In the legal scholarship, the 'new governance' mode of governance advances an administrative arrangement where decision-making is shared amongst a range of actors, both public and private. The flexible, responsive, and collaborative governance orientation is intended to counter the ill effects of a coercive, top-down, state-centric, command-and-control approach to governance. Critics contend the new governance framework can displace the interests of local communities, disempower individuals, and dislodge basic human rights. The U.S. military has adopted such an adaptive approach in its own governance structure, which in this article is referred to as: the new governance "mentality." This mentality of governance …

Edification From The Andorran Model: A Brief Exploration Into The Condominium Solution On The International Stage And Its Potential Application To Current Land Disputes, Taylor Calvin Perkins

Indiana Journal of Global Legal Studies

This note explores the international legal concept of the condominium solution and its current manifestation under the Andorran political system. It endeavors to come to a working definition of condominium, before embarking on a survey of condominiums throughout history. The note then chronicles the history of Andorra and the genesis of the Andorran condominium, and then analyzes the current Andorran constitution and the influence of the condominium within the document. Lastly, the paper explores why Andorra has been able to remain a condominium for over eight centuries, before finally ruminating on the optimistic future of condominium solutions in international law.

When Harvard Said No To Eugenics: The J. Ewing Mears Bequest, 1927, Paul A. Lombardo

James Ewing Mears (1838-1919) was a founding member of the Philadelphia Academy of Surgery. His 1910 book, The Problem of Race Betterment, laid the groundwork for later authors to explore the uses of surgical sterilization as a eugenic measure. Mears left $60,000 in his will to Harvard University to support the teaching of eugenics. Although numerous eugenic activists were on the Harvard faculty, and who of its Presidents were also associated with the eugenics movement, Harvard refused the Mears gift. The bequest was eventually awarded to Jefferson Medical College in Philadelphia. This article explains why Harvard turned its back …

French And Indian Cruelty? The Fate Of The Oswego Prisoners Of War, 1756-1758, Timothy J. Shannon

This article examines what happened to approximately 1,200 prisoners of war taken by the French and their Indian allies at the British post Fort Oswego in August 1756. Their experiences illuminated the contrast between traditional methods of warfare in colonial America and the new rules of war being introduced by European armies fighting in the French and Indian War. Although European armies claimed to treat POWs more humanely than Native Americans, their supposedly civilized rules of warfare actually increased the suffering of the Oswego prisoners.

The United States Special Operations Command (USSOCOM) has emphasized the importance of international SOF collaboration, or what USSOCOM refers to as a “global SOF network.” It is difficult to achieve requisite levels of collaboration even among departments and agencies within a single country, much less on an international basis. Yet USSOCOM has been rightly praised for its trailblazing collaboration efforts in counterterrorism operations, so perhaps it can extend successful collaboration to its “global SOF network.” This article argues collaboration lessons from the past decade of counterterrorism operations can be used to facilitate better international SOF collaboration. Illicit drug trafficking is a prominent national security issue in a globalizing world. Drug trafficking intersects with major security issues such as rogue and narco-states, weak and failing states, insurgencies and terrorism, transnational organized crime and protracted intrastate conflicts. These are the same issues that sets the operational environment for the deployment of SOF. Rather than treating drug trafficking as a singular and separate security issue, global SOF counternarcotics operations must adapt previous approaches to new realities.

The current Defense Strategy assigns Special Operations Forces (SOF) to play a central role in countering terrorism, weapons of mass destruction, and irregular warfare. However, there has been little published that defines the role of Special Operations alongside air, land, and sea domains. The U.S. Special Operations Community struggles to define its own theoretical concepts such as direct approach and indirect approach. Specific recommendations for managing the Russia relationship in the context of missile defense are given. At the Congress of Vienna from September 1814 to June 1815, Stewart, the second Marquees of Londonderry and Viscount Castlereagh, succeeded in encircling France with a cordon of strong states that could better resist the possibility of future French military aggression. He conceived these goals with an eye towards European balance of power, strategically resettling European borders and placating allies when necessary. Analysis Of The Detection Of Organophosphate Pesticides In Aqueous Solutions Using Polymer-Coated Single Idt Sensors, Michael J. Mccarthy

The single interdigital transducer (IDT) device was investigated as a micro-chemical sensor for the detection of organophosphates compounds in aqueous solutions. The compounds of interest are: parathion, parathion-methyl, and paraoxon. The polymers used as a partially-selective coating for the direct detection of these compounds are 2,2'-diallylbisphenol A- 1,1,3,3,5,5-hexamethyltrisiloxane (BPA-HMTS) and polyepichlorohydrin (PECH). BPA-HMTS is synthesized here at Marquette University. The measurement of interest for the single IDT is the change radiation resistance. The radiation resistance represents the energy stored in the propagating acoustic wave. As analyte absorbs into the polymer coating, changes in the film's properties will undergo resulting in …

Regime change during the Arab Spring allowed Islamist political forces that had long been marginalized to achieve political influence in Tunisia, Egypt, and Libya. Morocco’s first government led by an Islamist party has been in power since January 2012. Birmingham, Alabama was a racially segregated city up until 1963 when members of Southern Christian Leadership Conference (SCLC) began a movement to stop discrimination against the African American population. Though the movement itself was conducted in a peaceful nonviolent manner, opposition from the white civic authorities was often cruel and bloody. Images of protesters both young and old were projected across the news and made the American people think deeply about the problems within their country. Eventually, the protests paid off and the Civil Rights Act of 1964 passed, prohibiting racial discrimination in public accommodations, facilities, transportation and the workplace. …

Globalization’s “interconnecting” effects have blended with an ethos of instability to create an extraordinarily complex global security environment. Though the number of armed conflicts worldwide has declined since the early 1990s, the character of those conflicts has evolved in some troubling ways.
