Responding To Foreclosures In Cuyahoga County: 2013 Evaluation Report, Kathryn Hexter, Molly Schnoke
Responding To Foreclosures In Cuyahoga County: 2013 Evaluation Report, Kathryn Hexter, Molly Schnoke
All Maxine Goodman Levin School of Urban Affairs Publications
In 2005, Cuyahoga County became one of the first places in the nation to respond to the rapid increase in the number of residential foreclosure filings. In response to concerns raised by suburban mayors, the County developed a comprehensive foreclosure prevention initiative. The County’s response was multi-faceted and included modifications to the judicial foreclosure process to make foreclosures faster and fairer, greater coordination across County agencies involved in foreclosures such as the sheriff, the prosecutor, the treasurer and the recorder. A key facet of the response was the creation of the Cuyahoga County Foreclosure Prevention Program (CCFPP) which involves face …

Did Congress Intend For Corporations To Benefit From The Mvra?, Leslie M. Villacis Esq.
Did Congress Intend For Corporations To Benefit From The Mvra?, Leslie M. Villacis Esq.
Legislation and Policy Brief
When it enacted the statute, did Congress consider corporations to be “victims” entitled to restitution under the MVRA? This answer has not been provided or discussed by existing case law applying the MVRA. This article answers this question. In addition, it highlights the possible issues a judge may encounter in the application and interpretation of the MVRA, the current use of the MVRA by corporations, and offers potential defenses a defendant could employ in challenging a corporate giant’s restitution request. Additionally, I discuss several policy arguments justifying the application of the MVRA to corporations as well those arguments that oppose …

How Are Local Professionalism Panels Working?, Gary Blankenship
How Are Local Professionalism Panels Working?, Gary Blankenship
Professionalism Research Library
“It works because we care, and we let them know we care.” West Palm Beach attorney David Prather identified that as the key to the 15th Circuit’s Local Professionalism Panel, set up under the Supreme Court’s Commission on Professionalism’s plan to have a local means of addressing lawyers’ professional conduct. The 15th Circuit has heard more cases than any other LPP around the state, a statistic that Amy Borman, who co-chairs the Palm Beach County Bar Association’s Professionalism Commission and who serves on the 15th Circuit LPP, attributes to its taking over for an existing Palm Beach County Bar professionalism …

Representation In Context: Party Power And Lawyer Expertise, Colleen F. Shanahan, Anna E. Carpenter, Alyx Mark
Representation In Context: Party Power And Lawyer Expertise, Colleen F. Shanahan, Anna E. Carpenter, Alyx Mark
Georgetown Law Faculty Publications and Other Works
The questions when, why, and how legal representation makes a difference for parties in civil litigation remain largely unanswered, although recent scholarship raises compelling new questions and suggests new explanations and theoretical approaches. Understanding how legal representation operates, we argue, requires an appreciation for the context in which the representation actually takes place. This article examines two previously unexplored elements of the context of legal representation through empirical and theoretical analysis: the balance of power between the parties to a dispute and the professional, specifically strategic, expertise that a legal representative contributes. The results of a study of 1,700 unemployment …

The Sovereign Citizen Movement: Strain, Conflict, And The American Dream, Jessica Leann Middleton
Student Theses and Dissertations
The purpose of this study is to examine factors that may influence Sovereign Citizen Movement (SCM) activity in the United States from 2000 through 2010. Data is collected from all English language newspapers on the LexisNexis database, and incidents were coded and mapped spatially using ArcMap, a geographical mapping software. Using a state level analysis (N=51), incident frequencies are examined using OLS regression analysis of socioeconomic information, percent minority, African American and Hispanic, population, murder rate, percent manufacturing employment, and state hate group frequencies . The study found two significant indicators of SCM incidents, hate groups and percentage minority group …

Making The Invisible Visible: Latin American Women With Undocumented Status And Their Experiences Of Intimate Partner Violence, Maria Teresa (Maytte) Restrepo-Ruiz
Master's Theses
This study aimed to contribute to the currently scarce literature on unauthorized Latina immigration and intimate partner violence expanding the analysis to include women’s reasons for migrating, their experiences during the migration journey, and the intimate partner violence once they arrived in the United States. Through these women’s voices, this study shows how the lack of migratory documentation affects the experiences of Latina immigrant women. Qualitative data were collected from 11 in-depth interviews with Latin American women that had an undocumented status and received services from five domestic violence programs in Connecticut. A thematic analysis approach was employed to examine …
