An International Law Response To Economic Cyber Espionage, Christina Parajon Skinner
An International Law Response To Economic Cyber Espionage, Christina Parajon Skinner
Connecticut Law Review
Cyber threats have emerged as one of the most serious dangers to U.S. and global security. Increasingly, malicious actors—some private, but others that appear to be state-sponsored—seek to advance their strategic aims through violent or non-violent cyber-attacks. This Article considers the problem of non-violent, yet still destructive, economic cyber espionage, which targets the intellectual, industrial, and information property of major global powers like the United States. The Article argues that the international community’s reticence is owing to a stale set of international legal norms. The Article explains how existing principles of international law—such as state sovereignty, non-intervention, and state responsibility—should …

Suspended Sediment And Nutrient Behaviour On The River Bandon, Ireland, James Hickey
Suspended Sediment And Nutrient Behaviour On The River Bandon, Ireland, James Hickey
Theses
Suspended sediment is a key contributor to contaminant transfer within river systems. The relationship between the transport of suspended sediment and nutrients influences the status of water quality and sustainability of aquatic habitats. This thesis studies suspended sediment and nutrient transport on the River Bandon.
This thesis includes a literature review of suspended sediment and nutrient transport, appropriate legislation, river flow representation and flood frequency estimation.
As part of a structured field monitoring programme, manual samples have been collected periodically and tested for suspended sediment concentration (SSC), turbidity, five species of phosphorus and five species of nitrogen. Continuous in-situ turbidity …

Why The United States Cannot Agree To Disagree On Blasphemy Laws, Evelyn Aswad, Rashad Hussain, M. Suleman
Faculty Articles
At the Boston University International Law Journal's symposium "Realigning Western Policy and International Law after the Arab Spring," held on March 25, 2013, Professor Aswad gave the keynote address, where she described the extensive U.S. diplomatic efforts to promote the broadest possible protections for freedoms of expression and religion, even when it comes to speech that is considered blasphemous. A symposium participant asked why the United States cannot just agree to disagree with Muslim-majority countries on the treatment of blasphemy given the religious sensibilities in those countries and the number of other pressing equities the United States has pending with …

Have Inter-Judge Sentencing Disparities Increased In An Advisory Guidelines Regime? Evidence From Booker, Crystal S. Yang
Have Inter-Judge Sentencing Disparities Increased In An Advisory Guidelines Regime? Evidence From Booker, Crystal S. Yang
Coase-Sandor Institute for Law & Economics Research Paper Series
The Federal Sentencing Guidelines were promulgated in response to concerns of widespread disparities in sentencing. After almost two decades of determinate sentencing, the Guidelines were rendered advisory in United States v. Booker. How has greater judicial discretion affected inter-judge disparities, or differences in sentencing outcomes that are attributable to the mere happenstance of the sentencing judge assigned? This Article utilizes new data covering almost 400,000 criminal defendants linked to sentencing judge to undertake the first national empirical analysis of inter-judge disparities post Booker. The results are striking: inter-judge sentencing disparities have doubled since the Guidelines became advisory. Some of the …
Establishing Canada's First Integrated Domestic Violence Court: Exploring Process, Outcomes, And Lessons Learned, Rachel Birnbaum, Nicholas Bala, Peter Jaffe
Establishing Canada's First Integrated Domestic Violence Court: Exploring Process, Outcomes, And Lessons Learned, Rachel Birnbaum, Nicholas Bala, Peter Jaffe
Canadian Journal of Family Law
The establishment of domestic violence courts has resulted in significant improvements in responses to family violence, but these courts have generally dealt only with criminal cases and do not address the risks that the victim and children may face in family proceedings. In some locations in the USA, courts have been established to deal with both criminal and family proceedings that arise from a domestic violence situation. This paper describes and analyzes the establishment of the first court in Canada that hears both criminal and family cases concerning families where there are domestic violence issues. The authors report on a …
The Dignity Of The Human Person: Catholic Social Teaching And The Practice Of Criminal Punishment, Dora W. Klein
The Dignity Of The Human Person: Catholic Social Teaching And The Practice Of Criminal Punishment, Dora W. Klein
Faculty Articles
The moral foundation that supports the Catholic Church's opposition to the death penalty is wide and deep. This Article proposes that despite the oft-repeated maxim that "death is different," the same foundation that supports efforts to abolish the death penalty can also support those who seek to achieve other reforms in the practice of criminal punishment.

Fda Involvement In Off-Label Use: Debate Between Richard Epstein And Ryan Abbott, Richard A. Epstein, Ryan Abbott

Before a drug can be sold legally in the United States, the Food and Drug Administration (FDA) must approve it as safe and effective for a particular indication or use — the use then appears on the drug's label. Federal law, however, allows doctors to prescribe drugs that the FDA has approved for one indication for any other indication, even though the FDA never evaluated the safety or efficacy of the drug for that use. Off-label prescribing is an integral part of modern-day medicine. Patients may benefit when they receive drugs or devices in contexts not approved by the FDA. …

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
The author reviews the 11 constitutional decisions released by the Supreme Court of Canada in 2013. She makes three main points. First, the decisions are mainly unanimous. The great majority also upholds the existing law, excepting the dramatic decision of the Court to strike down three sections of the Criminal Code in the Bedford challenge to Canada’s criminal laws around the sale of sex. Second, two cases in which the Court was not unanimous, Quebec v. A and Manitoba Metis, engaged with critical and difficult constitutional questions, namely, the scope of section 15 equality protection and Canada’s constitutionalized relationships with …
Charter Right Or Charter-Lite?: Administrative Discretion And The Charter, Audrey Macklin
Charter Right Or Charter-Lite?: Administrative Discretion And The Charter, Audrey Macklin
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
The Supreme Court of Canada has vacillated in its guidance about the incorporation of the Charter into the exercise of discretion. The author contends that Doré’s attempt to synchronize proportionality analysis (derived from constitutional adjudication) with deferential reasonableness review (derived from administrative law) is unsatisfactory. The replacement of Charter “right” or “freedom” with Charter “value” obscures the recognition of rights and freedoms in play. The administrative law proportionality analysis that the Court endorses in Doré does not respect the primacy or priority of Charter rights, and curial deference toward the outcomes it produces exacerbates the dilution of rights protection. The …
