The True Legacy Of Atkins And Roper: The Unreliability Principle, Mentally Ill Defendants, And The Death Penalty’S Unraveling, Scott E. Sundby

In striking down the death penalty for intellectually disabled and juvenile defendants, Atkins v. Virginia and Roper v. Simmons have been understandably heralded as important holdings under the Court’s Eighth Amendment jurisprudence that has found the death penalty “disproportional” for certain types of defendants and crimes. This Article argues, however, that the cases have a far more revolutionary reach than their conventional understanding. In both cases the Court went one step beyond its usual two-step analysis of assessing whether imposing the death penalty violated “evolving standards of decency.” This extra step looked at why even though intellectual disability and youth …

Rising sea level and increases in temperature are causing biogeographic shifts in intertidal zones and can also lead to shifts in the local vertical zonation of organisms due to changes in body temperature during aerial exposure during low tide. Swash is an important determinant of aerial body temperatures, and vulnerability of intertidal zones to changes in climate could potentially depend on how much and how often animals are cooled by waves. Falls in the senior population represent an immediate threat to both current and future generations’ quality of life. The results of falls can be disastrous, create a long road to recovery, and in many cases result in death. Hypertension represents a difficult-to-quantify condition which is known to contribute to gait and balance dysfunction. Both look at the current maintenance practices done by the United States Army and propose a solution for improvement utilizing condition-based maintenance (CBM) practices. As diverse populations within schools increase, the need for culturally-sensitive assessment is essential; however, test of ability vary in their degree of influence from culture. This qualitative case study explored a learning community in action. The purpose of this study was to investigate the professional conversations that teachers in a learning community had and the impact of those conversations on the practices and beliefs of the individual teachers in the community. Specifically, the study sought to discover how and why facets of professional learning transferred (or did not transfer) into classroom practice. This case study documents the perceived influences on three novice elementary teachers’ use of concrete representations for teaching mathematics. In order to develop mathematical proficiency, students need access to a variety of representations (i.e. pictures, words, symbols, concrete materials, and real world contexts) to make sense of mathematical ideas. Three sources of data were collected: video-recorded lessons, interviews, and a focus group. Analyses indicated that although concrete representations were accessible to all three teachers, they were least used among the available representations. Direct post-translational control over a protein of interest (POI) can be exploited by manipulating the cells protein quality-control systems responsible for either intracellular turnover through ubiquitination (POI half-life) or repairing and degrading misfolded proteins.1 In an effort to target and degrade a high value POI we selected the enzyme human thymidylate synthase (TS) for post-translational degradation through ligand-directed ubiquitination and hydrophobic tagging. Thymidylate synthase catalyzes the reductive methylation of 2’-deoxyuridine monophosphate (dUMP) to 2’-deoxythymidine monophosphate (dTMP). Background: Implantation of vascular grafts provides a means to restore blood flow in compromised regions of the circulatory system, and thus is used to treat a wide range of cardiovascular diseases. Despite significant advancements in autologous grafting strategies as well as the engineering of synthetic alternatives, mechanical, structural, and compositional incongruities between the graft and the host artery remain as contributing factors to graft failure. Embedded system-on-chip processors such as the Texas Instruments C66 DSP and the IBM Cell provide the programmer with a software controlled on-chip memory to supplement a traditional but simple two-level cache. By decomposing data sets and their corresponding workload into small subsets that fit within this on-chip memory, the processor can potentially achieve equivalent or better performance, power efficiency, and area efficiency than with its sophisticated cache. This work focused on using polymers to modify the surface of various inorganic substrates, ranging from TiO2, ITO, CDSe and CdS nanostructures to micron sized silica particles. The synthesis of the polymers using the RAFT technique and the characterization of the functionalized substrates were analyzed in detail to provide insights into their use for various applications. In the first part of this work, novel phosphate based RAFT agents and phosphate containing polymers, including poly(methyl methacrylate) (PMMA), poly(glycidyl methacrylate) (PGMA) and poly(dimethyl siloxane) (PDMS) were synthesized. We apply an interior point algorithm to two nonlinear optimization problems and achieve improved results. We also devise an approximate convex functional alternative for use in one of the problems and estimate its accuracy. The first problem is maximum variance unfolding in machine learning. The traditional method to solve this problem is to convert it to a semi-definite optimization problem by defining a kernel matrix. We obtain better unfolding and higher speeds with the interior point algorithm on the original non-convex problem for data with less than 10,000 points. Although quantitative ultrasound has the potential to evaluate bone quality even better than the current gold standard X-ray based modality, its clinical utility has been hampered by the incomplete understanding of the mechanisms governing the interaction between ultrasound and bone. Thirteen mono-N-acyl derivatives of 2,6-diaminopimelic acid (DAP)—new potential inhibitors of the dapE-encoded N-succinyl-l,l-diaminopimelic acid desuccinylase (DapE; EC 3.5.1.18)—were analyzed and characterized by infrared (IR) and nuclear magnetic resonance (NMR) spectroscopies and two capillary electromigration methods: capillary zone electrophoresis (CZE) and micellar electrokinetic chromatography (MEKC). Structural features of DAP derivatives were characterized by IR and NMR spectroscopies, whereas CZE and MEKC were applied to evaluate their purity and to investigate their electromigration properties. This dissertation reports the novel synthesis of PbS quantum plates (QPs) via a reaction executed at low temperatures. The PbS QPs are grown in a template-assisted mechanism, with the first excitonic peak observed in the visible region of light at ~620 nm (2.0 eV), at an energy radically different than the band gap of bulk PbS (~3000 nm, 0.42eV). The large energy shift is due to the extremely thin dimension of these nanoplates, which is determined to be ~1 nm in thickness. Thickness measurements are made in a powder X-ray diffractometer (XRD) at low angles (between 2-15º 2θ). These measurements …

Isotope harvesting from heavy-ion fragmentation facilities is a potential source of isotopes of interest for applications research. With the upgrade of the National Superconducting Cyclotron Laboratory (NSCL) to the Facility for Rare Isotope Beams (FRIB) usable quantities of many isotopes of interest will be produced and available for harvest from an aqueous beam dump.
