Is There A "Duty To Read"?, Charles L. Knapp
Is There A "Duty To Read"?, Charles L. Knapp
Faculty Scholarship
The notion that there is in general contract law a "duty to read" persists in the decisions of American courts. This Article explores the general question of what it may mean to say that there is a "duty to read," and concludes by suggesting what role (if any) that doctrine should play in our present-day law of contract. The Article begins by examining various ways in which the "duty to read" is commonly articulated, and compares it to other contract law concepts: the "duty to bargain in good faith" and the "duty to mitigate damages." The Article next considers a …

The Reasonable Use Doctrine In California Water Law And Policy, Brian E. Gray
The Reasonable Use Doctrine In California Water Law And Policy, Brian E. Gray
Faculty Scholarship
The cardinal principle of California water law is that all water rights, and all uses of water, must be reasonable. This seemingly simple and innocuous sentence masks a world of meaning and complexity, however, because the requirement of reasonable use embraces at least four interrelated concepts. The determination of reasonable water use is utilitarian: the law seeks to encourage relatively efficient, economically and socially beneficial uses of the state’s water resources. It is situational: the evaluation of individual reasonable use concerns not only the water right holder’s own uses but also other competing demands (both consumptive and ecological) on the …

Explaining The "Pulse Of Protoplasm": The Search For Molecular Mechanisms Of Protoplasmic Streaming, Michael Dietrich
Dartmouth Scholarship
Explanations for protoplasmic streaming began with appeals to contraction in the eighteenth century and ended with appeals to contraction in the twentieth. During the intervening years, biologists proposed a diverse array of mechanisms for streaming motions. This paper focuses on the re-emergence of contraction among the molecular mechanisms proposed for protoplasmic streaming during the twentieth century. The revival of contraction is a result of a broader transition from colloidal chemistry to a macromolecular approach to the chemistry of proteins, the recognition of the phenomena of shuttle streaming and the pulse of protoplasm, and the influential analogy between protoplasmic streaming and …

2014 Oregon General Assistance Study, Karen Cellarius, Mary Oschwald, Sandra Marie Leotti
Regional Research Institute for Human Services
In early 2014, the Oregon legislature and the state Department of Human Services (DHS) commissioned a study to gather input from consumer and non-consumer stakeholders regarding how to most effectively meet the needs of childless adults with disabilities. This study was designed to answer the following questions: (1) What services for childless adults with disabilities exist within Oregon and in other states? (2) What is the need today? and (3) What potential program structures and funding options might address the needs or the target population while also addressing any barriers experienced with the previous program? The following synopsis describes the …

Department of Pathology and Laboratory Medicine
Teratomas are unusual tumours that derived from totipotent cells with their origin from more than one or usually all three germ cells. Here authors are presenting a case of primary retroperitoneal tumour that is a rare clinical entity. A 19-year-old male presented with right lumbar pain and was found to have complex cyst with large calcification in right adrenal gland on imaging. Intraoperatively, he was found to have a solid mass with areas of soft consistency, which was excised en bloc. On gross examination, the cyst contained pieces of bone, few teeth, and hairs entangled in mucinous material. On histological …

Abstract
BACKGROUND:
To determine the outcome and cost saving by placing ultrasound guided surgical clips for tumor localization in patientsundergoing neo-adjuvant chemotherapy for breast cancer.
MATERIALS AND METHODS:
This retrospective cross sectional analytical study was conducted at the Department of Diagnostic Radiology, Aga Khan University Hospital, Karachi, Pakistan from January to December 2014. A sample of 25 women fulfilling our selection criteria was taken. All patients came to our department for ultrasound guided core biopsy of suspicious breast lesions and clip placement in the index lesion prior to neo-adjuvant chemotherapy. All the selected patients had biopsy proven breast cancer.

Abstract
BACKGROUND:
To assess the frequency of normal and abnormal myocardial perfusion imaging (MPI) in a consecutive cohort of patients from Pakistan over a period of 8.5 years.
MATERIAL AND METHODS:
We assessed 9170 patients who had undergone stress-rest MPI between January 2004 and June 2013. Patients were assessed for change in demographics, risk factors, and frequency of abnormal and normal MPI.
RESULTS:
Overall mean age and male predominance of studied cohort was ≈ 55 years and ≈ 55:45 (M:F), respectively, with no appreciable decline or rise. Marked decline in exercise as mode of stress (from 71% to 35%, p …

Kimura’S Disease Of Head And Neck: A Rare Case Presentation, Talha Ahmed Qureshi, Moghira Siddiqui, Muhammad Tariq
Department of Surgery Docs
Kimura's disease (KD) is a rare, unusual occurrence, predominantly seen in Asian men, and poses a diagnostic challenge, often manifesting with allergic, eosinophilic hyperplasia, and nonspecific lymphadenitis. A 39-year-old man presented with mobile, well circumscribed, facial and neck swelling. His earlier biopsy showed a reactive lymph node hyperplasia on ultrasound neck and was suggestive of lipomatosis. As definitive diagnosis could not be made, the patient was planned for excision and biopsy. Subsequent histopathology demonstrated eosinophilic infiltration of lymphoid follicles and expansion of interfollicular area with interfollicular eosinophilic abscess formation and capillary venule proliferation. This was quite interesting as the previously …

Presentations and Publications
The Tutor-Facilitated Digital Literacy Acquisition in Hard-to-Serve Populations research project was supported by a National Leadership Grant from the Institute of Museum and Library Services (IMLS) grant. It was conducted over the course of 3 years in cooperation with five partners across the United States, which were participating in a project funded by the U.S. Department of Commerce’s Broadband Opportunities Technology Program (BTOP). All phases of the research were guided by two national advisory groups made up of scholars and practitioners in the field of adult education and digital literacy.

Research Briefs and Case Studies
The Learner/Tutor Relationship brief describes findings that show how tutors who are bilingual are preferred by English language learners, even when they do not speak the learner’s first language. The unique ways that tutors and learners work together in digital literacy acquisition program are featured. The Research Briefs series highlight key findings about how underserved adults acquire digital literacy skills, and include quotes from participants and practitioners. The Briefs are designed to be accessible by practitioners, program administrators, and policy makers to inform and enhance digital literacy programs.
