Addressing Twin Crises In The Law: Underserved Clients And Underemployed Lawyers, James R. Holbrook, Jonathan R. Hornok
Utah OnLaw: The Utah Law Review Online Supplement
The legal profession faces two unprecedented crises: underserved middle class clients and underemployed lawyers. On September 27, 2013, members of the Utah bench, bar, and academy gathered to discuss these crises at the Twin Crises in the Law CLE, sponsored by the Utah State Bar and Utah Law Review OnLaw. Papers from the CLE presenters are collected in this volume of Utah Law Review OnLaw.

Reflections On The Future Of Legal Education, James R. Holbrook
Utah OnLaw: The Utah Law Review Online Supplement
In 2012, the American Bar Association (“ABA”) created the Task Force on the Future of Legal Education (“Task Force”), which was charged with making recommendations to the ABA about how law schools, the ABA, state bar associations, and other groups and organizations can address the economics of legal education and its delivery to law students. The ABA determined that the Task Force was needed to respond to the rapid and substantial changes in the legal profession caused by the national and global economy.

Cold Comfort Food: A Systematic Examination Of The Rituals And Rights Of The Last Meal, Sarah Gerwig-Moore
Cold Comfort Food: A Systematic Examination Of The Rituals And Rights Of The Last Meal, Sarah Gerwig-Moore
Articles
Last meals are a resilient ritual accompanying executions in the United States. Yet states vary considerably in the ways they administer last meals. This paper explores the recent decision in Texas to abolish the tradition altogether. It seeks to understand, through consultation of historical and contemporary sources, what the ritual signifies. We then go on to analyze execution procedures in all 35 of the states that allowed executions in 2010, and show that last meal allowances are paradoxically at their most expansive in states traditionally associated with high rates of capital punishment (Texas now being the exception to that rule.) …
The Jewish Law Firm: Past And Present, Eli Wald
The Jewish Law Firm: Past And Present, Eli Wald
Sturm College of Law: Faculty Scholarship
The rise and growth of large Jewish law firms in New York City during the second half of the twentieth century was nothing short of an astounding success story. As late as 1950, there was not a single large Jewish law firm in town. By the mid-1960s, six of the largest twenty law firms were Jewish, and by 1980, four of the largest ten prestigious law firms were Jewish firms. Moreover, the accomplishment of the Jewish firms is especially striking because, while the traditional large White Anglo-Saxon Protestant law firms grew at a fast rate during this period, the Jewish …

The Lawyer's Monopoly — What Goes And What Stays, Benjamin H. Barton
The Lawyer's Monopoly — What Goes And What Stays, Benjamin H. Barton
Scholarly Works
We live in a time of unprecedented changes for American lawyers, probably the greatest changes since the Great Depression. That period saw the creation of the lawyer’s monopoly through a series of regulatory modifications. Will we see the same following the Great Recession? Formally, no. This Article predicts that formal lawyer regulation in 2023 will look remarkably similar to lawyer regulation in 2013. This is because lawyer regulators will not want to rock the boat in the profession or in law schools during a time of roil.
Informally, yes! We are already seeing a combination of computerization, outsourcing, and nonlawyer …

And Now A Crisis In Legal Education, James E. Moliterno
And Now A Crisis In Legal Education, James E. Moliterno
Scholarly Articles
The current crisis in legal education coincides with a crisis in the practice of law. Law practice has changed as a result of technology, globalization, and economic pressures. The market for legal education's product, law graduates, have diminished. Law schools cannot remain the same in this environment. Except for a very small number of elite schools, those that do not adjust are at serious risk of failing.
An economic change has taken place against a system in which mostly corporate clients willingly paid for the training of beginners at major law firms. Law firms could absorb those costs if partners …

Class Actions And Justiciability, Sergio J. Campos
Class Actions And Justiciability, Sergio J. Campos
Articles
A lingering issue in class action law concerns the case or controversy requirement of Article III, otherwise known as the requirement of justiciability. For purposes of justiciability doctrines such as standing, mootness, and ripeness, is the class action brought by all class members, some class members, or just the class representative?
This Article argues that the answer should be none of the above-it should be the class attorney. This Article first shows that the function of the class action is to assign dispositive control of, and a partial beneficial interest in, the class members' claims to the class attorney. Put …

An Empirical Examination Of Relational Governance And Service Capabilities On The Success Of Professional Service Firms Offshore Outscoring The Client Perspective, Renee M. Castrigano
ETD Archive
Professional services, such as accounting, finance, engineering and management consulting, are significant contributors to the U.S. economy accounting for the largest value added industry within the private sector. Knowledge-intensive professional services reached this level of economic prominence by responding to heightened competition, managing rising costs, utilizing key resources, and re-directing their focus to internal core competencies through the strategic decision to engage in offshore outsourcing relationships. By 2015, the Congressional Research Study report predicts 3.4 million, or 13.7 of professional service jobs will be offshore outsourced. Offshore outsourcing is a firm level strategic decision to relocate business activities to an …

Legal Education At A Crossroads: Innovation, Integration, And Pluralism Required!, Antoinette M. Sedillo Lopez, Robert F. Seibel, Peggy Maisel, Karen Tokarz

We conclude in this Article that expanded practice-based, experiential education will provide foundational learning for the successful transition from law student to law practice, and that clinical education (in-house clinics, hybrid clinics, and externships) is crucial to the preparation of competent, ethical law graduates who are "ready to become professionals." We urge law schools to require each graduate complete a minimum of twenty-one experiential course credits over the three years of law school, including at least five credits in law clinics or externships. Twenty-one required credits (or roughly 25 percent of the eighty-three required credits for graduation from an American …
