To the great relief of many, American criminal law, long known for its harshness and expansive prohibitory reach, is now showing signs of softening. A prime example of this shift is seen in the proliferation of laws decriminalizing the personal possession of small amounts of marijuana: today, almost twenty states and dozens of localities have embraced decriminalization in some shape or form, with more laws very likely coming to fruition soon. Despite enjoying broad political support, the decriminalization movement has however failed to curb a core feature of criminalization: police authority to arrest individuals suspected of possessing marijuana. Arrests for …

Police Sexual Misconduct: A National Scale Study Of Arrested Officers, Philip M. Stinson, John Liederbach, Steven L. Brewer, Brooke E. Mathna
Criminal Justice Faculty Publications
Police sexual misconduct is often considered a hidden crime that routinely goes unreported. The current study provides an empirical data on cases of sex-related police crime at law enforcement agencies across the United States. The study identifies and describes incidents where sworn law enforcement officers were arrested for one or more sex-related crimes through a quantitative content analysis of published newspaper articles and court records. The primary news information source was the Google News search engine using 48 automated Google Alerts. Data are analyzed on 548 arrest cases in the years 2005-2007 of 398 officers employed by 328 nonfederal law …

State Of Juvenile Justice Report: 2014, Anne M. Hobbs, Sommer Fousek
Reports
The 2014 State of Juvenile Justice Report provides a snapshot of the juvenile justice system in Nebraska, with a specific focus on the current legislative context and an examination of three key points in the system: diversion, probation, and detention.
Trends within the juvenile justice system should be analyzed against the backdrop of statewide shifts that are a result of legislative mandates. In particular, Legislative Bill 561 has altered the juvenile justice landscape. Passed in 2013, LB 561 required communities to use programs aligned with evidence-based practices or best practices, with the goal of diverting youth out of the formal …

Some Other Men's Rea - The Nature Of Command Responsibility In The Rome Statute, Joshua L. Root
Some Other Men's Rea - The Nature Of Command Responsibility In The Rome Statute, Joshua L. Root
Florida State University Journal of Transnational Law & Policy
The Rome Statute of the International Criminal Court provides for Command Responsibility. The provision addressing this is ambiguous and raises a number of interpretive issues. Command responsibility can either be understood as a mode of liability-a way of holding commanders vicariously responsible for the acts of their subordinates, or it can be understood as a separate, distinct crime based on the commander's dereliction of his supervisory duties. The Rome Statute is not clear on the matter and points in both directions. In recent years, the mode of liability approach has come under increasing scrutiny by academics and by judges, particularly …

The Shackling Of Incarcerated Pregnant Women: A Human Rights Violation Committed Regularly In The United States, University Of Chicago Law School - Global Human Rights Clinic, Chicago Legal Advocacy For Incarcerated Mothers, Aclu National Prison Project
Global Human Rights Clinic
The international human rights community has repeatedly expressed concern about the shackling of pregnant women deprived of their liberty in the United States. The federal government has adopted an anti-shackling policy and some states have passed laws or policies restricting shackling. Despite these positive developments, shackling of women prisoners continues to occur in violation of U.S. and international law.
Shackling pregnant women increases the substantial medical risks of childbirth. Shackling of pregnant women is a harmful, painful, and demeaning practice that is rarely necessary to preserve safety. Most female prisoners are non-violent offenders, and women who are pregnant, in labor, …

Background
A performance measurement system is planned for South African substance abuse treatment services. Provider-level barriers to implementing these systems have been identified in the United States, but little is known about the nature of these barriers in South Africa. This study explored the willingness of South African substance abuse treatment providers’ to adopt a performance measurement system and perceived barriers to monitoring service quality that would need to be addressed during system development.
Methods
Three focus group discussions were held with treatment providers from two of the nine provinces in South Africa. These providers represented the diverse spread of …
The Globalization Of Human Rights In Post-Genocide Rwanda, Sadara Shine
The Globalization Of Human Rights In Post-Genocide Rwanda, Sadara Shine
Bridges: A Journal of Student Research
In the past two decades, Rwanda has been through major changes, from a conflict-ridden society with deep divisions between the two main ethnic groups–Hutus and Tutsis–to a case of impressive economic growth. Despite the progress, deep divisions and human rights issues exist. To avoid the recurrence of any conflict, both state and non-state actors are playing varied roles in a post-genocide Rwanda. Based on both primary and secondary sources, this article argues that in an era of globalization and postgenocide in Rwanda, non-state actors like international non-governmental organizations have the most impact in the preservation of human rights. So, in …

An Examination Of Federal Sentencing Guidelines’ Treatment Of Mdma (“Ecstacy”), Alyssa Hennig
Belmont Law Review
This Note analyzes the MDMA drug equivalency ratio under the current Guidelines and argues that the ratio is based on incomplete and inaccurate information. Part I of this Note provides an overview of the United States Sentencing Commission (“the Commission”) and the United States Sentencing Guidelines (“the Guidelines”). Part II discusses the rise of MDMA and the legislative response. It also summarizes the Commission’s findings regarding the social and physiological harms of MDMA that formed the basis for the Commission’s decision about the appropriate MDMA drug equivalency ratio. Part III examines the errors in the Commission’s empirical analysis of the …
Informal Transnational Police-To-Police Information Sharing: Its Structure And Reform, Michael Robert Walton
Informal Transnational Police-To-Police Information Sharing: Its Structure And Reform, Michael Robert Walton
LLM Theses
This thesis examines the informal sharing of information and cooperation between police agencies across international borders, and how it is or should be informed by international human rights law. The author looks at how intelligence-led policing theory has affected transnational policing. A distinction is made between police actions made on domestic soil that have adverse consequences abroad and police actions made on foreign soil that have adverse consequences. The first category of cases is firmly within jurisdiction and covered by domestic and international legal obligations. The second category of cases introduces the concept of the extraterritorial application of international human …
