ABSTRACT OF CONFESSING IN THE HUMAN VOICE: A DEFENSE OF THE PRIVILEGE AGAINST SELF-INCRIMINATION
By Andrew E. Taslitz
The privilege against self-incrimination has fallen on hard times. Miranda rights shrink, as do those more traditional “core” aspects of the privilege. Partly this is due to an implicit skepticism by the courts about the value of the privilege, despite their occasional explicit words of praise for its role in our constitutional scheme. Scholars largely, though not uniformly, agree that the privilege cannot be justified as a philosophical matter, viewing it as an unfortunate burden we are stuck with because of its …

Ferguson, The Rebellious Law Professor, And The Neoliberal University, Harold A. Mcdougall Iii
School of Law Faculty Publications
Neoliberalism, a business-oriented ideology promoting corporatism, profit-seeking, and elite management, has found its way into the modern American university. As neoliberal ideology envelops university campuses, the idea of law professors as learned academicians and advisors to students as citizens in training, has given way to the concept of professors as brokers of marketable skills with students as consumers. In a legal setting, this concept pushes law students to view their education not as a means to contribute to society and the professional field, but rather as a means to make money. These developments are especially problematic for minority students and …
Heterotrophy And Lipids As Indicators Of Resilience To Climate Change Stress In Scleractinian Corals, Erica K. Towle
Heterotrophy And Lipids As Indicators Of Resilience To Climate Change Stress In Scleractinian Corals, Erica K. Towle
Open Access Dissertations
Coral reefs are biodiverse ecosystems with high biological, cultural, economic, and recreational value that are facing multiple anthropogenic stressors, the greatest of which is global climate change via warming and ocean acidification (OA). Increased warming throughout the century may reach a point where frequent bleaching, the expulsion of corals’ symbiotic algae that can provide the coral with over 90% of its daily metabolic requirements, may cause widespread mortality. OA, a result of increased carbon dioxide dissolving into seawater, changes the chemistry of seawater such that the pH of the ocean becomes more acidic. This decrease in pH is accompanied by …

The Foundation Of Cistercian Monasteries In France 1098-1789: An Historical Gis Evaluation, Jon Eric Klingenberg Rasmussen
Masters Theses
Historical geography focuses upon those relationships which have shaped the evolution of place and landscape over time. One fundamental approach used to achieve this objective is the set of theories associated with spatial diffusion. This includes the spatial and chronological paths, the periodicities and rates of spread, as well as the identification of areas of void or avoidance. An emerging trend in historical geography is the use of Geographic Information Systems (GIS). A GIS provides the researcher with the necessary tools to re-evaluate and challenge long-standing interpretations of any given event, historical or otherwise, as well as develop new insights …

Lepidopteran stem borers are among the most important pests of maize in East Africa. The objective of the present study was to predict the impact of temperature change on the distribution and abundance of the crambid Chilo partellus, the noctuid Busseola fusca, and their larval parasitoids Cotesia flavipes and Cotesia sesamiae at local scale along Kilimanjaro and Taita Hills gradients in Tanzania and Kenya, respectively. Temperature-dependent phenology models of pests and parasitoids were used in a geographic information system for mapping. The three risk indices namely establishment, generation, and activity indices were computed using current temperature data record from local …

Glucagon regulates glucose homeostasis by controlling glycogenolysis and gluconeogenesis in the liver. Exaggerated and dysregulated glucagon secretion can exacerbate hyperglycemia contributing to type 2 diabetes (T2D). Thus, it is important to understand how glucagon receptor (GCGR) activity and signaling is controlled in hepatocytes. To better understand this, we sought to identify proteins that interact with the GCGR to affect ligand-dependent receptor activation. A Flag-tagged human GCGR was recombinantly expressed in Chinese hamster ovary (CHO) cells, and GCGR complexes were isolated by affinity purification (AP). Complexes were then analyzed by mass spectrometry (MS), and protein-GCGR interactions were validated by co-immunoprecipitation (Co-IP) …

Polar Facts In The Age Of Polarization, Lawrence C. Hamilton
Polar Facts In The Age Of Polarization, Lawrence C. Hamilton
Sociology
Many drivers of polar-region change originate in mid-latitude industrial societies, so public perceptions there matter. Building on earlier surveys of US public knowledge and concern, a series of New Hampshire state surveys over 2011–2015 tracked public knowledge of some basic polar facts. Analysis indicates that these facts subjectively fall into two categories: those that are or are not directly connected to beliefs about climate change. Responses to climate-linked factual questions, such as whether Arctic sea ice area has declined compared with 30 years ago, are politicized as if we were asking for climate-change opinions. Political divisions are less apparent with …

Publications and Research
Public mobilisation is needed to enact obesity prevention policies and to mitigate backlash against their implementation. However, current approaches in public health focus primarily on dialogue between public health professionals and political leaders. Strategies to increase popular demand for obesity prevention policies include refining and streamlining public information, identifying effective frames for each population, enhancing media advocacy, building citizen protest and engagement, and developing a receptive political environment with change agents embedded across organisations and sectors. Long-term support and investment in collaboration among diverse stakeholders to create shared value is also important. Each actor in an expanded coalition for obesity …

Examining The Effects Of Socio Cultural Environment On Internationalization: Exporters' Perspective, Wineaster Anderson
Examining The Effects Of Socio Cultural Environment On Internationalization: Exporters' Perspective, Wineaster Anderson
Business Management Review
There is a shortage of literature and studies that link socio-cultural environment to internationalization particularly in developing countries. This paper examines the effects of socio-cultural environment on exporting using a multiple (n=30) case-study method. The exporter-specific in-depth interviews were conducted and responses categorized and presented using thematic statements and narrative form. The findings revealed that various cultural elements were affecting exporting activities particularly on marketing communication, price negotiations, labeling, branding and packaging. Language was found to have the greatest impact followed by education and religion. Exporters consider engaging local agents and exclusive distributors in the foreign markets as some of …

Personal Jurisdiction: A Doctrinal Labyrinth With No Exit, Simona Grossi
Personal Jurisdiction: A Doctrinal Labyrinth With No Exit, Simona Grossi
Akron Law Review
My goal is not to categorize, critique, or refine existing doctrine, but to challenge the idea that the Supreme Court’s case-by-case approach to personal jurisdiction represents an arc of progress. In my view, all too often the Court’s apparent refinements operate as detours from the fundamental principles at stake. The result is a clutter of doctrinal tests that is inconsistent with principle and confuses more than it informs. In Part II, I briefly explore the traditional bases of jurisdiction and the Court’s elaboration of the minimum contacts test in International Shoe Co. v. State of Washington. 9 Here, I show …

Dating Methods And Techniques At The John Hallowes Site (44wm6): A Seventeenth-Century Example, Lauren K. Mcmillan, D. Brad Hatch, Barbara J. Heath
Northeast Historical Archaeology
The John Hallowes site (44WM6) in Westmoreland County, Virginia, was excavated between July 1968 and August 1969. No report of the excavations was completed at that time, although an article summarizing the findings was published in Historical Archaeology in 1971, dating the site’s occupation to the period from the 1680s to 1716. From 2010 to 2012, a systematic reanalysis of the site, features, history, and artifacts was conducted by archaeologists at the University of Tennessee, Knoxville. Benefiting from nearly 40 years of advances in Chesapeake archaeology, the reanalysis has challenged accepted dates for the site’s occupation, which is now placed …

“An Earthly Tabernacle”: English Land Use And Town Planning In Seventeenth-Century Woodbridge, New Jersey, Michael J. Gall
Northeast Historical Archaeology
The archaeology of townscapes can provide important information about cultural development and the transfer of settlement systems. This close examination of 17th-century settlement in northeastern New Jersey focuses on Woodbridge Township, Middlesex County, between 1669 and 1676. The study highlights the complexity of early colonial settlement systems in East Jersey and also examines the ways in which experimentation with Old World– and New England–style corporation settlement models; strong desires for land accumulation, power, and wealth; inheritance practices; and religion influenced English townscape development within northeastern New Jersey. The aspects outlined herein likely influenced the creation of other township-corporation settlements by …
