Lost In The Weeds Of Pot Law: The Role Of Legal Ethics In The Movement To Legalize Marijuana, Helia Garrido Hull
Lost In The Weeds Of Pot Law: The Role Of Legal Ethics In The Movement To Legalize Marijuana, Helia Garrido Hull
Dickinson Law Review (1908-2003)
Every day attorneys face ethical dilemmas in trying to meet client needs while complying with professional rules of conduct. Perhaps nowhere is the risk of violating ethics rules more apparent than in states that have diverged from federal drug policy on marijuana. Attorneys currently engaged in marijuana-related counseling may violate federal law even where their actions are otherwise legal under state law. Changes in public opinion regarding the legality of marijuana that are driving some states to legalize or decriminalize certain marijuana-related activities provide no basis for attorneys to breach the covenant they have made with the public to uphold …
Brew Free Or Die? A Comparative Analysis Of U.S. And E.U. Craft Beer Regulations, Tammy Lam
Brew Free Or Die? A Comparative Analysis Of U.S. And E.U. Craft Beer Regulations, Tammy Lam
Cardozo Journal of International and Comparative Law
The note examines the challenges faced by craft beer brewers and small alcohol producers in the United States and the European Union under current regulatory frameworks, particularly the U.S. three-tier system. It critiques the system for constraining small producer growth while favoring large brewers and suggests that adopting elements of the E.U.'s regulatory approach, which prioritizes public health and advertising regulation, could foster growth and promote safe alcohol consumption. The analysis also highlights the need for cultural shifts in U.S. perceptions of alcohol to support smaller producers
Rehabilitate Or Incarcerate? A Comparative Analysis Of The United States' Sentencing Laws On Low-Level Drug Offenders And Portugal's Decriminalization Of Low-Level Drug Offenses, Caroline E. Sapp
Cardozo Journal of International and Comparative Law
America's criminal justice system is in need of targeted reform. Throughout this country, too many Americans are trapped- and too many communities are weakened - by a vicious cycle of poverty, criminality, and incarceration. Too many people go to too many prisons for far too long - and for no truly good law enforcement reason. The U.S. prison population has grown at an astonishing rate over the last three decades - by almost 800 percent since 1980, despite the fact that America's overall population has increased by only about a third. As we speak, more than 219,000 federal inmates are …
The Not So Speedy Trial Act, Shon Hopwood
The Not So Speedy Trial Act, Shon Hopwood
Washington Law Review
The Speedy Trial Act (STA) of 1974 occupies a peculiar place in the criminal justice system. Very few pieces of legislation can lay claim to protecting both the rights of criminal defendants and the public’s significant interest in timely justice, while reducing the cost of judicial administration. The STA formerly accomplished these lofty aims by reducing pretrial delays. But for the past two decades legal scholars have ignored the STA, and both prosecutors and defense attorneys have subverted the STA’s goals by routinely moving for continuances. And although the Act categorically applies in every federal criminal case, it has been …

Distinguishing Acts Of War In Cyberspace: Assessment Criteria, Policy Considerations, And Response Implications, Jeffrey L. Caton Mr.
Books, Monographs & Collaborative Studies
View the Executive Summary
Determining an act of war in the traditional domains of land, sea, and air often involves sophisticated interactions of many factors that may be outside the control of the parties involved. This monograph seeks to provide senior policymakers, decisionmakers, military leaders, and their respective staffs with essential background on this topic as well as introduce an analytical framework for them to utilize according to their needs. It develops this theme in four major sections. First, it presents the characterization of cyberspace to establish terms for broader dialogue as well as to identify unique technical challenges that …

“All Good Things Flow . . . ”: Rule Of Law, Public Goods, And The Divided American Metropolis, James J. Kelly Jr.
Journal Articles
This essay is a review of and a response to Urban Decay, Austerity, and Rule of Law, an article written by Brent White, Simone Sepe, and Saura Masconale. Building upon an intuitively compelling social contract theory insight, the article sets out the theoretical and empirical cases for the authors’ contention that sustained investment in highly visible, essential local public goods provides crucial support for rule of law. White, Sepe, and Masconale offer their theory as a “make ‘gov’ not war” alternative to the Broken Windows Theory, which underlies order maintenance policing strategies. In the final section of the piece, the …
Offices Of Goodness: Influence Without Authority In Federal Agencies, Margo Schlanger
Offices Of Goodness: Influence Without Authority In Federal Agencies, Margo Schlanger
Articles
Inducing governmental organizations to do the right thing is the central problem of public administration. Especially sharp challenges arise when “the right thing” means executing not only a primary mission but also constraints on that mission (what Philip Selznick aptly labeled “precarious values”). In a classic example, we want police to prevent and respond to crime and maintain public order, but to do so without infringing anyone’s civil rights. In the federal government, if Congress or another principal wants an executive agency to pay attention not only to its mission, but also to some other constraining or even conflicting value—I …

Risk Assessment Of Sexually Abusive Clergy: Utility Of Sex Offender Risk Instruments With A Unique Offender Subgroup, Anthony Perillo
Risk Assessment Of Sexually Abusive Clergy: Utility Of Sex Offender Risk Instruments With A Unique Offender Subgroup, Anthony Perillo
Dissertations, Theses, and Capstone Projects
Sex offender risk instruments provide empirically based outlooks on recidivism risk and often serve as a critical part of sex offender management. If applied to unrepresented offender groups, these instruments may offer inaccurate pictures of risk and hinder efforts to reduce sexual violence. With little research available on sexually abusive clergy prior to the abuse scandal of the early 2000s, sexually abusive clergy are one group not represented in the research used to develop risk measures. An understanding of the validity of current risk assessment practices with sexually abusive clergy is critical and timely, as changes to the handling of …
Marvel Comics And New York Stories: Anti-Heroes And Street Level Vigilantes Daredevil And The Punisher, Jesse Allen
Marvel Comics And New York Stories: Anti-Heroes And Street Level Vigilantes Daredevil And The Punisher, Jesse Allen
Dissertations, Theses, and Capstone Projects
This thesis argues that the creation of street level, vigilante heroes The Punisher and Daredevil created by Marvel Comics authors and illustrators in the late 1970s and early 1980s reflected the socio-economic environment of New York City at this same moment in history. By examining an era of New York that was fiscally and socially tense along with the development of characters created by the New York based Marvel Comics, I aim to show how their creation was directly related to the environment which they were produced in.

Interactive 3-D Software In Aircraft Rescue And Fire Fighting Training, Mary K. Gorman Ph.D., Rita "Rene" I. Herron Ph.D.
International Journal of Aviation, Aeronautics, and Aerospace
As the nexus between aviation, fire science, and emergency management becomes increasingly more complex, technology can be used to augment training and avoid risk while maintaining authenticity with situational reality. In Aircraft Rescue & Fire Fighting (ARFF), the manner in which the learning content is effectively imparted to the student-professional can make all the difference in a successful emergency response. The interactive 3-D software developed exclusively for Dallas/Fort Worth Fire Training Research Center (DFW FTRC) is part of a curriculum designed to educated and train ARFF professionals in life-saving strategies and tactics. Through a 2013 Memorandum of Understanding, the world’s …
The Little India Riot: Domestic And International Law Perspectives, Siyuan Chen
The Little India Riot: Domestic And International Law Perspectives, Siyuan Chen
Research Collection Yong Pung How School Of Law
A riot involving hundreds of foreign labourers broke out in Little India, Singapore, on 8 December 2013. Only the second riot to occur in more than 40 years in fairly tranquil Singapore, the damage was extensive as rioters destroyed police and emergency vehicles and even injured dozens of police and civil defence personnel. The authorities only needed a few days to complete the investigations and shortly after, some of the alleged rioters were arrested and charged, while some of them were repatriated. The swiftness of the entire process prompted harsh criticism from international and local human rights groups, who claimed …

Former Mentors' Perceptions Of The Faith-Based Approach To Reducing Recidivism Implemented By The Marinette-Menominee Jail Outreach, Inc., James Langteau
Doctoral Dissertations and Projects
The purpose of this qualitative, hermeneutic phenomenological study was to examine the impact of a faith-based approach to reduce recidivism. The theoretical frameworks guiding this study included the belief system and self-efficacy theories. Participants consisted of a convenience sample of 21 former mentors of the Marinette-Menominee Jail Outreach. The setting was a Christian non-profit organization serving the Marinette and Menominee County Jails located in rural northern Wisconsin and the Upper Peninsula of Michigan. Semistructured interviews, surveys, and a focus group provided data to illuminate common themes. Data analysis included highlighting significant statements from volunteer mentors who engaged offenders to effect …

Acquisition, Custody, And Storage Of Firearms Used In 4-H Shooting Sports Programs, David J. White, Jedediah D. Smith
Journal of Extension
Shooting sports has been a 4-H program offering since the 1930's. Tragic events related to the use of firearms as weapons have caused public and private entities to evaluate and consider the appropriateness of youth access to and usage of firearms. 4-H educators have the primary responsibility for managing the risk associated with shooting sports programs. All 4-H educators should follow protocols for the acquisition, custody, and storage of firearms. In Oregon, 4-H educators and volunteers must follow an Oregon-centric risk management plan. This Tools of the Trade article focuses on Oregon's precautionary system used to administer its 4-H Shooting …
