Keeping The Arms In Touch: Taking Political Accountability Seriously In The Eleventh Amendment Arm-Of-The-State Doctrine, Jameson B. Bilsborrow
Keeping The Arms In Touch: Taking Political Accountability Seriously In The Eleventh Amendment Arm-Of-The-State Doctrine, Jameson B. Bilsborrow
Emory Law Journal
The Eleventh Amendment to the United States Constitution embodies the principle of state sovereign immunity, long held to bar suits by private litigants in federal courts or under federal law who seek redress for rights violations at the hands of state governments. But states themselves are not the only prospective defendants shielded by this form of sovereign immunity. As a subset of Eleventh Amendment jurisprudence, the arm-of-the-state doctrine allows government entities closely situated to their respective state governments to partake of the state¿s Eleventh Amendment sovereign immunity. Unfortunately, this doctrine, both in theory and in application, has been fraught with …
Severability As Conditionality, Eric S. Fish
Severability As Conditionality, Eric S. Fish
Emory Law Journal
The Supreme Court currently operates under the premise that if it finds one part of a law unconstitutional, it can strike down other parts as well. But it is not clear where the Court finds this power to declare laws inseverable. And that lack of clarity has created a doctrinal muddle wherein the Court applies several inconsistent tests. Three such theories are implicit in the current judicial doctrine and academic debate about severability: (1) that it is an equitable remedial power, akin to the power to issue a civil injunction; (2) that it is a variant of intentionalist statutory interpretation, …
Scrutinizing Polygamy: Utah¿S Brown V. Buhman And British Columbia¿S Reference Re: Section 293, Maura I. Strassberg
Scrutinizing Polygamy: Utah¿S Brown V. Buhman And British Columbia¿S Reference Re: Section 293, Maura I. Strassberg
Emory Law Journal
In Brown v. Buhman, the recent challenge to the Utah law criminalizing polygamy brought by the stars of the reality television show Sister Wives, a federal district court determined both that strict scrutiny was required and that strict scrutiny could not be satisfied. A significant factor in this result was the state¿s failure to mount a strong defense of the law, assuming that it could rely on long standing polygamy precedents such as the United States Supreme Court decision in Reynolds v. United States and more recent Tenth Circuit and Utah Supreme Court decisions to justify limiting scrutiny to rational …
The Evolution Of Plural Parentage: Applying Vulnerability Theory To Polygamy And Same-Sex Marriage, Stu Marvel
The Evolution Of Plural Parentage: Applying Vulnerability Theory To Polygamy And Same-Sex Marriage, Stu Marvel
Emory Law Journal
Much of the legal debate surrounding the challenge to ¿traditional¿ heterosexual marriage has involved questions of liberty, discrimination, and equal treatment. Similar moves have now been made by advocates for polygamous marriage, indicating that polygamous families may be on track to follow in the rainbow contrails of same-sex marriage. This Article argues that such an evolution is indeed likely, but for different reasons than commonly held. Instead, it applies the emerging paradigm of vulnerability theory to a recent suite of polygamy and same-sex marriage rulings, with particular focus on the figure of the ¿vulnerable¿ child. At the same time, this …
Copyright = Speech, Derek E. Bambauer
Copyright = Speech, Derek E. Bambauer
Emory Law Journal
Expression eligible for copyright protection should be presumptively treated as speech for First Amendment purposes. Both copyright and the First Amendment share the goal of fostering the creation and dissemination of information. Copyright¿s authorship requirement furnishes the key link between the doctrines. This Essay examines where the two areas of law align and conflict in offering or denying protection. Using copyright law as a guide for the First Amendment offers three benefits. First, many free speech problems can be clarified when examined through copyright¿s lens. Second, this approach makes the seeming puzzle of non-human speakers understandable. Finally, it can help …
On The Distinction Between Speech And Action, Frederick Schauer
On The Distinction Between Speech And Action, Frederick Schauer
Emory Law Journal
Does the First Amendment rest on a mistake? More specifically, is the First Amendment¿s necessary distinction between speech and action fundamentally unsustainable? The basic idea of this Article is that it is hardly clear that respect for an agent¿s autonomy ought to lead other agents, or the state, to tolerate autonomous communicative actions that are determined to be likely to cause harm to third parties any more than they should tolerate autonomous non-communicative actions whose consequences are equivalent. If the principle of freedom to engage in autonomous actions is one that is limited to cases of harm to others, then, …

Incidence Of Microbial Infections Revealed By Assessing Nodulation Infield-Collected Insects From Adana Province, Hasan Tunaz, Mehmet Kubi̇lay Er, Ali̇ Arda Işikber
Turkish Journal of Agriculture and Forestry
Results of a field study designed to assess the extent of natural microbial infections in insects collected from agrarian fields surrounding Adana, Turkey, are reported. We identified and dissected specimens to assess the numbers of nodules. Formation of darkened melanotic nodules is the predominant cellular immune reaction to microbial and parasitic infection, and once formed, the nodules are permanently attached to internal surfaces. At least some nodules were found in 99% of 1200 examined specimens that were healthy in appearance. The number of nodules ranged approximately from 1 nodule/individual to >120 nodules/individual. We inferred that insects are regularly challenged by …

Turkish Journal of Agriculture and Forestry
Molybdenum cofactor sulfurases (MCSUs) are important enzymes for plant development and response to environmental queues, including processes such as nitrogen metabolism and regulation of the abscisic acid levels in plant tissues. We cloned and sequenced MCSU gene from barley and performed in silico comparison with rice, tomato, and Arabidopsis. Physico-chemical properties and subcellular predictions were found to be similar in different plant species. All MCSUs had three critical domains: aminotransferase class-V (Pfam: PF00266), MOSC N-terminal beta barrel (Pfam: PF03476), and MOSC (Pfam: PF03473). Secondary structure analysis revealed that random coils were the most abundant, followed by α-helices and extended strands. …
The Role Of The Nef Protein In Mhc-I Downregulation And Viral Immune Evasion By Hiv-1, Hannah Elliott, Gerard F. Hoyne
The Role Of The Nef Protein In Mhc-I Downregulation And Viral Immune Evasion By Hiv-1, Hannah Elliott, Gerard F. Hoyne
Health Sciences Papers and Journal Articles
The Nef protein is a major determinant of pathogenicity caused by the human immunodeficiency virus (HIV) and is encoded by the nef gene within the genomes of primate lentiviruses HIV-1, HIV-2 and simian immunodeficiency virus (SIV). The HIV Nef protein subverts the intracellular membrane traffic to mediate endocytosis of a number of cell surface receptors to accelerate their degradation. In this review we will examine how the multifunctional Nef can mediate down regulation of the Major histocompatibility Complex (MHC) I complex proteins from the surface of infected cells as a means of immune evasion by HIV. By selectively downregulating MHC-I …
Effects Of Partner Familiarity On Conversational Style In Signed-Interactions With Chimpanzees, Susan Ann Keenan
Effects Of Partner Familiarity On Conversational Style In Signed-Interactions With Chimpanzees, Susan Ann Keenan
All Master's Theses
Chimpanzees that use signs of American Sign Language (ASL) sign to friends and strangers, both human and nonhuman. Transcripts of signed conversations between four chimpanzees and 43 human interlocutors within a 4 min trial were analyzed for their style including lexical diversity. Twenty-two of the interlocutors were familiar to the chimpanzees, 21 were strangers, and all had basic or more know ledge of ASL. Overall, familiar signers used more vocabulary and had more conversations than unfamiliar signers. The two groups had 53 vocabulary signs in common. Only one chimpanzee, Loulis, participated in enough trials and in both conditions to elicit …

Feasibility Study On The Efficacy Of An Acoustophoretic Blood Filtration System, Brian P. Dutra
Feasibility Study On The Efficacy Of An Acoustophoretic Blood Filtration System, Brian P. Dutra
Master’s Theses - College of Engineering
"Blood filtration is a commonly utilized technique for the separation and isolation of red blood cells (RBCs), white blood cells (WBCs), and platelets from blood. Current blood filtration technology includes using centrifuges and membrane filters to isolate these cells from the blood. Acoustophoresis, the process of using an acoustic pressure field to selectively deflect and collect particles, is a proven blood cell separation technique in micro-electromechanical systems, but has not been scaled up for larger flow rates to meet the clinical need required by some applications. In this work, a system was designed and evaluated as a potential blood filtration …

Promising Forage Options To Enhance Livestock Production In Mediterranean Climate Agricultural Systems, Serkan Ates, Hayley C. Norman, Hichem Ben Salem, Bradley Nutt, Harun Cicek
IGC Proceedings (1977-2023)
The increasing demand for food, fibre and animal products inevitably requires intensifying agricultural production worldwide. This can present a number of environmental and farming systems challenges in Mediterranean climate areas of the world. Developments of novel strategies, employing ecologically sound intensification practices, are crucial to enhance production in the Mediterranean agropastoral production systems. In this paper, we have discussed forage based systems that improve productivity, profitability, environmental quality and resilience of the farming systems. Key opportunities include better use and integration of diverse genetic resources, new agronomic techniques and the utilization of perennial forage plants that are adapted to land …

IGC Proceedings (1977-2023)
Monitoring grassland areas to assess changes in their condition over time has been the subject of a lot of research at different scales. Initially the techniques focused on field-based measurements, and modelling. However, several obtained data were site specific. Based on the increase in availability of remote sensing data and products, there is an expectation that remote sensing can provide rapid and definite answers to the challenges of detecting and monitoring grassland conditions and associated changes in productivity. At the time of European Copernicus Programme, the new possibilities of satellite data from the group of Sentinel satellites give the new …
Grazing Management Options For Maintaining Optimum Pasture Composition And Utilization, Glen E. Aiken
Grazing Management Options For Maintaining Optimum Pasture Composition And Utilization, Glen E. Aiken
IGC Proceedings (1977-2023)
Global demand for meat and dairy products will continue to increase over the 21st century, however, the global forage-based livestock industry will be challenged in meeting production goals with minimal impact of the environment. Sustainable production of grazing livestock will depend on the use of carefully planned grazing management strategies. Development of a grazing management plan involves making two decisions: determining the livestock density at which pastures are stocked and settling on the method used to graze the pastures. Stocking rate indirectly affects output per animal and per hectare through its direct effect on forage mass and pasture composition. A …

Enhancing Grassland Productivity Through Disease Management Of Grass And Forage Species, Tingyu Duan, Chunjie Li, Yanzhong Li, Binhua Yu, Zhibiao Nan
IGC Proceedings (1977-2023)
The total area of grassland in China is about 400 million hectares, accounting for 41.7% of the country’s land area, which plays important role in ecological construction and food security assurance of the national. However, diseases of grass and forage limited the development of the pastoral agriculture. There are more than1500 new diseases were reported in the past 16 years with more and more new diseases were discovered. The damage to grassland is becoming more severe with the known diseases prevalent areas expanding.

Management Of Pasture Soils: Biochar Stability, Carbon Storage Potential And Its Effect On Production And Quality, Bhupinder Pal Singh, Yunying Fang, Mark Boersma, Damian Collins, Lukas Van Zwieten, Lynne M. Macdonald
IGC Proceedings (1977-2023)
The use of biochar has been proposed as a stable carbon (C) amendment with long-term carbon (C) storage potential in agricultural soils while improving primary productivity. However, this concept has not been widely tested in contrasting soils under temperate pasture systems. To address this knowledge gap, a 13C-labelled biochar, produced from Eucalyptus saligna biomass by slow pyrolysis (450° C; d13C -36.7‰) was surface (0"10 cm) applied in C3 dominated, annual temperate pasture systems across Arenosol, Cambisol and Ferralsol. The results show that only 2% of the applied biochar-C was mineralised in a relatively clay- and C-poor …
Grassland Renovation And Consequences For Nutrient Management, Johannes Isselstein, Manfred Kayser
Grassland Renovation And Consequences For Nutrient Management, Johannes Isselstein, Manfred Kayser
IGC Proceedings (1977-2023)
Sward degradation is a serious threat to the functioning of grassland and the provision of ecosystem services. Renovation measures are frequently applied in order to restore degraded swards. However, the success is highly variable and substantial tradeoffs are often found following renovation such as among agronomic and environmental services. Starting from a general classification of renovation measures the paper investigates the processes induced by renovation that lead to a change of the vegetation and that affect carbon and nitrogen fluxes. These processes are strongly interrelated and dependent on site, climate and management condition as well as on the time scale. …
Effective Use Of Trails For Assessing Terrestrial Salamander Abundance And Detection: A Case Study At Great Smoky Mountains National Park, Joseph Milanovich, Daniel J. Hocking, William E. Peterman, John A. Crawford
Effective Use Of Trails For Assessing Terrestrial Salamander Abundance And Detection: A Case Study At Great Smoky Mountains National Park, Joseph Milanovich, Daniel J. Hocking, William E. Peterman, John A. Crawford
Biology: Faculty Publications and Other Works
The conservation and management of wildlife species is contingent on estimating distribution and abundance. Sampling of wildlife requires repeated visits to accurately determine species occurrence and to quantify abundance across temporal and spatial scales. The use of trails to sample wildlife populations is increasing and offers opportunities to potentially sample more frequently, with increased ease of access, and less disturbance to habitats, which can be important in sensitive natural areas. We examined capture dataof terrestrial salamanders within Great Smoky Mountains National Park to determine if detection and abundance estimates from trail and non-trail transects were significantly different. Across two, 3-week …
Development Of Gc-Ms Database Of Essential Oil Components By The Analysis Of Natural Essential Oils And Synthetic Compounds And Discovery Of Biologically Active Novel Chemotypes In Essential Oils, Prabodh Satyal
Dissertations
Based on the numerous side effects of synthetically-derived medicines, many people are trying to transform their lifestyles through naturopathy. Unfortunately, due to a lack of complete instrumental techniques and strict government regulation, adulteration of natural products is rampant all over the world. About 80% of commercially available, so-called “natural” essential oils are adulterated for economic profit. So to track adulteration, the Sat-Set Gas Chromatography-Linear Retention Index-Mass Spectrometry (GC-LRI-MS) library has been created. This extensive library contains 2,700 pure, complete mass spectra, including retention index, molecular weight, and formula information. Those mass spectra were collected from 590 different essential oil samples …

Characterization Of The Afternoon To Evening Transition Of The Planetary Boundary Layer Over North Alabama And Implications For Convective Maintenance, Enhancement, And Initiation, Stephanie Mullins Wingo
Dissertations
Investigation of 143 cases of the north Alabama planetary boundary layer's afternoon to evening transition (AET) using surface, profiling, and radar observations contributes to the relative scarcity of datasets for this period. Results indicate several characteristics previously deemed important for convective initiation and/or maintenance, namely a rise in boundary layer water vapor and convergence. Waning surface heating causes turbulent eddies to decay, decreasing vertical heat and momentum fluxes, evident in declining surface wind speeds as horizontal flow above the surface layer increases. After surface temperature variances decline, the rate at which vertical velocity fluctuations decay increases as vigorous thermals diminish, …
