Applying The Social Ecological Model To Violence Against Women With Disabilities, Miranda Sue Terry Jan 2014

Applying The Social Ecological Model To Violence Against Women With Disabilities, Miranda Sue Terry

Faculty Publications

Violence against women (VAW) is a broad term used to capture aggressive acts committed toward women, which consists of numerous types of violence with the most commonly known types of abuse being emotional, sexual, and physical. One relatively invisible group, women with disabilities, not only experiences emotional, sexual, and physical abuse but also a unique type of disability-related abuse, which may increase their risk of experiencing acts of violence. The U.S. Congress passed two distinct yet not mutually exclusive policies into law to address violence against women and rights for individuals with disabilities: the Violence against Women Act and the …

"Practice Ready Graduates": A Millennialist Fantasy, Robert J. Condlin Jan 2014

"Practice Ready Graduates": A Millennialist Fantasy, Robert J. Condlin

Faculty Scholarship

The sky is falling on legal education say the pundits, and preparing “practice ready” graduates is one of the best strategies for surviving the fallout. This is a millennialist version of the argument for clinical legal education that dominated discussion in the law schools in the 1960s and 1970s. The circumstances are different now, as are the people calling for reform, but the two movements are alike in one respect: both view skills training as legal education’s primary purpose. Everything else is a frolic and detour, and a fatal frolic and detour in hard times such as the present.

Junk Justice: A Statistical Analysis Of 4,400 Lawsuits Filed By Debt Buyers, Peter A. Holland Jan 2014

Junk Justice: A Statistical Analysis Of 4,400 Lawsuits Filed By Debt Buyers, Peter A. Holland

Faculty Scholarship

Debt buyers have flooded courts nationwide with collection lawsuits against consumers. This article reports the findings from the broadest in-depth study of debt buyer litigation outcomes yet undertaken. The study demonstrates that in debt buyer cases, (1) the vast majority of consumers lose the vast majority of cases by default the vast majority of the time; (2) consumers had no lawyer in ninety-eight percent of the cases; and (3) those who filed a notice that they intended to defend themselves without an attorney fared poorly, both in court and in out of court settlements.

This study challenges the notion that …

Cashing In On Green: Casino Development And Sustainability, Emily Mikles Jan 2014

Cashing In On Green: Casino Development And Sustainability, Emily Mikles

University of Baltimore Journal of Land and Development

The development of the Horseshoe Casino in Baltimore, MD has created its fair share of contention and controversy for local residents. The typical residential concerns surrounding casino development- disparate impacts on surrounding businesses, employment concerns, and economic impact-are not raising eyebrows in the Baltimore area; rather, residents are concerned about the environmental impacts of the casino construction and development project. Several lawsuits have been filed attempting to halt casino construction due to the chemical contaminants that are seeping into the soil and into the bay through storm drains. These suits raise an interesting issue that some state legislatures and casino …

Settlement Equals Another Missed Opportunity For The Supreme Court To Define Disparate Impact Claims Under The Fair Housing Act, Erika Flaschner Jan 2014

Settlement Equals Another Missed Opportunity For The Supreme Court To Define Disparate Impact Claims Under The Fair Housing Act, Erika Flaschner

University of Baltimore Journal of Land and Development

In 2003, the New Jersey Township of Mount Holly designated a neighborhood known as the Gardens as a blighted, high crime area, and called for its redevelopment. The Township adopted a plan to demolish the Gardens and replace it with new residential units, of which only a fraction were designated for affordable housing. However, the predominately minority population of the Gardens filed suit to overturn the blight designation and stop the redevelopment plan on the grounds that the plan violated the Fair Housing Act (FHA) on a disparate impact theory.

Curricular Limitations, Cost Pressures, And Stratification In Legal Education: Are Bold Reforms In Short Supply?, Nora V. Demleitner Jan 2014

Curricular Limitations, Cost Pressures, And Stratification In Legal Education: Are Bold Reforms In Short Supply?, Nora V. Demleitner

Scholarly Articles

Many critics of legal education and reformers alike demand "bold reforms," though so far most change seems restricted to haphazard modifications of the curriculum, the hope for quick fixes, and a focus on shedding staff and faculty to balance budgets with a smaller student body. Whether those changes alone amount to bold action, defined as "not afraid of danger or difficult situations; showing or needing confidence or lack of fear; very confident in a way that may seem rude or foolish," is questionable. Curricular changes may merely camouflage or even detract from the crucial need to strategically rethink cost structures, …
