Privacy In Public, Joel R. Reidenberg Oct 2014

Privacy In Public, Joel R. Reidenberg

University of Miami Law Review

As government and private companies rapidly expand the infrastructure of surveillance from cameras on every street corner to facial recognition for photographs on social media sites, privacy doctrines built on seclusion are at odds with technological advances. This essay addresses a key conceptual problem in U.S. privacy law identified by Justice Sotomayor in United States v. Jones and by Justice Scalia in Kyllo v. United States; namely that technological capabilities undermine the meaning of the third-party doctrine and the Fourth Amendment’s ‘reasonable expectation of privacy’ standard. The essay argues that the conceptual problem derives from the evolution of three stages …

Good Conduct Time For Prisoners: Why (And How) Wisconsin Should Provide Credits Toward Early Release, Michael O'Hear Oct 2014

Good Conduct Time For Prisoners: Why (And How) Wisconsin Should Provide Credits Toward Early Release, Michael O'Hear

Marquette Law Review

Wisconsin is one of about twenty states not offering good conduct time (GCT) to prisoners. In most states, prisoners are able to earn GCT credits toward accelerated release through good behavior. Wisconsin itself had GCT for more than a century, but eliminated it as part of a set of reforms in the 1980s and 1990s that left the state with what may be the nation’s most inflexible system for the release of prisoners. Although some of these reforms helpfully brought greater certainty to punishment, they went too far in eliminating nearly all meaningful recognition and encouragement of good behavior and …

“Dope” Dilemmas In A Budding Future Industry: An Examination Of The Current Status Of Marijuana Legalization In The United States, Steven A. Vitale Oct 2014

“Dope” Dilemmas In A Budding Future Industry: An Examination Of The Current Status Of Marijuana Legalization In The United States, Steven A. Vitale

University of Miami Business Law Review

This Comment provides an in-depth analysis of the current status regarding legalization of marijuana in the United States. It begins by tracing a brief history of the legalization movement in this country. The next section addresses the federal-state law conflict issue, coupled with a thorough analysis of two recent and relatively unexamined developments—the Department of Justice’s August 29, 2013 memorandum issued as a guide to federal prosecutors concerning marijuana law enforcement, and the September 10, 2013 judicial committee hearing on the conflict between federal and state marijuana laws. So long as the federal-state law conflict exists, it seems that the …

Why Full Implementation Is Long Overdue, Merril Sobie Oct 2014

Why Full Implementation Is Long Overdue, Merril Sobie

Elisabeth Haub School of Law Faculty Publications

In 1980, the American Bar Association (ABA) promulgated a far-reaching comprehensive body of Juvenile Justice Standards, thereby providing a blueprint for the reform of a system that had serious deficiencies. Developed in partnership with the Institute of Judicial Administration (IJA) at New York University, the standards address the entire juvenile justice continuum, from police handling and intake to adjudication, disposition, juvenile corrections, and ancillary functions. Approximately 300 professionals collaborated for a decade to produce the 23 volumes approved by the ABA House of Delegates.

To this day, the standards remain relevant and reformist. Several have been implemented in whole or …

A Stochastic Multi-Criteria Assessment Of Security Of Transportation Assets, Michelle Sophie Dojutrek Oct 2014

A Stochastic Multi-Criteria Assessment Of Security Of Transportation Assets, Michelle Sophie Dojutrek

Open Access Dissertations

Transportation project evaluation and prioritization use traditional performance measures including travel time, safety, user costs, economic efficiency, and environmental quality. The project impacts in terms of enhancing the infrastructure resilience or mitigating the consequences of infrastructure damage in the event of disaster occurrence are rarely considered in project evaluation. This dissertation presents a methodology to address this issue so that in evaluating and prioritizing investments, infrastructure with low security can receive the attention they deserve. Secondly, the methodology can be used for evaluating and prioritizing candidate investments dedicated specifically to security enhancement. In defining security as a function of threat …

Image Analysis Using Visual Saliency With Applications In Hazmat Sign Detection And Recognition, Bin Zhao Oct 2014

Image Analysis Using Visual Saliency With Applications In Hazmat Sign Detection And Recognition, Bin Zhao

Open Access Dissertations

Visual saliency is the perceptual process that makes attractive objects "stand out" from their surroundings in the low-level human visual system. Visual saliency has been modeled as a preprocessing step of the human visual system for selecting the important visual information from a scene. We investigate bottom-up visual saliency using spectral analysis approaches. We present separate and composite model families that generalize existing frequency domain visual saliency models. We propose several frequency domain visual saliency models to generate saliency maps using new spectrum processing methods and an entropy-based saliency map selection approach. A group of saliency map candidates are then …

Evaluating The Student Health Needs At Dalton State College, Cheryl W. Owens Oct 2014

Evaluating The Student Health Needs At Dalton State College, Cheryl W. Owens

Doctor of Nursing Practice (DNP) Translational and Clinical Research Projects

The incidence of chronic diseases in college students mirrors that of older adults. Yet despite the enactment of the Affordable Care Act (ACA), college student continue to have difficulty accessing medical care. Many have no insurance, limited transportation and inadequate finances during college to obtain medical care. While college health centers may improve access to care, smaller colleges often do not have the financial and personnel resources to provide student health services. Even in colleges that provide student health services, the focuses are primarily on sexual health, mental health, violence, and substance abuse. Prevention and treatment of chronic diseases services …

Tales Of Color And Colonialism: Racial Realism And Settler Colonial Theory, Natsu T. Saito Oct 2014

Tales Of Color And Colonialism: Racial Realism And Settler Colonial Theory, Natsu T. Saito

Faculty Publications By Year

More than a half-century after the Civil Rights Era, people of color remain disproportionately impoverished and incarcerated, excluded and vulnerable. Legal remedies rooted in the Constitution’s guarantee of equal protection remain elusive. This article argues that the “racial realism” advocated by the late Professor Derrick Bell compels us to look critically at the purposes served by racial hierarchy. By stepping outside the master narrative’s depiction of the United States as a “nation of immigrants” with opportunity for all, we can recognize it as a settler state, much like Canada, Australia, and New Zealand. It could not exist without the occupation …

Our Non-Originalist Right To Bear Arms, Robert Leider Oct 2014

Our Non-Originalist Right To Bear Arms, Robert Leider

Indiana Law Journal

District of Columbia v. Heller was a landmark, if controversial, opinion. Discussion has centered on the merits of its self-described originalist approach. Supporters praise its efforts to return to a more originalist and textualist approach to constitutional questions, whereas critics challenge the accuracy of Heller’s historical claims and criticize its departure from precedent.

This Article challenges much of the conventional wisdom about Heller, its use of originalism, and its relationship to nineteenth- and twentieth-century case law. This Article argues that, despite much of its rhetoric, Heller actually exemplified popular constitutionalism—not originalism—in the way it approached the most important practical question …

Modifying The Criminalization Hypothesis: Predicting Jail Diversion Outcome With Clinical, Criminological, And Personality Factors, Wen Gu Oct 2014

Modifying The Criminalization Hypothesis: Predicting Jail Diversion Outcome With Clinical, Criminological, And Personality Factors, Wen Gu

Dissertations, Theses, and Capstone Projects

There are a disproportionate number of individuals with serious mental illness in the criminal justice system, compared to the general population. Mental health courts and jail diversion programs were developed to divert individuals with mental illness out of jails into community treatment to ease the overburden of treating psychiatric disorders in the criminal justice system. These programs have become increasing popular, but little is known about the characteristics of the diverted individuals that result in successful outcomes. The purpose of this study is to test different causal models of noncompliance as predicted by clinical, criminological, and personality variables, and examine …

Millennial Libertarians: The Rebirth Of A Movement And The Transformation Of U.S. Political Culture, Kaja Tretjak Oct 2014

Millennial Libertarians: The Rebirth Of A Movement And The Transformation Of U.S. Political Culture, Kaja Tretjak

Dissertations, Theses, and Capstone Projects

This dissertation examines the contemporary resurgence of libertarianism in the U.S., exploring a rapidly expanding, transnational network of hundreds of thousands liberty movement participants connected through student groups, community organizations, and established institutions, as well as through social media and a vast array of online forums. Grounded in 32 months of ethnographic fieldwork and over 200 interviews, it documents the rise of a profound disenchantment, particularly among millennials, with state-based solutions to pressing contemporary problems and, more broadly, with the nation-state project itself. Drawing on first-hand accounts ranging from elite boardrooms and think tank conference rooms, to political demonstrations and …

Post-9/11 Illegal Immigrant Detention And Deportation: Terrorism And The Criminalization Of Immigration, Stefany N. Laun Oct 2014

Post-9/11 Illegal Immigrant Detention And Deportation: Terrorism And The Criminalization Of Immigration, Stefany N. Laun

Student Publications

This paper analyzes the changes in immigration policy since the terrorist attacks of September 11, 2001 in terms of how immigrants are viewed in the United States. The goal is to address the recent criminalization of immigration in that the perceptions of terrorists and immigrants have become relatively synonymous since 2001. Although deportations have decreased, immigrant detention has increased significantly. Detention centers pose threats to the basic human rights of the immigrants residing in them, as well as perpetuate the culture of fear enveloping recent immigrants, whether they are legally or illegally in the country, and native United States citizens …

Time To Unpack The Juggernaut?: Reflections On The Canadian Federal Parliamentary Debates On "Cyberbullying", Jane Bailey Oct 2014

Time To Unpack The Juggernaut?: Reflections On The Canadian Federal Parliamentary Debates On "Cyberbullying", Jane Bailey

Dalhousie Law Journal

Cyberbullying has come to the fore in federal parliamentary debate largely in the last two years in tandem with high profile media reporting of several teen suicides. The government responded with the Protecting Canadians from Online Crime Act that incorporates, among other things, criminal law responses to nonconsensual distribution of intimate images and gender-based hate propagation, but only at the expense of expanded state surveillance. However, a review of the parliamentary debates reveals a richer array of approaches in which the efficacy of criminal law responses was contested. This article reports on the diversity of viewpoints that emerged within the …

Remedies For Non-Citizens Under Provincial Nominee Programs: Judicial Review And Fiduciary Relationships, Delphine Nakache, Catherine Blanchard Oct 2014

Remedies For Non-Citizens Under Provincial Nominee Programs: Judicial Review And Fiduciary Relationships, Delphine Nakache, Catherine Blanchard

Dalhousie Law Journal

In Canada, more and more people get permanent residency under Provincial and Territorial Nominee Programs (PTNPs). Despite this new reality, there is today no detailed examination of the consequences of PTNPs for immigrants' rights and protections. In this paper, we seek to fill this gap. As we show, PTNPs have no statutory basis and officials who administer these programs do not exercise statutory authority of any kind. An alternative would be that these programs become "law"; then the decisions made under them would bejudicially reviewable for conformity with that law. However, it is unlikely to happen because "flexibility" is seen …
