Treatment Decision Making In The Postpartum Period: Examining Women’S Preferences And Perspectives, Jenessa Danielle Deleault

Antioch University Dissertations & Theses

This research study aims to understand the medical decision-making process for new mothers who may be experiencing depression, anxiety, or psychological distress following birth, and understanding their treatment preferences. This study replicates one by Patel and Wisner (2011), and was developed from their suggestions in further research. The goal was to replicate the methodology with a more diverse sample of new mothers. The study reviews recent literature on postpartum depression and anxiety, including, symptoms, etiology, risk factors, the impact on family functioning and child development, as well as the literature on medical decision-making. Utilization Of Placebo Response In Double-Blind Psychopharmacological Studies, Contextual Perspective, Margarita Olegovna Ashirova Jan 2015

Utilization Of Placebo Response In Double-Blind Psychopharmacological Studies, Contextual Perspective, Margarita Olegovna Ashirova

Antioch University Dissertations & Theses

Placebo response has been an elusive phenomenon in the fields of medicine, medical research, and psychology. Even though it has been heavily utilized as a comparator treatment in double-blind psychopharmacological studies, the reliable definition and consistent understanding of placebo response are missing. In this contextual exploration, I outlined the state of current placebo response research and variable rates of placebo response reported in double-blind studies. I identified the gap in the literature—lack of consistent understanding of placebo response—that has led to a waste of resources by the psychopharmacological research industry. Further, I compared and contrasted the current inconsistent Western medical …

IntroductionOnly 30–40% of depressed patients treated with medication achieve full remission. Studies that change medication or augment it by psychotherapy achieve only limited benefits, in part because current treatments are not designed for chronic and complex patients. Previous trials have excluded high-risk patients and those with comorbid personality disorder. Radically Open Dialectical Behaviour Therapy (RO-DBT) is a novel, transdiagnostic treatment for disorders of emotional over-control. The REFRAMED trial aims to evaluate the effectiveness and cost-effectiveness of RO-DBT for patients with treatment-resistant depression. Methods and analysisREFRAMED is a multicentre randomised controlled trial, comparing 7 months of individual and group RO-DBT treatment with …

Personal Budgets For All? Implementing Self-Directed Support In Mental Health Services, Sherrie Hitchen, Graham R. Williamson, Mary Watkins Jan 2015

Personal Budgets For All? Implementing Self-Directed Support In Mental Health Services, Sherrie Hitchen, Graham R. Williamson, Mary Watkins

School of Nursing and Midwifery

Personal budgets provide people with more choice and control over how their needs are met and, allied to new thinking concerning individualisation of mental health care, are increasingly a feature of international governmental responses to long-term care. This study was based in an English National Health Service Health and Social Care Trust covering a large predominantly rural area. We aimed to develop self-directed support and understand more fully service-user and carer involvement in the process, using an action research design. Data collection took place between 2007 and 2011, and the project ran in three sequential spirals collecting qualitative data. Findings …

Chinese Foreign Direct Investment Into Africa In The Context Of Brics And Sino-African Bilateral Investment Treaties, Catherine Elkemann, Oliver C. Ruppel

Richmond Journal of Global Law & Business

China is now the second largest economy in the world after the United States of America and is deemed to be the most influential member of the group of leading emerging economies, the so called BRICS partnership consisting of Brazil, the Russian Federation, India, China and South Africa. According to the latest World Investment Report published by the United Nations Conference on Trade and Development (“UNCTAD”), China is also the second largest recipient of inward foreign direct investment (“IFDI”) and the third in terms of outward foreign direct investment (“OFDI”). In this context, Africa is emerging as an important destination …

The Rules And The Reality Of Petition Procedures In The Inter-American Human Rights System, Dinah Shelton Jan 2015

The Rules And The Reality Of Petition Procedures In The Inter-American Human Rights System, Dinah Shelton

Notre Dame Journal of International & Comparative Law

In this Essay, Professor Dinah Shelton draws on her personal experience as a member of the Inter-American Commission on Human Rights to discuss the underlying causes of a "crisis of commitment" to the Inter-American system of human rights. Shelton traces the roots of this crisis in large part to the Inter-American petition procedures. Giving an in-depth account of the structure of the Inter-American Commission on Human Rights and the details of the petition procedures, Shelton explores the issues of legitimacy, transparency, effectiveness, and efficiency raised by various aspects of the petitioning process, and discusses the various ways in which these …

The Anglo-Latin Divide And The Future Of The Inter-American System Of Human Rights, Paolo Carozza Jan 2015

The Anglo-Latin Divide And The Future Of The Inter-American System Of Human Rights, Paolo Carozza

Notre Dame Journal of International & Comparative Law

A former President of the Inter-American Commission on Human Rights, Paolo Carozza draws on his personal experience to identify and propose solutions for a key flaw in the Inter-American Human Rights System: the division between English-language member states and states with Latin-based languages. Terming this division "The Anglo-Latin Divide," Carozza traces the division not only to linguistic difference, but also to differences in legal traditions. He explains how the differences between Anglo tradition of common law and the Latin tradition of civil law manifest in both substantive and procedural divides within the Inter-American Human Rights system, including in sensitive areas …

The Map Is Not The Territory: How South Africa Followed The Anti-Corruption Roadmap And Got Lost Along The Way, George Langendorf Jan 2015

The Map Is Not The Territory: How South Africa Followed The Anti-Corruption Roadmap And Got Lost Along The Way, George Langendorf

University of Baltimore Journal of International Law

This paper charts the development of the anti-corruption roadmap and considers whether it has been effective in South Africa. Part I begins with an overview of the FCPA, the first and most influential anticorruption law. Part II reviews the multilateral treaties and conventions that proliferated in the 1990s and early 2000s and that outline the contemporary anticorruption roadmap. Part III focuses on the efforts of South Africa to follow the roadmap, and reviews the laws and institutions it established after acceding to the instruments and treaties described in Part II. Part IV looks at what happened next, summarizing four major …

Student Comment: Exchange Cooperation For Visas: Flaws In U.S. Immigration System Criminalizes Trafficking Victims, Laurie Culkin Jan 2015

Student Comment: Exchange Cooperation For Visas: Flaws In U.S. Immigration System Criminalizes Trafficking Victims, Laurie Culkin

University of Baltimore Journal of International Law

This student comment explores the Palermo Protocol to the United Nation’s Convention Against Transnational Organized Crime, and the United State’s response, the Trafficking Victim’s Protection Act (TVPA). Under the TVPA, the U.S. made a temporary, nonimmigrant visa, the T-Visa, available to trafficking victims illegally located in the U.S., provided that the victim cooperates with law enforcement to prosecute their trafficker. Though at first blush the TVisa seems like a valuable resource to victims who would otherwise find no immigration relief for violations of criminal and immigration law as a result of their victimization, but in practice the flawed process to …

Here follows a brief summary of Professor Bessler’s book

The Conflation Of Ethnicity And Religion In Malaysia: A Reflection, Mahmood Chandia, Kartina A. Choong Jan 2015

The Conflation Of Ethnicity And Religion In Malaysia: A Reflection, Mahmood Chandia, Kartina A. Choong

Cardozo Journal of International and Comparative Law

According to the Malaysian Constitution, a "Malay" is one who, among other things, professes the religion of Islam. All Malays are, by legal definition, at least Muslims and they are not at liberty to leave Islam since a renunciation of the Islamic faith is tantamount to a renunciation of one's legally defined ethnic identity. This constitutional conflation of ethnicity and religion, which also serves the purpose of uniting the Malays and advancing their socio-economic interests, has been a distinct feature of the social landscape of the country since 1957, when it gained independence from British rule. This Article seeks to …

Autonomous Weapons And The Problem Of State Accountability, Daniel N. Hammond Jan 2015

Autonomous Weapons And The Problem Of State Accountability, Daniel N. Hammond

Chicago Journal of International Law

Currently in development and expected to become functional in the near future, fully autonomous weapons will have the capacity to operate entirety on their own, selecting targets and completing missions without human involvement. The prospective development of these weapons has raised concerns among some scholars who fear that the weapons would be unable to meet international legal standards. One criticism consistently raised is that in the event one of these weapons commits a war crime or human rights violation, it is not clear who should be held accountable. In this context, critics have focused primarily on whether military officers, designers, …

Uefa Financial Fairplay Regulations And European Union Antitrust Law Complications, Valerie Kaplan Jan 2015

Uefa Financial Fairplay Regulations And European Union Antitrust Law Complications, Valerie Kaplan

Emory International Law Review

Financial struggles among European football clubs were far too common in the last decade. Mismanagement and overspending in the Rangers FC forced the club to go into administration and ultimately liquidate in 2012. The Rangers consistently spent more on players than the club's payroll could afford. The Union of European Football Associations observed the problem and approved Financial Fair Play Regulations (FFP) to fix these financial issues. FFP intends to introduce rationality and stabilize the financial environment of European club football. The structure of FFP makes the regulation illegal under the European Union's competition law. The predicted effect of FFP …

Wto Agricultural Trade And The Unfulfilled Promise Of Development, Destaw A. Yigzaw Jan 2015

Wto Agricultural Trade And The Unfulfilled Promise Of Development, Destaw A. Yigzaw

South Carolina Journal of International Law and Business

The World Trade Organization (WTO) was established with an alluring promise of enhancing the living standards of people around the world, creating jobs and spurring development, while ensuring equitable distribution of the fruits of trade, with particular regard to the needs of the poor. However, critics see the WTO as a mercantilist system tailored to the commercial interests of wealthy nations and their corporations, with little or no attention to the interests of the poor. What happens to agriculture affects the poor disproportionately. If spurring economic development and thereby enhancing the living standards of people is indeed the WTO’s goal, …

From Commitment To Compliance: Enforceability Of Remedial Orders Of African Human Rights Bodies, Roger-Claude Liwanga Jan 2015

From Commitment To Compliance: Enforceability Of Remedial Orders Of African Human Rights Bodies, Roger-Claude Liwanga

Brooklyn Journal of International Law

Over the last seven decades, there has been a global proliferation of international and regional human rights tribunals. But with no coercive power to enforce their judgments, these international tribunals rely either on the good faith of the State parties or on the political process for the implementation of their remedial orders. This nonjudicial approach to enforcement has showed its limits, as most State parties are noncompliant with international judgments to the detriment of human rights victims. This article recommends a new approach involving the judicialization of the post-adjudicative stage of international proceedings as an avenue to increase the enforceability …

Unilateral Non-Colonial Secession And The Criteria For Statehood In International Law, Glen Anderson Jan 2015

Unilateral Non-Colonial Secession And The Criteria For Statehood In International Law, Glen Anderson

Brooklyn Journal of International Law

The following article examines the interactions between the right of peoples to unilateral non-colonial (“UNC”) secession and the criteria for statehood in international law. In this respect a three-point thesis is developed. First, it is argued that the law of self-determination has resulted in a less strict application of the criteria for statehood based on effectiveness, particularly the effective government criterion. This means that a state created by UNC secession pursuant to the law of self-determination will not have its statehood called into question if lacks an effective government. Second, it is argued that the declaratory approach to recognition is …

Liberte, Egalite, Fraternite: The United Nations Declaration Of The Rights Of Indigenous Peoples Fails To Protect Hopi Katsinam From The Auction Block In France, Samantha K. Nikic Jan 2015

Liberte, Egalite, Fraternite: The United Nations Declaration Of The Rights Of Indigenous Peoples Fails To Protect Hopi Katsinam From The Auction Block In France, Samantha K. Nikic

Brooklyn Journal of International Law

The United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) compels member states to take action in order to protect the rights of the world’s 370 million indigenous peoples, including the right to their cultural property. Notwithstanding the UNDRIP’s robust set of protections, its status as a nonbinding piece of international law remains its ultimate and most fatal flaw. France was an enthusiastic supporter of the UNDRIP at ratification, but has effectively abandoned their position. French auction houses and courts have allowed for sales of Native American sacred property to proceed despite the objections of the Hopi Tribe. In …
