Neither Panacea, Placebo, Nor Poison: Examining The Rise Of Anti-Unemployment Discrimination Laws, Seth Katsuya Endo Mar 2014

Neither Panacea, Placebo, Nor Poison: Examining The Rise Of Anti-Unemployment Discrimination Laws, Seth Katsuya Endo

Pace Law Review

Since 2009, the unemployment rate in the United States has remained above eight percent, which means that more than twelve million individuals have been looking for work at any given time. With so many affected individuals, unemployment has become an issue of public concern, particularly as stories describing employers refusing to consider currently unemployed candidates for job opportunities have proliferated. In response to these trends, about twenty states and the federal government have passed, or are considering, legislation designed to prohibit employers from discriminating against individuals based on their employment status.

The goal of this Article is to survey the …

Voting Rights Act Panel, Kareem Crayton, Brian Kemp, Tomas Lopez Mar 2014

Voting Rights Act Panel, Kareem Crayton, Brian Kemp, Tomas Lopez

Working in the Public Interest Conferences

Section V of the Voting Rights Act (VRA) required covered jurisdictions to obtain “preclearance” before making changes to voting laws. In Shelby County v. Holder, the Supreme Court held that the formula determining which jurisdictions were covered by Section V was unconstitutional. Following Shelby County, states previously covered by Section V began proposing changes to election laws. If those laws are in fact discriminatory they must now be challenged under Section II of the VRA, which places the burden on plaintiffs to show racial discrimination. This panel will provide an update on proposed and enacted election law changes being made …

Roadmap For Graduating Students With Expertise In The Analysis And Development Of Secure Cyber-Systems, Ann Q. Gates, Salamah Salamah, Luc Longpre Mar 2014

Roadmap For Graduating Students With Expertise In The Analysis And Development Of Secure Cyber-Systems, Ann Q. Gates, Salamah Salamah, Luc Longpre

Departmental Technical Reports (CS)

Modern society is intensely and irreversibly dependent on software systems of extraordinary size and complexity. This includes software systems in domain areas such as defense, energy, communication, transportation, and manufacturing. Due to the rapid expansion and reliance on the global Internet for day-to-day functions of individuals, organizations, governments, and industry around the world, cyber-security has emerged as an essential component of computing curricula. To address regional and national needs, the Computer Science Department has defined a roadmap for educating and preparing students who have expertise in the analysis and development of secure cyber-systems. Toward that vision, the department has set …

“Somebody Grab The Wheel!”: State Autonomous Vehicle Legislation And The Road To A National Regime, Andrew Swanson Mar 2014

“Somebody Grab The Wheel!”: State Autonomous Vehicle Legislation And The Road To A National Regime, Andrew Swanson

Marquette Law Review

This Comment critically analyzes bills, statutes, and regulations that govern the use of autonomous vehicles. Autonomous vehicles, also known as self-driving cars, represent the future of personal transportation. States have begun to regulate the testing and implantation of this technology onto public highways, and the federal government has suggested baseline regulations for states to consider when proposing future legislation. First, this Comment provides a brief overview of autonomous vehicle technology, as well as the pros and cons of a self- driving vehicle. Second, this Comment analyzes both enacted and proposed legislation at the state level. This Comment then recommends various …

Soil Fertility Status And Degradation Of 2, 4, 6-Trinitrotoluene Contaminated Soils, Chelsea Kae Katseanes Mar 2014

Soil Fertility Status And Degradation Of 2, 4, 6-Trinitrotoluene Contaminated Soils, Chelsea Kae Katseanes

Theses and Dissertations

Current models for predicting the environmental fate of munitions constituents (MC) in soils are based mostly on chemical distribution parameters and neglect the larger considerations of other soil parameters. We are working towards a new approach based on the whole soil activity for predicting the long-term residence time and fate of MC in soils with connection to agronomic soil fertility concepts. These relationships are demonstrated by correlating experiments involving full physical and chemical characterization of eight taxonomically distinct soils, with batch reactor studies determining MC degradation potential. Soils were incubated in a slurry for 10 days in a closed reactor …

Evaluating Public Transportation Local Funding Options, Todd Litman Mar 2014

Evaluating Public Transportation Local Funding Options, Todd Litman

Journal of Public Transportation

This report describes and evaluates 18 potential local funding options suitable for financing public transportation projects and services. They are evaluated according to eight criteria, including potential revenue, predictability and sustainability, horizontal and vertical equity, travel impacts, strategic development objectives, public acceptance and ease of implementation. This is a somewhat larger set of options and more detailed and systematic evaluation than most previous studies. This study discovered no new options that are particularly cost-effective and easy to implement; each has disadvantages and constraints. As a result, its overall conclusion is that a variety of funding options should be used to …

Alaska's Local Option Law And Its Impacts On Underage Drinking Outcomes, Natasha M. Pineda Mar 2014

Alaska's Local Option Law And Its Impacts On Underage Drinking Outcomes, Natasha M. Pineda

Student Projects for Graduate Degrees

The purposes of this project were to explore the relationship between alcohol bans and 1) age of first use, 2) 30-day use and perceptions of harm among high school students, and 3) intentional and unintentional injury among adolescents. Methods involved secondary data analyses of two samples from the Alaska Youth Risk Behavior Survey (YRBS), the Alaska Trauma Registry (ATR), and the Alaska Violent Death Reporting System (AKVDRS) – including 49 communities without a ban on possession, and including 11 villages with a ban on sales, importation and possession. Lower rates of self-reported alcohol consumption in underage persons in communities with …

Policing By Numbers: Big Data And The Fourth Amendment, Elizabeth E. Joh Mar 2014

Policing By Numbers: Big Data And The Fourth Amendment, Elizabeth E. Joh

Washington Law Review

This article identifies three uses of big data that hint at the future of policing and the questions these tools raise about conventional Fourth Amendment analysis. Two of these examples, predictive policing and mass surveillance systems, have already been adopted by a small number of police departments around the country. A third example—the potential use of DNA databank samples—presents an untapped source of big data analysis. Whether any of these three examples of big data policing attract more widespread adoption by the police is yet unknown, but it likely that the prospect of being able to analyze large amounts of …

Fingerprinting Ieee 802.15.4 Devices With Commodity Radios, Ira Ray Jenkins, Rebecca Shapiro, Sergey Bratus, Ryan Speers, Travis Goodspeed Mar 2014

Fingerprinting Ieee 802.15.4 Devices With Commodity Radios, Ira Ray Jenkins, Rebecca Shapiro, Sergey Bratus, Ryan Speers, Travis Goodspeed

Computer Science Technical Reports

We present a reliable method of PHY-layer fingerprinting of IEEE 802.15.4-conformant nodes with commodity digital radio chips widely used in building inexpensive IEEE 802.15.4-conformant devices. Typically, PHY-layer fingerprinting requires software-defined radios that cost orders of magnitude more than the chips they can fingerprint; our method does not require a software-defined radio and uses the same inexpensive chips. For mission-critical systems relying on 802.15.4 devices, defense-in-depth is thus necessary. Device fingerprinting has long been an important defensive tool; reducing its cost raises its utility for defenders. We investigate new methods of fingerprinting 802.15.4 devices by exploring techniques to differentiate between multiple …

Energy Reform In Mexico: Lessons And Warnings From International Law, Guillermo J. Garcia Sanchez Mar 2014

Energy Reform In Mexico: Lessons And Warnings From International Law, Guillermo J. Garcia Sanchez

Faculty Scholarship

The article analyzes some of the contents of the Mexican Energy Reform of 2013 and warns on the international legal implications that the path that Mexico has chosen to follow could bring to its economy and international relations. Concretely, it argues that in order to avoid falling into the same mistakes made by other Latin American countries in the region, Mexico must consider its obligations contained in international treaties signed with the United States on transboundary resources, and its obligations in bilateral investment treaties that protect foreign investors from certain government acts and policies.

The Lancaster County Juvenile Reentry Project, Anne M. Hobbs, Ryan E. Spohn, Jenna Strawhun, Timbre Wulf-Ludden, Johanna Peterson, Sommer Fousek

Reports

In order to establish a best practice model for juveniles reentering the community, Lancaster County brought multiple agencies together in 2012 and began to develop a systematic juvenile reentry approach, which became known as the “Reentry Project.” By January 2013, Lancaster County had contracted with multiple agencies to ensure this new approach was used when youth were returning to the community.

Pretrial Detention And The Right To Be Monitored, Samuel R. Wiseman Mar 2014

Pretrial Detention And The Right To Be Monitored, Samuel R. Wiseman

Scholarly Publications

Although detention for dangerousness has received far more attention in recent years, a significant number of non-dangerous but impecunious defendants are jailed to ensure their presence at trial due to continued, widespread reliance on a money bail system. This Essay develops two related claims. First, in the near term, electronic monitoring will present a superior alternative to money bail for addressing flight risk. In contrast to previous proposals for reducing pretrial detention rates, electronic monitoring has the potential to reduce both fugitive rates (by allowing the defendant to be easily located) and government expenditures (by reducing the number of defendants …

Oregon Property Tax Capitalization: Evidence From Portland, Jenny H. Liu, Jeff Renfro Mar 2014

Oregon Property Tax Capitalization: Evidence From Portland, Jenny H. Liu, Jeff Renfro

Northwest Economic Research Center Publications and Reports

The passage of Measures 5 and 50 drastically changed the way property taxes were assessed in Oregon. The measures were intended to limit the ability of government to raise property taxes, while achieving other goals such as equalizing school funding across the state. The property tax system that resulted is complex and has introduced inequities into the system based on differing rates of changes between assessed value (AV) and real market value (RMV). The League of Oregon Cities (LOC) asked the Northwest Economic Research Center (NERC) to investigate the effect of the tax structure on residential sale prices as part …
