Measures With Multiple Purposes: Puzzles From Ec-Seal Products, Donald H. Regan Jun 2015

Measures With Multiple Purposes: Puzzles From Ec-Seal Products, Donald H. Regan

Articles

European Communities—Measures Prohibiting the Importation and Marketing of Seal Products is the first case in which the dispute system of the World Trade Organization (WTO) has wrestled with a regulation that pursued multiple conflicting, legitimate purposes. (I will explain later why Brazil—Retreaded Tyres is not such a case.) This generates puzzles about applying the definition of a “technical regulation” to complex measures; about whether an exception to a ban can be justified by a purpose different from that of the ban; and about how to apply “less restrictive alternative” analysis to measures with multiple goals. The first of these puzzles …

Role Of Ros (Reactive Oxygen Species) On Cocaine-Induced Da Release In The Nac, Jacqueline Solomon, Dr. Scott Steffensen Jun 2015

Role Of Ros (Reactive Oxygen Species) On Cocaine-Induced Da Release In The Nac, Jacqueline Solomon, Dr. Scott Steffensen

Journal of Undergraduate Research

Cocaine as a stimulant drug causes Dopamine (DA), a neurotransmitter, to be released in the Accumbens Nucleus (NAc). It accomplishes this by its well-known actions on the DA transporter (DAT). When the DAT is blocked, more DA stays in the synaptic cleft, leading to rewarding and pleasurable sensations. While in the synaptic cleft, DA undergoes excessive oxidation, giving rise to oxidative stress (OS) which causes neural damage. The OS has been shown in damaging the pleasure pathway and makes it so that addictive pathways are formed. In this research study we saw that Reactive Oxygen Species (ROS) Scavengers can eliminate …

Whose Meanings: Constructing Environmental Justice, Sofia L. Martinez Jun 2015

Whose Meanings: Constructing Environmental Justice, Sofia L. Martinez

Language, Literacy, and Sociocultural Studies ETDs

This study interprets language use and meaning with regard to race in a state regulatory process before the New Mexico Environmental Improvement Board (EIB). The document researched is the legal transcript of the EIB Hearing in 2006. The hearing was held to revise the New Mexico Solid Waste Regulations and to consider environmental justice provisions. The study analyzes language and the construction of meaning and discourses in this formal rule-making site; and how these discourses serve as a site for resistance as well as where the State creates and maintains its hegemony. The implication for educators is to consider the …

Cell Type Specificity Of Tissue Plasminogen Activator In The Mouse Barrel Cortex, Philip Chu, Eric Chen, Adesh Bajnath, Joshua C. Brumberg Jun 2015

Cell Type Specificity Of Tissue Plasminogen Activator In The Mouse Barrel Cortex, Philip Chu, Eric Chen, Adesh Bajnath, Joshua C. Brumberg

Publications and Research

It has been suggested that tissue-type plasminogen activator (tPA), a serine protease, plays a key role in regulating the extracellular matrix core proteins, thereby impacting the structural plasticity in the cerebral cortex. Much is known about its role in regulating plasticity in the visual cortex. However, its permissive role has not been demonstrated to generalize to other cerebral cortical areas. By utilizing a combination of immunofluorescent histochemistry and confocal microscopy, we demonstrate that endogenous tPA is indeed present in the somatosensory cortex, and its expression is experience-dependent. Chronic sensory deprivation induced by whisker trimming from birth for one month leads …

What Are Lawyers For?, Daniel Markovits Jun 2015

What Are Lawyers For?, Daniel Markovits

Akron Law Review

What are lawyers for? What social purposes do lawyers serve? What functions underwrite the special obligations and entitlements that accompany the lawyer’s professional role? I shall try to sketch an answer to these questions, at least with respect to lawyers who function as litigators, in adjudication. The answer will surprise many. Lawyers, I shall argue, do not serve truth or justice, and should not seek them. Instead, lawyers serve to legitimate

Toward Regional Governance In Environmental Law, Douglas R. Williams Jun 2015

Toward Regional Governance In Environmental Law, Douglas R. Williams

Akron Law Review

This article will proceed in three parts. Part I provides a brief introduction to the structured institutional arrangements under the CAA and the CWA. I discuss how these programs have evolved in ways that depart from what may have been originally anticipated and how their structure poses impediments to effective environmental management. Part II provides a short summary of current thinking about the institutional architecture of our environmental programs, focusing primarily on the “environmental federalism” scholarship of recent years. I offer reasons for abandoning federalism as an appropriate institutional framework. Part III presents a conceptual, rather than tightly engineered, argument …

Looking Back To The Future: The Curmudgeon's Guide To The Future Of Environmental Law, Denis Binder

Akron Law Review

This essay is not intended as a traditional law review article, but as an essay intended to raise questions about the current status and future of Environmental Law in light of the three and one-half centuries of a developmental, exploitative ethos in America.

Aligning Regulation With The Informational Need: Ecosystem Services And The Next Generation Of Environmental Law, Keith H. Hirokawa, Elizabeth J. Porter Jun 2015

Aligning Regulation With The Informational Need: Ecosystem Services And The Next Generation Of Environmental Law, Keith H. Hirokawa, Elizabeth J. Porter

Akron Law Review

This article explores the Clinch Coalition decision to understand why the court would perpetuate a process that systematically rejects the relevance and value of ecosystem processes in the information gathering exercise entailed in these environmental regulations. The discussion begins with an introduction to ecosystem services as a study of human dependency on the services provided by functioning ecosystems. In the second section, the article turns to the Clinch Coalition decision to outline the arguments relied upon by the court to legitimize the Forest Service’s decision to avoid an ecosystem services analysis. The article then presents the Clinch Coalition decision as …

Recovering From The Recovery Narrative: On Globalism, Green Jobs And Cyborg Civilization, Michael Burger Jun 2015

Recovering From The Recovery Narrative: On Globalism, Green Jobs And Cyborg Civilization, Michael Burger

Akron Law Review

In this Essay, I make a preliminary foray into this new narrative terrain, identifying several emerging legal storylines that have arisen in the wake of climate change disruptions and that I predict will prove influential in the coming years. In Part I, I discuss the ways in which new perceptions of scale are re-defining human beings’ attachments to a sense of “place” or “dwelling” and are shaping new attitudes about what constitutes the local, posing potential problems for existing federalism schemes. In Part II, I discuss the ways in which America’s long history of nationalizing nature manifests in the discourse …

Replacing Sustainability, Robin Kundis Craig, Melinda Harm Benson Jun 2015

Replacing Sustainability, Robin Kundis Craig, Melinda Harm Benson

Akron Law Review

This Article argues that, from a policy perspective, we must face the impossibility of even defining—let alone pursuing—a goal of “sustainability” in a world characterized by such extreme complexity, radical uncertainty, and discomfiting loss of stationarity. Instead, we need new policy directions and orientations that provide the necessary capacity to deal with these “wicked problems” in a meaningful and equitable way. The realities of current and emerging SES dynamics warrant a new set of tools and approaches to governance of those systems. Part II of this Article provides a brief history of sustainability and sustainable development, including corollary emphases on …

Developmental Detour: How The Minimalism Of Miller V. Alabama Led The Court's "Kids Are Different" Eighth Amendment Jurisprudence Down A Blind Alley, Mary Berkheiser Jun 2015

Developmental Detour: How The Minimalism Of Miller V. Alabama Led The Court's "Kids Are Different" Eighth Amendment Jurisprudence Down A Blind Alley, Mary Berkheiser

Akron Law Review

With its narrow ruling, Miller has taken the Eighth Amendment kids are different jurisprudence on a deleterious detour that could lead Miller and Jackson and others like them to a certain dead end. Where Miller went wrong is the subject of this paper. It begins with Graham and the significance of the Court’s ruling that the Eighth Amendment categorically precludes imposition of a sentence of life without parole on a juvenile nonhomicide offender. Next, this paper turns to the Supreme Court’s decision in Miller, parsing the Court’s reliance on precedent and the reasoning that led it to adopt a ruling …

Florence V. Board Of Chosen Freeholders: Police Power Takes A More Intrusive Turn, Wayne A. Logan Jun 2015

Florence V. Board Of Chosen Freeholders: Police Power Takes A More Intrusive Turn, Wayne A. Logan

Akron Law Review

This symposium affords an opportunity to reflect upon the combined force of Florence and one of its foundational precedents, also decided by a 5-4 vote: Atwater v. City of Lago Vista. In Atwater, the Court afforded police explicit authority to arrest individuals for very minor offenses (there failure to wear a seatbelt) without a warrant, paving the way not only for arrests such as experienced by Albert Florence, but also a myriad of others, based on laws contained in state, local and federal codes. With Atwater, the Court refused to limit the governmental power to subject individuals to the trauma …

Judging In A Vacuum, Or, Once More, Without Feeling: How Justice Scalia's Jurisprudential Approach Repeats Errors Made In Plessy V. Ferguson, Chris Edelson Jun 2015

Judging In A Vacuum, Or, Once More, Without Feeling: How Justice Scalia's Jurisprudential Approach Repeats Errors Made In Plessy V. Ferguson, Chris Edelson

Akron Law Review

James Fleming argues that “[Justice Clarence] Thomas’s concurrence in Adarand and dissent in Grutter reflect the Plessy worldview.” I argue in Part V of this article that Justice Antonin Scalia follows the Plessy approach in several of his dissenting opinions. One of this article’s goals is to explain these incongruencies—how can it be that each of these Justices believes he is true to the legacy of Brown, but is inadvertently adopting the reasoning used by the majority in Plessy? The key to resolving this paradox depends on identifying precisely how Plessy went wrong in its reasoning and how Brown corrected …

James Madison And The Constitution's "Convention For Proposing Amendments", Robert G. Natelson Jun 2015

James Madison And The Constitution's "Convention For Proposing Amendments", Robert G. Natelson

Akron Law Review

The last of the limited-subject interstate gatherings is today the most famous. The Annapolis Convention of 1786 was to focus on “the trade and Commerce of the United States.” Its limited scope induced Madison, who served as a delegate, explicitly to distinguish it from a plenipotentiary convention. For the most part, all of these conventions—today we might call them “task forces”—remained within the scope of their calls. If there was an exception, it was the abortive assembly at Annapolis, and that exception was solely to express the “wish” and “opinion” that another convention be held to consider defects in the …

Reassessing The Avoidance Canon In Erie Cases, Bernadette Bollas Genetin Jun 2015

Reassessing The Avoidance Canon In Erie Cases, Bernadette Bollas Genetin

Akron Law Review

This Article chronicles the Supreme Court’s inconsistent use of an avoidance canon in cases construing the substantive rights limitation of the Rules Enabling Act (Enabling Act or REA). It focuses primarily on the avoidance canon as used in cases under the REA branch of the Erie doctrine but also discusses avoidance in other REA contexts. The Article concludes that a reassessment and refocusing of the avoidance canon in Enabling Act jurisprudence is necessary... This Article explores the purposes and methodology that should guide avoidance in REA cases... I focus, in this Article, primarily on a subset of this group of …

Symposium: Erie Under Advisement: The Doctrine After Shady Grove; Forward: Erie's Gift, Jay Tidmarsh

Akron Law Review

A forward to the articles in this journal. All the articles manifest concern for the constitutional and structural concerns that animated Erie and its procedural progeny. Several articles, especially those by Professors Doernberg, Koppel, and Stempel examine the jurisprudential commitments underlying the Erie doctrine in general and the various opinions in Shady Grove in particular. Professors Genetin and Friedenthal examine the difficulties of, respectively, statutory and rule interpretation in the Erie context. Professor Koppel emphasizes the value of procedural uniformity. Professor Doernberg evaluates the relationship between the procedural Erie doctrine and concerns for federalism. Mr. Gaber brings some realpolitik to …
