“Clashing Images”: Issues Of Tournament And Identity In The Chivalric Literature Of Early Modern England, Dmitriy Istomin Jan 2014

“Clashing Images”: Issues Of Tournament And Identity In The Chivalric Literature Of Early Modern England, Dmitriy Istomin

Theses & ETDs

Knightly tournament was a vital tradition in both the history and literature of the European Medieval Era. My thesis examines the tournament in England in the transitional period of the fifteenth and sixteenth century as a tool for image-making and focuses on the relationship between monarchy and aristocracy; both the historical and literary depictions of tournament are covered. In the first chapter, I look at the publisher William Caxton and his cultivation of a chivalric readership in England as well as the literary manifestations of tournament in Thomas Malory’s Le Morte Darthur. The second chapter covers Queen Elizabeth’s use of …

A Wreck Of A Site: An Archaeological Examination Of Cauldrons From The Storm Wreck, 8sj5459, Annie E. Carter Jan 2014

A Wreck Of A Site: An Archaeological Examination Of Cauldrons From The Storm Wreck, 8sj5459, Annie E. Carter

Theses & ETDs

In this thesis, I examine a set of historic iron and copper cauldrons from an 18th century Loyalist shipwreck off the coast of St. Augustine, in hopes of contributing to a narrative about a people largely forgotten by popular history. The examination of these cauldrons offers an entryway for the analysis and interpretation of Loyalist intentions. The cauldrons on the Storm site were part of a colonial, capitalistic society – as key items in an intermediary and inconclusive time for a refugee population. This allows us to view the cauldrons as both economic and social factors in Loyalist lifestyles; on …

Translating Tristan: Reconsidering Medieval Translations Of The Tristan And Isolde Story, Holly Mcarthur Jan 2014

Translating Tristan: Reconsidering Medieval Translations Of The Tristan And Isolde Story, Holly Mcarthur

Theses & ETDs

This thesis examines three medieval versions of the Tristan and Isolde story: Brother Robert’s 1226 Old Norse Tristrams saga ok Ísöndar, the French prose Tristan (c. 1230–5), and the Tavola Ritonda (Italy, early to mid-fourteenth century). My study of these texts focuses on the way in which medieval authors approached translation as its own creative process, for example changing a narrative to make a story more suitable for new audiences in different cultural and political environments. Tristrams saga demonstrates the Norse appropriation of Angevin court culture carried out by King Håkon IV Håkonsson in support of a changing political system; …

John F. Kennedy At American University: The Rhetoric Of The Possible, Epideictic Progression, And The Commencement Of Peace, Denise M. Bostdorff, Shawna Ferris Jan 2014

John F. Kennedy At American University: The Rhetoric Of The Possible, Epideictic Progression, And The Commencement Of Peace, Denise M. Bostdorff, Shawna Ferris

All Faculty Articles

In his American University address, Kennedy employed epideictic progression, a pedagogical process drawing upon dissociation and epideictic norms to convince listeners, gradually, to embrace a new vision—in this case, a world in which a test-ban treaty with the U.S.S.R. was possible. To do so, Kennedy's words: (1) united the audience behind the value of “genuine peace”; (2) humanized the Soviets as worthy partners in genuine peace; (3) established the reality of the Cold War and the credibility of U.S. leadership; and (4) connected lessons on genuine peace to domestic civil rights.

Treaty Termination And Historical Gloss, Curtis A. Bradley Jan 2014

Treaty Termination And Historical Gloss, Curtis A. Bradley

Articles

The termination of U.S. treaties provides an especially rich example of how governmental practices can provide a “gloss” on the Constitution’s separation of powers. The authority to terminate treaties is not addressed specifically in the constitutional text and instead has been worked out over time through political-branch practice. This practice, moreover, has developed largely without judicial review. Despite these features, Congress and the President—and the lawyers who advise them—have generally treated this issue as a matter of constitutional law rather than merely political happenstance. Importantly, the example of treaty termination illustrates not only how historical practice can inform constitutional understandings …

“To Fly Is More Fascinating Than To Read About Flying”: British R.F.C. Memoirs Of The First World War, 1918-1939, Ian A. Isherwood Jan 2014

“To Fly Is More Fascinating Than To Read About Flying”: British R.F.C. Memoirs Of The First World War, 1918-1939, Ian A. Isherwood

Civil War Institute Faculty Publications

Literature concerning aerial warfare was a new genre created by the First World War. With manned flight in its infancy, there were no significant novels or memoirs of pilots in combat before 1914. It was apparent to British publishers during the war that the new technology afforded a unique perspective on the battlefield, one that was practically made for an expanding literary marketplace. As such former Royal Flying Corps pilots created a new type of war book, one written by authors self-described as “Knights in the Air”, a literary mythology carefully constructed by pilots and publishers and propagated in the …

Un Peacekeeping Impacts On Human Rights, Elise Durant Jan 2014

Un Peacekeeping Impacts On Human Rights, Elise Durant

Electronic Theses and Dissertations

This paper seeks to explore the impacts of peacekeeping operations by the United Nations on the human rights abuses associated with civil wars. Previous research has consistently found evidence that civil wars increase human rights abuses; however, the literature has not adequately analyzed possible factors that could decrease this violence or the affects peacekeeping could have on human rights performances. The UN has four types of peacekeeping operations: observer, traditional, multidimensional, and enforcement. The results of a Heckman selection model for 57 countries that have experienced a civil war between 1976 and 2012 suggest peacekeeping does impact human rights performances, …

Illinois Gets An “F” In Public School Financing, 48 J. Marshall L. Rev. 141 (2014), Matthew Locke

UIC Law Review

Contrary to the Federal Constitution, almost every state constitution, including Illinois’s, specifically guarantees its citizens’ the right to a free and efficient education provided by the state. This article will advocate for a number of reforms, which will minimize spending disparities across the state, enhance equality in per-pupil funding, and lower overall operating cost.

The Soldier Bears The Deepest Wounds And Scars Of War: Mobilizing Connecticut To Implement A Veterans Treatment Court Note, Rosendo Garza, Jr. Jan 2014

The Soldier Bears The Deepest Wounds And Scars Of War: Mobilizing Connecticut To Implement A Veterans Treatment Court Note, Rosendo Garza, Jr.

Connecticut Law Review

The first Veterans Treatment Court (“VTC”) opened in 2004 and aimed to help veterans who ran afoul of the law. These problem-solving courts not only serve to treat the underlying issues many veterans suffer post-military service, but also hold veterans accountable. As a consequence of their incredible results, there are now over one hundred VTCs across the nation. Connecticut has none. This Note urges Connecticut to establish a VTC.

Foreign Direct Investment From China: Sense And Sensibility, Angela Huyue Zhang Jan 2014

Foreign Direct Investment From China: Sense And Sensibility, Angela Huyue Zhang

Northwestern Journal of International Law & Business

Inspired by psychological studies on human judgment, this Article represents the first attempt to provide a systematic account of how various heuristics and cognitive biases can influence public perception as well as regulatory response to foreign direct investment. In particular, it catalogues the main social and cognitive mechanisms through which various well-organized interest groups can exploit public fear of foreign direct investment from China. By closely studying two examples—the U.S. Congress’ hostile response to CNOOC’s attempted acquisition of Unocal and the European Commission’s increased antitrust scrutiny of Chinese state-owned enterprises’ acquisitions in Europe—this Article shows how undue fear of Chinese …

Pashtunistan's Future: The Global Executive Or A Regional Solution, Joshua A. Kurtzman Jan 2014

Pashtunistan's Future: The Global Executive Or A Regional Solution, Joshua A. Kurtzman

Indiana Journal of Global Legal Studies

This note explores the transnational security issues associated with the Pashtunistan region following the withdrawal of NATO from Afghanistan in 2014. More specifically, at a time when this region is at a religious, governance, and globalization crossroads, this note posits that only two alternatives exist for addressing the security situation in this region. First, a global executive, or executives, could use their power to exert transnational security pressure through drone strikes or other pseudo-military alternatives. A second alternative, and one which this note considers much more promising, is the development of a "NATO like" organization of Muslim nations to assist …

Iris Young, Radical Responsibility, And War, Harry Van Der Linden Jan 2014

Iris Young, Radical Responsibility, And War, Harry Van Der Linden

Scholarship and Professional Work - LAS

In this paper I argue that a merit of Iris Young’s social connection model of responsibility for structural injustices is that it directs the American people’s responsibility for unjust wars, such as the recent war against Iraq, toward their responsibility to abolish the “war machine,” including the “empire of bases,” that is a contributing factor of unjust U.S. wars. I also raise two objections to her model. First, her model leads us to downplay the culpability of the American people as a political collective in voting to continue the Iraq war with the re-election of George W. Bush. Second, Young …

Escaping From Lawyers' Prison Of Fear, John Lande Jan 2014

Escaping From Lawyers' Prison Of Fear, John Lande

Faculty Publications

Lawyers regularly experience numerous fears endemic to their work. This is not surprising considering that lawyers generally operate in environments that frequently stimulate many fears. Lawyers’ fears can lead them to enhance their performance due to increased preparation and effective “thinking on their feet.” Fear is problematic when it is out of proportion to actual threats, is expressed inappropriately, or is chronically unaddressed effectively. It can lead to sub-optimal and counterproductive performance through paralysis, ritualized behavior, or inappropriate aggression. Some lawyers’ fears unnecessarily prevent them from performing well, producing good results for clients, earning more income, and experiencing greater satisfaction …
