Is Federalization Of Charity Law All Bad? What States Can Learn From The Internal Revenue Code, Melanie B. Leslie Nov 2014

Is Federalization Of Charity Law All Bad? What States Can Learn From The Internal Revenue Code, Melanie B. Leslie

Vanderbilt Law Review

Professor Ascher makes a compelling case that federal law, and especially the Internal Revenue Code (the "Code"), has eclipsed state law as the predominate regulating force of the charitable sector. Professor Ascher views this trend with trepidation-he criticizes the Code for imposing a "frightening and bewildering array of often draconian penalties" and for its failure to track preexisting state-law concepts.

I agree that the combination of state and federal law creates an impenetrable maze that charitable fiduciaries find overly difficult to negotiate. Yet I am reluctant to finger the Code as the primary culprit. In my view, state law deserves …

The Relationship Of Postsecondary Outcomes For Students With Disabilities In Kentucky Schools, Stephanie Dawn Cornwell Nov 2014

The Relationship Of Postsecondary Outcomes For Students With Disabilities In Kentucky Schools, Stephanie Dawn Cornwell

Dissertations

In order to compare the postsecondary success rates of students with disabilities in rural areas to those in urban areas in Kentucky, data were accessed from the Kentucky Postsecondary Outcome Study, a longitudinal study created to monitor the employment and education status of students with disabilities during their final year of high school and one year after exiting high school. U.S. Census data were also utilized to determine various demographic information and rural or urban classification of selected areas. Results show that the geographic classification as rural and suburban has a strong relationship with the postsecondary outcome for students with …

Research & Strategic Partnerships: Quarterly Review, Volume 2, Issue 1, Portland State University. Research & Strategic Partnerships

Portland State Research Magazine

This Review describes connections among Portland State University, society's needs, and innovation: engineer Evan Thomas’s public health program in Rwanda, chemist Steve Reichow's protein research in the Collaborative Life Sciences Building, environmental historian Catherine McNeur's look back at urban agriculture in New York City, the "My Life" mentoring program for foster teens, and "Reclaiming Futures" interventions that help at-risk kids avoid incarceration.

It also focuses on EXITO. EXITO, Portland State University's largest-ever federal grant, awarded by the NIH to a team headed by Professors Carlos Crespo and Tom Keller. In the next decade, EXITO will help hundreds of underrepresented students …

Developmental Differences In The Influence Of Phonological Similarity On Spoken Word Processing In Mandarin Chinese., Jeffrey G Malins, Danqi Gao, Ran Tao, James R Booth, Hua Shu, Marc F Joanisse, Li Liu, Amy S Desroches Nov 2014

Developmental Differences In The Influence Of Phonological Similarity On Spoken Word Processing In Mandarin Chinese., Jeffrey G Malins, Danqi Gao, Ran Tao, James R Booth, Hua Shu, Marc F Joanisse, Li Liu, Amy S Desroches

Brain and Mind Institute Researchers' Publications

The developmental trajectory of spoken word recognition has been well established in Indo-European languages, but to date remains poorly characterized in Mandarin Chinese. In this study, typically developing children (N=17; mean age 10; 5) and adults (N=17; mean age 24) performed a picture-word matching task in Mandarin while we recorded ERPs. Mismatches diverged from expectations in different components of the Mandarin syllable; namely, word-initial phonemes, word-final phonemes, and tone. By comparing responses to different mismatch types, we uncovered evidence suggesting that both children and adults process words incrementally. However, we also observed key developmental differences in how subjects treated onset …

Striatum In Stimulus-Response Learning Via Feedback And In Decision Making., Nole M Hiebert, Andrew Vo, Adam Hampshire, Adrian M Owen, Ken N Seergobin, Penny A Macdonald

Brain and Mind Institute Researchers' Publications

Cognitive deficits are recognized in Parkinson's disease. Understanding cognitive functions mediated by the striatum can clarify some of these impairments and inform treatment strategies. The dorsal striatum, a region impaired in Parkinson's disease, has been implicated in stimulus-response learning. However, most investigations combine acquisition of associations between stimuli, responses, or outcomes (i.e., learning) and expression of learning through response selection and decision enactment, confounding these separate processes. Using neuroimaging, we provide evidence that dorsal striatum does not mediate stimulus-response learning from feedback but rather underlies decision making once associations between stimuli and responses are learned. In the experiment, 11 males …

October 2014 Downloads From Unl Digitalcommons, Paul Royster

Institutional Repository Information

Some old and some new items dominate the download results for October 2014 from UNL DigitalCommons. Jonathan Edward’s hellfire sermon continues to lead the list, with 12,884 downloads. And chapters from Robert Katz’s Physics text continue to be extremely popular (and hopefully useful). Management publications on leadership theory are also perennially popular. New to the list are a chapter from Cindy Carlson’s Family Assessment, a book in the Buros-Nebraska Series on Measurement and Testing. Also crashing the top list are several articles from Library Philosophy & Practice, which has got to be among the most widely read scholarly …

Creating Digital Comics In Response To Literature: Aesthetics, Aesthetic Transactions, And Meaning Making, Kelly Wissman, Sean Costello Nov 2014

Creating Digital Comics In Response To Literature: Aesthetics, Aesthetic Transactions, And Meaning Making, Kelly Wissman, Sean Costello

Literacy Teaching & Learning Faculty Scholarship

This article explores how eighth-grade students in a reading support class responded to the novel The Outsiders with the software program Comic Life. Rather than viewing this work from a new technologies or digital literacies perspective, we argue that unique insights can be gained by analyzing students’ digital compositions with lenses attuned to the arts, the aesthetic transaction, and student perspectives. In our presentation of four case studies, we are informed by two conceptualizations of aesthetics. First, we consider the aesthetic qualities of students' comics by analyzing the presence and impact of image selection, color choice, and overall design on …

Aplikasi Model Rasch Untuk Penelitian Ilmu-Ilmu Sosial (Edisi Revisi), B. Sumintono, W. Widhiarso

Research Publications (2011 to 2015)

Manifest Complexity: A Foundational Ethic For Astrobiology?, Kelly C. Smith Nov 2014

Manifest Complexity: A Foundational Ethic For Astrobiology?, Kelly C. Smith

Publications

This paper examines the age old question of the basis of moral value in the new context of astrobiology, which offers a fresh perspective. The goal is to offer the broad outline of a general theory of moral value that can accommodate the diversity of living entities we are likely to encounter beyond the confines of Earth. It begins with ratiocentrism, the view that the possession of reason is the primary means by which we differentiate entities having moral value in and of themselves from those having moral value merely by virtue of the uses to which they can be …

Music, Personhood, And Eudaimonia: Implications For Educative And Ethical Music Education, David J. Elliott, Marissa Silverman Nov 2014

Music, Personhood, And Eudaimonia: Implications For Educative And Ethical Music Education, David J. Elliott, Marissa Silverman

John J. Cali School of Music Scholarship and Creative Works

This paper proposes that educative and ethical music making and teaching, which is based on a praxial philosophy of music education (Elliott and Silverman, 2014), can be carried out in a variety of ways that create places and spaces, in schools and community settings, for a variety of human values or "goods" that include, but go beyond, making and listening to classical instrumental music, or any other kind of music, for "the music itself." One premise of this philosophical discussion is that music does not have one value; music has numerous values, depending on the ways in which it is …

Symptom Burden And Healthcare Utilization In Pulmonary Arterial Hypertension, Catherina Anne Madani Phd Nov 2014

Symptom Burden And Healthcare Utilization In Pulmonary Arterial Hypertension, Catherina Anne Madani Phd

Dissertations

Background: Pulmonary arterial hypertension (PAH) is a rapidly progressive disease. There is currently no cure; thus treatment is aimed at prolonging survival, improving functional status (FS), and symptom mitigation. Symptom burden (SB) can impact quality of life (QOL), and lead to increased healthcare utilization. Palliative care (PC) has been associated with higher QOL, decreased depression, aggressive care, and mortality. The Institute of Medicine's (IOM) recent report supports earlier integration of PC for people living with serious illness. Detection of patients at high risk for heavy SB may help to identify patients who could benefit from earlier integration of PC into …

Patients With Advanced Lung Cancer: Quality Of Life And Perception Of Dyspnea, Barbara A. Roces Phd, Msn, Np, Rn

Dissertations

Background: Dyspnea perception can be defined as a multidimensional experience of breathing discomfort, influenced by physiological, psychological, social, and environmental factors, that includes secondary psychological and behavioral responses and cannot be defined only by physical objective abnormalities (Mularski et al., 2010). Dyspnea is the most common and distressing symptom in patients with advanced lung cancer and decreases one's quality of life (QOL) (Smith et al., 2001). Furthermore, dyspnea has been found to interfere with physical activities such as walking, work, and psychological activities such as disposition, taking pleasure in life, relationship with others, and sleep (Tanaka, Akechi, Okuyama, Nishiwaki, & …

Patient Care Technology And The Nurse-Patient Relationship, Belinda M. Toole Phd, Msn, Rn Nov 2014

Patient Care Technology And The Nurse-Patient Relationship, Belinda M. Toole Phd, Msn, Rn

Dissertations

Background: Technological devices are increasingly used in healthcare and their proliferation has providers questioning the impact on the patient-provider relationship. Technological device integration has been studied in the primary care setting, less extensively in the acute care setting. The impact of device use on the nurse-patient relationship in acute care setting required further study, particularly with nursing's history of holistic practice incorporating caring and presence. Objectives: The study purpose was to explore the patient's perceptions of nurse caring and presence when technological devices were used in care delivery in the acute care setting. Specific aims were: 1) to describe the …

Larsen's Legacy: The Three-Part Exposition And The New Formenlehre, Nathan John Martin Nov 2014

Larsen's Legacy: The Three-Part Exposition And The New Formenlehre, Nathan John Martin

HAYDN: Online Journal of the Haydn Society of North America

Both James Hepokoski and Warren Darcy’s Sonata Theory and William Caplin’s theory of formal functions give prominent place to sonata expositions that lack, in any traditional sense, an obvious subordinate theme—Hepokoski and Darcy through their category of the “continuous exposition” and Caplin through his notion of “transition/subordinate theme fusion.” Such expositions are a prominent feature of Haydn’s compositional practice, and have long been discussed by specialists writing on his music. In particular, in his 1963 essay “Sonataform-Probleme,” Jens Peter Larsen held up Haydn’s “three-part expositions” as an alternative to the standard, A. B. Marx-derived “two-part” model. Following Michelle Fillion’s, Alexander …

The Informal Property Rights Of Boomerang Children In The Home, Shelly Kreiczer-Levy Nov 2014

The Informal Property Rights Of Boomerang Children In The Home, Shelly Kreiczer-Levy

Maryland Law Review

Adult children living with their parents represent an increasingly common social phenomenon in the United States that challenges the boundaries of both the family and formal property rights. What is the legal status of adult children living with their parents? Do parents have any additional duties when they rescind permission for their child to live with them? Property and family scholars have not addressed this important issue. This Article fills the void. Instead of treating people who live together as strangers, owing no legal obligations to one another, I argue that under certain conditions living with others creates a property …

Parental Mentoring: An African American Approach To Raising Daughters With Self-Esteem, Qiana Brandy Smith Nov 2014

Parental Mentoring: An African American Approach To Raising Daughters With Self-Esteem, Qiana Brandy Smith

Dissertations

There is an ample amount of research that documents the positive effect of self-esteem on a child established through an affirmative parental or mentoring relationship, verses a specific parent-mentoring approach designed with a curriculum to enhance the positive self-esteem of African-American daughters based on the relationship with their maternal parent. The purpose of this qualitative study was to answer the following research questions: what strategies and behaviors are used by parents in African-American families to affect the self-esteem of female children and adolescents and, how can strategies and behaviors exhibited by African-American parental mentors be organized in a teachable format …

Pharmacy Student Perceptions: How Do They Change And What Does That Mean?, Erika Lynn Michalski Nov 2014

Pharmacy Student Perceptions: How Do They Change And What Does That Mean?, Erika Lynn Michalski

Dissertations

With healthcare moving rapidly toward interprofessional expectations, this study examined the perceptions of a particular population of students pursuing a degree in the healthcare field. Pharmacy students attending a free-standing pharmacy institution were interviewed over the course of the 2012 – 2013 academic year. Interviews were conducted before, during, and after the students engaged in collaborative coursework with students from a variety of health care majors attending a nearby institution. The results demonstrated the positive impact exposure to peer students pursuing degrees in health care fields can have. Results of the interview process highlighted the impact intentional interaction with a …

Assessment Of Noise-Induced Annoyance By Tones In Noise From Building Mechanical Systems, Joonhee Lee, Lily M. Wang Nov 2014

Assessment Of Noise-Induced Annoyance By Tones In Noise From Building Mechanical Systems, Joonhee Lee, Lily M. Wang

Durham School of Architectural Engineering and Construction: Faculty Publications

Prominent tones in noise generated by mechanical equipment in buildings can cause complaints from occupants in buildings. The ISO 1996-2 and ANSI S1.13 standards describe methodologies and metrics to quantify tonality perception, but the influence of tones in noise on human annoyance and performance is not fully understood yet. This paper investigates annoyance responses of humans while exposed to background noise with tonal components. Twenty participants completed digit span tasks while exposed to noise signals with differing levels of tones and overall loudness. Subjects were also asked to rate their annoyance after completing tasks under each noise signal. The subjective …
