The Federalist Provenance Of The Principle Of Privacy, Elvin T. Lim Dec 2015

The Federalist Provenance Of The Principle Of Privacy, Elvin T. Lim

Maryland Law Review

The right to privacy is the centerpiece of modern liberal constitutional thought in the United States. But liberals rarely invoke “the Founding” to justify this right, as if conceding that the right to privacy was somehow a radical departure from “original meaning,” perhaps pulled out of the hat by “activist” judges taking great interpretive liberties with the constitutional text. Far from being an unorthodox and modern invention, I argue here that privacy is a principle grounded in the very architecture of the Constitution as enumerated in its Articles, perhaps even more so than in particular sections of the Bill of …

Background—Perioperative antiplatelet agents potentially increase bleeding after non–ST‐segment elevation (NSTE) acute coronary syndromes (ACS). The protease‐activated receptor 1 antagonist vorapaxar reduced cardiovascular events and was associated with increased bleeding versus placebo in NSTE ACS, but its efficacy and safety in noncardiac surgery (NCS) remain unknown. We aimed to evaluate ischemic, bleeding, and long‐term outcomes of vorapaxar in NCS after NSTE ACS.

Methods and Results—In the TRACER trial, 2202 (17.0%) patients underwent major or minor NCS after NSTE ACS over 1.5 years (median); continuing study treatment perioperatively was recommended. The primary ischemic end point for this analysis was cardiovascular …

Understanding The Impact Of Intensive Horticulture Land-Use Practices On Surface Water Quality In Central Kenya, Faith K. Muriithi, Danlin Yu Dec 2015

Understanding The Impact Of Intensive Horticulture Land-Use Practices On Surface Water Quality In Central Kenya, Faith K. Muriithi, Danlin Yu

Department of Earth and Environmental Studies Faculty Scholarship and Creative Works

Rapid expansion of commercial horticulture production and related activities contribute to declining surface water quality. The study sought to understand the impacts on select rivers in Laikipia and Meru, production hotspots. The specific aims were (1) to identify prevailing surface water quality by examining variations of 14 physico-chemical parameters, and (2) to categorize measured surface water quality parameters into land use types highlighting potential pollutant source processes. Water samples were collected in July and August 2013 along 14 rivers in the study area. The data were analyzed using principal component analysis (PCA) and discriminant analysis (DA). Principal components (PCs) explained …

High-Preference Strategies And Other Interspersal Procedures For Learners With Disabilities: A Review Of The Literature, Elias Clinton, Tom J. Clees Dec 2015

High-Preference Strategies And Other Interspersal Procedures For Learners With Disabilities: A Review Of The Literature, Elias Clinton, Tom J. Clees

The Journal of Special Education Apprenticeship

Interspersal Procedures (IP) represent a group of interventions that imbed, at varying ratios, requests for individuals to exhibit mastered skills before or within sequences of requests for target skills. Interspersal Procedures include numerous strategies, such as high-probability request sequences, pre-task requests, and high-preference strategies. Such arrangements can increase attempts to perform target or less preferred tasks. The purposes of this review include (a) an overview of terminology related to IP, (b) a discussion of the conceptual basis for using IP, (c) a description of the experimental literature that has used IP with individuals with disabilities, (d) a categorical summary of …

Active Learning Strategies And Vocabulary Achievement, John Robert Griffith Dec 2015

Active Learning Strategies And Vocabulary Achievement, John Robert Griffith

Dissertations

Using a quantitative method of data collection, this research explored the question: Do active learning strategies used in grades 5 and 6 affect student vocabulary achievement in a positive or negative direction? In their research, Wolfe (2001), Headley, et al., (1995), Freiberg, et al., (1992), and Brunner (2009) emphasize the importance of understanding how children learn through active learning processes such as hands-on opportunities, cooperative learning, and technology-based instruction. Other researchers such as Baker, et al., (2000), Nagy, et al., (1987) and Searfoss, et al., (2001) stress the importance of meaningful vocabulary instruction when teaching reading. This study supports their …

The Global Architecture Of Financial Regulatory Taxes, Carlo Garbarino, Giulio Allevato Dec 2015

The Global Architecture Of Financial Regulatory Taxes, Carlo Garbarino, Giulio Allevato

Michigan Journal of International Law

This Article endeavors to broaden the analysis of available policy tools to address the problems created by financial crises and discusses how, in addition to direct regulation, certain tax measures having a regulatory nature may operate to address the so-called “negative externalities” often associated with those crises. There is a negative externality when an economic agent making a decision does not pay the full cost of the decision’s consequences. In such cases, the cost to society as a whole is greater than the cost borne by the individuals creating the economic impact. In practice, negative externalities result in market inefficiencies …

Privacy Almighty? The Cjeu's Judgment In Google Spain Sl V. Aepd, David J. Stute

Michigan Journal of International Law

The Internet has matured into an unprecedented repository of data, retrievable through myriad unique “links,” or Uniform Resource Locators. Yet, this wealth of information only became broadly accessible through the invention and continual development of algorithm-based search engines. Keyword searches empowered search-engine users to find—and sometimes stumble upon—information with great ease. Indeed, search-engine indices arguably have become the most comprehensive catalogues of information the world has ever seen. This wealth of accessible information poses challenges to traditional notions of privacy: aspects of our private and public lives, which previously would have rarely left the vicinities of our immediate social or …

The Calculus Of Consent, John Thrasher, Gerald Gaus Dec 2015

The Calculus Of Consent, John Thrasher, Gerald Gaus

Philosophy Faculty Books and Book Chapters

The Calculus of Consent: Logical Foundations of Constitutional Democracy is a groundbreaking work in democratic theory. This chapter argues that it is of continued relevance today, due both to its methodological innovations and its use of those innovative techniques to solve the fundamental problem of democratic justification. In Calculus, James Buchanan and Gordon Tullock fuse economic methods, political theory, and the normative project of showing how democratic institutions of a particular sort can be justified contractually, creating a unique form of democratic contractualism that came to be known as “Constitutional Political Economy” and the more general research program of “Public …

2015 Fall Migration Bird Banding At Wildcat Hills State Recreation Area, Holly Garrod Dec 2015

2015 Fall Migration Bird Banding At Wildcat Hills State Recreation Area, Holly Garrod

Nebraska Bird Review

It was a different season of bird banding this year at Wildcat Hills State Recreation Area in Scotts Bluff County, Nebraska. Due to construction at the nature center, the banding station was moved farther down the road to one of the picnic shelters. The habitat remained mostly the same, with Ponderosa Pine and multispecies-shrub understory dominating the unique ridge landscape characteristic of Wildcat Hills. The new site provided more shrub understory but lacked the running water of Turkey Creek and the bird feeders at the nature center. Bird Conservatory of the Rockies (formerly Rocky Mountain Bird Observatory) has been banding …

Fall Field Report, August–November 2015, W. Ross Silcock

Nebraska Bird Review

To start, a housekeeping item: in the species accounts that follow, whenever I use the term "migrant" I am referring to fall migration only. Many species, of course, have differing migration strategies and timing in spring and fall.

Much of the data used in this report relating to western and Pine Ridge passerines comes from the outstanding banding efforts by Bird Conservancy of the Rockies (formerly Rocky Mountains Bird Observatory) at Chadron State Park (CSP) and Wildcat Hills Nature Center (WHNC) in Scotts Bluff Co. This year’s operators were Josh Lefever and Holly Garrod. Related to the Chadron State Park …

Variability In The Selection Patterns Of Pronghorn: Are They Really Native Prairie Obligates?, Paul F. Jones, Mike Grue, Mike Suitor, Darren J. Bender, Cormack Gates, Dale Eslinger, Julie Landry-Deboer Dec 2015

Variability In The Selection Patterns Of Pronghorn: Are They Really Native Prairie Obligates?, Paul F. Jones, Mike Grue, Mike Suitor, Darren J. Bender, Cormack Gates, Dale Eslinger, Julie Landry-Deboer

The Prairie Naturalist

In Canada, pronghorn (Antilocapra americana) are primarily considered a native prairie obligate because of their reliance on open grassland vegetation communities, although an assessment of local ecological knowledge suggests that pronghorn in Alberta select a variety of habitat from native prairie to cultivated lands. The primary objective of our study was to assess whether pronghorn in Alberta and Saskatchewan are native prairie obligates. Specifically, we addressed the following questions: 1) do individual pronghorn show similar selection patterns for native prairie and, therefore, support the notion that they are prairie obligates; 2) do pronghorn show consistent resource selection patterns …

Fitting Conditional And Simultaneous Autoregressive Spatial Models In Hglm, Moudud Alam, Lars Rönnegård, Xia Shen Dec 2015

Fitting Conditional And Simultaneous Autoregressive Spatial Models In Hglm, Moudud Alam, Lars Rönnegård, Xia Shen

The R Journal

We present a new version ( 2.0) of the hglm package for fitting hierarchical generalized linear models (HGLMs) with spatially correlated random effects. CAR() and SAR() families for con ditional and simultaneous autoregressive random effects were implemented. Eigen decomposition of the matrix describing the spatial structure (e.g., the neighborhood matrix) was used to transform the CAR/SARrandomeffects into an independent, but heteroscedastic, Gaussian random effect. A linear predictor is fitted for the random effect variance to estimate the parameters in the CAR and SAR models. This gives a computationally efficient algorithm for moderately sized problems.

Living The Past: Bergson, Proust, Deleuze And Nietzsche On Memory And The Self, Danae Mcleod Dec 2015

Living The Past: Bergson, Proust, Deleuze And Nietzsche On Memory And The Self, Danae Mcleod

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Memory is not of the past, it is of the present and it is of the future. This insight, developed by Henri Bergson in Matter and Memory is the subject of this dissertation. Focusing on the figural representations in Matter and Memory, I argue that Bergson presents a dynamic conception of memory that can be read as destabilizing fixed notions of the human subject. I closely examine the implications of Bergson’s positive account of memory, demonstrating that his account is primarily oriented toward showing how memory is useful for action in the present. I continue to develop this dynamic model …

Shadow States: The Archaeology Of Power In The Marshes Of Southern Mesopotamia, Abdulameer M. Al-Dafar Dec 2015

Shadow States: The Archaeology Of Power In The Marshes Of Southern Mesopotamia, Abdulameer M. Al-Dafar

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Ancient states and early complex societies emerged in areas where urban settlements had the resources to house large populations and where economic and political centers and institutions could be established to run the society. By contrast, marshes, isolated deserts, extreme mountain peaks and thick forests served as refuges for those who wanted to escape from the state. Moreover, taking these examples into consideration, scholars seem to share the assumption that it is unexpected to find urban centers and central political organizations of isolated refuge areas in the ancient world. This dissertation examines the hypothesis that under certain historical and environmental …

The Habits Of Racism: A Phenomenology Of The Lived Experience Of Racism And Racialised Embodiment., Helen Ngo Dec 2015

The Habits Of Racism: A Phenomenology Of The Lived Experience Of Racism And Racialised Embodiment., Helen Ngo

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

This dissertation examines some of the complex questions raised by the phenomenon and experience of racism. My inquiry is twofold: First, drawing on the resources of Merleau-Ponty, I argue that the conceptual reworking of habit as bodily orientation helps us to identify the more subtle but fundamental workings of racism, to catch its insidious, gestural expressions, as well as its habitual modes of racialised perception. Racism, on this account, is equally expressed through bodily habits, and this in turn raises important ethical questions regarding the responsibility for one's racist habits; as its etymology suggests, habits are not merely passive sedimentations, …

Age Differences In Loneliness: Neural Correlates, Neurogenetics And Functional Connectivity, Alexandra D'Agostino Dec 2015

Age Differences In Loneliness: Neural Correlates, Neurogenetics And Functional Connectivity, Alexandra D'Agostino

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Loneliness, defined as the subjective experience of social isolation, has been linked to poor health outcomes (e.g. depression, cardiovascular disease) and is prevalent among older adult populations. To improve upon current treatments, the interaction between genetic and environmental risk factors for loneliness and their effect on the brain must be better understood. The present study investigated the brain basis of loneliness in younger (mean age = 20.4) and older adults (mean age = 62.9). We used functional magnetic resonance imaging (fMRI) and an emotional picture task to address this question. fMRI data were collected on a 3T Siemens Trio Scanner, …

Food Sharing During The Transition To Agriculture At Neolithic Çatalhöyük, Central Anatolia | Food Sharing During The Transition To Agriculture At Neolithic ÇAtalhã¶Yã¼K, Central Anatolia, G. Arzu Demirergi

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

All human societies share food. Investigation of food sharing in a society can provide great insights into social relations. Food sharing practices have been anthropologically explored in many cultures, especially in small scale societies such as hunter-gatherers and subsistence agriculturalists. According to the findings of these studies, it can be generalized that hunter gatherers tend to share food relatively widely and often beyond the kin level, while agriculturalists tend to share more restrictedly and often within the household. Although this general statement sheds light on how food is shared in different subsistence systems, it does not provide information on how …

An Investigation Of Epidermolysis Bullosa And An Analysis Of Research And Treatment, Anna Dowling Dec 2015

An Investigation Of Epidermolysis Bullosa And An Analysis Of Research And Treatment, Anna Dowling

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

The dysfunction of genes encoding integral proteins of the extracellular matrix and the basement membrane zone create foundations for the disease epidermolysis bullosa. Various proteins reside in the basement membrane zone and are responsible for the strength of the epidermal tissue. The cure for this disease is elusive which poses a problem for modern medicine. In this analysis, the mechanisms of epidermolysis bullosa subtypes were investigated and the viability of future treatment protocols was assessed. The promising treatment options include stem cell, gene, fibroblast, and protein therapy. Strategies need to be investigated further in order to develop therapeutic cures which …

Smart Sensing: Mixed-Signal Vlsi Implementation Of Gradient Flow Localization And Separation, Shuo Li Dec 2015

Smart Sensing: Mixed-Signal Vlsi Implementation Of Gradient Flow Localization And Separation, Shuo Li

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Acoustic source localization and separation are two crucial components in the acoustic signal processing field, which can be utilized in many applications such as smart hearing aids, tracking and surveillance devices. The small form factor of these applications urge the use of miniature sensor arrays. Nonetheless, the performance of traditional localization and separation techniques deteriorate with small-form-factor sensor arrays and they require higher sampling frequency to compensate for the performance loss, which means higher noise floor and more power consumption. Gradient flow is a technique for localization of an acoustic source using miniature microphone arrays by relating temporal and spatial …

Space Acquisition Strategies Of Zostera Marina, Bradley Thomas Furman Dec 2015

Space Acquisition Strategies Of Zostera Marina, Bradley Thomas Furman

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Seagrasses are a diverse group of clonal marine macrophytes. Their decline in recent decades has been an alarming component of estuarine urbanization, with large portions of historical coverage lost or degraded. Understanding patterns of dispersal and recruitment within and among the remaining populations is now critical to predicting the form and pace of recovery. Working in a developing eelgrass (Zostera marina) meadow in Shinnecock Bay, we combined field manipulations, genotypic surveys and correlative analyses to understand how vegetative growth and seedling recruitment contribute to space acquisition. First, we explored clonal foraging behavior and its effect on patch growth using subterranean …
