Anthony Lewis And The First Amendment, Adam Liptak Nov 2014

Anthony Lewis And The First Amendment, Adam Liptak

Missouri Law Review

It is a great privilege to be with you today to celebrate the life and work of Anthony Lewis who created modern legal journalism. I thought I would try to do three things today to help us think about Tony’s legacy. One is to sketch out what made Tony such a giant. A second is to reflect for a minute on the state of the modern Supreme Court press corps, which he essentially founded. And a third is to consider a topic Tony returned to again and again in his articles, columns and books: the role of the press in …

Legal Journalism Today: Change Or Die, Howard Mintz Nov 2014

Legal Journalism Today: Change Or Die, Howard Mintz

Missouri Law Review

Several years ago, I was a guest speaker for a media and law class at San Jose State University, volunteering my expertise as a legal journalist with a couple decades under my belt of covering courts and law. As I went through my usual dialogue, describing some of the newfound challenges of being a journalist in this brave new digital world, one of the students piped in about Twitter, which at the time was an emerging phenomenon that I frankly considered a mind-numbing threat to intelligent reporting with the shelf life of the Pet Rock (an obsolete cultural reference that …

Two Tests Unite To Resolve The Tension Between The First Amendment And The Right Of Publicity, Dora Georgescu Nov 2014

Two Tests Unite To Resolve The Tension Between The First Amendment And The Right Of Publicity, Dora Georgescu

Fordham Law Review

The right of publicity is an established legal doctrine that grants individuals the exclusive right to control the commercial use of their image. Though it has many important and laudable uses, one unfortunate consequence of the right of publicity is that it restricts artists’ abilities to portray real persons in their works. In so doing, the right of publicity directly conflicts with the First Amendment protections of an individual’s freedom of expression.

While the U.S. Supreme Court addressed this tension in Zacchini v. Scripps-Howard Broadcasting Co., the Court did not create a clear standard for balancing the interests of …

In Re Sanders And The Resurrection Of Stanley V. Illinois, Josh Gupta-Kagan Nov 2014

In Re Sanders And The Resurrection Of Stanley V. Illinois, Josh Gupta-Kagan

Faculty Publications

In 1972, the Supreme Court in Stanley v. Illinois declared that parents are entitled to a hearing on their fitness before the state places their children in foster care. Somewhat oddly, Stanley went on to be cited as a leading case regarding the rights of unwed fathers to object to private adoptions favored by mothers -- an issue not present in Stanley. Odder still, most states routinely violated Stanley in child welfare cases -- the context in which the Stanley rule arose. Most states apply the "one parent doctrine," which holds that finding one parent unfit justifies taking the child …

Evidence-Informed Guidelines For Pediatric Pandemic Planning And Response, Ginny Sprang, James J. Clark, Miriam Silman, Phyllis W. Leigh, Candice M. Jackson, A. Scott Lajoie Nov 2014

Evidence-Informed Guidelines For Pediatric Pandemic Planning And Response, Ginny Sprang, James J. Clark, Miriam Silman, Phyllis W. Leigh, Candice M. Jackson, A. Scott Lajoie

Center on Trauma and Children Reports

From the executive summary:

Pandemic events are unpredictable and inevitable. When they occur, the impact is both all-encompassing and asymmetrical; each pandemic targets specific, vulnerable populations, but ultimately impacts individuals, families and communities throughout the world. Regardless of origin or circumstances, the next pandemic will certainly count infants, children, and adolescents among its most vulnerable targets. As evidenced by the 2009 H1N1 influenza pandemic, children may be at higher risk than populations more typically seen as susceptible to pandemic illness (the elderly, those with weakened immune systems, etc.). Children also can function as disease vectors, spreading the virus through their …

Improving Community Health Through Hospital-Public Health Collaboration: Insights And Lessons Learned From Successful Partnerships, Lawrence Prybil, F. Douglas Scutchfield, Rex Killian, Ann Kelly, Glen P. Mays, Angela Carman, Samuel Levey, Anne Mcgeorge, David W. Fardo

Health Management and Policy Faculty Book Gallery

From the introduction:

Health care expenditures in the United States currently consume over 17 percent of the nation’s gross domestic product, a much larger share than other developed nations. Yet, despite this large investment, studies by Commonwealth Fund, the Institute of Medicine, and other organizations show the USA lags behind other developed nations on multiple metrics of population health such as infant mortality and life expectancy. Moreover, there is extensive evidence of disparities in access, cost, and quality of health care services.

Thus, we are confronted by a striking paradox: the USA spends a large and growing proportion of our …

Profits V. Purpose: Hybrid Companies And The Charitable Dollar, Rachel Culley, Jill R. Horwitz Nov 2014

Profits V. Purpose: Hybrid Companies And The Charitable Dollar, Rachel Culley, Jill R. Horwitz

Law & Economics Working Papers

Social entrepreneurship -- a catch-all term meaning harnessing business practices for social good -- has attracted people who want to “do well while doing good” for decades. Advocates of the idea have succeeded in blurring the boundaries among legal ownership types and inspired nonprofit/for-profit joint ventures, public-private partnerships, and the widespread privatization of traditional government functions and activities. The most recent manifestation of this trend is the creation of hybrid non-profit/for-profit firms. In the United States, the Low-Profit Limited Liability Company (L3C) is growing, and there are similar firms in the United Kingdom and Canada. In this paper we address …

The Effect Of Students' Mathematical Beliefs On Knowledge Transfer, Kristen Adams Nov 2014

The Effect Of Students' Mathematical Beliefs On Knowledge Transfer, Kristen Adams

Theses and Dissertations

Students learn many different concepts throughout their mathematical careers. In order to be successful in mathematics, students should be able to transfer these mathematical concepts learned in one situation and apply them to a new situation. There are many factors that might affect how students transfer knowledge; however research has focused mostly upon cognitive factors, even though affective factors might also exhibit a strong influence. This study examined how students' mathematical beliefs, specifically beliefs about mathematics education and self-efficacy, affect the transfer process. Data were collected from three middle school students. These data were collected through in-class observations, students' written …

Self-Reported Mastery: Moving On From Self-Reported Gains In Assessing Learning Outcomes, Michael S. Thompson Nov 2014

Self-Reported Mastery: Moving On From Self-Reported Gains In Assessing Learning Outcomes, Michael S. Thompson

Theses and Dissertations

As the learning outcomes movement gains strength, the need to effectively measure learning outcomes becomes more important. This study looked at the effectiveness of self-reported mastery in measuring learning outcomes by examining the correlations between (a) self-reported mastery, (b) self-reported gains, and (c) objective measures of learning outcomes. The objective measures of learning outcomes were final exams for two classes, Calculus (consisting of two forms) and Statistics. The self-reported mastery and self-reported gains items were taken from the pilot student ratings form and the old student ratings form. A total of 848 undergraduate students completed the final exam and the …

John Evans Study Report

"Universities are dedicated to the discovery and dissemination of knowledge. They are conservators of humanity's past. They cherish their own pasts, honoring forbears with statues and portraits and in the names of buildings. To study or teach at a [university] is to be a member of a community that exists across time, a participant in a procession that began centuries ago and that will continue long after we are gone. If an institution professing these principles cannot squarely face its own history, it is hard to imagine how any other institution, let alone our nation, might do so."

Neo-‐Colonial Criminology: Quantifying Silence, Antje Deckhert

African Journal of Criminology and Justice Studies

In Australia, Canada, New Zealand and the United States of America, Indigenous peoples continue to experience incarceration at markedly disproportionate rates. Some scholars have criticised criminology for contributing to this social problem by marginalising Indigenous peoples in research and research publications. This study is a first attempt to quantitatively evaluate the (de)colonised state of contemporary criminology. It involves a comprehensive review of research on ‘Indigenous peoples in the criminal justice context’, which has been undertaken in aforesaid countries and was published in elite criminology journals over the past decade (2001-‐2010). The findings reveal that publication rates on the subject are …

Immigration Surveillance, Anil Kalhan Nov 2014

Immigration Surveillance, Anil Kalhan

Maryland Law Review

In recent years, immigration enforcement levels have soared, yielding a widely noted increase in the number of noncitizens removed from the United States. Less visible, however, has been an attendant sea change in the underlying nature of immigration governance itself, hastened by new surveillance and dataveillance technologies. Like many other areas of contemporary governance, immigration control has rapidly become an information-centered and technology-driven enterprise. At virtually every stage of the process of migrating or traveling to, from, and within the United States, both noncitizens and U.S. citizens are now subject to collection and analysis of extensive quantities of personal information …

Debunking The Myths Surrounding Student Scholarly Writing, Kristina V. Foehrkolb, Marc A. Desimone Jr. Nov 2014

Debunking The Myths Surrounding Student Scholarly Writing, Kristina V. Foehrkolb, Marc A. Desimone Jr.

Maryland Law Review

There is a tendency to view scholarly writing by law students as an exercise that has little utility in preparing them for the actual practice of law. This assumption is unfounded; to the contrary, scholarly writing in law school gives students a unique learning opportunity that is surprisingly close to how students will learn and write when they enter practice. While few law schools take advantage of this valuable learning tool, law school journals have long served as a vehicle and an outlet for student scholarship. Relying on the practices of some of the country’s top journals and using our …

Traditional Ecological Knowledge: A Model For Modern Fire Management?, Gail Wells Nov 2014

Traditional Ecological Knowledge: A Model For Modern Fire Management?, Gail Wells

Joint Fire Science Program Digests

For many thousands of years, aboriginal peoples worldwide used fire to manage landscapes. In North America, the frequency and extent of fire (both human caused and natural) were much reduced after European colonization. Fire exclusion became the policy in the United States for most of the 20th century as the country became more settled and industrialized. Past fire exclusion has helped produce landscapes that are highly susceptible to uncharacteristically severe wildfire. An urgent challenge for land managers today is to reduce fire risk through several means, including prescribed burning, without harm to culturally significant resources or human communities. The Joint …

Doing A Lot With A Little: Making Digital Humanities Work At A Small College, Deborah Vanderbilt Nov 2014

Doing A Lot With A Little: Making Digital Humanities Work At A Small College, Deborah Vanderbilt

English Faculty/Staff Publications

I'm interested in how one goes about integrating digital tools into the liberal arts, and my perspective is that of a long-time faculty member in a small department at a small school. The common wisdom is that today's students know and can do more than most faculty in all things digital, and we need merely provide opportunities for them to use those skills. But that's not true for many students. Our department's newest faculty member has a specialty in digital media, specifically gamification. And although many students are flocking to her classes, she's also encountering resistance from some English majors: …

A Quantitative Study Of Educational Poverty, School Location, And Student Achievement Measured By The Program For International Student Assessment (Pisa), Brett Barger

Dissertations

The performance of the United States’ students on international tests remains an ongoing source of concern, division, and anxiety for government, educational, and business leaders, teachers (and their unions), as well as the general public. These selfsame test results have been used as evidence to support diametrically opposed political and educational strategy and policy for decades. All too often the performance of students is discussed with a single test score number that is used to represent the entirety of the education system’s students without accounting for geographical, demographic, or socioeconomic differences among the student test takers. The contributing factors of …

The purpose of this report is to explore the expansion of the MLTI program that occurred in the 2013‐2014 academic year. In June 2014, over 400 individuals from Maine public schools were solicited to participate in a survey examining their experiences with MLTI technology in their schools. In 2013‐2014, for the first time since the inception of MLTI in 2002, the program shifted to a multiple‐device solution, which offered schools the opportunity to select from a range of device choices, including a MacBook Air, iPad, or HP Probook. Both the MacBook Air and the HP Probook were traditionally formatted laptops, …

Increasingly, individuals are taking active participation in learning and managing their health by leveraging online resources. Understanding online health information searching behavior can help us to study what health topics users search for and how search queries are formulated. In this work, we analyzed 10 million cardiovascular diseases (CVD) related search queries from MayoClinic.com. We performed semantic analysis on the queries using UMLS MetaMap and analyzed structural and textual properties as well as linguistic characteristics of the queries.
