Building Legal Competency: Foundations For A More Effective Criminology And Criminal Justice Discipline, Claire Nolasco, Rolando V. Del Carmen, Kevin F. Steinmetz, Michael S. Vaughn, Aneta Spaic

Criminology and Criminal Justice Faculty Publications (Archived)

This article argues for the need to build legal competency in the discipline of criminal justice and criminology through incorporating law courses in its PhD program curriculum, whether as black letter law (i.e. criminal law, criminal procedure, courts), sociology of law, or socio-legal studies (i.e. law and society courses). Through requiring law courses as a necessary and integral part of the curriculum, and recognizing the mainstream impact of these courses, the discipline stands to enrich the field of legal studies in criminology and criminal justice. The discipline’s need and demand for law trained tenure track faculty with PhD credentials can …

Probing The Law On Probation: Suggestions For Reform, Darius Chan Feb 2015

Probing The Law On Probation: Suggestions For Reform, Darius Chan

Research Collection Yong Pung How School Of Law

To any criminal law practitioner, the Court’s power to grant probation as a sentencing option is of significant importance. Probation represents, to their clients, the key out of incarceration.Section 5 of the Probation of Offenders Act (Cap 252, 1985 Rev Ed) (“POA”) sets out the power of the Singapore Courts to grant probation. Section 5 uses three peculiar terms to create three categories of offences, namely:1. Sentences which are “fixed by law”; 2. Sentences carrying “specified minimum sentences”; and 3. Sentences carrying “mandatory minimum sentences”.For the latter two categories of offences, the Court can only grant probation if the offender:1. …

Harmonizing Third-Party Litigation Funding Regulation, Victoria Sahani Feb 2015

Harmonizing Third-Party Litigation Funding Regulation, Victoria Sahani

Faculty Scholarship

Third-party litigation funding is no longer a new phenomenon, but rather is a mainstay in global commerce and dispute resolution. Yet many observers still consider the third-party litigation funding industry as a “wild west” due to a lack of regulation in many countries. Some of the countries that have regulations suffer from a lack of uniformity and an array of conflicting laws at the sub-national level (i.e., the laws of states, provinces, territories, etc.). For example, the United States has a confusing patchwork of state laws on third-party litigation funding. This Article proposes harmonizing the regulatory framework for third-party litigation …

The Morality Of Law Practice, Geoffrey C. Hazard Jr. Feb 2015

The Morality Of Law Practice, Geoffrey C. Hazard Jr.

UC Law Journal

This is an inquiry about the morality of lawyers and law practice. Some modern academic critiques hold law practice to be immoral or unjust as compared to the standard of “common morality” or of the sense of “justice” shared in the community. This Essay advances a different standard of reference, one that takes into account the pervasive conflicts within society and the limitations on the government’s ability to get at the truth. These limitations generate a role for lawyers as empowered figures who employ government authority as partisans and confidantes for their clients. That role is comparable to other roles …

Dunning-Kruger And You: Evaluating Your Technological Competence With The Legal Tech Audit, Jason Tubinis Jan 2015

Dunning-Kruger And You: Evaluating Your Technological Competence With The Legal Tech Audit, Jason Tubinis

Continuing Legal Education Presentations

There’s an enormous skill set you must develop as an attorney. One skill that is too often neglected, though, is the ability to utilize technology to ease the burden of all your tasks for the benefit or your firm, your client, and most importantly, yourself.

This paper is a public service announcement, a reminder to question your preconceptions about what you do and how you do it. It’s a cautionary warning, the one discussed previously about the new ABA comment regarding an attorney’s duty of competence regarding technology. Just because you’re doing fine with technology doesn’t mean you can’t be …

Perceptions Of Collaboration And Service Integration As Strategic Alternatives: An Examination Of Social Service Nonprofit Organizations In The Late 1990s, Jennifer A. Wade-Berg, Vanessa Robinson-Dooley

Journal of Public Management & Social Policy

Nonprofit organizations (NPOs) have historically dealt with the problem of trying to build organizational capacity while simultaneously dealing with scarce resources. Consequently, practitioners and scholars continue to offer assistance to nonprofits in the development of techniques aimed at addressing these situations. Recent literature shows a push towards innovation, the use of new organizational tax structures, and/or the use of commercial revenue generating activities as plausible strategic alternatives for dealing with declining resources. While these techniques show promise, they typically are reserved for larger nonprofits (as measured by their funding base) and those nonprofits with missions that lend themselves for such …
