Two Case Studies Of The Contribution Of Emotional Intelligence, Communication Style, Job Competency, Vision, And Ethics To Constituent Buy-In For Leaders, David M. Schall
Dissertations
The purpose of this study was to investigate the similarities and dissimilarities of leadership traits that create leader buy-in for an educational leader and a football coach; specifically, emotional intelligence, communication style, job competency, vision, and ethics, between an educational leader and a sports coach. The rationale of this study was to create recent literature that provided insight for leaders in multiple areas on how to transfer leadership skills to establish common goals and missions within their organizations. Data was collected using a survey completed by 154 volunteer participants, along with interviews of 12 volunteer participants. A focus group of …
Failing Ninth-Grade Students In A Missouri School District, And The Comparison To Inadequate Learning Resources, Eric Wayne Ramsey
Failing Ninth-Grade Students In A Missouri School District, And The Comparison To Inadequate Learning Resources, Eric Wayne Ramsey
Dissertations
This study involved a mixed design to generate the perceptions of students and teachers about failing ninth-grade students and the impact of learning resources. The participants in this study were a purposive selection of ninth-grade students and ninth-grade teachers in one Missouri school district. The conceptual framework of this study was based on the premise that ninth-grade students who failed multiple classes also lacked learning resources. The learning resources were categorized into cultural and physical resources. To determine if learning resources had an impact on the ninth-grade students’ academic performance, the perceptions of the failing ninth-grade students were analyzed through …

Early Literacy Acquisition With The Inclusion Of The Five Components Of Research Based Reading Instruction, Jill Wright
Dissertations
The purpose of this study was to examine the existing research on early literacy and the types of approaches used in schools at the time of this writing. Although researchers could not agree on which types of reading programs are the most effective, there was a large amount of research supporting the work done in 2000 from the National Reading Panel, emphasizing the importance of the five components of reading: phonemic awareness, phonics, vocabulary, fluency, and comprehension. The study site historically used a traditional Balanced Literacy program, and reported proficiency scores in the 30th percentile overall. This research study investigated …

The Occupational Benefits Of Children Farming, Ellie Edrissi
OCCUPATION: A Medium of Inquiry about Health through Occupation
This paper analyses the positive outcomes of youth responsibilities, routines, autonomy, youth programs and scholarships, cultural identity, educational and life experiences through the occupation of farming during seasonal and/or after school hours. The multidimensional context of children willingly working in the agricultural industry allows positive psychological, economical, and cultural experiences while building a stronger family unity. The occupation of farming allows youth participation with the environment, social skills, inter-generational transfer of skills, and increased confidence for future aspirations as they mature to adulthood.

Building Trust And Breaking Down The Wall: The Use Of Restorative Justice To Repair Police-Community Relationships, Laura Merkey
Building Trust And Breaking Down The Wall: The Use Of Restorative Justice To Repair Police-Community Relationships, Laura Merkey
Missouri Law Review
The town of Ferguson, Missouri, captured national attention when a grand jury failed to indict Darren Wilson, a white police officer who shot and killed Michael Brown, an unarmed black teenager, three months prior. Similar citizen deaths involving police in both New York City and Cleveland have magnified the tensions felt across the country, and in many cities and communities, the community-police relationships are rapidly becoming untenable. Baltimore, Maryland, is a prime example; protests, riots, and an atmosphere of mistrust pervaded the city for months after the deaths of Michael Brown, Eric Garner, and Tamir Rice. The situation was, simply …

Part II of this Note provides a brief background of the facts and the Eighth Circuit’s ultimate holding in Ames. Part III discusses the legal history of Title VII and legislative efforts to prohibit discrimination in the workplace. Part IV examines the Eighth Circuit’s reasoning. Finally, Part V comments on the supposed limited use of summary judgment in employment discrimination cases, the reasonableness of Ames’s actions, the effect of stereotypes in employment discrimination, the role that the identity of the judiciary plays in discrimination cases, and how this case could have been prevented by appropriate human resource (“HR”) management practices. …

Ferguson And Police Use Of Deadly Force, Richard Rosenfeld
Missouri Law Review
The killing of Michael Brown, an unarmed black teenager, by Darren Wilson, a white police officer in Ferguson, Missouri, sparked widespread protests in the St. Louis area and across the nation. Protests and civil unrest resumed after a St. Louis County grand jury declined to indict the police officer.2 Protesters and commentators raised several issues related to the Ferguson incident and police use of deadly force. This Article addresses four of those issues: (1) Why Ferguson? (2) Did the Ferguson killing and ensuing civil unrest increase crime rates in St. Louis? (3) What is known about police use of deadly …

The Eighth Circuit’s decision in United States ex rel. Thayer v. Planned Parenthood addresses this very issue.9 As this Note argues, the Thayer decision not only departs from the Eighth Circuit’s previous position within the circuit split, but it also further contributes to the confusing variance of nuances and interpretations that exist regarding how to apply Rule 9(b) to FCA claims.10 Because the Thayer decision arguably increases the muddled confusion of Rule 9(b)’s application to FCA claims, it is imperative that the Supreme Court resolve the circuit split in the near future. In Part II, this Note analyzes the facts …
Restoring Chevron’S Domain, Jonathan H. Adler
Restoring Chevron’S Domain, Jonathan H. Adler
Missouri Law Review
This brief Article’s aim is not so ambitious as to praise or bury Chevron. It seeks only to make a more modest point about the Chevron doctrine and its domain.12 On the assumption that Chevron, in some form, will remain a significant part of the constellation of administrative law, this Article suggests Chevron’s domain should be defined and delimited by its doctrinal grounding. Put another way, the legal rationale for providing deference to agency interpretations of ambiguous statutory text should determine the doctrine’s scope and application. More precisely, insofar as the Court’s subsequent application and elucidation of Chevron have indicated …

I salute those who have been involved in the planning of this program and will be moderating, serving on panels, and making presentations throughout the day. I am not quite sure what my present qualifications are to be the opening speaker in such an august gathering of outstanding academics, teachers, lawyers, good government leaders, public servants, and others of distinction. My work these years of my life is largely in the field of social justice and poverty. I am no stranger to the field of law reform, however.
Enforcing Immigration Equity, Jason A. Cade
Enforcing Immigration Equity, Jason A. Cade
Fordham Law Review
Congressional amendments to the immigration code in the 1990s significantly broadened grounds for removal while nearly eradicating opportunities for discretionary relief. The result has been a radical transformation of immigration law. In particular, the constriction of equitable discretion as an adjudicative tool has vested a new and critical responsibility in enforcement officials to implement rigid immigration rules in a normatively defensible way, primarily through the use of prosecutorial discretion. This Article contextualizes recent executive enforcement actions within this scheme and argues that the Obama Administration’s targeted use of limited enforcement resources and implementation of initiatives such as Deferred Action for …

Out-Of-Pocket Spending Among Rural Medicare Beneficiaries, Erika C. Ziller Phd, Jennifer D. Lenardson Mhs, Andrew F. Coburn Phd
Access / Insurance
The majority of Medicare beneficiaries experience gaps between the care they need and costs covered by Medicare and seek supplemental coverage to meet this gap, including private plans offered by former employers or purchased individually, or public coverage through Medicaid. Since rural beneficiaries are more likely to purchase supplemental indemnity coverage individually, to participate in Medicaid, or to go without supplemental coverage altogether, it is likely that their out-of-pocket spending differs from that of urban residents, although the magnitude and direction of these differences may vary for individual beneficiaries. This study used data from the 2006-2010 Medical Expenditure Panel Survey …

Poster presented at American Association of the Study of Liver Diseases (AASLD) meeting in San Francisco California.
Objective:
Develop a urine test using a panel of select genetic and epigenetic markers for the early detection of primary and recurrent HCC.
Introduction:
Hepatocellular carcinoma (HCC) or liver cancer is an aggressive disease and one of the fastest growing cancers by incidence in the United States. Early detection is the key for effective treatment of HCC as the 5-year survival rate is 26% in early stage HCC as compared to only 2% when found after spreading to distant organs. The current marker, …

Inhalational general anesthesia results from the poorly understood interactions of haloethers with multiple protein targets, which prominently includes ion channels in the nervous system. Previously, we reported that the commonly used inhaled anesthetic sevoflurane potentiates the activity of voltage-gated K+ (Kv) channels, specifically, several mammalian Kv1 channels and the Drosophila K-Shaw2 channel. Also, previous work suggested that the S4-S5 linker of K-Shaw2 plays a role in the inhibition of this Kv channel by n-alcohols and inhaled anesthetics. Here, we hypothesized that the S4-S5 linker is also a determinant of the potentiation of Kv1.2 and K-Shaw2 by sevoflurane. Following functional expression …

How Patients Think: Assessing Clinician Competence In University Settings, Jennifer Allen

The past academic year of 2014–2015 I completed an independent research study to observe how patients assess clinician competence within a university setting. The goal of the research was twofold: first, to look at patient-clinician interactions from the patient’s perspective, and second to see if a patient’s past experiences with clinicians have any effect on their current assessment of clinician competence. The study focused on college students at the University of New Hampshire (UNH), Durham campus. In the following paragraphs, I provide a summary of the research project, methodology, and outcomes.

Hiv Knowledge Among Muslim University Women, Subha Singh

While studies have shown that HIV infections are increasing in Muslim countries, especially among the young population (Abu-Moghli et al. 2010), the prevalence of HIV infection among young Muslims in the United States is poorly understood. The United States has a Muslim population of 6.67 million and it is increasing every year. However, the CDC and other public health organizations do not include religious identification as a social category for which to gather statistics on risk behaviors and infection rates. Instead, health organizations disaggregate data on infection rates according to categories such as race, ethnicity, sex, social economic status, and …

Hiv/Aids Program Planning In Kwazulu-Natal, South Africa: Addressing Gendered Stigma, Stereotypes, And Responsibilities, Emily I. Belanus
Spectrum
Given the unequal distribution of HIV infection rates as well as the socio-cultural and economic context of Kwazulu-Natal, this program proposal intends to (1) promote and celebrate women’s self-empowerment, (2) increase awareness of the epidemic in the area while reducing AIDS-related stigma, and (3) reduce gender-based violence and gendered imbalances of power. If we wish to make any long-term, sustainable progress towards decreasing overall infection rates and increasing patient compliance, it is of utmost importance to address the gendered stigma and stereotypes associated with HIV and AIDS; without addressing the root of the epidemic, we cannot stunt its growth. Here, …

Background:
The concept of resilience is very crucial in promoting positive psychological well-being. However, this construct was never looked among married women of Karachi, Pakistan. Therefore, this study aimed to assess the prevalence and the associated risk factors of resilience in Pakistan.
Methods:
It was a cross-sectional survey, using the Wagnild Resilience Scale (RS) to assess resilience, Beck Depression Inventory II (BDI-II) for measuring depression and Trait Wellbeing Inventory for determining Life Satisfaction. Systematic sampling was employed to enroll 636 participants of aged 20 to 40 years living in two urban squatter settlements of Karachi, Pakistan. Prevalence ratio was computed …

Marketing Faculty Research and Publications
In this paper we will analyze the relationship between free market principles and ethics through an exploration of how too many business managers often approach the ideas of Adam Smith and Milton Friedman. In doing so, we aim to provide a thoughtful foundation for future discussions of how we ought to navigate this intersection. We briefly examine questions such as: What is the relationship between the “best” economy in terms of efficiency and the common good for society? Is pursuing one’s individual economic advantage the same as promoting the general interest? As we analyze and discuss these questions, specifically in …
Inside Regulatory Interpretation: A Research Note, Christopher J. Walker
Inside Regulatory Interpretation: A Research Note, Christopher J. Walker
Michigan Law Review First Impressions
We now live in a regulatory world, where the bulk of federal lawmaking takes place at the bureaucratic level. Gone are the days when statutes and common law predominated. Instead, federal agencies—through rulemaking, adjudication, and other regulatory action—have arguably become the primary lawmakers, with Congress delegating to its bureaucratic agents vast swaths of lawmaking power, the President attempting to exercise some control over this massive regulatory apparatus, and courts struggling to constrain agency lawmaking within statutory and constitutional bounds. This story is not new. Over two decades ago, for instance, Professor Lawson lamented the rise of the administrative state and …

Approximately eighty per cent of the value of most listed firms is driven by expectations of their future earning stream. Yet past and current period results are decreasingly relevant as indicators of future performance as the speed of change in business, technology, trends and markets increases. For many companies instability is the new norm, agility and preparing for future changes are essential capabilities.
This research, drawing on experiences of 30 global corporations, shows that far from being giants with slow reactions, several global corporations are able to leverage their extensive networks and their participation in a wide diversity of market …

A number of linear and cyclic peptides containing alternative arginine and cysteine residues, namely linear (CR)3, linear (CR)4, linear (CR)5, cyclic [CR]4, and cyclic [CR]5, were synthesized. The peptides were evaluated for their ability to deliver two molecular cargos, fluorescence-labeled cell-impermeable negatively charged phosphopeptide (F′-GpYEEI) and fluorescence-labeled lamivudine (F′-3TC), intracellularly in human leukemia cancer (CCRF-CEM) cells. We investigated the role of cyclization and the number of amino acids in improving the transporting ability of the peptides. The flow cytometry studies suggested that the synthesized peptides were able to work efficiently as …
