The Walking Dead Or Weekend At Bernie’S? How The Public Trust Doctrine Threatens Alternative Energy Development, Michael Julius Motta Jr. Apr 2014

The Walking Dead Or Weekend At Bernie’S? How The Public Trust Doctrine Threatens Alternative Energy Development, Michael Julius Motta Jr.

Washington and Lee Journal of Energy, Climate, and the Environment

One of the oldest doctrines of environmental law, the public trust doctrine, is sufficiently ambiguous that it risks threatening widespread adoptions of alternative energy sources such as wind energy. Because of this, the public trust doctrine threatens the protection of the environment in the name of protection of the environment. Yet, the public trust doctrine and future energy policy should be complementary and not exclusionary of each other. In light of this, whether an agency has public trust authority should be determined based on six factors: the legal authority of state fiduciaries; due diligence by state fiduciaries in determining if …

Columbus Community Geography Center

In 2013, the first year of urban whitewater rafting on the Chattahoochee River, WhiteWater Express guides introduced Columbus to over 15,000 rafting visitors. Over 90 percent of those visitors were from outside the local community. Understanding the importance of providing whitewater guides familiar with local history, Whitewater Express partnered with CSU’s Columbus Community Geography Center (CCGC). CCGC students in Dr. Rees’ Cultural Geography course at Columbus State University developed a semester project to create interpretive materials for the river guides and a new map of the river.

Small Migrant Nonprofit Organizations: Leadership Approaches That Connect To The Country Of Origin, Josephat Makori Nyangau

Theses and Graduate Projects

As a Kenya migrant who has observed leaders of migrant organizations play a great role both in country of origin and their host, I was motivated to undertake this study to find out the approaches migrant leaders use to connect to their country of origin. This study aimed to review literature on small migrant nonprofit organizations with emphasis on Kenyan registered migrant nonprofit organizations in Minnesota. Other migrant organizations were also explored to help bridge the gap in the literature. The literature review conducted found few registered migrant nonprofit organizations of Kenyan descent in the Minnesota registry based on their …

Substantive Due Process And U.S. Jurisdiction Over Foreign Nationals, Jennifer K. Elsea Apr 2014

Substantive Due Process And U.S. Jurisdiction Over Foreign Nationals, Jennifer K. Elsea

Fordham Law Review

The due process rights of suspected terrorists have played a major role in the debate about how best to engage terrorist entities after September 11, 2001. Does citizenship or immigration status have a bearing on the treatment of terrorists? Does location within or outside the United States matter? This Article explores the connection between citizenship and alienage, enemy status, allegiance, and due process rights against a backdrop of international law. It surveys the application of due process to citizens and aliens based on the location of misconduct within or outside the territory of the United States and notes the expansion …

Automated Vehicles Are Probably Legal In The United States, Bryant Walker Smith Apr 2014

Automated Vehicles Are Probably Legal In The United States, Bryant Walker Smith

Faculty Publications

This article provides the most comprehensive discussion to date of whether so-called automated, autonomous, self-driving, or driverless vehicles can be lawfully sold and used on public roads in the United States. The short answer is that the computer direction of a motor vehicle’s steering, braking, and accelerating without real-time human input is probably legal. The long answer, which follows, provides a foundation for tailoring regulations and understanding liability issues related to these vehicles.

The article’s largely descriptive analysis, which begins with the principle that everything is permitted unless prohibited, covers three key legal regimes: the 1949 Geneva Convention on Road …

The Tools Of Political Dissent: A First Amendment Guide To Gun Registries, Thomas E. Kadri Apr 2014

The Tools Of Political Dissent: A First Amendment Guide To Gun Registries, Thomas E. Kadri

Michigan Law Review First Impressions

On December 23, 2012, a newspaper in upstate New York published a provocative map. On it appeared the names and addresses of thousands of gun owners in nearby counties, all precisely pinpointed for the world to browse. The source of this information: publicly available data drawn from the state’s gun registry. Legislators were quick to respond. Within a month, a new law offered gun owners the chance to permanently remove their identities from the registry with a simple call to their county clerk. The map raised interesting questions about broadcasting personal information, but a more fundamental question remains: Are these …

Unpermitted Urban Agriculture: Transgressive Actions, Changing Norms And The Local Food Movement, Sarah B. Schindler Apr 2014

Unpermitted Urban Agriculture: Transgressive Actions, Changing Norms And The Local Food Movement, Sarah B. Schindler

Faculty Publications

Roberta keeps four chickens in her backyard. Bob snuck onto the vacant lot next door, which the bank foreclosed upon and now owns, and planted a vegetable garden. Vien operates an occasional underground restaurant from his friends’ microbrewery after beer-making operations cease for the day. The common thread tying these actions together is that they are unauthorized; they are being undertaken in violation of existing laws and often norms. In this Article, I explore ideas surrounding the overlap between food policy and land use law, specifically the transgressive1 actions that people living in urban and suburban communities are undertaking to …

What Will It Take? Terrorism, Mass Murder, Gang Violence, And Suicides: The American Way, Or Do We Strive For A Better Way?, Katherine L. Record, Lawrence O. Gostin Apr 2014

What Will It Take? Terrorism, Mass Murder, Gang Violence, And Suicides: The American Way, Or Do We Strive For A Better Way?, Katherine L. Record, Lawrence O. Gostin

University of Michigan Journal of Law Reform

The assertion that access to firearms makes us safe, rather than increases the likelihood that oneself or a family member will die, is contradicted by a large body of evidence. Gunshots kill more than 30,000 Americans each year. Homicide accounts for approximately one-third of these deaths, with the remainder involving suicides and accidental gun discharges. In fact, firearms put us at greater risk of death than participating in war; in four months, as many Americans were shot dead in the United States as have died fighting in Iraq for an entire decade. Given these grim statistics, it would be reasonable …

Automated Call Receiving And Forwarding Mechanism For Supporting Integrated Disaster Management System, N.A. Khamis, L. Chin Yang, A. Nordin Apr 2014

Automated Call Receiving And Forwarding Mechanism For Supporting Integrated Disaster Management System, N.A. Khamis, L. Chin Yang, A. Nordin

Research Publications (2011 to 2015)

Disasters have caused great loss of lives and economic loss besides disruption of services and infrastructure. In any case of a disaster, prolonged arrival of relevant agencies such as the rescue teams means delayed commencement of all restoration work that should be done after the incident. This prolonged arrival is one of the factors that delay in alerting the relevant agencies for them to commence in action. Currently in Malaysia, the call receiving and forwarding procedure is handled by MERS99 with human intervention, i.e telephone operators. This research proposed an algorithm which able to receive a call and identify the …

The European Court Of Human Rights And Intragroup Religious Diversity: A Critical Review, Lourdes Peroni Apr 2014

The European Court Of Human Rights And Intragroup Religious Diversity: A Critical Review, Lourdes Peroni

Chicago-Kent Law Review

This Article examines the ways in which one of the most established human rights courts—the European Court of Human Rights—encourages or discourages intragroup religious diversity when dealing with religious freedom claims. In particular, it critically assesses the Court’s attentiveness to internal group diversity by scrutinizing the objective filters that the Court employs to determine whether certain practices “count” as a manifestation of claimants’ religion for legal purposes. The Article argues that, at times, these filters are based on assumptions about religion and religious groups that impede recognition of more lived experiences of religion and internal group diversity. The Article further …
