The legal profession tends to look inward and backward when faced with crisis and uncertainty. The legal profession could make greater advances by looking outward and forward to find in society and culture the causes of and connections with the legal profession’s crises. Doing so would allow the profession to grow with society, solve problems with rather than against the flow of society, and be more attuned to the society the profession claims to serve.

Family Violence In Aboriginal Australian Communities: Causes And Potential Solutions, Eden Littrell
Family Violence In Aboriginal Australian Communities: Causes And Potential Solutions, Eden Littrell
Honors Thesis Collection
This thesis is an investigation into why family violence in Aboriginal Australian communities is so severe, and an examination into ways in which this violence might be decreased. It is also a critique of the two competing narratives around violence in Aboriginal communities. The political left typically tells a story about the legacy of violent colonization, and the consequent need to improve Aboriginal legal rights. On the right the narrative is less well defined, but the argument typically focuses on the importance of personal responsibility, or on the role of traditional culture in creating violence. This thesis argues that the …

Business Lawyering In The Crowdfunding Era, Joan Macleod Heminway
Business Lawyering In The Crowdfunding Era, Joan Macleod Heminway
Scholarly Works
Crowdfunding is all the rage in conversations about small business finance. Yet, as with many other rapidly developing business innovations, practicing lawyers were, perhaps, secondary players in the development of business models for crowdfunding. The advent of crowdfunding (and crowdfund investing, in particular) has exposed fault lines in business lawyering. This short Article defines the crowdfunding era, highlights a few examples of observed lawyering lapses, and, in concluding, offers a brief, preliminary assessment of possible sources of these dislocations and best practices. The conclusion also expresses a related cautionary note about the need for lawyers to redouble their efforts at …

One Small Step For Legal Writing, One Giant Leap For Legal Education: Making The Case For More Writing Opportunities In The "Practice-Ready" Law School Curriculum, Sherri Lee Keene
Faculty Scholarship
Legal writing is more than an isolated practical skill or a law school course; it is a valuable tool for broadening and deepening law students’ and new attorneys’ knowledge and understanding of the law. If experienced legal professionals, both professors and practitioners alike, take a hard look back at their careers, many will no doubt remember how their work on significant legal writing projects advanced their own knowledge of the law and enhanced their professional competence. Legal writing practice helps the writer to gain expertise in a number of ways: first, the act of writing itself promotes learning; second, close …

At the 2013 CALI Conference on Law School Computing, Professor James Milles, professor and former library director of the SUNY Buffalo Law School, presented his draft paper positing that academic law libraries are doomed. The author presented his contrasting viewpoints in the same session. This paper is based on his presentation and has been updated to account for adoption of the revised law school accreditation standards approved by the ABA Council on Legal Education and Admissions to the Bar in 2014. While the author agrees with the underlying observations set out by Professor Milles, he envisions a scenario where law …
The Way Forward: Underserved Clients, Underemployed Lawyers--What Can Law Schools Do?, Brett G. Scharffs
The Way Forward: Underserved Clients, Underemployed Lawyers--What Can Law Schools Do?, Brett G. Scharffs
Utah OnLaw: The Utah Law Review Online Supplement
Some lawyers are in the position where they would find it difficult to afford to hire themselves if they needed an attorney. The “twin crises” of underserved clients and underemployed lawyers might seem like a problem that would correct itself if we had a market that was working efficiently, but that does not appear to be the case.
This Article suggests that these are multifaceted problems, reflecting not just specific challenges facing law schools, such as declining applicants, declining minority enrollment, dramatic increases in law school tuition, falling salaries and too few jobs for graduates, and the high costs of …

It Is Time To Burn The Boats: "Twin Crises In The Law" Keynote Address, Michael D. Zimmerman
Utah OnLaw: The Utah Law Review Online Supplement
Two crises exist in modern day law: first, the many people with legal needs who are underserved, and second, the many lawyers who are underemployed. Both are changing law practice as we know it. This address discusses each of these problems and identifies topics to consider when generating solutions.

A Primer On Professionalism For Doctrinal Professors, Paula Schaefer

Legal education reform advocates agree that law schools should integrate “professionalism” throughout the curriculum. Ultimately, it falls to individual professors to decide how to incorporate professionalism into each course. This can be an especially difficult task for doctrinal professors. The law — and not the practice of law — is the focus of most doctrinal casebooks. Law students typically do not act in role as lawyers in these classes, so they are not compelled to resolve professional dilemmas in class, as students would be in a clinic or simulation-based course. As a result, it takes some additional preparation and thought …

Infusing Technology Skills Into The Law School Curriculum, Simon Canick
Infusing Technology Skills Into The Law School Curriculum, Simon Canick
Faculty Scholarship
Legal education has never considered technological proficiency to be a key outcome. Law professors may debate the merits of audiovisual teaching tools: do they work when they should?; do they facilitate learning objectives or are they just toys?; whom should they call when something breaks?; and so on. Teachers use course management sites like TWEN and Blackboard to share information and manage basic course functions. Many fear that laptops and other devices distract students in class, and some institute outright bans. Among many law teachers, technology is warily accepted, but only for the purpose of achieving traditional educational objectives.

“You Can Stay If You Want” -- Women’S Experiences Providing Rape Crisis Medical Advocacy, Chandra N. Strange
Theses and Dissertations--Educational, School, and Counseling Psychology
Many survivors of sexual trauma describe the forensic rape exam as a second rape (Campbell et al., 1999; Parrot, 1991). Rape crisis medical advocates (RCMAs) assist survivors through this process, a time of particular vulnerability to retraumatization (Resnick, Acierno, Holmes, Kilpatrick, & Jager, 1999), by providing emotional support, education, and advocacy for comprehensive and respectful services. Campbell (2006) stated that the primary role of the RCMA is to reduce victim-blame, or the tendency to blame the victim of a crime for the crime or the circumstances leading up to it. The literature has consistently shown that survivors who worked with …
