Naturalizing Immigration Imprisonment, César Cuauhtémoc García Hernández
Naturalizing Immigration Imprisonment, César Cuauhtémoc García Hernández
Sturm College of Law: Faculty Scholarship
Only recently has imprisonment become a central feature of both t across every level of government and involving civil and criminal law enforcement tools.
Examining the population as a whole provides crucial insights as to how we arrived at this state of mass immigration imprisonment. While political motivations — parallel to those that fueled the rapid expansion of criminal mass incarceration — may have started the trend, this Article demonstrates that key legal and policy choices explain how imprisonment has become an entrenched feature of immigration law enforcement. In fact, legislators and immigration officials have locked themselves into this choice, …

Differences Between Children With Fetal Alcohol Spectrum Disorders And Attention Deficit Hyperactivity Disorders: Rural Social Work Implications For Prevention, Assessment And Treatment, Susan M. Ryan, George S. Leibowitz, Jeanne M. Nauheimer, Paul Force-Emery Mackie
Social Work Department Publications
This literature review examined nine quantitative research studies published between 1992-2013 that compared children with Fetal Alcohol Spectrum Disorders (FASD) and Attention Deficit Hyperactivity Disorder (ADHD) to identify: (a) the differences between these children (e.g., intellectual, behavioral); and (b) the diagnostic tools that may be used to distinguish between them, thereby providing a differential diagnosis. Special focus was placed on rural treatment implications. These studies revealed differences between the intellectual, executive functioning, adaptive behavior, motor, and behavioral skills of children with FASD and ADHD. This review identified neurodevelopmental assessments used in these nine research studies that appear to support learning …

Men And Mustangs: From Communicative Messages Within The Wild Horse Inmate Program To A Communicative Theory Of Learning How To Teach, Kristine Larissa Reyes
Men And Mustangs: From Communicative Messages Within The Wild Horse Inmate Program To A Communicative Theory Of Learning How To Teach, Kristine Larissa Reyes
Electronic Theses and Dissertations
The purpose of this study was to discover the communicative messages within the Wild Horse Inmate Program. This dissertation developed the communicative theory of learning how to teach, a grounded theory based on the communicative messages of the Department of Corrections' officers and Bureau of Land Manager employees who work with inmates in a western state Wild Horse Inmate Program. I approached theorizing the communicative theory of learning how to teach from the applied communication perspective that communication is the enactment and application--symbolic and physical--of communication in daily life. The applied context was the Wild Horse Inmate Program where I …

What Is Cheating? Student And Faculty Perception Of What They Believe Is Academically Dishonest Behavior, Watson George, James M. Sottile, Grace Jia Liang
College of Education
The study of ethics and moral development of college students is an important issue. Knowing and understanding the ethical behavior of college students can lead to changing and increasing appropriate behavior among graduate and undergraduate students. Such changes in ethical behavior and moral development during the college experience can strengthen the foundation for appropriate adjustments and foster a greater awareness for positive ethical behavior throughout a lifetime. This research study examined the perception of what students and faculty believe is academically dishonest behavior by identifying different types of scenarios. Given the cheating behavior by students, it is important to know …

Victim Worthiness: The Effect Of Media Coverage On The Portrayal Of Homicide Victims, Danielle Christenson
Victim Worthiness: The Effect Of Media Coverage On The Portrayal Of Homicide Victims, Danielle Christenson
Undergraduate Review
In the last thirty years with the growth of 24-hour news channels, Internet only news sites and the decline of the newspaper, there have been tremendous changes in how the media covers crimes. Whether it is a catastrophic terrorist attack, school shooting or a low-profile homicide, violent crime is a staple of news coverage. The field of victimology has documented that the media does not portray all crime victims the same. The race and class of the victim as well as seemingly non-relevant factors such as their age, profession and the location of the crime as well as the demographics …
Cold Comfort Food: A Systematic Examination Of The Rituals And Rights Of The Last Meal, Sarah Gerwig-Moore
Cold Comfort Food: A Systematic Examination Of The Rituals And Rights Of The Last Meal, Sarah Gerwig-Moore
Articles
Last meals are a resilient ritual accompanying executions in the United States. Yet states vary considerably in the ways they administer last meals. This paper explores the recent decision in Texas to abolish the tradition altogether. It seeks to understand, through consultation of historical and contemporary sources, what the ritual signifies. We then go on to analyze execution procedures in all 35 of the states that allowed executions in 2010, and show that last meal allowances are paradoxically at their most expansive in states traditionally associated with high rates of capital punishment (Texas now being the exception to that rule.) …

From Morris To Nosal: The History Of Exceeding Authorization And The Need For A Change, 30 J. Marshall J. Info. Tech. & Privacy L. 465 (2014), Vasileios Karagiannopoulos
UIC John Marshall Journal of Information Technology & Privacy Law
This Article discusses and examines the various cases that pertain to the issue of exceeding authorized access throughout the years from United States v. Morris to the recent United States v. Nosal. Further, this Article thoroughly examines the Ninth Circuit’s approach regarding the issue of exceeding authorization; specifically, the need for the Ninth Circuit’s narrower interpretation in United States v. Brekka and Nosal. Finally, this Article proposes an alternative phrasing for the term “exceeding authorization,” and a revised interpretation of the phrase and the relevant offenses under the Computer Fraud and Abuse Act. This recommended interpretation suggests establishing different degrees …

Throughout its existence, the U.S. Securities and Exchange Commission (“SEC”) has allowed defendants to settle cases without admitting to the allegations of wrongdoing. This “neither admit nor deny” policy has received heavy criticism by judges, Congress, and the public, especially in the wake of the 2008 financial crisis. On June 18, 2013, SEC Chairman Mary Jo White announced the agency’s intention to require admissions of guilt in certain cases. While Chairman White did not articulate a clear standard of when admissions would be required, she did say that the agency would focus on the egregiousness of the defendant’s conduct and …
