An Opt-In Approach To Regulating The Employment Decisions Of Religious Schools, Greg Walsh
An Opt-In Approach To Regulating The Employment Decisions Of Religious Schools, Greg Walsh
Law Papers and Journal Articles
This article evaluates the merits of an opt-in approach to regulating the employment decisions of religious schools in Australia under anti-discrimination legislation. The essence of the model involves religious schools registering with the government for the specific protection they need to make employment decisions that they consider necessary due to the school’s religious identity. The legislature, executive and judiciary are provided with significant supervisory roles under the proposed model to address the potential for religious schools to abuse the protections provided. The article argues that the opt-in model has the potential to more appropriately regulate the employment decisions of religious …

Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State
F rom 2011 through 2014, the Texas Department of Transportation collaborated with Prewitt and Associates, Inc., to investigate an isolated grave in a remote area alongside FM 481 in Maverick County, Texas. An initial archeological investigation confirmed that the location was a historic grave, and archival records revealed that it contained the remains of Salvador Camarena, a Mexican citizen who died in Texas in January 1950. Additional research identified Camarena’s son and other family members living in Mexico, California, and Texas. With the family’s permission, the burial remains were exhumed, examined, and reinterred at La Marque Cemetery in Galveston County, …

Demographics On Crime: A Look At The U.S.A., Nicolas Eceizabarrena
Demographics On Crime: A Look At The U.S.A., Nicolas Eceizabarrena
Empirical Economic Bulletin, An Undergraduate Journal
This study aims to identify how change in social indicators and demographics affect crime, more specifically, the number of aggravated assaults. As policy makers attempt to reduce crime to improve social conditions, changes to social indicator and demographic variables would allow quantifying these changes. This study uses a cross-sectional data set for the fifty states in the United States of America for the 2005 period.

Prisoners And Habeas Privileges Under The Fourteenth Amendment, Lee B. Kovarsky
Prisoners And Habeas Privileges Under The Fourteenth Amendment, Lee B. Kovarsky
Faculty Scholarship
The U.S. Reports contain no answer to a million-dollar question: are state prisoners constitutionally entitled to a federal habeas forum? The Supreme Court has consistently ducked the basic constitutional issue, and academic work on the question idles on familiar themes.
The strongest existing argument that state prisoners are constitutionally entitled to a federal habeas forum involves a theory of incorporation under the Fourteenth Amendment’s Due Process Clause. I provide a new and different account: specifically, that the Fourteenth Amendment’s Privileges and Immunities Clause (“PI Clause”) guarantees a habeas privilege as a feature of national citizenship, and that the corresponding habeas …
The Internal Revenue Service And A Crisis Of Confidence: A New Regulatory Approach For A New Era, Donald B. Tobin
The Internal Revenue Service And A Crisis Of Confidence: A New Regulatory Approach For A New Era, Donald B. Tobin
Faculty Scholarship
The Internal Revenue Service is not usually thought of as the agency charged with enforcing the nation’s campaign finance laws. It has found itself, however, at the center of a firestorm over both its involvement and its ineptitude in enforcing certain rules that regulate the campaign activities of tax-exempt organizations. For historical, legal, and practical reasons, the Internal Revenue Code regulates the political activity of tax-exempt groups, in some instances providing for disclosure of campaign donors and expenditures, and in other instances limiting the amount of political activity engaged in by tax-exempt organizations. As campaigns become more sophisticated and complicated, …

Taiwan’S 2014 Nine-In-One Election: Gauging Politics, The Parties, And Future Leaders, John F. Copper
Maryland Series in Contemporary Asian Studies
On Saturday November 29, 2014 voters in Taiwan (officially known as the Republic of China) went to the polls to cast ballots for mayors and city council members of the metropolitan cities, mayors and councilors of the counties and provincial cities, town- ship chiefs and councilors, aboriginal district chiefs and councilors, and borough and village chiefs. Sometimes called Taiwan’s “midterms”, these combined elections are held at four-year intervals, scheduled in between its national presidential/vice presidential and legislative elections. The midterms are now considered nearly as important as the latter elections, one of the reasons being as of 2014 all local …

Betty Klaric was a pioneering environmental reporter for the Cleveland Press. She began her career in 1955 as a "copy boy" at the paper, rising to reporter, assistant city editor, and first woman president of the Cleveland Newspaper Guild. Klaric's persistent and unflinching coverage of pollution in Cleveland's air, water, and soil inspired environmental legislation and community involvement, and won her national acclaim.
Older Prisoners, Edward F. Ansello
Older Prisoners, Edward F. Ansello
Director's Editorials from Age in Action
The impact of an aging prison population is causing concern among different stakeholders, including prison officials, legislative bodies, clergy, and some gerontologists. Prison officials are scrambling to accommodate the numbers and needs of older inmates, but they are confounded by constrained budgets, inappropriate prison architecture, lack of gerontologically and geriatrically trained staff members, indifferent legislative bodies, and a general lack of awareness among the public of these problems. Our states need not only retrofitted and newly designed physical facilities but also staffs and providers with gerontological and geriatric training, from corrections personnel to health care providers to clergy and mental …

Taking On Water: Local Government, Eminent Domain, And The Foreclosure Crisis, Brian Cullin
Taking On Water: Local Government, Eminent Domain, And The Foreclosure Crisis, Brian Cullin
University of Baltimore Journal of Land and Development
The 2008 Financial Crisis and the ensuing Great Recession sent shockwaves throughout the U.S. and global economy, wreaking havoc from Wall Street to Main Street. The Crisis harkened economic contraction, high unemployment, and elevated rates of home foreclosure. While the financial industry recovered, spelling an end to one crisis, another continues - the Foreclosure Crisis. The rate of home foreclosure, already ominously on the rise before 2008 and growing in intensity and breadth in the aftermath of the Financial Crisis, provides the foundation for this paper. This article examines an innovative public-private partnership between a private firm, Mortgage Resolution Partners …

Lethal Injection And The Right Of Access: The Intersection Of The Eighth And First Amendments, Timothy F. Brown
Lethal Injection And The Right Of Access: The Intersection Of The Eighth And First Amendments, Timothy F. Brown
Faculty Publications, School of Management
The Spring and Summer of 2014 have witnessed renewed debate on the constitutionality of the death penalty after a series of high profile legal battles concerning access to lethal injection protocols and subsequent questionable executions. Due to shortages in the drugs traditionally used for the lethal injection, States have changed their lethal injection protocols to shield information from both the prisoners and the public. Citing public safety concerns, the States refuse to release information concerning the procurement of the drugs to the public. Such obstruction hinders the public’s ability to determine the cruelty of the punishment imposed and creates the …
Renewed Commitment: The Latest Chapter In Reforming Virginia's Mental Health System, The Honorable Jennifer L. Mcclellan
Renewed Commitment: The Latest Chapter In Reforming Virginia's Mental Health System, The Honorable Jennifer L. Mcclellan
Richmond Journal of Law and the Public Interest
In the wake of the highly publicized Virginia Tech tragedy, the 2008 General Assembly Session adopted mental health reforms that focused on the provision of emergency services during the detention and commitment process, and an increase in funding to implement these reforms and strengthen emergency services. Despite the reforms, the issue of inadequate capacity to meet the increasing demand for mental health services remains in a number of key areas, including emergency services and a decline in in-patient psychiatric bed capacity while population growth continues.

Screening The Poor: The Legality Of Drug Testing For Welfare Benefits, Jacquelyn Bolen
Richmond Journal of Law and the Public Interest
On March 8, 2014, at the conclusion of the 2014 Virginia General Assembly regular session, Virginia joined at least 17 other states that, in this year alone, have introduced proposals to screen or test applicants for illegal substances prior to obtaining public assistance. Following the enactment of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, which permitted states to conduct drug testing as part of the Temporary Assistance for Needy Families (TANF) program, states began proposing drug screenings for applicants of public welfare benefits. Despite a 2003 Sixth Circuit decision holding that suspicionless drug testing is unconstitutional, in …
