorney visits or phone calls or read inmate-attorney postal mail. Courts are currently divided, however, as to whether or not they can forbid prosecutors from reading inmate- attorney email.
This Note explores the cases that address whether federal prosecutors may read inmates’ legal email. As courts have unanimously held, because inmates know that the Bureau of Prisons (BOP) monitors all …
Liberalizing Trade In Legal Services Under Asia-Pacific Ftas: The Asean Case, Pasha L. Hsieh
Liberalizing Trade In Legal Services Under Asia-Pacific Ftas: The Asean Case, Pasha L. Hsieh
Research Collection Yong Pung How School Of Law
The article examines the liberalization of trade in legal services in the Association of the Southeast Asian Nations (ASEAN) and its reform prospects to meet the challenges of multi-jurisdictional practice. It argues that while the ten-country bloc pledges to progressively liberalize the legal sector, ASEAN commitments under free trade agreements (FTAs) constitute merely ‘paper commitments’. To achieve the goal of the ASEAN Economic Community to form a single market and production base, a feasible, incremental roadmap is imperative to integrate the legal services market. The article first analyzes the economic impact of foreign law firms on ASEAN’s legal capacity building …

Rebuilding The Classification System Of The Ocean Economy, Dr. Kwang Seo Park, Dr. Judith T. Kildow
Rebuilding The Classification System Of The Ocean Economy, Dr. Kwang Seo Park, Dr. Judith T. Kildow
Journal of Ocean and Coastal Economics
Many ocean countries have attempted to estimate the size of the ocean economy or industry. However, it is difficult to compare the ocean economy among countries because the definition, classification standard, and scope vary within each country. This study aims to provide concrete practical proposals for universal definition, classification standard, and scope of the ocean economy. With regard to the definition of the ocean economy, a combination of industrial and geographical perspectives is considered simultaneously. As a result, the ocean economy is defined as the economic activities that directly or indirectly take place in the ocean and use outputs from …

Should The Law Preserve Party Control? Litigation Investment, Insurance Law, And Double Standards, Anthony J. Sebok
Should The Law Preserve Party Control? Litigation Investment, Insurance Law, And Double Standards, Anthony J. Sebok
William & Mary Law Review
Litigation investment, sometimes known as litigation finance, is increasingly accepted around the world. Once prohibited as champerty, litigation investment is now embraced in England, Canada, and Australia, as well as in many civil law nations. In the United States, the development of a robust market for investment in litigation has been met by various objections. One objection is that litigation investment interferes with the autonomy of lawyers. A second objection is that it promotes frivolous litigation.
This Article takes up a popular argument against litigation investment: the legal system should not encourage parties to sell their control over litigation that …
