The Future Of Ediscovery In Tennessee, Roe Frazer, Marc Jenkins

This Article begins by outlining changes in the modern digital world through an examination of essential laws of computing unfamiliar to most lawyers but crucial to an understanding of the changing landscape of technology and its projected impact on modern society. Part II then applies these principles to the practice of law in the context of electronic discovery, pointing to the challenges posed under the current Rules of Civil Procedure, an ever-increasing overabundance of discoverable data, and the inadequacy of existing technology and processes possessed by the typical lawyer to deal with these challenges. Finally, Part III of this Article …

Insuring Against Guns Symposium Article, George A. Mocsary Jan 2014

Insuring Against Guns Symposium Article, George A. Mocsary

Connecticut Law Review

This Article examines whether mandating liability insurance for firearm owners would meet its avowed goals of efficiently compensating shooting victims and deterring unlawful and accidental shootings without creating a net social loss by chilling socially beneficial gun use. In the process, the Article also examines whether nonmandatory liability insurance may enable socially desirable, but potentially risky, firearm-related activities. The analysis indicates that a compulsory firearm-liability insurance regime is unlikely to attain its goals, and may in fact exacerbate the problems it seeks to solve by incentivizing firearm owners to take less care with their weapons. It also shows that it …

The Soldier Bears The Deepest Wounds And Scars Of War: Mobilizing Connecticut To Implement A Veterans Treatment Court Note, Rosendo Garza, Jr.

Connecticut Law Review

The first Veterans Treatment Court (“VTC”) opened in 2004 and aimed to help veterans who ran afoul of the law. These problem-solving courts not only serve to treat the underlying issues many veterans suffer post-military service, but also hold veterans accountable. As a consequence of their incredible results, there are now over one hundred VTCs across the nation. Connecticut has none. This Note urges Connecticut to establish a VTC.

Cause Lawyering In Japan: Reflections On The Case Studies And Justice Reform, Daniel H. Foote Jan 2014

Cause Lawyering In Japan: Reflections On The Case Studies And Justice Reform, Daniel H. Foote

Chapters in Books

Each of the case studies presented in this volume is an important and fascinating story in its own right. Taken together, the case studies enrich our understanding of cause lawyering and the relationship between law and social change in Japan. Despite their rather disparate subjects, the studies dovetail exceptionally well. They show numerous commonalities in the use of law to further social causes, as well as some important differences. They reveal a truly impressive level of creativity in the use of law, and they disclose several common barriers to successful litigation to promote social causes in Japan. As discussed below, …

The Possibility Of Private Rights And Duties, Adam J. Macleod Jan 2014

The Possibility Of Private Rights And Duties, Adam J. Macleod

Scholarly Articles

Is it possible for us to know what we owe others, or do we need the state to tell us? To ask the question this way could be understood as a provocation. It might suggest that the possibility of private rights and duties - a possibility that common law takes for granted and which lawyers witness in their daily practice threatens the foundations of the legal realist jurisprudential project and the liberal political project. But it is not my intention here to attack those projects. I simply want to consider the possibility that legal realism and liberalism might not be …

Narrowing The Gap Between Rights And Resources: Finding A Role For Law Students In Court-Annexed Resource Centers, Faith Mullen

Scholarly Articles

This article relates the experience of law students from The Catholic University of America providing assistance in the Small Claims Resource Center during the past eight years. During this time, the District of Columbia Bar Pro Bono Program has played a pivotal role in the development and the ongoing success of court-annexed resource centers in the District of Columbia. They have recruited law firms and legal services providers (including law school clinics) to staff the resource centers, sought changes in the rules of professional responsibility, and developed intake forms and model pleadings. Their steady oversight, provided by knowledgeable and resourceful …

Guidelines For The Self Evaluation Of Legal Education Clinics And Clinical Programs, J.P. "Sandy" Ogilvy

Scholarly Articles

This volume is an effort to present a comprehensive set of guidelines for the self-evaluation of legal clinics and programs. The last time that guidelines were developed for legal clinics was in 1980 when a joint AALS and ABA Committee on Guidelines for Clinical Legal Education published its Guidelines for Clinical Legal Education. The present guidelines trace their lineage to the efforts of a group of clinicians working under the auspices of the CLEA-AALS Section on Clinical Legal Education Joint Task Force on Clinical Standards, which was formed in 1995 and was active for several years. These guidelines also draw …

Investment Arbitration Under Nafta Chapter 11: A Threat To Sovereignty Of Member States?, William L. Owen

Canada-United States Law Journal

Critics of NAFTA Chapter 11's investor state dispute settlement mechanism are primarily concerned with its invocation by corporate entities and its potential to effectively overturn or significantly weaken NAFTA states' ability to legislate or regulate in the public interest. This article will address this central concern and demonstrate, by evaluating Chapter 11 arbitration results, that these criticisms have been overstated

The Civil Codes Of Libya And Syria: Hybridity, Durability, And Post-Revolution Viability In The Aftermath Of The Arab Spring, Dan E. Stigall Jan 2014

The Civil Codes Of Libya And Syria: Hybridity, Durability, And Post-Revolution Viability In The Aftermath Of The Arab Spring, Dan E. Stigall

Emory International Law Review

The Arab Spring sent shockwaves through the political landscape of the Middle East and North Africa and upended long-standing authoritarian regimes throughout the region in rapid succession. Among the many countries touched by the Arab Spring, Libya and Syria have been among the most profoundly impacted, experiencing institutional deficits that complicate efforts to resolve ongoing conflicts and now threaten regional stability. The effects of such instability also pose a threat to the international community. In order to transition from conflict to peace and sustainable development in Libya and Syria, however, international actors will need to make concerted efforts at rebuilding …
